SUMMARY:Webinar: Working with and Challenging Expert Witnesses
DESCRIPTION:Panelists will discuss the legal standards for admissible expert testimony\, practical tips for working with a scientific expert in science based cases\, and strategies for why\, when\, and how to challenge the opinions of an opposing expert. Mr. Jacobs will discuss the approaches an attorney may pursue in Patent litigation and other Science Based cases. In patent cases\, trials were often handled by litigation attorneys in the beginning and only after creation of the Court of Appeals for the Federal Circuit did cases begin to be handled by science-educated attorneys.  Mr. Jacobs saw cases where each side had well qualified experts and rarely was there a “Daubert” challenge. Rather experts were challenged on their scientific analyses. Mr. Michel’s experience is quite different\, and his cases involved frequent “Daubert’ challenge for a variety of strategic reasons\, particularly challenges to quasi-scientific\, social science\, and non-scientific experts.  How to use the economic analysis of the other side to help you select one or more experts\, and why you might hire more than one will be discussed. Also\, the difference between testifying experts and consulting experts will be explored\, along with the strategy of when and why to employ them. \nPresented by the Senior Lawyers Division and the Younger Lawyers Division. \n\nAbout the Presenters\nAlbert Jacobs\, Jr.\, Chair of Senior Lawyer’s Division of the FBA\, Albert Jacobs PLLC\nWith more than 40 years of experience in every phase of Patent Law\, Mr. Jacobs has spent the last 30 years litigating Biotech\, Pharmaceutical\, and Medical Device Patents\, for multinational companies both before the Federal District Courts\, the Court of Appeals for the Federal Circuit (CAFC) and the International Trade Commission (ITC). He was the first of a group of attorneys to participate in the ITC’s first 100 Day Proceeding dealing with the issue of whether or not there was a Domestic Industry in the subject matter of the Patent. He was successful in proving there was not. He successfully sued a number of large well known foreign companies in one of the largest ITC cases ever filed when he brought an action against 44 companies. He has appeared before the CAFC from its outset and is the only attorney ever to invalidate a Patent for his client on an appeal from an improvidently granted Preliminary Injunction. Mr. Jacobs has participated in numerous Mediations both in the Federal Courts and in the ITC. He was appointed by the Secretary of Commence to a 3-year term on the Patent Public Advisory Committee. He is a Certified Mediator under New York State Statutes and has participated in a wide range of Domestic Family Matters. He has served as a coach for the Association of the Bar of the City of New York in their Mediation Program. A graduate of Harvard College and Columbia Law School where he was a Stone Scholar\, he is a member of numerous Bars as well as the Supreme Court of the United States. He is currently Chair Elect of the Maricopa County Bar Association Litigation Section and is the Chair of the Senior Lawyers Division of the Federal Bar Association (FBA)\, and Chair of the Senior Lawyers Committee of the Phoenix Chapter of the FBA as well as member of that Chapter’s Executive Committee. \nDavid Michel\, Partner\, Sherin and Lodgen\nA partner in the firm’s Litigation Department\, his experience includes representing companies in a variety of complex civil and commercial disputes in federal and state court and through alternative dispute resolution. In particular\, David represents companies\, developers\, and landlords involved in real estate and construction disputes\, including adverse possession\, construction and design contracts\, and zoning. He also represents clients in employment matters involving restrictive covenants and wage and hour litigation. Before taking on the decanal role at UMKC\, Dean Mulligan held numerous administrative posts at other institutions\, including interim vice provost for faculty affairs\, associate dean for faculty\, and center director. Dean Mulligan’s legal experience includes co-founding Stowell & Mulligan\, P.A.\, working as a litigation associate attorney at a large Kansas City-based law firm\, and serving as a judicial clerk on the United States Tenth Circuit Court of Appeals. Prior to joining UMKC School of Law\, Dean Mulligan maintained a small practice representing clients in state and federal courts during his time in the academy. In addition to his roles in the academy and in legal practice\, Dean Mulligan serves as a senior fellow at the Rodel Leadership Institute – Judicial Project\, a research fellow for the Council on Criminal Justice – Veterans Initiative\, a member of the Kansas Judicial Council – Civil Rules Advisory Committee\, and as a leader in other non-partisan organizations. Dean Mulligan earned his J.D. (magna cum laude\, Order of the Coif)\, from the University of Michigan Law School. He holds an M.A. in philosophy from the University of Colorado and a B.A. with honors from the University of Kansas. Prior to UMKC School of Law\, Dean Mulligan was on faculty at the University of Kansas Law School\, Michigan State University College of Law\, and the University of Michigan School of Business. \n \nCharlie Eblen\, Partner\, Shook\, Hardy & Bacon L.L.P.