SUMMARY:Immigration Law Section: Introduction to Labor Based Deferred Action
DESCRIPTION:Noncitizens in the United States disproportionately suffer labor-based abuses at their employers. Thankfully\, in a fairly newly announced joint program between the Department of Labor and Department of Homeland Security\, individuals who have been victims of labor-based abuses\, even if they are entirely undocumented\, have a pathway to deferred action and lawful work authorization as they come forward and report these abuses. Please join the Immigration Law Section’s Newer Lawyers Division in a discussion on what this program is\, how your clients can take advantage of it\, and tips on filing these life-changing applications.\nPresented by the Immigration Law Section \n\n\nPresenters\nAnn Garcia\, Staff Attorney\, National Immigration Project\n \nAnn Garcia is a Staff Attorney at the National Immigration Project (NIPNLG). Her work at NIPNLG is focused on holding DHS accountable through advocacy\, litigation\, and training. Before joining NIPNLG\, she ran projects at the Catholic Legal Immigration Network (CLINIC) to assist separated families and free immigrants from detention. Ann’s work appears regularly in national media. She previously started a detained removal defense program at the RAICES office in Fort Worth\, Texas as an Equal Justice Works Fellow. Ann is a graduate of the American University Washington College of Law\, where she was on the editorial board of the ABA’s Administrative Law Review. She has a bachelor’s degree from Middlebury College. Prior to law school\, Ann worked on immigration policy at the Center for American Progress. \n\n\n \n\n\nMary Yanik\, Clinical Associate Professor of Law and Director of the Immigrant Rights Clinic\, Tulane University \nMary Yanik directs the Immigrant Rights Clinic\, supervising students in representing immigrants in deportation defense\, affirmative applications for lawful status\, constitutional litigation\, and strategic advocacy. She specializes in assisting immigrant workers\, including victims of labor trafficking\, and in defending constitutional rights of immigrants. \nYanik previously worked at the New Orleans Workers’ Center for Racial Justice\, leading a law & organizing practice in support of community-directed campaigns for labor\, migrant\, and racial justice. She served as local and trial counsel in federal litigation challenging the constitutionality of Louisiana’s marriage license law and\, separately\, prolonged immigration detention in Louisiana. She represented dozens of immigrant workers in reporting labor abuse to the Department of Labor\, Occupational Safety and Health Administration\, and National Labor Relations Board\, including the immigrant whistleblower who complained of unsafe conditions at the now-collapsed Hard Rock Hotel site in New Orleans. She further represented immigrant workers and immigrant victims of crime in U and T visa applications based on their assistance to government officials\, in part through supervising law students in the Tulane Immigrant Rights’ Practicum. After law school\, she clerked for Judge David F. Hamilton of the U.S. Court of Appeals for the Seventh Circuit. \nIn the Clinic\, Professor Yanik teaches core lawyering skills alongside reflection on the role of lawyers\, clients\, and communities in addressing social injustice and power dynamics in legal relationships and legal systems. The Clinic represents individual detained immigrants in seeking release and relief from deportation and also engages in strategic advocacy in defense of migrant rights. Professor Yanik continues to monitor and enforce the federal consent judgment in Cacho v. Lamberth \nRoyce C. Lamberth was appointed United States District Judge for the District of Columbia on November 16\, 1987.  He served as Chief Judge from May 1\, 2008 to July 15\, 2013\, at which time he became a Senior Judge. \nJudge Lamberth\, a native of San Antonio\, Texas\, graduated from the University of Texas\, receiving a B.A. degree in 1966 and from the University of Texas School of Law\, receiving an LL.B degree in 1967.  He served as a Captain in the Judge Advocate General’s Corps of the United States Army from 1968 to 1974.  After service at Fort Bragg\, North Carolina\, and in Vietnam\, Judge Lamberth served in the Litigation Division of the Office of the Judge Advocate General of the Army at the Pentagon from 1971 to 1974. \nJudge Lamberth served as an Assistant United States Attorney for the District of Columbia from 1974 to 1987.  He was Chief of the Civil Division of the United States Attorney’s Office\, 1978 – 1987. \nJudge Lamberth is married to the former Janis K. Norman brings more than three decades of experience as an Assistant United States Attorney to help guide clients facing government False Claims Act investigations or other allegations of fraud or abuse of government programs. He is a member of the Health Care and FDA practice. Prior to joining the firm\, Norman served as acting U.S. attorney\, the chief federal law enforcement officer in the Eastern District of North Carolina. That office is responsible for prosecuting all federal crimes in the district\, including drug crimes\, violent crimes\, white collar fraud\, terrorism\, and public corruption. The U.S. Attorney’s Office (USAO) also represents the United States in civil court\, handling a wide variety of civil litigation. He previously served as an assistant U.S. attorney for more than 30 years\, focusing his practice on the investigation and civil prosecution of health care fraud and other fraud against the government. In this capacity\, he worked closely with the Health and Human Services Office of Inspector General (HHS-OIG)\, the North Carolina Medicaid Investigations Division (NC-MID)\, the Department of Defense Criminal Investigation Service (DCIS)\, the Drug Enforcement Administration (DEA)\, the FBI\, and other law enforcement agencies. SUMMARY:Kansas and Western District of Missouri Chapter: From Murder to Museums: Current Controversies Over Nazi-Looted Art
