DESCRIPTION:EVENT RECAP\nThe Government and Modern FCA Practice\nThe Qui Tam Section hosted its Annual Hybrid Qui Tam Conference on Thursday\, February 22 – Friday\, February 23\, 2024. Session programming explored the fundamental role that the government plays in all FCA qui tam cases\, from the initial relator interview\, through the government’s investigation and intervention decision\, to litigation\, trial\, and appeals (in both intervened and declined cases)\, as well as the final resolution of cases regardless of the stage of the matter. Storch is the Inspector General (IG) of the Department of Defense (DoD). He is the first DoD IG to be appointed by the President and confirmed by the Senate since early 2016\, and assumed his responsibilities at the DoD Office of Inspector General (OIG) in December 2022. Before coming to the DoD OIG\, Rob served for close to 5 years as the first presidentially appointed\, Senate-confirmed IG for the National Security Agency/Central Security Service (NSA)\, where he worked to enhance the impact\, independence\, and transparency of the office’s work. He also spent several years at the Department of Justice (DOJ) OIG\, where he served as the Deputy IG and as the DOJ OIG’s first Whistleblower Ombudsperson\, leading efforts related to whistleblower rights and protections that he continued to emphasize at the NSA OIG and now at the DoD OIG. \n[KEYNOTE] Rob DeConti\, Chief Counsel to the Inspector General\, Office of Inspector General\, U.S. Department of Health and Human Services \nSince 2023\, Robert K. DeConti has served as Chief Counsel to the Inspector General\, Department of Health and Human Services (HHS)\, Office of Inspector General (OIG).  Mr. DeConti leads the more than 120-person HHS Office of Counsel to the Inspector General (OCIG). OCIG provides all legal services to HHS OIG\, including advice on audits\, investigations\, evaluations\, and OIG operations; representation of OIG in civil and administrative fraud enforcement; and issuance of guidance to the health care industry. Mr. DeConti oversees all OIG internal legal advice\, coordination with the Department of Justice on False Claims Act cases involving HHS\, OIG’s civil money penalty and program exclusion enforcement\, negotiation and monitoring of corporate integrity agreements\, and industry guidance on the anti-kickback statute and other OIG enforcement authorities. Mr. DeConti has served in a variety of management and staff positions in OCIG since 1999. DESCRIPTION:Since 1976\, the Supreme Court of the United States has observed the constitutional right to health care for all incarcerated persons. This right has coalesced into three fundamental tenets: (1) the right of access to care; (2) the right to care that is ordered; and (3) the right to professional medical judgment.  This CLE examines how different jurisdictions define deliberate indifference to a serious medical need pursuant to 42 U.S.C. § 1983\, assessing in detail both the subjective and objective components of the claim.  This CLE explores the evolution of the doctrine since the precedential ruling of Estelle v. Buchannan\, Detachment Chief\, Suspension & Revocation National Center of Expertise (S&R NCOE)\, U.S. Coast Guard\nLieutenant Commander Buchanan is the Suspension and Revocation NCOE Detachment Chief. In this capacity\, she leads a team of eight civilians and three military members to provide expert advice to field investigators and the Office of Investigations & Casualty Analysis (CG-INV) at Coast Guard Headquarters. She also assigns attorneys to represent the Coast Guard at administrative hearings\, supports course alignment at TRACEN Yorktown\, and liaises with entities such as the National Maritime Center\, the Transportation Security Administration (TSA)\, and Coast Guard Investigative Services.  She previously served at Atlantic Area Legal (LANT-094) as a Senior Staff attorney\, providing legal advice to operational commands and the Atlantic Area Commander. DESCRIPTION:We are excited to announce the inaugural Civil Rights Law Section Book Club! \nOur club will be on-line with a speaker and Q&A period and some optional discussion\, but we will be working with local FBA Chapters to help organize follow-up discussion or social events in-person\, so you can talk about the book (or talk about why you didn’t read the book\, or talk about anything other than the law) with real humans in a real\, physical space! \nThe first edition of the book club will discuss “Shielded: How the Police Became Untouchable” by UCLA Law Professor Joanna Schwartz. \nProf. Schwartz is one of the preeminent experts on qualified immunity and is a prolific author of articles analyzing qualified immunity\, especially using empirical evidence to gauge its effectiveness.  