I was admitted to the California Bar in 1986 and am also a member of the Bars of the District of Columbia, the State of Georgia, and the State of New York. In my 40 years as an attorney, I have served in various roles, including eight years as a federal prosecutor with the Computer Crime & Intellectual Property Section (CCIPs) at the U.S. Department of Justice. I led the first prosecution under the Economic Espionage Act and also acted as acting Deputy Chief. I was also involved in novel computer search and seizure issues and wrote the Department’s first monograph on criminal intellectual property violations. While at Justice, I tried approximately a dozen cases involving various federal criminal laws, including one of the first trials under the Economic Espionage Act, and served as Acting Deputy Chief, winning several special achievement awards. I was also a partner at Sidley & Austin, where I handled various intellectual property cases, including patents, copyrights, theft of trade secrets, and trademarks. Apart from my extensive IP experience. I have also represented my family in several litigations against the Federal Republic of Germany concerning art that the Nazis looted. In 2014, the National Law Journal recognized me as one of the Top 50 Intellectual Property Trailblazers and Pioneers. I am on the Board of IPLaw 360. Throughout my career, I have been actively involved in the pro bono sector. For example, during my nine years as an intellectual property partner at Sidley Austin in New York City, I volunteered to lead a team of four attorneys in a death penalty habeas corpus case for the Equal Justice Institute in Alabama. After a decade, including an appeal before the Alabama Supreme Court, the state agreed to reduce our client’s sentence to life in prison without parole. I also worked with the ACLU in representing Chinese American scientist, Sherry Chen, against the United States, involving claims relating to her unlawful arrest and malicious prosecution by the United States. Throughout my legal career, I have written extensively on a variety of issues. I am co-author of The Trade Secret Case Management Judicial Guide (Federal Judicial Council) (2023) and Defend Trade Secrets Act of 2016 Handbook (Wolters Kluwer, 2024, updated four times since first publication in 2017, and author of the leading treatise on criminal violations of intellectual property rights and computer crime, Intellectual Property & Computer Crimes (Full Court Press 2020) (first published by Law Journal Press 2003). Further, I have written over 125 legal articles and have been frequently quoted in national publications and trade journals, including by The New York Times, Wall Street Journal, Washington Post, Forbes, Fortune, CNNMoney, Al Jazeera, Hollywood Reporter, Christian Science Monitor, Bloomberg News, Thomson Reuters, Law360, Variety, and the Guardian. Has also appeared on CNN, Bloomberg TV, ABC, BBC, and CCTV.
