SUMMARY:Qui Tam Section: [VIRTUAL] Insurance Coverage for FCA Resolutions & Defense Costs
DESCRIPTION:**Program hosted in (ET) time zone**\n\n\n\nThis panel of insurance dispute litigators and former Department of Justice False Claims Act prosecutors will discuss an evolving field of litigation between policyholders and insurers over coverage claims from False Claims Act settlements\, judgments\, and defense costs. What aspects of an FCA resolution might constitute a “loss” that is insurable? The panel will also review notable case law discussing these issues and more. \nRegister Today!\nPresented by the FBA Qui Tam Section \n\nPresenters\n\n\n\n\nDerek Adams\, Potomac Law Group\, PLLC (Moderator) \n \nLilit Asadourian\, Barnes & Thornburg LLP \n \nCara Duffield\, Lavin Rindner Duffield LLC \n \nEllen London\, London & Naor P.C. \n \n\nRegistration\nRegister Here! \n\nFBA Members: $0\nNon-Members: $0\n\n\nCLE\nPlease note that CLE credit is not offered for this webinar. \n\nEmail Communication Policy \nBy registering for this event\, you agree to receive email communications from the Federal Bar Association and affiliated sponsors of the program concerning event details\, Continuing Legal Education certification\, programming changes\, upcoming events\, surveys\, and post-event communications. \nRecording Disclaimer \nBy registering for an FBA webinar\, you agree to the recording of audio and visual content presented during the live event and consent to subsequent use of the recording by the FBA. This panel will discuss the pros and cons on whether Congress should adopt a “loser pays” approach\, or if this is just a solution looking for a problem. Regarding construction\, there have been questions with regard to the legal status of Project Labor Agreements (PLA) in Federal Construction Contracts. Are they in or are they out? What is the impact of anticipated tariffs on the construction industry? The panelists will discuss the impact of the Administration’s recent interim DBE Rule on DOT contractors and subcontractors and how contractors should be reacting. As far as the impact of new Administration policies on Small Business and Other Socioeconomic Programs\, there has been talk of the elimination of the small business “Rule of Two”\, and a decrease in the emphasis of government utilization of businesses from underserved communities. Is this true? Or are there any bright lights for small businesses in the near future? \nNetworking Break | 2:15 pm – 2:30 pm \nProspective Outlook on Federal Construction\, Employment & Labor Law\, Federal Grants\, and Strategic Alliances | 2:30 pm – 3:30 pm \nWith regard to employment and labor law\, the panel will discuss the latest legal developments and changing legal landscape at the US DOL\, OFCCP\, and the EEOC\, as well as how federal contractors can navigate these changes\, among other issues. There will also be discussion on the outlook for Federal Grants and what new grant vehicles will look like and how grant recipients should be preparing themselves for the future. Should grant terminations be challenged. What about contract terminations? How should contractors respond? What should contractors be doing during the shutdown in preparation of filing claims and recovering costs? In addition\, what should contractors know about how the FAR overhaul has affected or will affect the claims and disputes resolution process? \nNetworking Break |3:30 pm – 3:45 pm \nLatest Developments in International Procurement\, Sanctions & Export Controls\, Cybersecurity & Enforcement\, Suspensions and Debarments | 3:45 pm – 4:45 pm \nWhat is the current state of international procurement? Are there any common themes in public procurement in other countries that are common denominators that government contractors should be aware of? Meanwhile\, have you ever wondered what happens when companies ignore red flags\, bypass legal advice\, and underestimate the reach of U.S. export laws? This panel will focus on how companies must navigate complex trade and sanctions landscapes\, highlighting the steep costs of compliance failures. In addition\, the Administration’s recent cybersecurity executive order seems to signal a strategy shift in federal cybersecurity that might be described as narrower in scope with an emphasis on decentralization and a streamlined compliance framework for federal agencies and defense contractors. And what about the procedures for suspensions and debarments? Are those regulations impacted by the FAR overhaul? And what should we know about the FAR overhaul in general? \nClosing Remarks | 4:45 pm – 5:00 pm \nNetworking Reception | 5:00 pm – 6:30 pm \n\nThank You to Our Sponsors!\n  \n \n  \n \n

SUMMARY:Webinar: Recent Developments in “Mass Arbitrations”
DESCRIPTION:**Program hosted in (ET) Time Zone** \nThis panel will explore recent developments in the administration and management of “mass arbitration” claims.  Faced with provisions in consumer and similar contracts requiring the resolution of disputes through arbitrations on an individual (not class-wide) basis\, plaintiffs have sought to aggregate related claims through “mass arbitration” proceedings.  Such proceedings have created logistical challenges for parties and arbitration providers\, including for respondents required to pay filing fees that sometimes exceed the amounts at issue in the underlying dispute.   Following these developments\, courts have considered when and under what circumstances parties may be subject to consolidated and streamlined arbitration proceedings\, including under procedures and guidelines that arbitration providers have adopted for “mass arbitrations.”  The panel will discuss these developments\, as well as their broader impact on aggregate claims litigation. \nPresented by FBA Annual Meeting & Convention 2025 sponsor JAMS. \nRegister Now!\n\nPresenters\nSteve Lucke serves as a JAMS arbitrator and mediator\, including with respect to the arbitration of disputes involving similar claims brought by consumers.  