Qui Tam Section: [VIRTUAL] Scienter in the Aftermath of SuperValu

More than a year ago, the Supreme Court in SuperValu substantively addressed the False Claims Act’s scienter element, holding that scienter refers to a particular defendant’s knowledge and subjective beliefs, not to what an objectively reasonable person may have known or believed. This panel will examine how lower courts have interpreted and applied SuperValu, trends in those decisions that may impact how False Claims Act cases are pursued and defended, practice pointers, and open issues to be decided.
