Webinar: Just When I Thought I Was Out They Pull Me Back In! Will the Military Continue to Retain Courts-Martial Jurisdiction Over Retirees?
For nearly 75 years, military courts have squarely rejected challenges to the Uniform Code of Military Justice’s continued jurisdiction over certain retirees. Two years ago, University of Texas School of Law Professor Stephen Vladeck successfully convinced a judge of the D.C. District Court to find that courts-martial jurisdiction over retirees is unconstitutional. Although the Supreme Court declined to hear Larrabee v. United States, this issue is ripe for further scrutiny by lower courts. This webinar will feature a discussion by Prof. Vladeck as to why military courts’ jurisdiction over retirees should end.
