DESCRIPTION:This panel will discuss the intricacies of INA 101(b)(1)(E)\, (F) and (G). As immigration and adoption practitioners\, Karen Law and Rachel Thompson receive a lot of questions regarding the complex process for international adoption. This panel attempts to clarify common misconceptions and myths surrounding international adoption and provide a legal framework for one pursuing adoption in any context. \n  \nPresented by the Immigration Law Section \n  \nRegistration is Closed \n\nPresenters\nRachel L. D. Thompson  \nRachel L. D. Thompson\, an immigration and adoption attorney\, is the owner and managing attorney at Poarch Thompson Law. She serves on the Federal Bar Association’s Governing Board as Programs Chair and is the Chair of their Law School Committee. She was the recipient of the FBA-ILS “Younger Lawyer of the Year Award” (2018) and the recipient of the “Alison Parker Young Woman of Achievement Award” (2016) given by DePaul Community Resources where she served as a board member for six years. She also served as a board member for Blue Ridge Legal Services. In 2020\, she was listed in Roanoker Magazine’s Class of 2020 for “40 Under 40\,” was named a Rising Star by Super Lawyers Magazine\, and nominated by her peers as Legal Elite by Virginia Business. She is also an adjunct professor at Liberty University School of Law teaching Adoption Law. Rachel first moved to Southwest Virginia after she attended Liberty University School of Law (Lynchburg\, Virginia)\, graduating in May 2012. The multiculturalism inherent in her native city (Philadelphia) and her family (South African mother and Jamaican father) instilled an early and profound love for diverse cultures and a hope in the possibilities of immigration. She is married to her law school sweetheart and has four children and two dogs. \nKaren Stoutamyer Law \nKaren Stoutamyer Law is an adoption and immigration attorney practicing in Virginia. As a Virginia adoption attorney\, she represents prospective adoptive parents\, foster parents\, birth parents\, and adoptees before courts all over the Commonwealth. Her immigration practice is national. She graduated from the University of Pennsylvania School of Law in 1985 and became licensed in Virginia in that same year. She is a fellow of the Academy of Adoption and Assisted Reproduction Attorneys and a member of the American Immigration Lawyers Association\, the Virginia State Bar\, and the Virginia Women Attorneys Association. She served as the Deputy Director of Intercountry Adoption for the Academy of Adoption and Assisted Reproduction Attorneys for two years. She also served on the AILA International Operations Liaison Committee for two years. Working with those professional associations\, she submitted comments to USCIS on proposed rules\, operating procedures and policy memoranda. She has also assisted with drafting federal and state legislation and has provided comments and technical expertise to legislators and policy makers at the Department of State\, USCIS\, and the Virginia Assembly. She was designated as a 2013 Angel in Adoption by the Congressional Coalition on Adoption. In cooperation with the Loudoun County Department of Family Services and the Virginia Women Attorneys Association\, she co-chaired the annual celebration of adoption in Loudoun County\, Virginia\, for thirteen years. In addition to appeals\, Kayla works on retroactive resentencing projects\, like compassionate release and guidelines-change litigation\, and supports the office’s district court motions practice. Kayla has previously worked as an assistant federal public defender in the Southern District of Texas and as a law clerk for the Fifth Circuit Court of Appeals. She graduated from Wake Forest University and received her J.D. from New York University School of Law. \nChris Michel\, Partner\, Quinn Emanuel Urquhart & Sullivan\, LLP\nChris Michel is Co-Chair of the firm’s National Appellate Practice.  His practice focuses on complex legal issues at all stages of litigation\, with a particular emphasis on appellate and Supreme Court matters.  He has handled significant matters in the areas of securities\, antitrust\, intellectual property and technology\, health care\, administrative law\, the First Amendment\, corporate governance\, foreign affairs\, energy and the environment\, and criminal procedure—among others.  He practices frequently in the U.S. Supreme Court\, federal and state courts of appeals\, and trial courts.  