Qui Tam Section: [VIRTUAL] Forensic Accounting Across the FCA Lifecycle

Success in a False Claims Act matter—whether you define that as a government, relator, or defense verdict—can turn on whether complex financial data can be transformed into clear, credible proof—and whether you can do so early enough to drive sound strategic decisions. From initial relator disclosures through DOJ intervention decisions, litigation, and resolution, forensic accounting can play a critical role in shaping FCA cases. This program examines how forensic accountants support FCA matters across the full lifecycle of a qui tam case. The panel will discuss how financial analysis helps test insider allegations, identify and map alleged schemes, frame damages at an early stage, distinguish suspicious activity from actionable conduct, and translate large, commingled, or high volume datasets into defensible evidence. The discussion will highlight how forensic accounting can inform decision making for relators and their counsel, support efficient government investigation and intervention analysis, and enable defendants to assess exposure, challenge assumptions, and value cases earlier and more realistically. Panelists will address best practices and common pitfalls at each stage, from prefiling to trial, using real-world FCA contexts such as healthcare billing, government contracting, grant programs, alleged kickbacks, and cases driven by systemic rather than isolated alleged misconduct. The program will conclude with practical takeaways for each stakeholder group on how early financial discipline and rigorous methodology can strengthen outcomes, reduce risk, and improve resolution strategies in FCA litigation.
