SUMMARY:District of Columbia Chapter: FCPA Enforcement - The International Perspective
DESCRIPTION:With the Department of Justice pursuing fewer cases of international corruption and re-orienting its FCPA enforcement priorities\, three European regulators have come together to fill the void. In late March\, authorities from the UK’s Serious Fraud Office (SFO)\, France’s Parquet National Financier (PNF)\, and Switzerland’s Office of the Attorney General (OAG) announced a task force to strengthen collaboration in cases involving international bribery and corruption. In this panel moderated by former US Attorney Joe Whitley\, hear from prominent white-collar practitioners in each jurisdiction to learn more about the task force\, what it portends for European enforcement trends\, and what it means for American companies doing business overseas.  \nSpeakers include: \nJoe D. Whitley\nMr. Whitley is the Chair of Womble Bond Dickinson’s White Collar Defense\, Investigations and Regulatory Enforcement practice. He represents clients nationally and internationally in a variety of white collar matters. Mr. Whitley has served as Acting Associate Attorney General\, the U.S. Attorney for both the Middle and Northern Districts of Georgia\, and as the General Counsel to the Department of Homeland Security. \nRoss Dixon\nMr. Dixon is a partner at Hickman & Rose in London\, where he handles matters involving financial crime\, business crime\, and regulatory compliance. He has acted in some of the UK’s most serious and complex fraud\, false accounting and bribery and corruption cases. Mr. Dixon has great experience in cases that involve parallel investigations in the UK and overseas\, including the US\, Europe\, South East Asia\, Africa\, and the Middle East. \nSonja Maeder Morvant\nMs. Maeder Morvant is the Group Head of Legal at Edmond de Rothschild in Geneva. She is a legal executive with broad experience as an in-house lawyer\, outside counsel\, and board member. Her practice focuses mainly on complex disputes and\, particularly\, white collar crime\, mutual assistance in criminal matters\, asset tracing\, and compliance. Ms. Maeder Morvant has been ranked in the International Who’s Who of Business Crime Lawyers and as a Top 100 Women Worldwide in Investigations by the Global Investigation Review. \nEmmanuel Moyne\nEmmanuel Moyne is a partner at Bougartchev Moyne in Paris. He handles white collar criminal matters\, often in cases involving several foreign jurisdictions. Mr. Moyne has particular expertise in sensitive financial and political matters\, bribery\, and environmental crimes. In 2023\, Thatcher launched a new brand\, Juniper Custom\, dedicated to the curating and designing custom book sets\, book collections\, and libraries for homeowners\, gift givers\, interior designers\, and others worldwide. Thatcher has long been an advocate for reading as a form of self-care and a means to build focus in the digital age\, concepts that form part of the foundation of The Twelve Monotasks. While defending the place of printed books in our culture for the past twenty years\, Thatcher has also sought to reinvent their creative potential. He has spoken widely about books and libraries including a TED Talk called “The Books We Keep\, the Stories We Tell.” Thatcher’s monotasking philosophy took shape as he grew Juniper Books and weathered numerous personal challenges\, including a life-threatening cancer diagnosis. He is admitted to the Bars of California\, New York\, and Florida. \nErin Lindgren\, Assistant United States Attorney\, U.S. Attorney’s Office – Eastern District of Pennsylvania\nErin Lindgren is an Assistant U.S. Attorney in the Eastern District of Pennsylvania\, where she has handled a number of significant investigations and settlements under the False Claims Act\, including securing a $44 million settlement against a remote cardiac monitoring company for fraudulent billing practices and a significant settlement with a psychiatrist for overbilling Medicaid through inadequate patient consultations. Prior to joining the U.S. Attorney’s Office\, Erin was hired into the Attorney General’s Honors Program in the Tax Division for the Department of Justice. While at the Tax Division\, Erin served as Counsel to the Acting Assistant Attorney General\, and received the Outstanding Trial Attorney award and two Special Commendations. Erin clerked for the Honorable Juan R. Sánchez of the Eastern District of Pennsylvania. Erin received her J.D. from the Temple University Beasley School of Law\, with honors\, and her B.A. from the University of Southern California\, with honors. \nEmily McGowan\, Partner\, Alston & Bird LLP\nEmily McGowan helps health care companies handle complex enforcement and litigation matters. She regularly defends clients in False Claims Act and Anti-Kickback Statute investigations and assists managed care organizations\, pharmacy benefit managers\, and drug manufacturers in high-stakes government enforcement actions and related litigation.
