Judge Gunn serves as an Associate Editor of the American Bankruptcy Institute Law Journal and is a Coordinating and Associate Editor of the American Bankruptcy Institute Law Journal. SSA Harris started her career as a Special Agent with the FBI in 2004\, and her first assignment was to work public corruption and civil rights investigations in the Newark Field Office. SSA Harris has also worked temporary duty assignments in Iraq and at FBI Headquarters in Washington\, DC. She transferred to the Boston Field Office in 2015 wherein she worked health care fraud cases until she was promoted to be a Supervisory Special Agent in February 2018 as the Associate Division Counsel (ADC) for the Boston Field Office. Since December of 2022\, SSA Harris has been the Acting Chief Division Counsel (CDC). In her role as the ADC and CDC\, she assists employees and task force officers with legal\, compliance\, and ethical issues that arise during their investigations\, to include search and seizure\, free speech\, forfeiture\, and civil litigation. \nSupervisory Special Agent Alison Pauly \nSupervisory Special Agent Alison Pauly graduated from Duke University with a degree in Political Science and Russian language. After graduation she worked as a paralegal at a large New York law firm\, then as an advocate for victims of crime in the Manhattan District Attorney’s Office. SSA Pauly then earned a J.D. and a Masters in Social Work at the University of Pennsylvania. She started her legal career in intellectual property litigation in the San Francisco Bay Area at a large law firm. After a few years\, she shifted to federal employment at the United States Department of Labor and then the FBI. SSA Pauly has worked counterintelligence investigations in San Francisco\, Boston\, and as an FBIHQ Program Manager. While in Boston\, she also spent three years working public corruption investigations. SSA Pauly spent 10 years as a member of the Evidence Response Team (ERT). She is also a member of the FBI’s Behavioral Analysis Program (BAP) where she consults with counterintelligence agents on investigations from the perspective of human behavior. SSA Pauly currently is the supervisor of a counterintelligence squad that includes FBI Boston’s Office of Private Sector (outreach) team. \nSpecial Agent Kyle Zavorotny  \nSpecial Agent Kyle Zavorotny attended Johns Hopkins University\, and after graduating with a degree in psychology joined the Baltimore Police Department\, working as a patrol officer\, a detective in the department’s Fraud Unit\, and as a sergeant in patrol. While working for the police department\, he attended the University of Maryland School of Law\, graduating in 2000. SA Zavorotny practiced law for two years in a small firm in Towson\, Maryland specializing in corporate law. In 2002\, he joined the FBI\, and was assigned to the Boston Division\, working Health Care Fraud. DESCRIPTION:Panelists will discuss the legal standards for admissible expert testimony\, practical tips for working with a scientific expert in science based cases\, and strategies for why\, when\, and how to challenge the opinions of an opposing expert. Mr. Jacobs will discuss the approaches an attorney may pursue in Patent litigation and other Science Based cases. In patent cases\, trials were often handled by litigation attorneys in the beginning and only after creation of the Court of Appeals for the Federal Circuit did cases begin to be handled by science-educated attorneys.  Mr. Jacobs saw cases where each side had well qualified experts and rarely was there a “Daubert” challenge. Rather experts were challenged on their scientific analyses. Mr. Michel’s experience is quite different\, and his cases involved frequent “Daubert’ challenge for a variety of strategic reasons\, particularly challenges to quasi-scientific\, social science\, and non-scientific experts.  How to use the economic analysis of the other side to help you select one or more experts\, and why you might hire more than one will be discussed. Also\, the difference between testifying experts and consulting experts will be explored\, along with the strategy of when and why to employ them. \nPresented by the Senior Lawyers Division and the Younger Lawyers Division. \n\nAbout the Presenters\nAlbert Jacobs\, Jr.\, Chair of Senior Lawyer’s Division of the FBA\, Albert Jacobs PLLC\nWith more than 40 years of experience in every phase of Patent Law\, Mr. Jacobs has spent the last 30 years litigating Biotech\, Pharmaceutical\, and Medical Device Patents\, for multinational companies both before the Federal District Courts\, the Court of Appeals for the Federal Circuit (CAFC) and the International Trade Commission (ITC). He was the first of a group of attorneys to participate in the ITC’s first 100 Day Proceeding dealing with the issue of whether or not there was a Domestic Industry in the subject matter of the Patent. He was successful in proving there was not. He successfully sued a number of large well known foreign companies in one of the largest ITC cases ever filed when he brought an action against 44 companies. He has appeared before