This extraordinary panel brings together attorneys with deep experience representing plaintiffs in such cases, an attorney who was also a plaintiff as a survivor of sexual assault in a headline case involving USA Gymnastics, and an expert in forensic psychology. 10:15 a.m. – 11:15 a.m. | [CLE] It’s About Time: Opening Up Options for Using Neutrals in Bankruptcy Proceedings [Grand Ballroom B]
The American Bar Association has urged that Bankruptcy Rule 9031 be amended to permit courts responsible for cases under the Bankruptcy Code have the same ability to use court-appointed neutrals (masters) in the same way as do federal courts responsible for other cases. This move is part of a much broader effort by numerous organizations to rethink how all courts state and federal can improve the way neutrals are considered and use both to benefit courts and to provide litigants with more involvement and protection in the process. This change may well be coming to a court near you and this program will discuss the history and effort to amend the Bankruptcy Rule, the broader effort, and what the use of neutrals in Bankruptcy proceedings would mean for courts and litigants.

10:15 a.m. – 11:15 a.m. | [CLE] Jury Takes Center Stage: A Historic Courtroom Design for Modern Jury Trials [Grand Ballroom A]
“We shape our buildings, and afterwards, our buildings shape us.” (Winston Churchill). The federal court in Charlotte, NC has just built a courtroom inspired by the eighteenth-century Commonwealth of Virginia county courtroom design, including the historic Albemarle County Courtroom built in 1803 and designed by Thomas Jefferson. The essential design feature places the jury box underneath the judge facing a witness box situated in the middle of the well, with counsel tables on either side. Situating judge and jury together represents the shared authority of each for a fair trial. If we tell the jury they are the “judges of the facts” our architecture should reflect it. This design enables the jury (and judge) to have a direct view of the witness whose credibility they are assessing. These and other substantive benefits make this design a superior model for conducting jury trials. Present day needs, historical design, philosophical considerations and functionality support resurrecting this design for modern use.

11:30 a.m. – 12:30 p.m. | [CLE] Supreme Court Decides Two Significant False Claims Act Cases: A Review of Polansky and SuperValu and Their Implications [Grand Ballroom A]
It is rare for the United States Supreme Court to take up one False Claims Act (FCA) case in a year. However, this year, the Supreme Court considered two and rendered decisions in both in June 2023. This panel will discuss the results of these two important cases. The Polansky case determined the criteria for the Government to dismiss a qui tam case even when opposed by the Relator, holding that the Government must first intervene in the case and courts must apply the rule governing voluntary dismissal of suits in ordinary civil litigation. The SuperValu case determined that the subjective mindset of the Defendant is relevant in an FCA case in determining the scienter requirement, regardless of what an objectively reasonable person may have believed. This Panel represents three distinct viewpoints on these cases: (1) the Government’s viewpoint (represented by the Deputy Assistant Attorney General for the Civil Division of the U.S. Department of Justice); (2) the Defendant’s viewpoint (represented by an experienced FCA defense attorney, John Lawrence); and (3) the Relator’s viewpoint (represented by an experienced Relator’s Counsel, Tejinder Singh). The Panel will discuss the Supreme Court decisions in these two cases, and the implications for practitioners (and their clients) moving forward in FCA cases. This panel would be especially important for any attorneys practicing federal litigation, including handling FCA and qui tam cases, as well as any attorneys practicing in the health care sector, government contracting sector, or any other industry regulated by the Federal Government.

3:15 p.m. – 4:15 p.m. | [CLE] Federal Court Litigation before U.S. Magistrate Judges: Consent Jurisdiction [Grand Ballroom B]
U.S. Magistrate Judges serve a vital role in our federal judiciary that is not well understood by the majority of the federal bar. This is due, in part, to the fact that each district court utilizes magistrate judges differently according to the needs of that court. As a result, few attorneys understand the power and flexibility provided by magistrate judge consent jurisdiction. Nationally, the Federal Courts seek to foster a culture of consent to relieve overburdened district judges. Due to district courts’ heavy workloads, case scheduling orders are strictly adhered to with less case specific flexibility, oral argument is disappearing, fewer opportunities for lawyers to make court appearances exist, and trials are timed and shortened. However, when parties consent, a U.S. Magistrate Judge can act as the trial judge, and make determinations on all matters, same as a district judge. Consent to a magistrate judge generally allows for more flexibility to the case schedule and attorneys schedules, more opportunities for oral argument and hearings, and permits the lawyers to have more input into trial length based on the needs of the case. Due to District Court heavy workloads, there are programs in place to promote consent to a Magistrate Judge. This program will explain how magistrate judges are utilized by district courts, the various consent programs, and how they can be beneficially utilized by federal litigants and their counsel.

The replacement of a Supreme Court justice focuses national attention on the Court more than almost any other Court-related event. These are constitutionally-unique events that can have significant effects on the development of law. Yet not all judicial transitions have comparable impact. This presentation will provide a variety of criteria on which we might calculate the impact of Supreme Court transitions and utilize those criteria to evaluate which transitions between 1953 and the present have been the most impactful. These criteria will include the ideological difference between outgoing and incoming justice as well as the effect of the transition on the ideological balance and median justice on the Court. In addition to these quantitative measures, the presentation will also explore some narrative elements that add to the significance of particular transitions. Finally, for several of the more significant transitions, the presentation will go into greater depth and highlight some short-term and long-term impacts (such as cases in which the incoming justice provided a determinative vote).
