SUMMARY:Webinar: Evaluating and Preparing Successful Qui Tam Actions from Intake to Filing
DESCRIPTION:This webinar will provide a comprehensive overview from evaluating potential qui tam actions at intake to the steps necessary to prepare a case for filing. Initially\, we will examine the legal\, evidentiary\, and practical issues and factors the relator’s counsel should consider before filing a case. Then\, upon determining to file\, we will discuss how relator’s counsel can put together an effective Disclosure Statement and complaint; one that will not only get the government’s attention but dramatically increase the likelihood of intervention. Historically\, the government intervenes in only ~20% of all filed cases. Further\, and most importantly\, when the government decides to intervene\, the likelihood of successfully resolving the case is ~90%. Thus\, an experienced and successful relator’s counsel evaluates and assesses cases based on multiple factors\, many of which are the same as what the government uses when making intervention decisions. Also\, when deciding to file\, the experienced and successful relator’s counsel prepares the way forward by making informed strategic decisions and following through on the corresponding steps that can\, and will\, have a critical impact on the success or failure of the case. The panelists will share their insights on gaining federal litigation experience\, identifying entry points into federal practice\, and dispelling misconceptions about federal court. This webinar is geared toward attorneys who want to enter or increase their federal practice. \nPresented by the Federal Litigation Section.  \n\nAbout the Presenters\nModerator: Renai Rodney\, Counsel\, Ropes & Gray and Co-Chair of the FBA’s Federal Litigation Section’s Programming Committee\nRenai Rodney is counsel in Ropes & Gray’s litigation & enforcement practice group. Clients benefit from her perspective as a former federal prosecutor\, as well as her extensive investigative and trial skills. During her nearly 12 years as Assistant U.S. Attorney in the Northern District of Illinois\, Renai investigated and prosecuted cases involving a wide range of criminal conduct\, including health care fraud\, financial crimes and human trafficking. She prevailed in 11 jury trials and three bench trials\, and successfully argued and defended nine cases before the U.S. Court of Appeals for the Seventh Circuit. Renai’s government experience also includes serving as First Assistant Corporation Counsel in the City of Chicago’s law department. In this role\, she advised on strategic approaches to high-profile litigation and complex transactional matters\, as well as on their resolution. She also advised on the development and implementation of legal policies and procedures\, and coordinated legal strategy with numerous city\, county and federal agencies and legal organizations. Since 2012\, Renai has served as an adjunct professor at Northwestern Pritzker School of Law\, teaching “Introduction to Trial Advocacy.” She has also taught “International Criminal Law in U.S. Courts” and the “Civil Government Practicum.” Her teaching experience also includes traveling to Tanzania to conduct an intensive training on trial advocacy techniques and anti-corruption practices for local magistrate judges and lawyers. \nAndrea Campbell\, Assistant United States Attorney\, Narcotics and Money Laundering Section\, United States Attorney’s Office for the Northern District of Illinois\nAs a litigator with over 10 years of experience\, Andrea Campbell has shown a commitment to public service. After graduating from Howard University School of Law in 2012\, she joined the Cook County State’s Attorney’s Office where she served as an Assistant State’s Attorney in the First Municipal Division\, the Juvenile Justice Bureau\, and the Felony Review Unit.  She joined the City of Chicago as an Assistant Corporation Counsel in 2018\, serving in the City’s Federal Civil Rights Litigation Division (FCRL).  After becoming a supervising ACC\, she joined the United States Attorney’s Office for the Northern District of Illinois\, where she currently serves as an AUSA in the Narcotics and Money Laundering Section. \nAmanda Keaveny\, Law Office of Amanda Bethea Keaveny\nLaw Office of Amanda Bethea Keaveny is the owner of Law Office of Amanda Bethea Keaveny in Charleston\, South Carolina since 1989. 1989-2004\, provided legal representation in a variety of civil and criminal matters\, 2004 to present\, practice exclusively limited to immigration and federal criminal defense\, removal defense practice in Immigration Court\, before the Board of Immigration Appeals\, and before the Fourth Circuit Court of Appeals\, and practice before USCIS and the Department of State\, with a focus on family-based petitions\, naturalizations\, U visas\, VAWA petitions and limited employment-based petitions. Amanda’s professional activities include: Member of AILA Board of Governors June 2020-June 2023\, attended four Board Meetings per year to create and implement the annual plans for the organization. Chair\, AILA EOIR Liaison Committee 2022-2023 : Met with EOIR leadership twice annually in liaison meetings\, assisted in preparation of agenda items for liaison