She has litigated a number of complex class action matters and represented numerous pension funds and other institutional investors in cases involving corporate fraud. Since 2013\, she has been on the forefront of international data breach litigation\, representing consumers and financial institutions against retailers\, insurance companies\, and software providers. \nMs. Riebel began her career by spending seven months in Anchorage\, Alaska as a member of the trial team that secured a jury verdict for punitive damages in the amount of $5 billion for a mandatory punitive damages class in In re The Exxon Valdez\, Case No. A89-0095-CV (D. Alaska). For their efforts\, Ms. Riebel and the other members of the trial team were awarded the Trial Lawyers’ For Public Justice Trial Lawyers of the Year award in 1994. \nMost recently\, Ms. Riebel has served in leadership roles in data breach litigation involving Premera Blue Cross\, Capital One\, Yahoo!\, and Progress (the MoveIt Data Breach). Ms. Riebel lives in Minneapolis with her husband and two children. \nEmma Ritter Gordon\, Associate\, Lockridge Grindal Nauen PLLP\nEmma Ritter Gordon is an Associate at Lockridge Grindal Nauen PLLP practicing in the firm’s data-breach and healthcare groups. She represents consumers and healthcare providers in individual and class litigation. Since joining LGN\, she has represented pro bono clients with criminal appeals before the Minnesota Court of Appeals. \nAfter graduating summa cum laude from Duke Law School\, Emma clerked at the Eighth Circuit Court of Appeals for the Honorable Judge David R. Judge Freeman is a graduate of the Harvard Law School and University of California\, Berkeley. \n \nDistrict Judge Paul J. Oetken\, Southern District of New York \nPaul Oetken has been a United States District Judge for the Southern District of New York since his appointment in 2011. He graduated from the University of Iowa in 1988\, where he majored in philosophy\, and received a J.D. from Yale Law School in 1991. He served as a law clerk to Justice Harry A. Blackmun on the United States Supreme Court in 1993-1994\, after clerking for Judge Richard D. Cudahy (U.S. Court of Appeals for the Seventh Circuit) and Judge Louis F. Oberdorfer (U.S. District Court for the District of Columbia). Following his clerkships\, Judge Oetken worked as an attorney at Jenner & Block in Washington\, DC. He then served as attorney-adviser in the United States Department of Justice Office of Legal Counsel from 1997 to 1999. \nIn 1999\, Judge Oetken joined the White House Counsel’s Office\, serving as Associate Counsel to President Bill Clinton until the end of President Clinton’s term in January 2001. Judge Oetken then worked as an attorney at Debevoise & Plimpton in New York from 2001 to 2004\, leaving to become head of litigation at Cablevision Systems Corporation\, where he was Senior Vice President and Associate General Counsel until his appointment to the bench. Judge Oetken is an Adjunct Professor at NYU Law School and previously taught at Fordham Law School. While in private practice he served on the Media Law Committee of the New York City Bar Association \n \nDistrict Judge Anuraag Singhal\, Southern District of Florida \nOn December 20\, 2019\, Raag Singhal received his judicial commission to serve on the United States District Court for the Southern District of Florida.  Judge Singhal is the first Asian American in history to serve as an Article III judge in the jurisdiction of the Eleventh Circuit (Alabama\, Georgia and Florida). \nImmediately prior to becoming a federal judge\, Judge Singhal spent eight years as a State Circuit Court Judge in Broward County\, Florida\, having been appointed by then-Governor Rick Scott in 2011.  While on the state bench\, Judge Singhal served\, at times\, in the criminal\, civil and mental health divisions and was fortunate enough to sit as an Associate Judge on Florida’s Fourth District Court of Appeal on four occasions. \nAs a lawyer\, Judge Singhal gained experience at a civil litigation firm followed by three years as an Assistant State Attorney.  After that\, Singhal ran a successful criminal defense practice in Fort Lauderdale for eighteen years.  During that time\, he handled more than two hundred jury trials including thirty first-degree murder cases. \nJudge Singhal has had leadership roles in many law-related groups.  He is past-President of the Broward Association of Criminal Defense Lawyers and the Stephen H. Booher Chapter of the American Inns of Court.  He was on the Board of Directors of the Broward County Bar Association\, and is a frequent speaker at events for various local Bar groups such as the Asian Pacific American Bar Association and the Federalist Society.  