\nCharlie is a versatile and adaptive trial and appellate lawyer who represents clients in high-stakes cases in jurisdictions across the United States as both a plaintiff and defense lawyer. Recognized for his trial and appellate abilities\, Charlie is a fellow in the American College of Trial Lawyers and the International Academy of Trial Lawyers. The College is composed of preeminent members of the Trial Bar from the United States and Canada and is recognized as the leading trial lawyers organization in both countries. The College maintains and seeks to improve the standards of trial practice\, professionalism\, ethics and the administration of justice. Charlie has recently had several significant verdicts as a plaintiff lawyer\, including a $189 million verdict in an unfair competition case\, and an $8.5 million verdict in a civil rights case. He has also defended a range of clients in matters involving a wide variety of subjects\, including the defense of international corporations in antitrust and RICO litigation; federal criminal and civil rights litigation on behalf of those unable to afford representation; complex commercial matters; as well as consumer protection\, mass tort\, catastrophic injury/wrongful death\, class action and product liability matters for many different industries. \nTom Duncombe\, Assistant United States Attorney\, Northern District of Oklahoma\nTom Duncombe is an Assistant United States Attorney in the U.S. Attorney’s Office for the Northern District of Oklahoma. He serves in the appellate unit\, handling appeals to the Tenth Circuit and consulting on written work product in the U.S. District Court. He is a graduate of the Georgetown University Law Center. He previously served as a law clerk at the U.S. Court of Appeals for Veterans Claims and as a litigation associate at Goodwin Procter LLP in Boston\, Massachusetts. \nKym Gore\, Research and Writing Specialist\, Office of the Federal Public Defender for the Southern District of Mississippi\nKym joined the Office of the Federal Public Defender for the Southern District of Mississippi in October 2022 as a Research and Writing Specialist. She handles appeals to the Fifth Circuit and works with litigators on written motion practice at the trial level. Kym fell in love with appellate work early in her career while serving as a judicial law clerk to the then-Chief Judge at the Mississippi Court of Appeals. She has spent a significant portion of her career as a judicial law clerk\, working for multiple United States Magistrate Judges\, both in the Northern District of Oklahoma and the Middle District of Florida. That experience heavily influences her appellate practice. In addition to her appellate work in criminal defense\, Kym worked as an appellate attorney in Florida’s child welfare system for three years. Three experts in this arena–Virginia Canter\, Chief Ethics Counsel for CREW (Citizens for Responsibility and Ethics in Washington)\, Hon. Andre M. Davis\, U.S. Court of Appeals for the Fourth Circuit (Ret.)\, and Charles G. Geyh\, Indiana University Distinguished Professor\, and the John F. Kimberling Chair in Law at the Indiana University Maurer School of Law–will talk about the Constitutional and ethical matters surrounding this important topic. Davis\nJudge of the United States Court of Appeals for the Fourth Circuit\, Retired \nDuring a thirty-year judicial career starting in 1987\, Davis served as an Associate Judge on the District Court of Maryland for Baltimore City; as an Associate Judge on the Circuit Court for Baltimore City; as federal district judge on the U.S. District Court for the District of Maryland; and as a federal appellate judge on the Court of Appeals for the Fourth Circuit. In September 2017\, Davis retired fully from service as a judge to become City Solicitor\, as Head of the Law Department\, of Baltimore. There\, he managed a department of approximately 110\, including 70 lawyers who represent the City in all civil legal matters.  In his role as counsel to the Baltimore City Police Department\, he was at the forefront of the City’s implementation of the federal court consent decree requiring broad policing reforms. He retired as City Solicitor in February 2020. \n  \n \nProfessor Charles G. Geyh\nIndiana University Distinguished Professor \nCharles G. Geyh is Indiana University Distinguished Professor\, and the John F. Kimberling Chair in Law at the Indiana University Maurer School of Law. His work on judicial conduct\, ethics\, independence\, administration\, practice\, and procedure has appeared in over one hundred books\, articles\, book chapters\, reports\, and other publications. \nGeyh has served as an expert witness in the Senate impeachment trial of Federal District Judge G. Thomas