meetings with the Agency\, met with Deputy Attorney General to suggest immigration fixes for consideration by the Administration\, met with the Director of EOIR and the Chief Immigration Judge to raise issues of concern to the Bar\, and prepared Practice Advisories for AILA membership. \nPatrick Miles\, Partner\, Barnes & Thornburg\, LLP\nFormer U.S. Attorney for the Western District of Michigan\, Patrick Miles focuses his practice on corporate compliance\, investigations\, monitorships\, corporate governance\, and business transactions. He brings clients over 30 years of experience as both a business counselor and federal prosecutor. Patrick represents and advises companies ranging in size from small local startups and private ventures to large publicly held international corporations. As a federal prosecutor\, he focused on prosecuting those who exploited children\, committed violent crimes or defrauded taxpayers\, seniors and institutions\, as well as on improving relations between law enforcement and the communities they serve. Patrick also worked to prevent crime and helped people from becoming victims. Serving as the chief federal law enforcement and legal officer in Western Michigan’s 49 counties provided him with unique insights into a wide variety of federal criminal and civil legal matters\, as well as exposure to local\, tribal\, state and federal government officials. DESCRIPTION:This presentation will provide an overview of the federal Fair Labor Standards Act\, addressing both the substantive components of the statute – the pay practices regulated\, the jobs exempt from the statute’s purview\, and the remedies available for violations – as well as the unique procedural issues that arise in cases litigated under the statute. Our speakers will discuss the procedural oddity of an FLSA collective action as distinct from a Rule 23 class action\, and the types of motions and issues arising in the collective action context. The standard for certifying a collective action and sending class notice is currently the subject of a split among the circuits that could be heading to the U.S. Supreme Court. This webinar will focus on the experiences\, strategies\, and mechanism of representing clients in such actions in private\, pro bono and public interest practices. \nPresented by the Civil Rights Law Section and the LGBTQ+ Law Section \n\nAbout the Presenters\nWesley D. Bizzell\, Senior Assistant General Counsel\, Altria; Past President\, National LGBTQ+ Bar Association \nWesley Bizzell serves as Senior Assistant General Counsel and Managing Director of Political Law & Ethics Programs for Altria Client Services. Overseeing a comprehensive compliance system covering the regulation of government affairs\, Mr. Bizzell provides advice and guidance on political law compliance for more than 75 jurisdictions. In 2021\, he was appointed to serve as a commissioner for the American Bar Association’s Sexual Orientation and Gender Identity (SOGI) Commission. \nMr. Bizzell graduated with a B.A. in Justice\, magna cum laude\, from the American University in Washington\, D.C. and received a Master of Social Work with a focus in public policy from the Catholic University of America. He went on to “do a lot of drugs” (as a special agent working gangs and narcotics in Southern California and Florida). After a long nuisance legal battle he initiated alleging the DOJ did not have a representative number of short bald Irishmen\, Ovie was ultimately was hired in 2006 by the DOJ to establish a cybercrime lab to support over 10\,000 needy and often unappreciated prosecutors across the DOJ. \nOvie is an internationally known speakers\, having just returned from SE Asia training judges and prosecutors in digital evidence. Ovie is requested as a speaker not necessarily because of his expertise in the field\, but rather because he is frequently mistaken as Brad Pitt or Chris Hemsworth. Davis\, U.S. Court of Appeals for the Fourth Circuit (Ret.) – Moderator\nDuring a thirty-year judicial career starting in 1987\, Davis served as an Associate Judge on the District Court of Maryland for Baltimore City; as an Associate Judge on the Circuit Court for Baltimore City; as federal district judge on the U.S. District Court for the District of Maryland; and as a federal appellate judge on the Court of Appeals for the Fourth Circuit. In September 2017\, Davis retired fully from service as a judge to become City Solicitor\, as Head of the Law Department\, of Baltimore. There\, he managed a department of approximately 110\, including 70 lawyers who represent the City in all civil legal matters.  In his role as counsel to the Baltimore City Police Department\, he was at the forefront of the City’s implementation of the federal court consent decree requiring broad policing reforms. He retired as City Solicitor in February 2020. \n \nJonathan Aronie\, Partner\, Sheppard Mullin; Consent Decree Monitor\, New Orleans\nJonathan Aronie is a partner at Sheppard Mullin where he is the Leader of the firm’s Government Contracts\, Investigations\, and International Trade Practice Group and is a former Managing Partner of the Washington\, D.C. office.  