So, you may have heard about it and understand that it is something that appears, every now and then, in certain commercial cases or perhaps in personal injury cases for plaintiffs hoping for or waiting on a settlement. Its proponents call it a necessary tool for David’s going up against Goliaths. Its critics see it as a socially deleterious device encouraging spurious litigation. But did you know that litigation finance, a/k/a third-party or non-party litigation funding, can often find its way into FCA qui tam cases? Is that a good thing or a bad thing … for Relators and their lawyers now faced with having to finance a declined case coming out of seal against a Fortune 500 company? For those in the Relator’s Bar starting a new firm? For qui tam defendants and their counsel not quite sure of who they are up against? And for the government lawyers ultimately in charge of overseeing the case who may be concerned about who is calling the shots in the litigation?
