Qui Tam Section: [VIRTUAL] Are Qui Tam Suits Unconstitutional?

In the early summer of 2023, Justice Thomas penned a notable dissent questioning whether the False Claims Act’s qui tam provisions comport with Article II of the U.S. Constitution. Since then, qui tam defendants across the country have taken the cue and raised constitutional challenges to the FCA. The panel will discuss how courts have addressed these challenges over the past year and will highlight what to watch for as the issue continues to percolate.
