Qui Tam Section: [VIRTUAL] Battle of the Experts in FCA Litigation
Expert testimony may be pivotal in a False Claims Act case, helping to establish the falsity (or not) of a claim — how evidence shows that a medical facility failed to comply with relevant regulations, for instance, or why it matters that body armor doesn’t meet military specifications. Experts also can testify about prevailing industry practices; they can help to quantify damages from a false claim; and they can help to establish the validity of statistical sampling methods in a case with thousands or millions of individual payments, among other things. This panel will discuss pitfalls and best practices for working with experts in FCA matters, including what makes a good expert; how to depose experts; how to defend or strike an expert for trial; and how to examine an expert before a judge or jury.