Prior to joining JAMS\, Steve litigated class action and other complex matters\, including a “mass action” brought against over 300 health plans and their claims administrator that the trial judge described as “perhaps the most complex case pending in [the United States District Court for] the Central District of California.” Steve also teaches Complex Litigation at the University of St. Thomas School of Law. \n  \nThe Hon. Ellen L. Maas (Retired) serves as a JAMS arbitrator and mediator and has helped resolve numerous related\, consumer law disputes. During her 28-year career as a Minnesota District Court Judge\, she routinely was assigned and requested to preside over complex civil litigation matters. In addition to a six-week jury trial that arose from a train collision involving multiple fatalities\, Judge Maas presided over hundreds of product liability\, employment\, professional liability\, and consumer law matters. While in private practice\, Judge Maas had an active trial practice in the areas of toxic tort\, product liability\, negligence\, employment and municipal liability\, and insurance coverage. \n  \nBehdad Sadeghi is a partner at Zimmerman Reed LLP.  His practice focuses on plaintiff side representation of individuals and public entities in consumer fraud\, data privacy\, and civil rights disputes. He has litigated numerous mass arbitration cases from initiation to conclusion with JAMS\, AAA\, and NAM\, involving relief for tens of thousands of claimants. He also has experience litigating the enforceability of arbitration provisions in federal courts. \n  \nCollin Vierra is a partner at Eimer Stahl LLP and Chair of the firms Mass Arbitration\, and Data Privacy and AI\, practice groups. Collin has helped companies respond to approximately a quarter-million individual demands for arbitration and is known or pioneering techniques for the fair and efficient resolution of mass claims. Collin also frequently litigates over arbitration and other issues at the trial and appellate levels. \n  \n  \n\n\nRegister Now!\n\n\nLive Broadcast | FBA Member: $0\nLive Broadcast | Nonmember: $95\nOn-Demand Broadcast | FBA Member: $50\nOn-Demand Broadcast | Nonmember: $95\n\n\n\nCLE\nPlease note: CLE for this webinar has not been pre-approved.\nMyLaw and the FBA will seek 1.0 General CLE credit hours in 60-minute states\, and 1.2 General CLE credit hours in 50-minute states. \nPosted credit hours are estimated and subject to respective state approval and rounding rules. SUMMARY:Webinar: Mass Arbitration: Tactics and Lessons from the Trenches
DESCRIPTION:**Program hosted in (ET) Time Zone** \nMass arbitration is increasingly being used as a powerful tool to pressure companies—leveraging the economics of arbitration fees and serial proceedings to overwhelm them. What begins as a handful of claims can rapidly escalate into hundreds\, if not thousands\, of near-identical arbitrations\, threatening financial stability and litigation continuity. \nThis webinar will explore the evolving landscape of mass arbitration and mass litigation through the lens of defense counsel with firsthand experience navigating high-volume dockets. Drawing from real-world examples\, speakers will unpack the strategic challenges posed by mass filings\, how plaintiffs’ counsel are structuring these campaigns\, and defense approaches that can mitigate risk\, manage cost\, and turn the tide. Attendees will learn best practices for coordinating national defense strategy\, developing global settlement frameworks\, and tailoring responses even as new plaintiffs and theories emerge. \nIdeal for federal practitioners\, in-house counsel\, and outside litigation teams\, this session offers practical tools and tactical insights for responding effectively when your client becomes the next target of a mass action wave. \nPresented by FBA Annual Meeting & Convention 2025 sponsor Winthrop & Weinstine\, P.A. \nRegister Now!\n\nPresenters\nMaggie Green is an attorney at Winthrop & Weinstine with extensive experience in handling large-scale mass arbitrations. In recent years\, Maggie\, alongside Joseph and Olga\, has served as lead counsel in defending clients against substantial waves of arbitrations\, with plaintiffs’ counsel bringing claims ranging from forty to over three hundred at a time. Through this work\, Maggie has developed expertise in managing complex dockets\, streamlining discovery processes\, and addressing “near-identical” claims while ensuring consistency in defense strategies. \n  \nOlga Rogne is a litigator at Winthrop & Weinstine. Together with Joseph and Maggie\, Olga has served as lead counsel in defending clients against mass arbitration waves\, with plaintiffs’ counsel bringing claims ranging from forty to over three hundred at a time. Olga has considerable expertise in streamlining discovery\, managing complex dockets\, dealing with resource constraints brought on by the challenge of mass arbitration\, and tailoring defenses as new plaintiffs and theories emerge. \n  \n  \nJoseph Windler is a trial attorney at Winthrop & Weinstine with extensive experience in litigation\, regulatory matters\, and business and employment law. In the realm of mass arbitration\, Joseph\, alongside colleagues Olga and Maggie\, has successfully defended clients against large-scale claims\, including cases where plaintiffs’ counsel have filed on behalf of over 300 claimants simultaneously. Joseph has honed expertise in developing and executing national defense strategies\, developing global settlement frameworks\, and advising clients on proactive risk management to mitigate exposure. \n  \n\n\nRegister Now!\n\n\nLive Broadcast | FBA Member: $0\nLive Broadcast | Nonmember: $95\nOn-Demand Broadcast | FBA Member: $50\nOn-Demand Broadcast | Nonmember: $95\n\n\n\nCLE\nPlease note: CLE for this webinar has not been pre-approved.\nMyLaw and the FBA will seek 1.0 General CLE credit hours in 60-minute states\, and 1.2 General CLE credit hours in 50-minute states. \nPosted credit hours are estimated and subject to respective state approval and rounding rules.