In 2023\, he was named an Appellate MVP by Law360 and one of America’s 500 Leading Litigators by Lawdragon. Chris joined the firm from the Office of the Solicitor General at the U.S. Department of Justice.  During his time there\, he argued 10 cases before the Supreme Court\, briefed roughly 200 Supreme Court cases at the certiorari and merits stages\, and advised the Solicitor General on all aspects of federal litigation strategy. Among other recognition\, he received a Civil Division Special Commendation Award for his work on high-stakes civil litigation. Chris has a unique perspective on the workings of the federal government and key strategic issues facing business clients. In addition to his experience in the Solicitor General’s Office\, he served as a counselor to the Attorney General on civil litigation matters and as a special adviser in the White House Counsel’s Office. He began his legal career as a law clerk to Chief Justice John G. Roberts\, Jr.\, at the Supreme Court\, and to Justice Brett M. Kavanaugh\, who was then sitting on the U.S. Court of Appeals for the D.C. Circuit. Before attending law school\, Chris worked at the White House under President George W. Bush\, whom he served as Director of Speechwriting\, drafting more than 500 presidential speeches including five State of the Union addresses. He also collaborated on President Bush’s memoir\, Decision Points\, assisting with the researching\, drafting\, and editing of the book. A native of California and a graduate of Yale College and Yale Law School\, Chris is a member of the Virginia and District of Columbia bars. He has represented and counseled clients in matters at all levels of the federal judiciary\, in state trial and appellate courts\, before administrative agencies\, and in both civil and criminal investigations. He has also taught constitutional law and separation of powers at Georgetown University Law Center\, and he is an appointed member of the D.C. Circuit’s Advisory Committee on Procedures. \nMorgan Ratner\, Partner\, Sullivan & Cromwell\nMorgan Ratner is a partner in Sullivan & Cromwell’s Litigation Group and is a member of the Firm’s Supreme Court and Appellate Practice.  She has argued nine cases before the U.S. Supreme Court.  Before joining the Firm\, Ms. Ratner served in the Office of the Solicitor General at the U.S. Department of Justice.  During her tenure there\, she argued Supreme Court cases involving areas of federal law such as securities regulation\, bankruptcy\, employment\, intellectual property\, criminal law\, and elections law.  She received a John Marshall Award\, the Department of Justice’s highest award offered to attorneys\, for exceptional service to the Office of the Solicitor General and the Department of Justice.  In private practice\, Ms. Ratner regularly briefs and argues appeals and dispositive motions; provides strategic guidance for trial and administrative proceedings; and counsels clients confronting high-stakes legal issues. The U.S. Supreme Court recently appointed her as amicus curiae to brief and argue a case\, making her just the ninth woman of at least 69 such appointments the Court has made since 1926.  After graduating Harvard Law School—where she was awarded the Fay Diploma as the top student in her class—Ms. Ratner clerked for Chief Justice John G. Roberts\, Jr. of the U.S. Supreme Court and then-Judge Brett M. Kavanaugh of the U.S. Court of Appeals for the D.C. Circuit. SUMMARY:Immigration Law Section: Updates in Prosecutorial Discretion
DESCRIPTION:Panelists on this section webinar will discuss recent updates in prosecutorial discretion\, including the recently reinstated Mayorkas memo and the recent EOIR memorandum released on September 28\, 2023. \nPresented by the Immigration Law Section \nRegistration is Closed \n\nPresenters\nAaron Hall\, Senior Partner\, Joseph & Hall P.C. \nAaron Hall is a graduate of the University of Colorado Law School. Mr. Hall is an active member of the American Immigration Lawyers Association (AILA) and has served as the Chair of the Colorado Chapter’s New Members Division\, the Colorado Chapter’s Immigration and Customs Enforcement (ICE) Liaison Committee\, and on AILA National’s Amicus Committee. Mr. Hall is a member of the Colorado Bar Association (CBA) and served as the Chair of the Immigration Law Section for the 2014-2015 year. In addition\, Mr. Hall is a member of the Colorado Criminal Defense Bar\, focusing on analyzing the potential for