Singhal was also Associate Dean of the Florida College for Advanced Judicial Studies at the time of his appointment  to the federal court system. \nJudge Singhal received his law degree from Wake Forest University School of Law in 1989 where he was very active in Moot Court activities\, and was on the winning team of the J. DESCRIPTION:With the Department of Justice pursuing fewer cases of international corruption and re-orienting its FCPA enforcement priorities\, three European regulators have come together to fill the void. In late March\, authorities from the UK’s Serious Fraud Office (SFO)\, France’s Parquet National Financier (PNF)\, and Switzerland’s Office of the Attorney General (OAG) announced a task force to strengthen collaboration in cases involving international bribery and corruption. In this panel moderated by former US Attorney Joe Whitley\, hear from prominent white-collar practitioners in each jurisdiction to learn more about the task force\, what it portends for European enforcement trends\, and what it means for American companies doing business overseas.  \nSpeakers include: \nJoe D. Dowd\, Partner\, Dunnington Bartholow & Miller LLP \nRaymond J. Dowd is a managing partner of the law firm Dunnington Bartholow & Miller LLP in New York City. He acts as problem-solver for businesses\, not-for-profits and individuals confronting potential investigations\, litigation\, arbitration and mediation. He serves as lead counsel in high-stakes litigation in state and federal trial and appellate courts in disputes often centered on foreign law issues. He has obtained multimillion-dollar intellectual property judgments\, recovered Nazi-looted art\, and scored landmark trusts and estates decisions from Surrogate’s Court to the New York Court of Appeals (including removing the butler from the Estate of Doris Duke and representing the Republic of Germany in recovering an ancient Assyrian tablet for Berlin’s Pergamon Museum). \nRay authored Copyright Litigation Handbook in 2006 and updates it annually with decisions focusing on the Federal Rules of Civil Procedure. He has testified as a New York law expert before London’s High Court. He teaches trial advocacy through use of statistics\, data and charts and use of expert witnesses at his alma mater Fordham Law School. In 2019 he received the Roger J. Goebel International Alumni Award. Current scholarship focuses on the 1907 Hague Convention on Land Warfare and its impact on art restitution claims. \nRay’s past volunteer service includes National Arts Club\, Board of Governors and Chair\, Audit Committee\, Federal Bar Association\, General Counsel and Board of Directors\, Southern District of New York President\, Network of Bar Leaders President\, American Foreign Law Association President. He is a Fellow of the New York Bar and the Federal Bar Foundations. Olivera has also served as an arbitrator in intellectual property disputes. \nOlivera is an adjunct professor of law at Brooklyn Law School where she teaches Fashion Law and an adjunct professor of law at Cardozo Law School where she teaches Advertising Law. She is also a visiting professor at Paris 1 Panthéon-Sorbonne on the topic of Fashion Law. SUMMARY:Reflections from Judge Scott W. Stucky
DESCRIPTION:**Program hosted in (ET) Time Zone** \nJudge Scott W. Stucky will reflect on his distinguished career\, including his service as a federal judge\, chief judge\, and senior judge. He will share lessons learned and other observations from some of his many cases. Steven R. Miller\, Federal Career Service Division Chair\, will moderate. \nRegistration is closed\nPresented by the Federal Bar Association’s Federal Career Service Division \n\nPresenter\nThe Honorable Scott W. Stucky\, Senior Judge. \nPresident George W. Bush appointed Scott W. Stucky to the United States Court of Appeals for the Armed Forces on December 20\, 2006.  He became Chief Judge on August 1 \, 2017\, and Senior Judge on August 1\, 2021.  \nJudge Stucky was born in Hutchinson\, Kansas\, in 1948\, and grew up on a family farm near Pretty Prairie\, Kansas.  He graduated from Wichita State University\, where he received a commission as a second lieutenant\, U.S. Air Force Reserve\, through ROTC. He then attended Harvard Law School\, from which he graduated in 1973.  After his admission to the Kansas bar\, Judge Stucky went on active duty as a judge advocate in the Air Force\, serving in San Antonio\, Texas; U-Tapao\, Thailand; and Syracuse\, New York. After leaving active duty\, Judge Stucky practiced with a Washington\, D.C.\, Jaw firm and then served as a branch chief with the U.S. Nuclear Regulatory Commission.  \nIn  1983\, Judge Stucky became a civilian legislative counsel for the Department of the Air Force.  Four years later\, he became the Air Force’s principal legislative counsel\, responsible  for its legislative drafting\, statutory analysis\, and related matters.  \nHe served as a member and panel chairman on the Air Force Board for Correction of Military Records .  Judge Stucky was selected to serve as an OPM LEGIS Fellow\, and to attend the Federal Executive Institute\, the Harvard Program for Senior Officials in National  Security\, and the National  War College.  \nIn 1996\, Judge Stucky became General Counsel of the Senate Committee on Armed Services. Jn this capacity\, he was the principal legal officer for the majority side of the Committee.  \nHe served two chairmen \, Senators Thurmond and Warner ; three staff directors; and was responsible as counsel for I 0 consecutive national defense authorization  acts  \nFrom  1982 to 2003\, Judge Stucky served in the Air Force Reserve as a judge advocate individual mobilization  augmentee (IMA). He was three times appointed  as an appellate military judge on the Air Force Court of Criminal Appeals\, serving for a total of almost seven years on that court. From  1999 to 2001\, he was the senior I MA in Washington\, D.C.\, responsible to the Judge Advocate General for the training and readiness of some 120 Reservists .  Upon his retirement as a colonel in 2003\, Judge Stucky was awarded the Legion of Merit for outstanding service.  \nIn addition to his undergraduate and law degrees\, Judge Stucky holds master’s degrees in history from Trinity University and in international law from George Washington University. He has lectured at the JAG schools of all three services and was for I0 consecutive years a panelist at the ABA’s annual Law and National Security Conference.  He was a member of the board of directors of Omicron Delta Kappa (a college leadership society) from 2006 to 2010\, and of the Executive Committee of the ABA Appellate Judges Conference from 2012 to 2016.  \nJudge Stucky was married to the former Jean Seibert.  Jean Stucky\, a graduate of Wellesley College and Cornell Law School\, retired as Assistant General Counsel for Contractor Human Resources at the U.S. Department of Energy in 2018 and died in 2020.  The Judge has two children\, Mary-Clare and Joseph.  \n\n\nRegistration\nRegistration is closed for this event. \n\n\nRegistration Fees\n\nFBA Member: $0\nNonmember: $95\n\nLive Captioning: Closed captioning is available for all virtual webcasts. \nInternet Requirements: Virtual programs require suitable internet strength to stream online panels. DESCRIPTION:*Program hosted in (ET) Time Zone** \nJoin us for a panel discussion on the January 2025 revisions to the Federal Acquisition Regulation (FAR) rules on suspension and debarment\, intended to bring the FAR more closely into alignment with the Nonprocurement Common Rule (NCR) that applies to non-procurement transactions.  Panelists will also discuss the ongoing “Revolutionary FAR Overhaul” and any overhaul (or predictions on overhaul) of FAR Part 9. \nRegister Now!\nPresented by the FBA’s Government Contracts Section \n\nPresenters\nSarah Drabkin\, Suspension and Debarment and Whistleblower Manager\, U.S. Department of State (invited) \nSarah Drabkin is the Suspension and Debarment and Whistleblower Manager in the Office of Global Acquisitions\, Office of Acquisition Policy Directorate at the U.S. Department of State (State). Sarah is also the Acting Federal Assistance Director and serves as an Alternate Competition Advocate. \nPreviously\, Sarah was an Integrity Officer with the Office of Suspension and Debarment in the U.S. General Services Administration (GSA) for over 7 years. As an Integrity Officer Sarah analyzed S&D cases\, agency protests\, and various other government contract policy issues. Prior to this Sarah was a procurement analyst at the U.S. Department of Health and Human Services (HHS) where she helped to create their first S&D office\, The Office of Recipient Integrity Coordination.  Sarah was also an intern at GSA in the Suspension and Debarment Division during her time in law school. \nSarah received a Bachelor of Arts degree in Political Science with a minor in History from Old Dominion University and a Juris Doctor from University of the District of Columbia David A. Clarke School of Law in May 2012. She is a member of the D.C. Bar Association and serves as a co-chair for the American Bar Association – Public Contracts Law Section\, Debarment and Suspension Committee. \nLeslie Edelstein\, Associate\, Vinson & Elkins (Moderator) \nLeslie is a litigation and regulatory attorney focused on government contracts and national security. Her work involves representing government contractors in litigation matters\, including litigating bid protests at the Government Accountability Office (GAO) and the Court of Federal Claims (COFC); filing and responding to contract claims; and prosecuting claim appeals at the different Boards of Contract Appeals. Leslie assists government contractors on contract and regulatory compliance matters involving the Federal Acquisition Regulation (FAR)\, Defense Federal Acquisition Regulation Supplement (DFARS)\, and agency supplemental acquisition regulations. Her practice also involves compliance counseling and risk mitigation associated with internal and government investigations. She helps clients conduct risk assessments\, and develop and adopt compliance policies. She provides guidance to clients on government contracting risks associated with mergers and acquisitions. In addition\, Leslie assists clients in conducting internal investigations and responding to government fraud investigations and present responsibility inquiries. Leslie routinely assists clients in