Qui Tam Section: [VIRTUAL] Damages & Penalties Under the FCA: How Much Is Too Much?

FCA plaintiffs continue to press for the full contract price as the proper measure of damages, with mixed success. Panelists will dive into recent case law in the measurement of damages, and look ahead to what damages theories may apply in FCA cybersecurity cases. Panelists will additionally discuss the recent string of cases addressing 8th Amendment Excessive Fines challenges to FCA judgments: U.S. ex rel. Fesenmaier v. Cameron-Ehlen Group, Grant ex rel. U.S. v. Zorn and Stop Illinois Health Care Fraud, LLC v. Sayeed.