post-conviction relief for noncitizen defendants in criminal court and on working with defense counsel to apprise noncitizen defendants of the potential immigration consequences of criminal charges. \nMr. Hall frequently presents both locally and nationally on immigration topics including immigration consequences of criminal convictions\, removal defense\, and family immigration. Mr. Hall was named to 5280 Magazine’s list of Top Lawyers for immigration in 2015 and was named a rising star by Super Lawyers Magazine in 2012\, 2013\, 2014\, and 2015. He was also recognized as a “Lawyer of the Year” recipient in the 2023 edition of The Best Lawyers in America. \nPrior to joining Joseph & Hall P.C.\, Mr. Hall gained experience working with detained non-citizens at the Rocky Mountain Immigrant Advocacy Center (“RMIAN”). Since 2011\, he has volunteered on RMIAN’s Pro Bono Mentoring Panel. Mr. Shuart is involved in numerous professional organizations; publishes and lectures extensively on topics relevant to his practice; has received several honors from his peers; and has been appointed by the local courts many times to help oversee litigation\, serve as an expert witness or sit as a Pro Tem Judge. Shuart and his colleagues at Hutton & Hutton have appeared as lead counsel in some of the most publicized and well-known catastrophic injury or death cases in the community over the past several years\, and he frequently receives referrals from other attorneys in the community across all specialties of practice. \nHon. Bob Bacharach\, Judge of the Tenth Circuit Court of Appeals\nJudge Bacharach was appointed in February 2013 as a United States Circuit Judge for the Tenth Circuit Court of Appeals. He graduated with High Honors from the University of Oklahoma with  B.A. in History and the Tom Lottinville Award for the Best Essay submitted in the History Department. He obtained his Juris Doctorate from Washington University School of Law in St. Louis in 1985\, where he graduated order of the coif and was awarded the Breckenridge Scholarship for the second highest grade average in his senior year of law school. In law school at Washington University\, he also served as the Developments Editor of the Washington University Law Quarterly (now named the Washington University Law Review) and was awarded the Mary Collier Hitchcock Prize for writing for the best Note (student article) in the law review. Upon graduation from law school\, Judge Bacharach clerked from 1985 to 1987 for Judge William J. Holloway\, Jr.\, who was then the Chief Judge of the Tenth Circuit Court of Appeals. After completing this clerkship\, Judge Bacharach practiced civil litigation at Crowe & Dunlevy in Oklahoma City\, Oklahoma from 1987 to 1999. He then served as a U.S. Magistrate Judge in the Western District of Oklahoma until 2013\, when he was appointed to the Tenth Circuit Court of Appeals. Judge Bacharach authored the recently published book on legal writing\, Legal Writing: A Judge’s Perspective on the Science and Rhetoric of the Written Word\, published by ABA Press. He has also authored “Section 1983 and the Availability of a Federal Forum: A Reappraisal of the Police Brutality Cases\,” 16 Memphis State University Law Review 353 (1986); “Section 1983 and an Administrative Exhaustion Requirement\,” 40 Oklahoma Law Review 407 (1987); “Motions in Limine in Oklahoma State and Federal Courts\,” 24 Oklahoma City University Law Review 113 (1999); “Dirks v. SEC=s Footnote Fourteen: Horizontal and Vertical Reach\,” 62 Washington University Law Quarterly 477 (1984); and “Post-Trial Juror Interviews by the Press: The Fifth Circuit= Approach\,” 62 Washington University Law Quarterly 783 (1985). In addition\, he and Professor Lyn Entzeroth (now Dean of Tulsa University School of Law) coauthored “Judicial Advocacy in Pro Se Litigation: A Return to Neutrality\,” 42 Indiana Law Review 19 (2009). He began his legal career in New York\, first serving as a law clerk in the Commercial Division of the New York Supreme Court\, New York County\, and then as an associate at a mid-size law firm. DESCRIPTION:**Program hosted in (ET) time zone** \nThis September\, the Qui Tam Section will present a two-part series on developments relating to pandemic relief fraud. \nOn Sept. 20\, 2023\, this first panel will examine DOJ’s response to date involving borrower liability as well as the possibility of DOJ action against financial institutions and fintechs that processed pandemic-relief