Jonathan also is a founding member of the firm’s Organizational Integrity Group\, a cross-disciplinary team of litigators\, regulatory specialists\, federal monitors\, and ex-prosecutors with extensive experience helping organizations prevent and defend against challenges to their organizational integrity.  After graduating from Brandeis University (1990) and Duke University School of Law (1993)\, during which he worked with the United States Attorney’s Office in North Carolina\, Jonathan served as a law clerk to the Honorable Judge Patricia Wynn on the DC Superior Court.  In the early 2000s\, Jonathan served as the Deputy Independent Monitor over the Memorandum of Agreement between the Department of Justice and the DC Metropolitan Police Department. In August 2013\, Jonathan was appointed as the lead monitor over the New Orleans Police Department Consent Decree\, a position he continues to hold. Bowers\, Counsel\, Arent Fox\nTerree has extensive experience in criminal\, civil\, and municipal law and previously served as the US Attorney for the Central District of California and the Chief Deputy City Attorney for Los Angeles. He brings more than 35 years of experience in corporate investigations\, crisis management\, securities fraud\, criminal and civil RICO cases\, banking and financial institution fraud\, the Foreign Corrupt Practices Act (FCPA)\, the False Claims Act (FCA)\, civil rights actions\, political corruption and campaign contribution issues\, government contracting\, health care fraud and regulatory matters\, pharmaceutical issues\, environmental criminal and regulatory matters\, employment issues\, customs\, tax fraud\, antitrust issues\, insurance coverage\, California Unfair Competition (Section 17200) cases and a variety of other complex litigation matters. Susie Morgan\, U.S. District Court for the Eastern District of Louisiana\nJudge Morgan graduated from the LSU Law Center where she was a member of the Order of the Coif. After graduation\, she clerked for Judge Henry Politz who served as Chief Judge of the United States Fifth Circuit Court of Appeal. Judge Morgan was a civil trial lawyer before becoming a United States District Court Judge for the Eastern District of Louisiana on March 30\, 2012. SUMMARY:Webinar: A Practitioner’s Guide to Evaluating Wrongful/Reversed Conviction Claims
DESCRIPTION:Joel Rudin\, a criminal defense attorney\, and Jabbar Collins\, then a State inmate\, met in 2002 while Jabbar was incarcerated in Greenhaven Correctional Facility serving a 34 years to life sentence for a murder he steadfastly claimed he did not commit.  At the time\, Jabbar was a quintessential jailhouse lawyer\, helping numerous other inmates and winning several their release\, but he let Joel know he was not yet ready to discuss his own conviction.  A few years later\, after completing his reinvestigation of his own case from prison\, Jabbar was ready to discuss it\, having accumulated a remarkable array of evidence undermining every part of the case against him.  Together\, they overcame a denial of their motion to vacate Jabbar’s conviction in state court and\, after four years of litigation\, won an extraordinarily rare grant of federal habeas corpus relief under which any retrial in state court in Brooklyn\, NY\, was barred.  Thereafter Jabbar and Joel successfully litigated Jabbar’s claims for damages for unjust conviction in the NY Court of Claims and for violations of Jabbar’s federal constitutional rights in a federal Section 1983 civil rights action\, recovering a total settlement in the two cases of  $13 million.  But this story did not end with the $13 million settlement:  the Jabbar Collins story is still being written.  Along with the new head of the Brooklyn DA’s Conviction Review Unit\, Professor Collins is now teaching a course at St John’s Law School concerning wrongful convictions while applying for admission to law school.  Join us for a CLE on wrongful convictions from Attorney Rudin and Professor Jabbar Collins. \nPresented by:\nCivil Rights Law Section\n \nRegistration for this event is now closed. \n\nAbout the Presenters\nWylie M. Stecklow\, Wylie Stecklow PLLC (Moderator) \nWylie Stecklow is a civil rights attorney in downtown Manhattan. Mr. Stecklow is a past President of the Southern District of New York Chapter of the Federal Bar Association\, past National chair of its Civil Rights Law Section\, and is an adjunct Professor at Fordham Law School (his alma mater).  He is the 2021 recipient of the Sarah T. Hughes Civil Rights Award.   He is a founding member of the National Action Network’s Legal Rights Nights and for the past twenty years\, he has been litigating police policies and practice concerning the constitutional rights of protesters and photographers.  He has litigated 1983 cases involving First Amendment Rights in New York\, Maryland and Iowa and tried constitutional cases to verdict in various state and federal courts.  His firm was retained by the Occupy Wall Street General Assembly in 2011\, where he organized pro bono representation for over 200 Occupy arrestees and has continued to litigate civil rights claims relating to the policing of Occupy.   