She also led dozens of large-scale commercial fraud investigations and worked closely with federal law enforcement and regulatory agencies. \nIn addition to her civil practice\, Ms. Akers has investigated and tried a range of federal criminal cases\, including those involving the International Traffic in Arms Regulations (ITAR)\, conspiracy\, wire fraud\, Racketeer Influenced and Corrupt Organizations (RICO) conspiracy\, assault\, witness tampering\, obstruction of justice and domestic terrorism. She has managed complex e-discovery in highly sensitive cases and presented cases to federal grand juries. Ms. Akers has also handled international trade matters\, including litigating before the U.S. Court of International Trade\, and leading a high-priority DOJ task force to combat international trade fraud. She is an accomplished appellate lawyer who has argued 26 cases before the U.S. Court of Appeals for the Federal Circuit. \nIn addition to her legal practice\, Ms. Akers is a faculty lecturer at the DOJ’s Trial Advocacy Seminar\, one of the department’s premier training courses\, and the National Institute of Trial Advocacy\, widely recognized as the leading organization for training lawyers in courtroom advocacy. DESCRIPTION:**Program hosted in (ET) Time Zone** \nIn numerous circumstances\, the Government pays out money not so it can receive a tangible benefit for itself but rather to promote a policy objective designed to benefit third-parties\, or society as a whole. Thus\, in exchange for receiving Government money\, program participants do not promise to provide the Government with a specific product or service\, but rather promise to conduct themselves in a particular fashion\, or to spend the money in a particular way. Examples abound: Government loans or grants with policy strings attached\, such as minority and veteran set-aside funding; HUD loans and grants conditioned on using funds to promote low-income housing and requiring that such properties be maintained in habitable conditions; Government regulations prohibiting kickbacks or labor trafficking; Government subsidies conditioned on compliance with environmental or regulations; Pandemic funding designed to mitigate hardships experienced by employees affected by lockdowns; and many others. \nWhen recipients of Government funds fail to comply with the strings attached to the funding\, qualitatively impacting the very purpose of the government program or policy\, do they violate the FCA? If so\, how is the violation proved\, and what is the Government’s measure of damages\, especially where there does not appear to be any tangible fiscal impact on the Government? Is the Government entitled to recover the full amount it paid out\, based on the notion that the payment is tainted by the policy violation\, or are damages calculations meant to assess the benefit of the Government’s bargain? If a conditional loan is disbursed\, and then paid back\, can the Government or a relator still assert an FCA claim based on the borrower’s failure to comply with the regulatory conditions for the loan? Dempsey\, principal of Dempsey Law PLLC\, served with the Office of Immigration Litigation at the U.S. Department of Justice in Washington\, D.C. for over a decade.  He retired in March 2018 as the Chief of the National Security and Affirmative Litigation Unit within his Section\, where he supervised a team of attorneys conducting national security and immigration-related\, affirmative and defensive litigation in district courts and courts of appeal across the nation.  Mr. Dempsey supervised all national security litigation of an office with over 75 attorneys\, regularly trained Department attorneys in Washington\, D.C. and the National Advocacy Center\, and instructed agency attorneys and law enforcement officers at venues throughout the United States.  Prior to his work at the Justice Department\, Mr. Dempsey served on active duty with the U.S. Army Judge Advocate General’s Corps then remained active trying criminal cases in the Army Reserves. \nMr. Dempsey has significant litigation experience.  He has appeared in thirty-nine U.S. District Courts and eight U.S. Circuit Courts of Appeal\, tried seventeen jury cases and over fifty bench trials\, and handled dozens of appeals. Mr. Dempsey is a member of the American Immigration Lawyers Association (“AILA”)\, and currently serves as an Executive Director and Chair of the Litigation & Collective Advocacy Committee of the Central Florida Chapter (“CFC”) of AILA\, regularly provides instruction as faculty at national immigration seminars\, and is routinely sought out for his expertise in immigration matters by attorneys across the nation. \nElizabeth J. Stevens\, Attorney of Counsel\, Amaryllis Law \nElizabeth J. Holloway\, Jr.\, who was then the Chief Judge of the Tenth Circuit Court of Appeals. After completing this clerkship\, Judge Bacharach practiced civil litigation at Crowe & Dunlevy in Oklahoma City\, Oklahoma from 1987 to 1999. He then served as a U.S. Magistrate Judge in the Western District of Oklahoma until 2013\, when he was appointed to the Tenth Circuit Court of Appeals.  \n Judge Bacharach is the author of Legal Writing: A Judge’s Perspective on the Science and Rhetoric of the Written Word\, published by ABA Press. He has also authored “Section 1983 and the Availability of a Federal Forum: A Reappraisal of the Police Brutality Cases\,” 16 Memphis State University Law Review 353 (1986); “Section 1983 and an Administrative Exhaustion Requirement\,” 40 Oklahoma Law Review 407 (1987); “Motions in Limine in Oklahoma State and Federal Courts\,” 24 Oklahoma City University Law Review 113 (1999); “Dirks v.