loans. Last December\, a congressional investigation outlined potential misconduct by fintechs whose loans had a significantly higher rate of fraud. Panelists will discuss DOJ’s response to pandemic fraud so far and what implications that response may have for future actions. DESCRIPTION:Please join the Alaska Lawyers Chapter and the Federal Bar Association (Alaska Chapter) for its first annual Supreme Court Roundup to discuss the blockbuster cases—and other interesting cases—from the Supreme Court’s past term. We are pleased to be joined by Kannon Shanmugam\, widely recognized as one of the top Supreme Court litigators in the country\, having argued 36 cases before the Court. Among other interesting cases from last term\, Kannon will explore the Supreme Court’s affirmative action decision in Students for Fair Admissions v. Harvard\, the voting rights decision in Allen v. Milligan\, the student-loan forgiveness case in Biden v. Nebraska\, and the religious liberty case in 303 Creative v. Elenis. \n\nPresenter\nKannon Shanmugam\nPartner\, Paul\, Weiss\, Rifkind\, Wharton & Garrison LLP \nChair of the Supreme Court and Appellate Litigation Practice and managing partner of the Washington office\, Kannon Shanmugam is widely recognized as one of the nation’s top appellate lawyers. Kannon has argued 36 cases before the Supreme Court\, including 28 cases in private practice. He has also argued over 100 appeals in courts across the country\, including arguments in all thirteen federal courts of appeals and in numerous state courts. One study found that\, over a five-year period\, Kannon had the highest rate of successful petitions for review of any Supreme Court practitioner. He was lead counsel in the successful constitutional challenge to the structure of the Consumer Financial Protection Bureau\, described by the Wall Street Journal as the “constitutional case of the year.” This year alone\, he successfully overturned the certification of a $13 billion securities class action arising out of the 2008 financial crisis (ATRS v. Goldman Sachs); he successfully defended the settlement of what is believed to be the largest private antitrust settlement in history (Fikes Wholesale v. HSBC Bank USA); and he successfully overturned a $570 million damages award in a high-profile trade-secrets case (Syntel v. TriZetto). Prior to private practice\, Kannon served as an Assistant to the Solicitor General at the U.S. Department of Justice. He also served as a law clerk to Supreme Court Justice Antonin Scalia and to Judge J. SUMMARY:Webinar: Supreme Court’s Recent Trademark Cases
DESCRIPTION:The FBA’s Intellectual Property Law Section is hosting this CLE program regarding two of the Supreme Court’s Lanham Act decisions from the 2022 Term: \nThe U.S. Supreme Court’s Bad Spaniels Case\nOn June 8\, 2023\, the U.S. Supreme Court issued its long-awaited opinion in Jack Daniel’s Properties\, Inc. v. VIP Products LLC\, holding that parody trademarks do not receive special First Amendment protection when they function as trademarks.  This talk will review the decision and its possible implications for future parody trademarks\, as well as guidance gleaned from the concurring opinions regarding the use of brands in creative works and the use of surveys in litigation. \nAbitron Case Regarding Extraterritorial Application of the Lanham Act\nThis part of the program will discuss Abitron Austria GmbH v. Hetronic International\, Inc.\, issued June 29\, 2023\, in which the Supreme Court\, for the first time in seventy years\, has decided a case involving the extraterritorial application of the Lanham Act. In so doing\, it has resolved a circuit split on the applicability of the Lanham Act actions involving foreign conduct.  In Abitron\, the Court concluded that the Lanham Act applies only to domestic conduct and does not apply extraterritorially to purely foreign sales that never reached the United States or confused U.S. consumers. Abitron is an important case because of the Court’s restrained view on the extent to which a U.S. company may seek damages for exterritorial trademark infringement.  The talk will review the Court’s reasoning and speculate on the practical ramifications of the decision. \nPresented on behalf of the Intellectual Property Law Section.  \n\nAbout the Presenters\nModerator: Oliver A. Wylie is the 2021 recipient of the Sarah T. Hughes Civil Rights Award\, and in 2022 he joined the Second Circuit Civic Education Committee.