Porteous; Director of and consultant to the ABA Judicial Disqualification Project\, and as Reporter to four ABA Commissions (the Joint Commission to Evaluate the Model Code of Judicial Conduct\, the Commission on the 21st Century Judiciary\, the Commission on the Public Financing of Judicial Campaigns\, and the Commission on the Separation of Powers and Judicial Independence). He has likewise served as Director of the American Judicature Society’s Center for Judicial Independence; Consultant to the Parliamentary Development Project on Judicial Independence and Administration for the Supreme Rada of Ukraine; Assistant special counsel to the Pennsylvania House of Representatives on the impeachment and removal of Pennsylvania Supreme Court Justice Rolf Larsen; Consultant to the National Commission on Judicial Discipline & Removal; and legislative liaison to the Federal Courts Study Committee. \nHe received his B.A. in political science from the University of Wisconsin in 1980 and graduated from the University of Wisconsin law school in 1983\, after which he clerked for the Honorable Thomas A. Clark on the United States Court of Appeals for the Eleventh Circuit\, worked as an associate at the Washington D.C. law firm of Covington & Burling\, and served as counsel to the United States House of Representatives Committee on the Judiciary\, before beginning his teaching career in 1991. D. Thompson  \nRachel L. D. Thompson\, an immigration and adoption attorney\, is the owner and managing attorney at Poarch Thompson Law. She serves on the Federal Bar Association’s Governing Board as Programs Chair and is the Chair of their Law School Committee. She was the recipient of the FBA-ILS “Younger Lawyer of the Year Award” (2018) and the recipient of the “Alison Parker Young Woman of Achievement Award” (2016) given by DePaul Community Resources where she served as a board member for six years. She also served as a board member for Blue Ridge Legal Services. In 2020\, she was listed in Roanoker Magazine’s Class of 2020 for “40 Under 40\,” was named a Rising Star by Super Lawyers Magazine\, and nominated by her peers as Legal Elite by Virginia Business. She is also an adjunct professor at Liberty University School of Law teaching Adoption Law. Rachel first moved to Southwest Virginia after she attended Liberty University School of Law (Lynchburg\, Virginia)\, graduating in May 2012. The multiculturalism inherent in her native city (Philadelphia) and her family (South African mother and Jamaican father) instilled an early and profound love for diverse cultures and a hope in the possibilities of immigration. She is married to her law school sweetheart and has four children and two dogs. \nKaren Stoutamyer Law \nKaren Stoutamyer Law is an adoption and immigration attorney practicing in Virginia. As a Virginia adoption attorney\, she represents prospective adoptive parents\, foster parents\, birth parents\, and adoptees before courts all over the Commonwealth. Her immigration practice is national. She graduated from the University of Pennsylvania School of Law in 1985 and became licensed in Virginia in that same year. She is a fellow of the Academy of Adoption and Assisted Reproduction Attorneys and a member of the American Immigration Lawyers Association\, the Virginia State Bar\, and the Virginia Women Attorneys Association. She served as the Deputy Director of Intercountry Adoption for the Academy of Adoption and Assisted Reproduction Attorneys for two years. She also served on the AILA International Operations Liaison Committee for two years. Working with those professional associations\, she submitted comments to USCIS on proposed rules\, operating procedures and policy memoranda. She has also assisted with drafting federal and state legislation and has provided comments and technical expertise to legislators and policy makers at the Department of State\, USCIS\, and the Virginia Assembly. She was designated as a 2013 Angel in Adoption by the Congressional Coalition on Adoption. In cooperation with the Loudoun County Department of Family Services and the Virginia Women Attorneys Association\, she co-chaired the annual celebration of adoption in Loudoun County\, Virginia\, for thirteen years. Kayla has previously worked as an assistant federal public defender in the Southern District of Texas and as a law clerk for the Fifth Circuit Court of Appeals. She graduated from Wake Forest University and received her J.D. from New York University School of Law. \nChris Michel\, Partner\, Quinn Emanuel Urquhart & Sullivan\, LLP\nChris Michel is Co-Chair of the firm’s National Appellate Practice.  His practice focuses on complex legal issues at all stages of litigation\, with a particular emphasis on appellate and Supreme Court matters.  He has handled significant matters in the areas of securities\, antitrust\, intellectual property and technology\, health care\, administrative law\, the First Amendment\, corporate governance\, foreign affairs\, energy and the environment\, and criminal procedure—among others.  