Shielded\, which was released last February\, combines Schwartz’s scholarship with personal stories of individuals who sought to hold police officers accountable but encountered the qualified immunity defense. \nThough Shielded takes a strong policy stand against the doctrine of qualified immunity\, this book\, and the book club\, are not intended solely for practitioners and others who work on the plaintiff’s side. Civil Rights Law members from all background and practice areas are welcome\, and discussion from all viewpoints is encouraged. \nThe book is in stock in print or electronic versions at Amazon or other major sellers\, and in hardcover at bookshop.org (an online bookseller that partners and profit shares with local bookshops). Her recent scholarship concerns the status and significance of silence in criminal investigations\, the relationship between constructing narratives and achieving factual accuracy in the courtroom\, the criminalization of dishonesty in legal institutions\, and the impact of popular culture about the criminal justice system. Griffin’s book\, False Honesty: Truth\, Lies\, and the Misleading Law of Questioning\, is forthcoming from Cambridge University Press. Her academic articles have appeared in the California Law Review\, the Columbia Law Review\, the Duke Law Journal\, the Georgetown Law Journal\, the New York University Law Review\, the North Carolina Law Review\, the Texas Law Review\, and the online editions of the Cornell Law Review and the Michigan Law Review\, among others. She has also edited and contributed to volumes of Law & Contemporary Problems and authored chapters in several books. Her opinion essays have been published in various outlets\, including The Atlantic\, Slate\, SCOTUSblog\, and The New York Times. Griffin joined the Duke Law faculty in 2008 and is the recipient of the Distinguished Teaching Award and the A. SSA Harris started her career as a Special Agent with the FBI in 2004\, and her first assignment was to work public corruption and civil rights investigations in the Newark Field Office. SSA Harris has also worked temporary duty assignments in Iraq and at FBI Headquarters in Washington\, DC. She transferred to the Boston Field Office in 2015 wherein she worked health care fraud cases until she was promoted to be a Supervisory Special Agent in February 2018 as the Associate Division Counsel (ADC) for the Boston Field Office. Since December of 2022\, SSA Harris has been the Acting Chief Division Counsel (CDC). In her role as the ADC and CDC\, she assists employees and task force officers with legal\, compliance\, and ethical issues that arise during their investigations\, to include search and seizure\, free speech\, forfeiture\, and civil litigation. \nSupervisory Special Agent Alison Pauly \nSupervisory Special Agent Alison Pauly graduated from Duke University with a degree in Political Science and Russian language. After graduation she worked as a paralegal at a large New York law firm\, then as an advocate for victims of crime in the Manhattan District Attorney’s Office. SSA Pauly then earned a J.D. and a Masters in Social Work at the University of Pennsylvania. She started her legal career in intellectual property litigation in the San Francisco Bay Area at a large law firm. After a few years\, she shifted to federal employment at the United States Department of Labor and then the FBI. SSA Pauly has worked counterintelligence investigations in San Francisco\, Boston\, and as an FBIHQ Program Manager. While in Boston\, she also spent three years working public corruption investigations. SSA Pauly spent 10 years as a member of the Evidence Response Team (ERT). She is also a member of the FBI’s Behavioral Analysis Program (BAP) where she consults with counterintelligence agents on investigations from the perspective of human behavior. SSA Pauly currently is the supervisor of a counterintelligence squad that includes FBI Boston’s Office of Private Sector (outreach) team. \nSpecial Agent Kyle Zavorotny  \nSpecial Agent Kyle Zavorotny attended Johns Hopkins University\, and after graduating with a degree in psychology joined the Baltimore Police Department\, working as a patrol officer\, a detective in the department’s Fraud Unit\, and as a sergeant in patrol. While working for the police department\, he attended the University of Maryland School of Law\, graduating in 2000. SA Zavorotny practiced law for two years in a small firm in Towson\, Maryland