Specifically\, we will discuss apology statutes; the rules of evidence; apology and forgiveness; the CANDOR program\, which promotes a culture of safety that focuses on caring for the patient\, family\, and caregiver by providing freedom for providers to acknowledge an error without fear that the admission will be used against them in court; and the possible criminalization of medical malpractice. \nPresented by the Alternative Dispute Resolution Section \n\nAbout the Presenters\nModerator: Herschenia Brown\, MBA\nMediator; FBA ADR Section Board Member \nHerschenia Brown is an aspiring employment mediator and financial operations professional with more than ten years experience in project management and process provement strategies\, and nine years in legal finance. She has obtained both Bachelor of Technical Management and Master of Business Administration degrees. Due to the growing number of employees who were experiencing work-related chronic stress\, anxiety\, and depression\, Herschenia decided to shift focus and embark on a new career. Prior to her current position at Pacific Apex Law Group\, Angela practiced law for several years at Eastman Law + Dispute Resolution providing outside counsel to health insurance companies and other health organizations\, and served as in-house counsel for a large health insurer. As a result\, she is well versed in litigation\, transactions\, mediation\, and arbitration. Angela also provides ADR training and coaching services across the nation to employers and employees\, nonprofits\, and other business organizations\, and instructs business graduate and law students as an adjunct professor. She is active in the local Boulder\, Colorado community by volunteering for and supporting non-profit organizations with missions focused on self-sufficiency\, education\, women\, and mental health and substance use disorder. \nJulie McCoy\, PharmD\, JD\nSenior Manager of Pharmacy\, Quality & Medication Safety and Director\, Pharmacy Residency\, Providence Southwest Washington; Partner\, Pacific Apex Law Group \nJulie focuses her legal practice on Health Care and Life Sciences with an emphasis on regulatory compliance\, and Alternative Dispute Resolution. She is experienced in collaborative development\, production\, distribution\, and utilization of scientific and healthcare-related products and services\, pharmaceuticals\, and devices\, with a focus on quality\, efficacy\, safety\, technological efficiency and minimization of cost. She practices in the areas of Health Care and Life Sciences\, with a special interest in telehealth and telemedicine\, and Alternative Dispute Resolution. Katie currently serves on the Board of Optometry for the state of Florida and is a member of the American Optometric Association’s Third-Party committee. \nMark Maines\, MDiv\nGrief & Trauma Specialist\, Crisis Consultant and Veteran Advocate\, Mark Maines Crisis Consulting \nMark Maines has been leading at the intersections of psychology\, spirituality\, and leadership science for over two decades.  He is the founder of a crisis consulting firm that specializes in guiding individuals and communities through grief and trauma\, moral injuries and crisis response/recovery planning.  As a former Naval officer he possessed subject matter expertise in combat trauma\, combat re-integration\, post traumatic stress\, and military ethics.  Mark was forward deployed and  proudly served the heralded “Blue Diamond” 1st Marine Division.  Mark works best in “high stakes\,” “high stress” environments and offers outside perspective\, useful strategy\, and enduring hope whenever possible. Judge Bacharach was kind enough to present at a similar event one year ago and the event was tremendously popular – some of you may have attended. \nThe Honorable Robert E. Bacharach of the U.S. Court of Appeals for the Tenth Circuit.\nJudge Bacharach authored the popular book Legal Writing: A Judge’s Perspective on the Science and Rhetoric of the Written Word. Judge Bacharach received his B.A. from the University of Oklahoma in 1981 and his J.D. from the Washington University School of Law in 1985. Judge Bacharach was a Law Clerk to the Hon. William J. Holloway\, Jr.\, U.S. Court of Appeals for the Tenth Circuit\, from 1985-1987. From 1987-1999\, Judge Bacharach was engaged in private practice in Oklahoma City. From 1999-2013\, Judge Bacharach was a U.S. Magistrate Judge in the U.S. District Court\, Western District of Oklahoma.
