Webinar: Dissecting Legal Developments on Healthcare Access and Protections for Transgender People

Please join the LGBT Law Section of the Federal Bar Association (FBA) for a webinar to discuss the Administration’s recent decisions on health care access and protections for transgender people.  Guests will discuss several different examples including 1) the Trump Administration’s rollback of transgender healthcare protections put in place by the Obama Administration in Section 1557 of the Affordable Care Act (ACA), which “prohibits discrimination based on race, color, national origin, sex, age or disability in certain health programs and activities” 2) efforts in state legislatures across the country to criminalize gender-affirming care for trans youth 3) exclusions for gender affirming care in state Medicaid programs and 4) barriers to healthcare for transgender prisoners.

This panel will feature two leading attorneys who are well-versed in the area of transgender health protections, Shannon Minter, Legal Director of the National Center for Lesbian Rights (NCLR), and Carl Charles, a Staff Attorney in the New York office of Lambda Legal, who will address how these actions affect transgender youth and adults, the legal challenges and advocacy responses, and what is to come in this area.

About the Presenters:

Brandon King, Associate, Baker & McKenzie LLP; FBA LGBT Law Section Chair (Moderator)

Brandon King is an associate in Baker McKenzie’s Tax Practice Group in Washington, DC. He focuses on tax controversy and tax planning. Brandon regularly advises clients on various aspects of tax law, including international tax planning for multinational corporations and tax dispute resolution. Prior to joining the Firm, Brandon was a law clerk for the Honorable Albert G. Lauber at the United States Tax Court. He also served as a Presidential Personnel Associate in the Obama administration, where he was the tax advisor on the vetting team for presidential nominations. He received his BA in Political Science from University of Cincinnati, followed by his JD at Indiana University’s Maurer School of Law and LLM at Georgetown University Law Center.

Carl Charles, Staff Attorney, Lambda Legal

Carl Charles is a Staff Attorney in the New York Office of Lambda Legal, the oldest and largest organization dedicated to advancing the civil rights of lesbians, gay men, bisexuals, transgender people and individuals living with HIV, where he previously served as a law fellow in the Transgender Rights Project. During his time at Lambda Legal, Carl has been involved in litigating a number of cases expanding and solidifying federal civil rights protections for transgender people. Most recently, he is counsel in Karnoski v. Trump, a federal lawsuit challenging the constitutionality of the Trump administration’s ban on military service by transgender people, counsel in Conforti v. St. Joseph’s Healthcare, a federal lawsuit filed in response to a New Jersey Catholic Hospital’s discriminatory denial of transition-related health care for a transgender man, and counsel in the recently filed Eller v. Prince George’s County School District, a federal lawsuit on behalf of a teacher who endured years of abuse, harassment and retaliation at the hands of school administrators, fellow teachers, staff, parents and students because she is a transgender woman. Prior to joining Lambda Legal, Carl served as a Staff Attorney with the LGBTQ Rights Project at A Better Balance and the New York City Commission on Human Rights Law Enforcement Bureau. Carl has written about his own experiences as a transgender man, as well as legal issues facing transgender people for publications including The Advocate, Conde Nast’s them., and the former LGBTQ Digital News platform Into. Carl is a graduate of the University of Denver Sturm College of Law where he was co-president of OUTLaw and vice president of the Student Bar Association. He received his bachelor’s degree in English Education from the University of Northern Colorado.

Shannon Minter, Legal Director, National Center for Lesbian Rights (NCLR)

Shannon Minter is the Legal Director of the National Center for Lesbian Rights (NCLR), one of the nation’s leading advocacy organizations for lesbian, gay, bisexual, and transgender people. Minter was lead counsel for same-sex couples in the landmark California marriage equality case which held that same-sex couples have the fundamental right to marry and that laws that discriminate based on sexual orientation are inherently discriminatory and subject to the highest level of constitutional scrutiny. Minter was also NCLR’s lead attorney in Christian Legal Society v. Martinez, a U.S. Supreme Court decision upholding student group policies prohibiting discrimination based on sexual orientation and gender identity, and rejecting the argument that such policies violated a student group’s rights to freedom of speech, religion, and association.  NCLR represented Hastings Outlaw, an LGBTQ student group who intervened to help defend the nondiscrimination policy. In 2009, Minter was named a California Lawyer of the Year by California Lawyer. He received the Dan Bradley Award from the National Gay and Lesbian Bar Association for outstanding work in marriage cases in 2008. Minter was one of 18 people to receive the Ford Foundation’s “Leadership for a Changing World” award in 2005. Shannon has also received the Anderson Prize Foundation’s Creating Change Award by the National Gay and Lesbian Task Force and the Distinguished National Service Award from GAYLAW, Cornell Law School’s Exemplary Public Service Award, the Unity Award from Bay Area Lawyers for Individual Freedom, the Advocacy Award from the San Francisco Bar Association, and the Justice Award from Equality California. Minter serves on the boards of Faith in America and the Transgender Law & Policy Institute. He has previously served on the American Bar Association Commission on Sexual Orientation and Gender Identity. Minter received his J.D. from Cornell Law School in 1993. He is originally from Texas.
