Preserving issues for appellate review is at the heart of both trial and appellate practice. And due to the numerous and unpredictable circumstances of trial, complying with federal preservation rules can often add unwelcome stress and complications to effective trial advocacy. This program will address the many specific rules for specific trial pleadings and contexts but will also place those rules into the context of broader preservation principles that will help take the worry and fear out of preservation.

Peter Askin is a Parter at ThompsonMcMullan, P.C., in Richmond, Virginia, where his practice focuses on appellate and trial civil litigation in both state and federal court. He has briefed and orally argued multiple appeals before the Court of Appeals of Virginia, the Supreme Court of Virginia, and the U.S. Court of Appeals for the Fourth Circuit. Peter previously served as a law clerk at the Supreme Court of Virginia for the Honorable Chief Justice S. Bernard Goodwyn, and at the United States District Court for the Eastern District of Virginia for the Honorable Elizabeth W. Hanes.

John O’Herron is a Partner and member of the firm’s Executive Committee at ThompsonMcMullan, P.C., in Richmond, Virginia, where his practice focuses on appellate litigation–including amicus briefing–and motions practice in both state and federal court. John serves as a member of the Joint ADR Committee Council’s Special Committee to Study Appellate Mediation in Virginia, is a member of the Virginia Bar Association’s Appellate Council, holds the position of Virginia State Chair for the Council of Appellate Lawyers, and keeps his clients updated through richmondappeals.com.