the CAFC from its outset and is the only attorney ever to invalidate a Patent for his client on an appeal from an improvidently granted Preliminary Injunction. Mr. Jacobs has participated in numerous Mediations both in the Federal Courts and in the ITC. He was appointed by the Secretary of Commence to a 3-year term on the Patent Public Advisory Committee. He is a Certified Mediator under New York State Statutes and has participated in a wide range of Domestic Family Matters. He has served as a coach for the Association of the Bar of the City of New York in their Mediation Program. A graduate of Harvard College and Columbia Law School where he was a Stone Scholar\, he is a member of numerous Bars as well as the Supreme Court of the United States. DESCRIPTION:Over the years\, there has been much debate about the creation of legislation that would set ethics rules for the U.S. Supreme Court\, as well as what such rules would cover and how they could be enforced. Three experts in this arena–Virginia Canter\, Chief Ethics Counsel for CREW (Citizens for Responsibility and Ethics in Washington)\, Hon. Andre M. Davis\, U.S. Court of Appeals for the Fourth Circuit (Ret.)\, and Charles G. Geyh\, Indiana University Distinguished Professor\, and the John F. Kimberling Chair in Law at the Indiana University Maurer School of Law–will talk about the Constitutional and ethical matters surrounding this important topic. Davis\nJudge of the United States Court of Appeals for the Fourth Circuit\, Retired \nDuring a thirty-year judicial career starting in 1987\, Davis served as an Associate Judge on the District Court of Maryland for Baltimore City; as an Associate Judge on the Circuit Court for Baltimore City; as federal district judge on the U.S. District Court for the District of Maryland; and as a federal appellate judge on the Court of Appeals for the Fourth Circuit. In September 2017\, Davis retired fully from service as a judge to become City Solicitor\, as Head of the Law Department\, of Baltimore. There\, he managed a department of approximately 110\, including 70 lawyers who represent the City in all civil legal matters.  In his role as counsel to the Baltimore City Police Department\, he was at the forefront of the City’s implementation of the federal court consent decree requiring broad policing reforms. He retired as City Solicitor in February 2020. \n  \n \nProfessor Charles G. Geyh\nIndiana University Distinguished Professor \nCharles G. Geyh is Indiana University Distinguished Professor\, and the John F. Kimberling Chair in Law at the Indiana University Maurer School of Law. His work on judicial conduct\, ethics\, independence\, administration\, practice\, and procedure has appeared in over one hundred books\, articles\, book chapters\, reports\, and other publications. \nGeyh has served as an expert witness in the Senate impeachment trial of Federal District Judge G. Thomas Porteous; Director of and consultant to the ABA Judicial Disqualification Project\, and as Reporter to four ABA Commissions (the Joint Commission to Evaluate the Model Code of Judicial Conduct\, the Commission on the 21st Century Judiciary\, the Commission on the Public Financing of Judicial Campaigns\, and the Commission on the Separation of Powers and Judicial Independence). He has likewise served as Director of the American Judicature Society’s Center for Judicial Independence; Consultant to the Parliamentary Development Project on Judicial Independence and Administration for the Supreme Rada of Ukraine; Assistant special counsel to the Pennsylvania House of Representatives on the impeachment and removal of Pennsylvania Supreme Court Justice Rolf Larsen; Consultant to the National Commission on Judicial Discipline & Removal; and legislative liaison to the Federal Courts Study Committee. \nHe received his B.A. in political science from the University of Wisconsin in 1980 and graduated from the University of Wisconsin law school in 1983\, after which he clerked for the Honorable Thomas A. Clark on the United States Court of Appeals for the Eleventh Circuit\, worked as an associate at the Washington D.C. law firm of Covington & Burling\, and served as counsel to the United States House of Representatives Committee on the Judiciary\, before beginning his teaching career in 1991. He joined the faculty at Indiana University in 1999\, has served as the law school’s associate dean for research\, and is the recipient of a Carnegie Fellowship\, three faculty fellowships\, four Trustees teaching awards\, the Wallace teaching award\, and an Indiana University Bicentennial Medal. \nAbout the Moderator\n \nSamantha Pallini\nCivil Rights Practice Area Lead at Lex Machina \nSamantha Pallini\, Esq. is a civil rights attorney based in St. Paul\, Minnesota and is thrilled to moderate this distinguished panel. \nShe began her legal career litigating 42 U.S.C. 1983 cases for the City of New York’s Special Federal Litigation Unit. D. Thompson  \nRachel L. D. Thompson\, an immigration and adoption attorney\, is the owner and managing attorney at Poarch Thompson Law. She serves on the Federal Bar Association’s