suspension and debarment matters. \nLeslie also assists foreign and domestic clients to comply with the requirements of the Committee on Foreign Investment in the United States (CFIUS). This involves helping clients understand the risks associated with proposed transactions and\, when necessary\, filing notice of the transaction with CFIUS. \n\n\n\n\n\n  Duc Nguyen\, Partner\, Fluet \nDuc H. Nguyen is a Partner in Fluet’s Government Contracts Practice\, specializing in federal procurement\, suspension and debarment\, and corporate compliance. He previously served as Managing Director at a national integrity monitoring firm and as the Senior Debarring Official at the EPA\, where he issued over 1\,500 exclusion notices and led high-profile administrative agreements. He also served as Vice Chair of the Interagency Suspension and Debarment Committee\, appointed by the OMB. \nEarlier in his career\, Mr. Nguyen was a Senior Attorney at NASA and an Attorney-Advisor at U.S. Army Materiel Command\, overseeing contracts totaling over $100 billion. A retired U.S. Army Judge Advocate and logistician\, he served for 20 years with deployments across East Asia\, Africa\, and the Middle East. \nHe is active in the ABA\, co-authoring the Practitioner’s Guide to Suspension and Debarment\, and is fluent in Vietnamese with additional proficiency in French and Korean. A former refugee\, he continues to advocate for Southeast Asian refugee communities. \n Kara Sacilotto\, Partner\, Wiley \nKara Sacilotto is a nationally recognized government contracts attorney whose practice focuses on suspension and debarment\, bid protests\, internal investigations\, False Claims Act matters\, and ethics and compliance counseling. She has successfully represented clients of all sizes before the GAO\, U.S. Court of Federal Claims\, and Boards of Contract Appeals\, and regularly advises on emerging areas of risk such as cybersecurity compliance\, procurement collusion\, and artificial intelligence. \nKara has testified before Congress on federal procurement issues and serves as an adjunct professor at American University’s Washington College of Law. He has represented clients at all levels of Social Security from initial claims up through the federal district court. \nSpelios was the Chair of the Chicago Bar Association Social Security Law Committee from 2020-2021. As Chair\, he authored and advocated for Public Act 102-0183\, which expanded the definition of medical providers in Illinois and provided that individuals seeking SSDI\,SSI\, Aid to the Aged Blind and Disabled\, and Federal Veterans’ benefits could obtain their medical records in Illinois for no charge. Adam is an avid outdoorsman who loves to run\, hike\, bike\, camp\, canoe\, and kayak. Attorney Vanderwerff is the son of an engineer and a musician who taught him that he should creatively think through every problem. \nAdam has had an extremely varied early career in litigation\, including family law\, landlord-tenant issues\, and personal injury. Adam also served as an Assistant Attorney General for Consumer Protection and Antitrust for two years\, helping ensure fair\, safe\, and effective pharmaceutical treatment for the Citizens of Wisconsin. \nAdam learned the value of hard work from his father\, who showed him that the work was not done until it was done right. \nHe is admitted to the Federal District Courts\, including the Eastern and Western Districts of Wisconsin and Colorado\, and to the U.S. Courts of Appeals for the Seventh Circuit. She manages the judge advocate recruiting programs\, including all recruiting communications and materials\, and provides technical assistance and policy guidance for all prospective judge advocate applicants. Prior to this assignment\, she served as victims’ counsel\, deployed deputy staff judge advocate\, and assistant staff judge advocate. \nMaj Bell received her commission through the Direct Appointment Program and entered active duty in January 2018.  While in law school\, she participated in the University of South Carolina School of Law Juvenile Justice Clinic.  She also interned at the City of Columbia City Attorney’s Office\, Richland County Public Defender’s office\, and the U.S. District Court for the District of South Carolina interning for the Honorable Judge Margaret B. Lucas is currently stationed at Marine Corps Recruiting Command in Quantico\, VA. She is presently assigned as the Deputy Staff Judge Advocate and Law Programs Manager. Previously\, she served as the Executive Officer for Headquarters Battalion Marine Corps Base Hawaii from June 2023 to June 2024. Capt Lucas simultaneously served as the Service Company Commander beginning in March 2023. Prior to taking company command\, Capt Lucas was the Deputy Staff Judge Advocate for Marine Corps Base Hawaii from May 2021 to March 2023. Before her time as the DSJA\, Capt Lucas was attached to the Legal Services Support Team as a Trial Counsel from October 2020 to May 2021. Capt Lucas is originally from New York and attended the University of San Diego where she earned