DESCRIPTION:The program will kick off with a panel “introduction to art law” followed by Raymond Dowd’s presentation\, which recounts epic legal battles including the seizure of two\nstolen Schieles spotted at the Salon+Art Show at the Park Avenue Armory in\nNovember 2015. The seizure and return of the artworks garnered international\nheadlines upon their restitution to the heirs of Fritz Grunbaum\, a Viennese cabaret\nartist who was murdered in the Dachau Concentration Camp. The Schieles are now\nat Christie’s while Grunbaum’s heirs continue to fight the London art dealers’\nappeals. \nThe presentation traces Abraham Lincoln’s idea of taking the profit out of war\nthrough the Lieber Code Executive Order 100 of April 1863\, to the 1899 and 1907\nHague Conventions\, to the Nuremberg Trials\, demonstrating that returning stolen\nproperty to Holocaust victims is consistent with American ideals and foreign\npolicy. \nDowd discusses how 1. Confiscatory US tax laws\, 2. A fair market value deduction\nfor artworks donated to museums\, and 3. An unwillingness of museums to look gift\nhorses in the mouth led to the current situation: US museums with large\ninventories of unprovenanced works that left Europe after 1933\, but were created\nprior to 1946. SUMMARY:Webinar: Credibility\, Implicit Bias\, and Discretion in Decision-Making
DESCRIPTION:This webinar will focus on how the adjudicator’s implicit bias affects their decisions about credibility and their exercise of discretion. While adjudicators may recognize their own bias\, this may not necessarily lead to stopping bias. Judges know that they need to assess credibility\, and appellate judges are not supposed to replace their determination. The demeanor of the defendant\, witnesses\, prosecutor\, and defense attorney can make a difference in the outcome of cases. \nA professor\, a former administrative law judge\, and a District Court judge will discuss how adjudicators can recognize and attempt to eliminate implicit bias in decision-making. \nProfessor Susan Bandes\, who teaches at DePaul Law School and the University of Miami Law School\, is a founder of the field of Law and Emotion. She will address the ways in which cultural scripts and worldviews influence credibility determinations\, including remorse evaluations. She will further discuss the dangers of selective empathy based on race\, ethnicity\, social class\, and other factors. She will suggest some approaches for addressing these issues. \nFormer Board of Immigration Appeals judge Lory Rosenberg will speak about how adjudicators address issues of credibility and discretion in adjudications\, bearing in mind that their own life experiences color their decisions. \nDistrict Court Judge Judith Levy uses an implicit bias instruction during jury selection. She will discuss her experience with that instruction and raise concerns about the wide number of credibility determinations trial judges need to make with very little information or exposure to the individual. These include bond determinations\, sentencing decisions\, early termination of supervised release or probation\, and more. Bandes is a scholar in the areas of criminal procedure\, federal courts\, and civil rights\, and a pioneer in the interdisciplinary study of the role of emotion in law. She is a 1976 graduate of the University of Michigan Law School. Her legal career began at the Illinois Office of the State Appellate Defender. In 1980\, she became staff counsel for the Illinois A.C.L.U.\, where she litigated a broad spectrum of civil rights cases and helped draft and secure passage of the Illinois Freedom of Information Act. She joined the DePaul faculty in 1984\, was named the Centennial Professor of Law in 2012\, and the Centennial Professor of Law Emeritus in 2017. She has written more than 70 articles\, which appear in the Yale\, Stanford\, University of Chicago\, Michigan and Southern California law reviews\, as well as interdisciplinary journals like Law and Social Inquiry\, the Annual Review of Law and Social Science\, and the Law and Society Review. Her book The Passions of Law was published by NYU Press in 2000. She is a member of the American Law Institute\, a fellow of the American Bar Foundation\, and the founder of the Law and Society Association’s Collaborative Research Network on Law and Emotion. \nHon. Judith Levy\, United States District Judge\, United States District Court for the Eastern District of Michigan \nJudith E. Levy is a United States District Court for the Eastern District of Michigan. She was nominated for the position by President Barack Obama and the U.S. Senate confirmed her nomination on March 12\, 2014. She previously served as an Assistant U.S. Attorney in the Eastern District of Michigan since 2000\, and she was the Civil Rights Unit Chief for the last three years. Prior to that role\, she was a trial attorney with the U.S. Equal Employment Opportunity Commission in Detroit. From 1996-1999\, she served as a law clerk for Judge Bernard A. DESCRIPTION:Event Recap\nAdvancing Tribal Sovereignty through Everyday Practice and Representation\nThe FBA Indian Law Section and 800 invested law professionals gathered in Albuquerque\, NM this past April 4-5 for collaborative education and conversation. This was a sell out event! \nIn the past