Qui Tam Section: [VIRTUAL] When FCA Cases Go to Bankruptcy Court

This panel will feature two bankruptcy judges, Relator’s counsel, and a DOJ trial attorney discussing the strategies and pitfalls when a False Claims Act case lands in bankruptcy court. The panelists will explain bankruptcy basics for the uninitiated, including what it means to be a creditor, and then discuss FCA cases when either a relator files for bankruptcy or when a defendant files for bankruptcy, including how to address cases that are still under seal. Finally, the panel will discuss settling FCA cases in bankruptcy court.