her Bachelor of Arts in History with a minor in Political Science in May 2014. She attended the University of South Carolina School of Law\, where she earned her Juris Doctorate in May 2018. She is a member of the Alabama State Bar. \nCapt Lucas competed on the NCAA Division I Women’s Rowing team at the University of San Diego from 2010 to 2014 where she was named to the West Coast Conference Commissioner’s Honor Roll in 2012 and 2013. Capt Lucas served on the Student Athlete Advisory Committee and as Chair for the Out-of-State Student Council. During law school at the University of South Carolina\, she was a Member of the Mock Trial Bar\, served as a Representative of the Student Bar Association\, practiced as a Student Attorney in the University’s Criminal Defense Clinic\, and edited a manuscript for the South Carolina Bar Association. Additionally\, Capt Lucas clerked at the law office of Quinn and Hardy and completed an externship at the Office of the Staff Judge Advocate on United States Army installation\, Fort Jackson\, South Carolina. \nCapt Lucas completed Officer Candidate Course 222 at Officer Candidate School\, Quantico\, Virginia and commissioned as a Second Lieutenant in the United States Marine Corps in August 2016. In the summer of 2017 Capt Lucas conducted on-the-job training at the Legal Services Support Section on Marine Corps Base Quantico. Capt Lucas then attended The Basic School in Quantico\, Virginia where she graduated fourth overall from Alpha Company 1-20 in April 2020 earning meritorious career designation. Following her training at The Basic School\, she then completed the Force Fitness Instructor Course in Quantico\, VA with a certificate of commendation as the honor graduate. Capt Lucas then attended Naval Justice School in Newport Rhode Island where she earned the Trial Advocacy Award for BLC 20030. \nCapt Lucas served as a legal augment for PHIBRON Five on the USS Essex LHD-2 during the Rim of the Pacific (RIMPAC) exercise 2022. While aboard the Essex\, she provided staff judge advocate support to 7th Marines\, the USS Essex Captain and crew\, and international allies and partners during the conduct of the exercise scenario. Capt Lucas also supported Exercise Spartan Trident in January of 2022 and September of 2023 by serving as a Staff Judge Advocate for 3dMLR throughout the execution of the exercise. Peyton Nedley\, Coast Guard Judge Advocate \nLieutenant Peyton Nedley serves as the Accessions & Resource Program Manager for the Coast Guard Legal Program (CGJAG)\, overseeing the Coast Guard’s legal recruiting and judge advocate accessions. \nShe previously served as a staff attorney in the Office of Claims and Litigation\, where she was responsible for representing the Coast Guard in federal civil litigation nationwide in coordination with the Department of Justice. Before she became a professor\, she was a partner in Skadden\, Arps\, Slate\, Meagher & Flom LLP’s corporate restructuring group\, where she practiced law for a number of  years. \nDuring the years she practiced law\, Ms. Henry represented virtually all interested parties in corporate restructuring cases\, including banks\, debtors\, unsecured creditors\, and trustees\, and handled cross-border transactions involving Germany\, Mexico\, Israel\, Argentina\, and many other jurisdictions. \nA graduate of Duke University and New York University School of Law. Ms. Henry is the author of several books and numerous articles on commercial law and restructuring topics. She has lectured on these topics throughout the world. \nDuring the time she practiced\, Ms. Henry was the recipient of an annual New York city-wide award from The Legal Aid Society for her pro bono work. As a teacher\, she has been the recipient of a number of awards\, including the Texas Tech Hispanic Law Students’ Professor of the Year and the Texas Tech Black Law Students’ Professor of the Year awards. DESCRIPTION:**Program hosted in (ET) Time Zone** \nAs it relates to admiralty and maritime subject matter jurisdiction\, the U.S. Constitution states in Article III\, Section 2 that “[t]he judicial Power shall extend. . . to all Cases of admiralty and maritime Jurisdiction…” The first statute defining the boundaries of admiralty jurisdiction was enacted in 1789 (known as the First Judiciary Act; Chapter 20\, section 9\, 1 Stat. 73). The current statutory grant of admiralty jurisdiction can be found at 28 U.S.C. § 1333(1)\, which gives federal district courts original jurisdiction over “any civil case of admiralty or maritime jurisdiction\, saving to suitors in all cases all other remedies to which they are otherwise entitled.” Some kinds of maritime cases—typically those involving in rem remedies against a vessel or cargo—are subject to the exclusive jurisdiction of the federal courts. Under the “savings to suitors” clause\, on the other hand\, state courts may have concurrent jurisdiction over admiralty claims when a state court is competent to grant relief\, which is in most instances where in personam jurisdiction may be had in a state court.
