Webinar: 30(b)(6) Issues for In-House and Outside Counsel

Two federal magistrate judges, one outside legal counsel, and one in-house lawyer will discuss various aspects of 30(b)(6) depositions.  Topics will include federal magistrate judges who have issued opinions in this area discussing proper notice of a deposition and how to avoid or a quash a 30(b)(6) notice.  Furthermore, in-house and outside legal counsel will present on how to choose the right deponent and how to ask best questions to elicit most useful evidence at trial.  We look forward to presenting 30(b)(6) depositions from all angles.

The Honorable Donna Phillips Currault, United States Magistrate Judge

The Honorable Donna Phillips Currault serves as a United States Magistrate Judge for the Eastern District of Louisiana.  Before joining the federal bench in June 2020, she was a member of Gordon, Arata LLC, where she handled complex commercial litigation matters including class and collective actions, business disputes, and business torts.  She regularly represented employers in claims brought under federal and state anti-discrimination statutes and advised clients on employment agreements and non-competition/non-solicitation issues, prepared policies and handbooks, and conducted training on employment matters.

Judge Currault graduated magna cum laude from Tulane University School of Law in 1989 and was selected for Order of the Coif.  While in law school, she was a Managing Editor and member of the Tulane Law Review.  She also served as a Senior Fellow for Tulane Law School’s Legal Research and Writing program.  From 1989-1990, she served as a judicial law clerk to the Honorable Morey L. Sear, United States District Judge for the Eastern District of Louisiana.

Judge Currault is a Life Fellow of the Federal Bar and American Bar Foundations and a Fellow of the Louisiana Bar Foundation and Litigation Counsel of America.  She is a member of the Tulane Law Review Advisory Board, St. Thomas More Inn of Court, and the Federal Magistrate Judges Association.  Judge Currault currently serves as the Fifth Circuit Director for the Federal Magistrate Judges Association.  She is a former Director of the Foundation of the FBA, past President of the New Orleans Chapter of the FBA (2021-22), former member of the New Orleans Chapter FBA Board of Directors (2002-2023), past Chair of the FBA’s Labor & Employment Section (2015-16), and past Chair of the Louisiana Board of Legal Specialization’s Employment Law Advisory Commission.  She formerly served as the Code I Bar Examiner and is currently on the Testing Committee for the Louisiana Committee on Bar Admissions.

The Honorable Hope T. Cannon, United States Magistrate Judge for the Northern District of Florida

Hope T. Cannon was appointed as a United States Magistrate Judge for the Northern District of Florida in 2019.  Before taking the bench, Judge Cannon was a partner at the Southeast Regional firm Bradley Arant Boult Cummings, LLP, where she practiced for almost 2 decades.  During her time at Bradley, Judge Cannon handled complex commercial and products cases and appeals across the country.  Since taking the bench, Judge Cannon has been the magistrate judge assigned to several complex cases, including two multi-district litigations.  She is a graduate of the University of Alabama, School of Law and recently completed the Duke Law School’s Bolch Judicial Institute Judicial Studies LLM program.

 

 

 

Alexander Fischer, Founder/Partner, Sanchez, Fischer, Levine, LLP.

Alexander Fischer is a founding partner of Sanchez Fischer Levine, LLP and heads the firm’s Broward Office. His practice is focused on complex commercial litigation and appeals, with a specific emphasis on business disputes, fraud, and class action defense. Alex’s clients include publicly traded companies, large corporate entities, small to mid-sized businesses, and private U.S. citizens, and he routinely represents shareholders in disputes within a corporation. As a former prosecutor, Alex also has vast experience in the area of criminal law and is a seasoned trial attorney, with over 40 jury trials handled through verdict.

Alex has been able to utilize his litigation experience to achieve positive results for his clients in difficult and complex matters, such as obtaining a favorable judgment in a million-dollar proceeding supplementary seeking to, among other things, void two fraudulent transfers made by the judgment debtors to an offshore trust; his success on appeal of a finding of contempt in that same case; his full award in an arbitration against a trans-national moving company for damages; his representation of a major cruise line in numerous complex commercial litigation matters; as well as many others representations resulting in favorable resolutions. Alex’s success in this area has led to his nomination and induction into the International Association of Defense Counsel, where he can further assist his corporate clients.

Prior to founding Sanchez Fischer Levine, Alex worked for a well-respected South Florida law firm handling civil litigation matters for local police departments, private businesses, and individual litigants. Alex successfully represented clients in matters relating to civil forfeitures, FDUTPA violations, employment disputes, civil appeals, and general business litigation. He also litigated matters relating to the unique Risk Protection Order (“RPO”) law, which allows for law enforcement to seize firearms and ammunition if they are deemed to be a threat to themselves or others. Alex began his career as a prosecutor in the Office of the State Attorney in and for Broward County, Florida. In just under six years, Alex secured thousands of criminal convictions and prosecuted an array of criminal charges, including violent crimes and major drug trafficking offenses.

William Whitman, Lead Counsel, Federal Express Corporation.

William G. Whitman serves as in-house counsel for Federal Express Corporation in Pittsburgh, Pennsylvania. There, William is Lead Counsel in the Litigation Department. He often serves as trial counsel for FedEx in arbitrations and in federal and state court. Prior to FedEx, he was a commercial litigator at the law firm of Bass, Berry & Sims in Memphis, Tennessee. He as well served as a federal law clerk for the Honorable Thomas M. Shanahan in the U.S. District Court in Nebraska. William graduated from Notre Dame Law School.  William currently serves as the Division Chair of the Corporate and Association Counsel Division (CACD) of the Federal Bar Association, and has been active in FBA and the CACD in various other roles over the past several years.