He practices frequently in the U.S. Supreme Court\, federal and state courts of appeals\, and trial courts.  In 2023\, he was named an Appellate MVP by Law360 and one of America’s 500 Leading Litigators by Lawdragon. Chris joined the firm from the Office of the Solicitor General at the U.S. Department of Justice.  During his time there\, he argued 10 cases before the Supreme Court\, briefed roughly 200 Supreme Court cases at the certiorari and merits stages\, and advised the Solicitor General on all aspects of federal litigation strategy. Among other recognition\, he received a Civil Division Special Commendation Award for his work on high-stakes civil litigation. Chris has a unique perspective on the workings of the federal government and key strategic issues facing business clients. In addition to his experience in the Solicitor General’s Office\, he served as a counselor to the Attorney General on civil litigation matters and as a special adviser in the White House Counsel’s Office. He began his legal career as a law clerk to Chief Justice John G. Roberts\, Jr.\, at the Supreme Court\, and to Justice Brett M. Kavanaugh\, who was then sitting on the U.S. Court of Appeals for the D.C. Circuit. Before attending law school\, Chris worked at the White House under President George W. Bush\, whom he served as Director of Speechwriting\, drafting more than 500 presidential speeches including five State of the Union addresses. He also collaborated on President Bush’s memoir\, Decision Points\, assisting with the researching\, drafting\, and editing of the book. A native of California and a graduate of Yale College and Yale Law School\, Chris is a member of the Virginia and District of Columbia bars. He has represented and counseled clients in matters at all levels of the federal judiciary\, in state trial and appellate courts\, before administrative agencies\, and in both civil and criminal investigations. He has also taught constitutional law and separation of powers at Georgetown University Law Center\, and he is an appointed member of the D.C. Circuit’s Advisory Committee on Procedures. \nMorgan Ratner\, Partner\, Sullivan & Cromwell\nMorgan Ratner is a partner in Sullivan & Cromwell’s Litigation Group and is a member of the Firm’s Supreme Court and Appellate Practice.  She has argued nine cases before the U.S. Supreme Court.  Before joining the Firm\, Ms. Ratner served in the Office of the Solicitor General at the U.S. Department of Justice.  During her tenure there\, she argued Supreme Court cases involving areas of federal law such as securities regulation\, bankruptcy\, employment\, intellectual property\, criminal law\, and elections law.  She received a John Marshall Award\, the Department of Justice’s highest award offered to attorneys\, for exceptional service to the Office of the Solicitor General and the Department of Justice.  In private practice\, Ms. Ratner regularly briefs and argues appeals and dispositive motions; provides strategic guidance for trial and administrative proceedings; and counsels clients confronting high-stakes legal issues. The U.S. Supreme Court recently appointed her as amicus curiae to brief and argue a case\, making her just the ninth woman of at least 69 such appointments the Court has made since 1926.  After graduating Harvard Law School—where she was awarded the Fay Diploma as the top student in her class—Ms. Ratner clerked for Chief Justice John G. He will be drawing on his book\, “Legal Writing: A Judge’s Perspective on the Science and Rhetoric of the Written Word\,” which uses techniques of communication based on famous examples of oratory and data gathered by psycholinguists. \nPresented by the Civil Rights Law Section\, Labor & Employment Law Section\, the Federal Judicial Law Clerk Committee\, and the Kansas and Western District of Missouri Chapter. \n\nAbout the Presenters\nModerator: Blake A. Shuart\, Attorney\, Hutton & Hutton Law Firm\nMr. Shuart is a trial lawyer with a wide range of litigation experience handling all types of difficult and complex tort cases in various state and federal courts across the United States. He has significant experience in every stage of the process: from initial case workup and strategy to identifying and consulting with elite experts; from pre-suit negotiations and settlement demands to mediations and complex negotiations; depositions of fact witnesses\, corporate representatives\, and experts; briefing and arguing dispositive motions; contested hearings; and trials and appeals in the state and federal courts. He has successfully handled hundreds of serious cases as lead counsel\, has tried many cases to verdict as lead\, solo\, or second-chair counsel\, and has briefed and argued cases in the appellate courts several times. His experience spans virtually every type of tort claim arising out of catastrophic injury or death. Mr. Shuart is involved in numerous professional organizations; publishes and lectures extensively on topics relevant to his practice; has received several honors from his peers; and has been appointed by the local courts many times to help oversee