specializing in corporate law. In 2002\, he joined the FBI\, and was assigned to the Boston Division\, working Health Care Fraud. In 2005\, SA Zavorotny began working counterintelligence investigations\, and in 2008 was transferred to the FBI’s office in Bedford\, New Hampshire. \nSpecial Agent Courtney Pillsbury \nSpecial Agent Courtney Pillsbury graduated Boston College with a degree in Sociology and after 2 years as a paralegal went on to Boston College Law School. SA Pillsbury practiced at a large multi-national law firm in Boston for 5 years before joining the FBI in 2006. After graduating the FBI Academy\, she was assigned to the Los Angeles Field Office where she worked counterintelligence investigations for 9 years as both a case agent and supervisor. In 2015 SA Pillsbury transferred to the Boston Field Office to continue working national security violations. She is currently the Applicant Coordinator and Recruiter in the Boston Field Office where she processes and tests applicants for the Special Agent position. SA Pillsbury is a member of the Evidence Response Team (ERT)\, a team of Special Agents and professional support staff responsible for the collection of evidence as crime scenes. She is also a member of the FBI’s Behavioral Analysist Program (BAP) where she has advised counterintelligence agents on various facets of their investigations based on the behavioral profiles of the subjects. \nSpecial Agent Chenee Castruita \nSpecial Agent Chenee Castruita has a degree in Journalism from Ohio University in Athens\, Ohio and a law degree from The Ohio State University in Columbus Ohio. SA Castruita practiced personal injury law with a focus on workers compensation and medical malpractice for about three years. In 2017\, she moved to a defense firm and practiced insurance defense for over five years before joining the FBI in June of 2022. SUMMARY:Webinar: Working with and Challenging Expert Witnesses
DESCRIPTION:Panelists will discuss the legal standards for admissible expert testimony\, practical tips for working with a scientific expert in science based cases\, and strategies for why\, when\, and how to challenge the opinions of an opposing expert. Mr. Jacobs will discuss the approaches an attorney may pursue in Patent litigation and other Science Based cases. In patent cases\, trials were often handled by litigation attorneys in the beginning and only after creation of the Court of Appeals for the Federal Circuit did cases begin to be handled by science-educated attorneys.  Mr. Jacobs saw cases where each side had well qualified experts and rarely was there a “Daubert” challenge. Rather experts were challenged on their scientific analyses. Mr. Michel’s experience is quite different\, and his cases involved frequent “Daubert’ challenge for a variety of strategic reasons\, particularly challenges to quasi-scientific\, social science\, and non-scientific experts.  How to use the economic analysis of the other side to help you select one or more experts\, and why you might hire more than one will be discussed. He was the first of a group of attorneys to participate in the ITC’s first 100 Day Proceeding dealing with the issue of whether or not there was a Domestic Industry in the subject matter of the Patent. He was successful in proving there was not. He successfully sued a number of large well known foreign companies in one of the largest ITC cases ever filed when he brought an action against 44 companies. He has appeared before the CAFC from its outset and is the only attorney ever to invalidate a Patent for his client on an appeal from an improvidently granted Preliminary Injunction. Mr. Jacobs has participated in numerous Mediations both in the Federal Courts and in the ITC. He was appointed by the Secretary of Commence to a 3-year term on the Patent Public Advisory Committee. He is a Certified Mediator under New York State Statutes and has participated in a wide range of Domestic Family Matters. He has served as a coach for the Association of the Bar of the City of New York in their Mediation Program. A graduate of Harvard College and Columbia Law School where he was a Stone Scholar\, he is a member of numerous Bars as well as the Supreme Court of the United States. SUMMARY:Webinar:  A Conversation on Ethics and the United States Supreme Court
