Miller – Assistant Chief Immigration Judge (Houston – Greenspoint Park\, TX) \nJeffrey S. Miller was appointed as an Assistant Chief Immigration Judge in April 2020. Judge Miller earned a Bachelor of Science in 1996 from Berry College and a Juris Doctor in 2006 from Florida Coastal School of Law. From 2018 to 2020\, he served as an Immigration Judge at the Los Angeles Immigration Court. From 2010 to 2018\, he served as an assistant U.S. attorney at the U.S. Attorney’s Office for the Southern District of Texas in Corpus Christi\, Texas. From 2008 to 2010\, as a member of the U.S. Coast Guard Judge Advocate General Corps\, he served as a special assistant U.S. attorney at the U.S. Attorney’s Office for the Middle District of Florida in Tampa\, Florida. From 2006 to 2008\, he served as an assistant state attorney in Jacksonville\, Florida. Since 2005 he has served in the U.S. Coast Guard Reserve. Judge Miller is a member of the Florida State Bar. \nJudge Jennifer I. Peyton – Assistant Chief Immigration Judge (Chicago\, IL) \nJennifer I. Peyton was appointed as an Assistant Chief Immigration Judge in January 2022. Judge Peyton earned a Bachelor of Arts in 1994 from Trinity College and a Juris Doctor in 1998 from the Case Western Reserve University School of Law. From 2016 to 2021\, she served as an Immigration Judge at the Chicago Immigration Court. From 2003 to 2016\, she was in private practice as managing partner of Jennifer I. Peyton\, Attorney at Law LLC\, in Cleveland. In 2013\, she joined the faculty of the Cleveland State University Cleveland-Marshall College of Law\, where she served as an adjunct clinical professor\, and in 2006 she joined the faculty of the Case Western University School of Law\, where she served as an adjunct professor. Judge Peyton is a member of the Ohio State Bar. \nJudge Rebecca J. Walters – Assistant Chief Immigration Judge (Annandale\, VA) \nRebecca J. Walters was appointed by U.S. Attorney General Merrick Garland as an Assistant Chief Immigration Judge in September 2021. Judge Walters earned a Bachelor of Arts in 2005 from the University of Virginia and a Juris Doctor in 2010 from the American University Washington College of Law. From 2005 to 2007\, she served as the Staff Assistant for the American Bar Association’s Commission on Immigration. From 2010 to 2012\, she served as a Skadden Fellow at Ayuda\, a non-profit organization based in the Washington\, D.C. metropolitan region\, where she provided direct representation to low-income immigrants\, with a focus on serving vulnerable populations including domestic violence\, sexual assault\, and human trafficking survivors\, and unaccompanied immigrant children. Following her fellowship\, Judge Walters continued at Ayuda’s Virginia office as a Staff Attorney from 2012-2014\, a Supervising Attorney from 2014-2019\, and as Managing Attorney from 2019-2021. SUMMARY:Webinar: Evaluating and Preparing Successful Qui Tam Actions from Intake to Filing
DESCRIPTION:This webinar will provide a comprehensive overview from evaluating potential qui tam actions at intake to the steps necessary to prepare a case for filing. Initially\, we will examine the legal\, evidentiary\, and practical issues and factors the relator’s counsel should consider before filing a case. Then\, upon determining to file\, we will discuss how relator’s counsel can put together an effective Disclosure Statement and complaint; one that will not only get the government’s attention but dramatically increase the likelihood of intervention. Historically\, the government intervenes in only ~20% of all filed cases. Further\, and most importantly\, when the government decides to intervene\, the likelihood of successfully resolving the case is ~90%. Thus\, an experienced and successful relator’s counsel evaluates and assesses cases based on multiple factors\, many of which are the same as what the government uses when making intervention decisions. Also\, when deciding to file\, the experienced and successful relator’s counsel prepares the way forward by making informed strategic decisions and following through on the corresponding steps that can\, and will\, have a critical impact on the success or failure of the case. DESCRIPTION:Alternative dispute resolution (ADR) reference materials often cite “confidentiality” as a critical feature of ADR processes.  Confidentiality encourages candid discussions that open the door to negotiated resolutions-  but when ADR programs and neutrals promise confidentiality\, they must know the bounds of their promise under the law and applicable ADR agreements.  This presentation will review statutes\, caselaw\, and ADR agreements so mediators don’t promise more confidentiality than they can deliver.  The program will focus on federal administrative cases with an emphasis on FAA issues\, but will be useful to practitioners in all fields. \n  \nPresented by the Alternative Dispute Resolution Section & Transportation & Transportaion Law Section \n  \nRegistration is Closed \n\nPresenters\nIntroduction & Q&A – James Downey\, Chair\, ADR Section\n \nJames Downey is an Attorney/Advisor for the Department of the Army.