year\, Tribes have seen the direct impact of issues coming before the courts. Educational sessions at our Annual Indian Law Conference were developed to help practitioners understand recent litigation developments and turn the conversation forward for Indian Country. It is essential that Indigenous law practitioners are at the ready to protect critical rights and advance tribal sovereignty. The conference also addressed how practitioners can help Tribes and Indigenous individuals protect their rights\, lands\, communities\, and culture while maintaining collaborative efforts with state and U.S. Federal governments. Before working for the Utah AG’s Office\, Kyle was employed as Staff Attorney for Justice Dale Wainwright of the Supreme Court of Texas\, where he not only assisted Justice Wainwright in researching and preparing opinions and analyzing petitions for review\, but was in charge of the Court’s annual hot pepper eating competition. Before that\, Kyle was a litigation and intellectual property associate with the law firm of Winthrop & Weinstine\, P.A. in Minneapolis\, Minnesota\, and served as a law clerk for Richard Dorr\, United States District Judge for the Western District of Missouri\, in Springfield. Kyle received his J.D.\, with high distinction\, from the University of Iowa College of Law in 2003\, where he was Senior Managing Editor of the Iowa Law Review\, was awarded the Hancher-Finkbine Medallion\, and was inducted into Order of the Coif. Kyle received his bachelor’s degree in journalism from Drake University\, summa cum laude\, in 2000. Constance Baker Motley\nRichard Jasper\, Criminal Defense Lawyer \nRichard Jasper is a practicing criminal defense lawyer in the New York City metropolitan area.   He is a graduate of Wesleyan University\, Middletown\, Connecticut\, and New York Law School.  Following law school\, he served as deputy clerk to Chief Judge Constance Baker Motley\, United States District Judge for the Southern District of New York.  He has participated in over seventy-five federal death eligible cases either as Learned Counsel or Resource Counsel. In addition\, Mr. Jasper has tried three federal death penalty cases to a verdict without a death sentence. He has represented defendants in post 911 terrorist and racketeering cases. He has been a member of the faculty at the Santa Clara University School of Law Death Penalty College since 2008 and member of the Faculty at the National College for Capital Voir Dire in Boulder\, Colorado since 2014.  He is a member of the Federal Capital Resource Project and serves on the Board of Directors of Advancing Real Change (ARC)\, an organization that assists mitigation specialists in capital cases.  He also previously served on the Board of Directors of both the New York Criminal Bar Association and the New York State Association of Criminal Defense Lawyers.  He received the 2019 Honorable Lewis Cohen’s Award for Professional Excellence. In 2023 received the Gideons Promise Champion of the Community Award. \nAmber Koonce\, Assistant Counsel\, Legal Defense Fund \nAmber M. Koonce is an Assistant Counsel at the NAACP Legal Defense Fund (LDF). Her civil rights practice covers matters of economic justice\, First Amendment protections\, affirmative action\, desegregation\, and criminal justice. Amber has represented Pulitzer Prize-winning journalist Nikole Hannah Jones in her tenure dispute with UNC\, a class of Black parents and students challenging for the desegregation of their school district in Alabama\, and incarcerated individuals seeking access to covid mitigation measures in Arkansas\, among others. Amber has substantial experience advising mission-driven financial institutions regarding title VI\, title VII\, and Section 1981 parameters for programs supporting underrepresented minorities. Amber received her J.D. from Yale Law School and her B.A. from the University of North Carolina at Chapel Hill. \nRiad P. Williams\, Assistant Deputy Chief Court Attorney\, Law Department of the Appellate Division Second Department \nRiad P. Williams is an Assistant Deputy Chief Court Attorney for the Law Department of the Appellate Division Second Department.  In that role\, Riad supervises and instructs approximately 50 to 60 Appellate Court Attorneys in the preparation of confidential reports for the Justices of the Appellate Division.   Before becoming a Law Department supervisor in 2019\, Riad was an Appellate Court Attorney\, who analyzed complex legal issues and prepared confidential reports for the Justices of the Appellate Division. \nPrior to joining the Law Department of the Appellate Division in 2006\, Riad was a Certified Financial Planner at Morgan Stanley and JP Morgan Chase.  She was responsible for creating wealth management plans and specialized investment solutions for her clients.  Prior to that\, Riad worked as an associate at Morrison & Foerster.  In 1994-1995\, Riad had the wonderful opportunity to clerk for the Honorable Constance Baker Motley. \nRiad earned an A.B. in Political Philosophy with Honors from Princeton University where she was awarded the “Class of 1869 Prize in Ethics” for her senior thesis.  Riad graduated from New York University Law School with dual degrees: J.D. and an M.A. in Philosophy\, and was an associate editor of the Law Review. \n  \n\nRegistration\nRegistration is Closed \nRegistration for this event will close Tuesday\, March 26 at 2:00 PM EDT. \nRegistration Fees \n\nComplimentary for FBA Members & Non-Members\n\n\n\n\n\n\n\n\n\nLive Captioning: Closed captioning is available for all virtual webcasts. \n\n\nInternet Requirements: Virtual programs require suitable internet strength to stream online panels.