DESCRIPTION:Over the years\, there has been much debate about the creation of legislation that would set ethics rules for the U.S. Supreme Court\, as well as what such rules would cover and how they could be enforced. Three experts in this arena–Virginia Canter\, Chief Ethics Counsel for CREW (Citizens for Responsibility and Ethics in Washington)\, Hon. Andre M. Davis\, U.S. Court of Appeals for the Fourth Circuit (Ret.)\, and Charles G. Geyh\, Indiana University Distinguished Professor\, and the John F. Kimberling Chair in Law at the Indiana University Maurer School of Law–will talk about the Constitutional and ethical matters surrounding this important topic. The distinguished panel will discuss: whether such legislation is necessary and\, if so\, what conduct should be addressed; what the implications of such legislation could be if it is implemented; and how enforcement of rules could be carried out. She joined CREW in that position following a career in public service. Her prior experience includes serving as Ethics Advisor to the International Monetary Fund\, White House Associate Counsel to Presidents Obama and Clinton\, Senior Ethics Counsel for the Department of the Treasury\, and Assistant Ethics Counsel for the Securities and Exchange Commission. Virginia received her B.A. and J.D. from the University of Baltimore and is a member of the Maryland Bar. \n  \n \nHon. Andre M. Davis\nJudge of the United States Court of Appeals for the Fourth Circuit\, Retired \nDuring a thirty-year judicial career starting in 1987\, Davis served as an Associate Judge on the District Court of Maryland for Baltimore City; as an Associate Judge on the Circuit Court for Baltimore City; as federal district judge on the U.S. District Court for the District of Maryland; and as a federal appellate judge on the Court of Appeals for the Fourth Circuit. In September 2017\, Davis retired fully from service as a judge to become City Solicitor\, as Head of the Law Department\, of Baltimore. There\, he managed a department of approximately 110\, including 70 lawyers who represent the City in all civil legal matters.  In his role as counsel to the Baltimore City Police Department\, he was at the forefront of the City’s implementation of the federal court consent decree requiring broad policing reforms. He retired as City Solicitor in February 2020. \n  \n \nProfessor Charles G. Geyh\nIndiana University Distinguished Professor \nCharles G. Geyh is Indiana University Distinguished Professor\, and the John F. Kimberling Chair in Law at the Indiana University Maurer School of Law. His work on judicial conduct\, ethics\, independence\, administration\, practice\, and procedure has appeared in over one hundred books\, articles\, book chapters\, reports\, and other publications. \nGeyh has served as an expert witness in the Senate impeachment trial of Federal District Judge G. Thomas Porteous; Director of and consultant to the ABA Judicial Disqualification Project\, and as Reporter to four ABA Commissions (the Joint Commission to Evaluate the Model Code of Judicial Conduct\, the Commission on the 21st Century Judiciary\, the Commission on the Public Financing of Judicial Campaigns\, and the Commission on the Separation of Powers and Judicial Independence). He has likewise served as Director of the American Judicature Society’s Center for Judicial Independence; Consultant to the Parliamentary Development Project on Judicial Independence and Administration for the Supreme Rada of Ukraine; Assistant special counsel to the Pennsylvania House of Representatives on the impeachment and removal of Pennsylvania Supreme Court Justice Rolf Larsen; Consultant to the National Commission on Judicial Discipline & Removal; and legislative liaison to the Federal Courts Study Committee. \nHe received his B.A. in political science from the University of Wisconsin in 1980 and graduated from the University of Wisconsin law school in 1983\, after which he clerked for the Honorable Thomas A. Clark on the United States Court of Appeals for the Eleventh Circuit\, worked as an associate at the Washington D.C. law firm of Covington & Burling\, and served as counsel to the United States House of Representatives Committee on the Judiciary\, before beginning his teaching career in 1991. He joined the faculty at Indiana University in 1999\, has served as the law school’s associate dean for research\, and is the recipient of a Carnegie Fellowship\, three faculty fellowships\, four Trustees teaching awards\, the Wallace teaching award\, and an Indiana University Bicentennial Medal. \nAbout the Moderator\n \nSamantha Pallini\nCivil Rights Practice Area Lead at Lex Machina \nSamantha Pallini\, Esq. is a civil rights attorney based in St. Paul\, Minnesota and is thrilled to moderate this distinguished panel. \nShe began her legal career litigating 42 U.S.C. 1983 cases for the City of New York’s Special Federal Litigation Unit.
