Webinar: Preventing Medical Malpractice and Other Health Practice Issues through Empathic Communication

Do you represent healthcare providers and facilities? Are you in-house counsel for a health system? If so, are you prepared to advise your clients how to properly and effectively respond to harm or adverse events in healthcare settings?

During this CLE, we will discuss how healthcare providers and practices may avoid medical malpractice litigation through the use of empathic communication. Specifically, we will discuss apology statutes; the rules of evidence; apology and forgiveness; the CANDOR program, which promotes a culture of safety that focuses on caring for the patient, family, and caregiver by providing freedom for providers to acknowledge an error without fear that the admission will be used against them in court; and the possible criminalization of medical malpractice.

About the Presenters

Moderator: Herschenia Brown, MBA
Mediator; FBA ADR Section Board Member

Herschenia Brown is an aspiring employment mediator and financial operations professional with more than ten years experience in project management and process provement strategies, and nine years in legal finance. She has obtained both Bachelor of Technical Management and Master of Business Administration degrees. Due to the growing number of employees who were experiencing work-related chronic stress, anxiety, and depression, Herschenia decided to shift focus and embark on a new career. She became a Board Certified Integrative Mental Health Coach to support organizations in creating solutions to building better mental wellness cultures in an effort to retain top talent, improve employee morale, and reduce the number of grievances/legal claims. To offer the added critical benefit of mediation, she entered the Dispute Resolution program at Pepperdine’s Straus University, Caruso School of Law, which she will complete in summer 2021. In her spare time, Herschenia enjoys writing. She is an Amazon bestselling (in five parenting categories) and award-winning author under the pen name Aria Craig. She has written several articles for multiple publications and working on her first novel about the effects of sibling narcissism.

Angela Eastman, JD, LLM
Partner, Pacific Apex Law Group; FBA ADR Section Officer and Board Member

Angela Eastman is a health law attorney and regulatory compliance consultant primarily focusing on healthcare compliance and insurance regulatory law. Prior to her current position at Pacific Apex Law Group, Angela practiced law for several years at Eastman Law + Dispute Resolution providing outside counsel to health insurance companies and other health organizations, and served as in-house counsel for a large health insurer. As a result, she is well versed in litigation, transactions, mediation, and arbitration. Angela also provides ADR training and coaching services across the nation to employers and employees, nonprofits, and other business organizations, and instructs business graduate and law students as an adjunct professor. Angela earned her BA from of McGill University, JD from Vermont Law School, and LLM in ADR from Pepperdine the Straus Institute for Dispute Resolution at Pepperdine University Caruso School of Law. She has completed leadership training through the Vermont Leadership Institute (Snelling Center for Government), Leadership Champlain (Lake Champlain Regional Chamber of Commerce), and the University of Vermont (School of Business Administration). Angela holds certifications and designations in Project Management, Advanced Project Management, Market Conduct Management (MCM), Leadership and Management, and Emotional Intelligence. Her admissions include the States of Vermont, Washington and Colorado, U.S. District Court (Vermont), and the U.S. Supreme Court. Angela serves as a board member for Cardinal Opportunities, Inc. and chair-elect of the Federal Bar Association ADR Section. She is active in the local Boulder, Colorado community by volunteering for and supporting non-profit organizations with missions focused on self-sufficiency, education, women, and mental health and substance use disorder.

Julie McCoy, PharmD, JD
Senior Manager of Pharmacy, Quality & Medication Safety and Director, Pharmacy Residency, Providence Southwest Washington; Partner, Pacific Apex Law Group

Julie focuses her legal practice on Health Care and Life Sciences with an emphasis on regulatory compliance, and Alternative Dispute Resolution. She is experienced in collaborative development, production, distribution, and utilization of scientific and healthcare-related products and services, pharmaceuticals, and devices, with a focus on quality, efficacy, safety, technological efficiency and minimization of cost. In addition to private practice, Julie is currently Senior Manager of Pharmacy, Quality and Medication Safety and Director of post-graduate year-one (PGY1) pharmacy residency programs at Providence Southwest Washington, as well as an Adjunct Faculty member at Washington State University, College of Pharmacy and Pharmaceutical Sciences and an Affiliate Faculty member at the University of Washington, School of Pharmacy. Julie received her law degree at Mitchell Hamline School of Law with a concentration in Health Law and Compliance, and completed her legal externships with the Communication and Optimal Resolution Team (CANDOR) as well as the Pharmacy Quality Assurance Commission (PQAC) and FAVROS Law firm with a focus in Medical Malpractice Defense.

Katie Gilbert Spear, OD, JD
Partner, Pacific Apex Law Group 

Katie Gilbert-Spear is a dedicated, results-driven professional with a vast background and wealth of knowledge in health care, coupled with a passion for utilizing 15+ years of experience to provide legal services, consulting, advocacy, and expertise to organizations, corporations, and individuals. She practices in the areas of Health Care and Life Sciences, with a special interest in telehealth and telemedicine, and Alternative Dispute Resolution. Katie graduated with honors from Auburn University with a degree in Biomedical Sciences and obtained a Master’s degree in Public Health, specializing in Epidemiology, from University of Alabama at Birmingham School of Public Health. She earned her Doctorate of Optometry from University of Alabama at Birmingham. Katie also graduated from the Mitchell Hamline School of Law with a concentration in Health Law and Compliance. Prior to law school, Katie grew a multi-location Optometry/Ophthalmology office. She is also the founder and director of The Visual Performance Center, which has conducted numerous research studies, over the past decade, in contact lenses, solutions, dry eye and visual performance. She is a consultant and speaker with various eyecare companies. Katie currently serves on the Board of Optometry for the state of Florida and is a member of the American Optometric Association’s Third-Party committee.

Mark Maines, MDiv
Grief & Trauma Specialist, Crisis Consultant and Veteran Advocate, Mark Maines Crisis Consulting

Mark Maines has been leading at the intersections of psychology, spirituality, and leadership science for over two decades.  He is the founder of a crisis consulting firm that specializes in guiding individuals and communities through grief and trauma, moral injuries and crisis response/recovery planning.  As a former Naval officer he possessed subject matter expertise in combat trauma, combat re-integration, post traumatic stress, and military ethics.  Mark was forward deployed and  proudly served the heralded “Blue Diamond” 1st Marine Division.  Mark works best in “high stakes,” “high stress” environments and offers outside perspective, useful strategy, and enduring hope whenever possible. Mark earned his BS from John Brown University, M.Div from Fuller Theological Seminary, Certificate of Dispute Resolution from the Straus Institute for Dispute Resolution at Pepperdine University Caruso School of Law, and is working to complete his Doctorate of Psychology.  Mark’s most important work happens on the sidelines of baseball fields, soccer pitches, and horse arenas where he cheers on the passions of his three “tween” children.  Mark lives in north county San Diego and can be reached through his website www.markmaines.com.