Governing Board as Programs Chair and is the Chair of their Law School Committee. She was the recipient of the FBA-ILS “Younger Lawyer of the Year Award” (2018) and the recipient of the “Alison Parker Young Woman of Achievement Award” (2016) given by DePaul Community Resources where she served as a board member for six years. She also served as a board member for Blue Ridge Legal Services. In 2020\, she was listed in Roanoker Magazine’s Class of 2020 for “40 Under 40\,” was named a Rising Star by Super Lawyers Magazine\, and nominated by her peers as Legal Elite by Virginia Business. She is also an adjunct professor at Liberty University School of Law teaching Adoption Law. Rachel first moved to Southwest Virginia after she attended Liberty University School of Law (Lynchburg\, Virginia)\, graduating in May 2012. The multiculturalism inherent in her native city (Philadelphia) and her family (South African mother and Jamaican father) instilled an early and profound love for diverse cultures and a hope in the possibilities of immigration. She is married to her law school sweetheart and has four children and two dogs. \nKaren Stoutamyer Law \nKaren Stoutamyer Law is an adoption and immigration attorney practicing in Virginia. As a Virginia adoption attorney\, she represents prospective adoptive parents\, foster parents\, birth parents\, and adoptees before courts all over the Commonwealth. Her immigration practice is national. She graduated from the University of Pennsylvania School of Law in 1985 and became licensed in Virginia in that same year. She is a fellow of the Academy of Adoption and Assisted Reproduction Attorneys and a member of the American Immigration Lawyers Association\, the Virginia State Bar\, and the Virginia Women Attorneys Association. She served as the Deputy Director of Intercountry Adoption for the Academy of Adoption and Assisted Reproduction Attorneys for two years. She also served on the AILA International Operations Liaison Committee for two years. Working with those professional associations\, she submitted comments to USCIS on proposed rules\, operating procedures and policy memoranda. She has also assisted with drafting federal and state legislation and has provided comments and technical expertise to legislators and policy makers at the Department of State\, USCIS\, and the Virginia Assembly. She was designated as a 2013 Angel in Adoption by the Congressional Coalition on Adoption. In cooperation with the Loudoun County Department of Family Services and the Virginia Women Attorneys Association\, she co-chaired the annual celebration of adoption in Loudoun County\, Virginia\, for thirteen years. Among other recognition\, he received a Civil Division Special Commendation Award for his work on high-stakes civil litigation. Chris has a unique perspective on the workings of the federal government and key strategic issues facing business clients. In addition to his experience in the Solicitor General’s Office\, he served as a counselor to the Attorney General on civil litigation matters and as a special adviser in the White House Counsel’s Office. He began his legal career as a law clerk to Chief Justice John G. Roberts\, Jr.\, at the Supreme Court\, and to Justice Brett M. Kavanaugh\, who was then sitting on the U.S. Court of Appeals for the D.C. Circuit. Before attending law school\, Chris worked at the White House under President George W. Bush\, whom he served as Director of Speechwriting\, drafting more than 500 presidential speeches including five State of the Union addresses. He also collaborated on President Bush’s memoir\, Decision Points\, assisting with the researching\, drafting\, and editing of the book. A native of California and a graduate of Yale College and Yale Law School\, Chris is a member of the Virginia and District of Columbia bars. He has represented and counseled clients in matters at all levels of the federal judiciary\, in state trial and appellate courts\, before administrative agencies\, and in both civil and criminal investigations. He has also taught constitutional law and separation of powers at Georgetown University Law Center\, and he is an appointed member of the D.C. In addition\, Mr. Hall is a member of the Colorado Criminal Defense Bar\, focusing on analyzing the potential for post-conviction relief for noncitizen defendants in criminal court and on working with defense counsel to apprise noncitizen defendants of the potential immigration consequences of criminal charges. \nMr. Hall frequently presents both locally and nationally on immigration topics including immigration consequences of criminal convictions\, removal defense\, and family immigration. Mr. Hall was named to 5280 Magazine’s list of Top Lawyers for immigration in 2015 and was named a rising star by Super Lawyers Magazine in 2012\, 2013\, 2014\, and 2015. He was also recognized as a “Lawyer of the Year” recipient in the 2023 edition of The Best Lawyers in America. \nPrior to joining Joseph & Hall P.C.\, Mr. Hall gained experience working with detained non-citizens at the Rocky Mountain Immigrant Advocacy Center (“RMIAN”).