litigation\, serve as an expert witness or sit as a Pro Tem Judge. Shuart and his colleagues at Hutton & Hutton have appeared as lead counsel in some of the most publicized and well-known catastrophic injury or death cases in the community over the past several years\, and he frequently receives referrals from other attorneys in the community across all specialties of practice. \nHon. Bob Bacharach\, Judge of the Tenth Circuit Court of Appeals\nJudge Bacharach was appointed in February 2013 as a United States Circuit Judge for the Tenth Circuit Court of Appeals. He graduated with High Honors from the University of Oklahoma with  B.A. in History and the Tom Lottinville Award for the Best Essay submitted in the History Department. He obtained his Juris Doctorate from Washington University School of Law in St. Louis in 1985\, where he graduated order of the coif and was awarded the Breckenridge Scholarship for the second highest grade average in his senior year of law school. In law school at Washington University\, he also served as the Developments Editor of the Washington University Law Quarterly (now named the Washington University Law Review) and was awarded the Mary Collier Hitchcock Prize for writing for the best Note (student article) in the law review. Upon graduation from law school\, Judge Bacharach clerked from 1985 to 1987 for Judge William J. Holloway\, Jr.\, who was then the Chief Judge of the Tenth Circuit Court of Appeals. After completing this clerkship\, Judge Bacharach practiced civil litigation at Crowe & Dunlevy in Oklahoma City\, Oklahoma from 1987 to 1999. He then served as a U.S. Magistrate Judge in the Western District of Oklahoma until 2013\, when he was appointed to the Tenth Circuit Court of Appeals. Judge Bacharach authored the recently published book on legal writing\, Legal Writing: A Judge’s Perspective on the Science and Rhetoric of the Written Word\, published by ABA Press. He has also authored “Section 1983 and the Availability of a Federal Forum: A Reappraisal of the Police Brutality Cases\,” 16 Memphis State University Law Review 353 (1986); “Section 1983 and an Administrative Exhaustion Requirement\,” 40 Oklahoma Law Review 407 (1987); “Motions in Limine in Oklahoma State and Federal Courts\,” 24 Oklahoma City University Law Review 113 (1999); “Dirks v. SEC=s Footnote Fourteen: Horizontal and Vertical Reach\,” 62 Washington University Law Quarterly 477 (1984); and “Post-Trial Juror Interviews by the Press: The Fifth Circuit= Approach\,” 62 Washington University Law Quarterly 783 (1985). In addition\, he and Professor Lyn Entzeroth (now Dean of Tulsa University School of Law) coauthored “Judicial Advocacy in Pro Se Litigation: A Return to Neutrality\,” 42 Indiana Law Review 19 (2009). He has represented clients in a variety of complex litigation matters including assisting employees with disabilities in obtaining accessible technology and accommodations in the workplace\, representing individuals who have been wrongfully convicted\, commercial litigation disputes\, and fighting workplace discrimination based on sexual orientation. Prior to joining the firm\, Anthony was the Francis D. Murnaghan\, Jr. Appellate Advocacy Fellow at The Public Justice Center\, where he represented indigent clients\, authored amicus briefs\, and argued in the United States Court of Appeals for the Fourth Circuit and Maryland appellate courts on various anti-poverty and civil rights cases. Anthony is a graduate of the University of Akron and the University of Maryland Francis King Carey School of Law. \nMario Choi\, Partner\, Donahue Fitzgerald LLP \nMario Choi is a Partner at Donahue Fitzgerald LLP\, where he advises and represents clients in complex commercial litigation and other matters. Prior to Donahue Fitzgerald\, Mario was an attorney at a plaintiff class action firm. He began his legal career in New York\, first serving as a law clerk in the Commercial Division of the New York Supreme Court\, New York County\, and then as an associate at a mid-size law firm. Mario is active in the community\, serving as a Judge Pro Tem for the San Francisco Superior Court\, a lecturer at Berkeley Law\, and as a director on the boards of several non-profit and legal organizations. \n  \nKevin Griffiths\, Managing Partner\, Scanlan Griffiths + Aldridge \nKevin is one of the founders of Scanlan Griffiths + Aldridge\, a boutique civil-litigation firm Boise\, Idaho. DESCRIPTION:**Program hosted in (ET) time zone** \nThis September\, the Qui Tam Section will present a two-part series on developments relating to pandemic relief fraud. \nOn Sept. 20\, 2023\, this first panel will examine DOJ’s response to date involving borrower liability as well as the possibility of DOJ action against financial institutions and fintechs that processed pandemic-relief loans. Last December\, a congressional investigation outlined potential misconduct by fintechs whose loans had a significantly higher rate of fraud. Panelists will discuss DOJ’s response to pandemic fraud so far and what implications that response may have for future actions.