Currently he is co-counsel to two of the consolidated cases in the litigation in the SDNY\, In Re New York City Policing During Summer 2020 Demonstrations. \nJabbar Collins\, St. Johns Law School \nJabbar Collins is President of Horizon Research Services\, a consulting firm providing legal research and writing services to appellate and civil rights attorneys.  In 1994 Mr. Collins was wrongfully convicted of murder and sentenced to life in prison.  He spent the next 16 years of his life there\, teaching himself appellate\, civil\, and post-conviction litigation.  While incarcerated\, Mr. Collins drafted scores of successful New York Freedom of Information law lawsuits\, won a federal habeas corpus petition raising complex ineffective assistance of trial and appellate counsel claims\, and was granted permission by two federal judges to orally argue cases on behalf of two prisoners he assisted.  In 2010\, Mr. Collins\, working with Joel B. Rudin\, who would later hire Mr. Collins as a paralegal\, won a rare unconditional writ of habeas corpus petition dismissing all charges based on egregious prosecutorial misconduct.  Mr. Collins and Mr. Rudin then sued the City and State\, exposing systemic misconduct in the Brooklyn DA’s Office and ultimately winning a $13 million dollar settlement\, at the time one of the highest settlements for a wrongful conviction in New York City history.  Mr. Collins’ legal work following his exoneration has resulted in five other wrongfully convicted men being freed after decades in prison.  Mr. Collins’ case also prompted former Brooklyn DA Ken Thompson to run for office and establish a Conviction Integrity Unit that to this day has freed 28 other wrongfully convicted men.  Mr. Collins is currently an adjunct professor at St. John’s Law School where along with the new Chief of the Brooklyn District Attorney’s Conviction Review Unit\, he teaches Justice Dissected: The Anatomy of a Wrongful Conviction. \n \nJoel B. Rudin\, Law Offices of Joel B. Rudin\, P.C. \nJoel B. Rudin is the principal in a four-attorney criminal defense and plaintiff’s civil rights firm based in Manhattan.  He has won three cases before the U.S. Supreme Court\, numerous Second Circuit decisions expanding the rights of former criminal defendants to recover money damages for police and prosecutorial misconduct\, and numerous seven-figure wrongful conviction settlements\, including $13 million for Jabbar Collins and $15.45 million for William Vasquez. He has been a leader in the movement for prosecutorial accountability\, developing through civil litigation voluminous evidence showing the indifference of local District Attorneys to prosecutorial misconduct and winning leading court decisions holding municipalities liable for such misconduct under federal civil rights law even though the individual prosecutors have personal immunity.  The New York State Association of Criminal Defense Lawyers has awarded him its prestigious Thurgood S. DESCRIPTION:For nearly 75 years\, military courts have squarely rejected challenges to the Uniform Code of Military Justice’s continued jurisdiction over certain retirees.  Two years ago\, University of Texas School of Law Professor Stephen Vladeck successfully convinced a judge of the D.C. District Court to find that courts-martial jurisdiction over retirees is unconstitutional.  Although the Supreme Court declined to hear Larrabee v. Tunheim has served for over 25 years as United States District Judge in the District of Minnesota and has served as Chief Judge since 2015. From 1994-1998\, Judge Tunheim served as Chair of the U.S. Assassination Records Review Board\, an independent federal agency empowered to declassify the remaining secret records of the assassination of President Kennedy. Before his appointment as a federal judge\, he served as Minnesota’s Chief Deputy Attorney General and Solicitor General\, and in the U.S. Senate\, as Staff Assistant to U.S. Senator Hubert H. Humphrey. He has devoted much of his judicial career to helping develop the rule of law in new democracies\, including drafting the Kosovo Constitution and advising over 40 countries on counter-terrorism measures and judicial independence. He is a graduate of Concordia College and the University of Minnesota Law School\, where he served as President of the Law Review. DESCRIPTION:As the nation looks toward its possible first African-American woman on the U.S. Supreme Court\, and as the Supreme Court’s docket includes a growing number of cases implicating social and racial justice\, the memory of Justice Thurgood Marshall – the first African-American ever to serve on the U.S. Supreme Court (1967-1991) – has never loomed larger.    \nA towering figure in civil rights and the law long before he became a U.S. Supreme Court Justice\, Marshall argued the momentous Brown v. Currently she teaches Constitutional Law\, Race and American Law\, and a writing seminar about American segregation\, education and opportunity. \nHer new book — White Space\, Black ‘Hood: Opportunity Hoarding and Segregation in the Age of Inequality (forthcoming\, Beacon 2021) — is about the role of residential segregation in producing racial inequality. Her book\, Loving: Interracial Intimacy in America and the Threat to White Supremacy (Beacon\, 2017)\, explores the history and future of interracial intimacy\, how white supremacy was constructed and how “culturally dexterous” allies undermine it.
