Webinar: The Cost of Free Speech: How Institutional Interests Impact First Amendment Protections

A discussion concerning the balance between free speech and institutional concerns, and how to determine when the line of reasonableness has been crossed. After discussing common issues and current events, participants will provide attendees with recommendations for best practices concerning the development/implementation of personnel policies/handbooks, and management practices.

About the Speakers

Morgan Davis, Associate, Debevoise & Plimpton LLP

Morgan Davis is an associate in the Litigation Group of Debevoise & Plimpton LLP in New York. Her practice focuses on complex civil litigation, including securities litigation and contract disputes. Ms. Davis also has an active pro bono practice.  Her recent pro bono representations include: a First Amendment case on behalf of University of Florida professors who were barred from participating as expert witnesses or amici curiae in litigation against the State of Florida; advising a legal services organization on potential legal challenges to the detention of protestors; and civil rights litigation on behalf of a transgender woman who was denied insurance coverage for medically necessary facial feminization surgery, which resulted in a landmark settlement.  Ms. Davis has also represented the Government of Canada and the Partnership for New York City as amici curiae in the Eighth Circuit Court of Appeals and the New York Court of Appeals, respectively. Ms. Davis joined Debevoise in 2016. Prior to joining the firm, she clerked for Judge Claire C. Cecchi in the United States District Court for the District of New Jersey from 2015 to 2016. Ms. Davis received a J.D. cum laude from Harvard Law School in 2015, where she was co-editor-in-chief of the Harvard Human Rights Journal. She received a B.A. magna cum laude and Phi Beta Kappa from Barnard College in 2011.

Paul Donnelly, Principal, Donnelly + Gross

Paul Donnelly focuses on managing a law practice at Donnelly + Gross that provides day-to-day advice and representation on workplace and people management issues. Paul protects small businesses, national corporations, professionals, and highly paid executives. In doing so, he calls upon his 30-plus years of experience as an attorney who traveled across the State of Florida to consult with clients and represent them in contract negotiations and before courts, arbitrators, administrative law judges, and other authorities. He has extensive experience in virtually every aspect of labor and employment law. Paul is effectively the CEO of an organization with 6 attorneys, 6 support staff, and 2 offices—in Gainesville and Fort Myers. Paul is a frequent speaker to professional, community and business groups. He served as a long-term Adjunct Professor who taught Trial Practice skills to senior law students at the University of Florida. He and his firm regularly contribute to publications by the local bar association, Gainesville Area Chamber of Commerce, and industry groups including the Builders Association of North Central Florida and Lee Building Industry Association. He is a Fellow in the College of Labor & Employment Lawyers, which is the highest distinction in the field. Under his leadership, his law firm Donnelly + Gross is recognized among the “Best Law Firms” for 2020 by U.S. News & World Report and Best Lawyers with four Tier 1 rankings in the Jacksonville metropolitan area for employment law, labor law and litigation.
