Webinar: Conflict of Interest Restrictions After Government Employment

Many federal government employees who retire, establish a consulting practice, or take up employment in the private sector, using their skills and experience to support the business needs of their clients and employers. There are restrictions, however, on the ability of these former government professionals to approach the U.S. government, particularly their former agencies, on behalf of clients or employers. There are additional restrictions, where the principal is a foreign entity. The key federal statute and regulations governing these restrictions are 18 U.S.C. § 207 (Restrictions on former officers, employees, and elected officials of the executive and legislative branches) and 5 C.F.R. § 2641 (Post-employment conflict of interest restrictions).

This presentation will examine the general provisions of the statute and regulations, discuss the prohibitions they stipulate, and the applicable exceptions and waivers. The presentation will offer a special focus on the restrictions relating to foreign entities, and the relationship of these restrictions to the Foreign Agents Registration Act of 1938 (FARA). The presentation will also offer an overview of key federal agency components and other resources relevant to the compliance with, and enforcement of the statute and its implementing regulations.

About the Presenters

Armen Kharazian is the owner of a small law practice in the District of Columbia specializing in white-collar criminal defense (Foreign Corrupt Practices Act and anti-money laundering statutes), export control and sanctions, Foreign Agents Registration Act (FARA) and Lobbying Disclosure Act, 18 U.S.C. § 207 (Restrictions on former officers, employees, and elected officials of the executive and legislative branches), and corporate formation. Prior to establishing his law practice, Armen served as a Law Fellow at the U.S. Department of Energy’s Office of the General Counsel, where he worked on U.S. Atomic Energy Act-related nuclear contamination litigation, and an Honors Law Clerk at the U.S. Environmental Protection Agency, where he worked on regional enforcement programs related to the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). He holds a JD from the University of the District of Columbia David A. Clarke School of Law, MA in Security Studies from Georgetown University School of Foreign Service, and BA in Middle Eastern Studies from Yerevan State University in Armenia. His article on the constitutional implications of Congress’s enactment of the Religious Freedom Restoration Act of 1993 (RFRA), and RFRA’s applicability to federal law appeared in the September/October 2020 issue of The Federal Lawyer magazine. Glen McMurry is a partner at Taft Stettinius & Hollister LLP in its Dayton, Ohio office. He is a member of the firm’s litigation practice group. He has over 14 years of experience serving diverse corporations and individuals across the country resolving a wide variety of issues, including complex dispute resolution and compliance with local, state, and federal laws. Glen also focuses his practice on employment issues, construction claims, insurance claims/defense, and mergers and acquisitions.

Glen is currently serving his second term as a member of the Board of Directors having been an active participant in the FBA for over a decade, Glen served as the Dayton, Ohio Chapter President for three years (2010-2012). Since then, he has served in many capacities, including Chairing the Younger Lawyer Division in 2016, serving on Government Relations Committee, the Editorial Board, and serving as one of the Sixth Circuit Vice-Presidents. Most recently, Glen was appointed to steer a national task force aimed at increasing courtroom advocacy opportunities for younger lawyers across the country. He was also recently appointed to chair the Law Student Division.
