Sessions typically focus on a single federal district and feature an experienced local panel that includes an Assistant U.S. Attorney for the district; a federal judge; a relator-side attorney; and a defense attorney. This online-only event will be conducted via Zoom and will spotlight the Eastern District of Pennsylvania. \nThis event does not offer CLE credit. Registrants will receive Zoom login details on the day before the event. \nRegistration is Closed \n\nAbout the Presenters\nHon. Mitchell S. Goldberg\, District Judge\, E.D. Pa. \nJudge Goldberg was appointed to the United States District Court for the Eastern District of Pennsylvania on October 31\, 2008. He had previously served on the Bucks County Court of Common Pleas. \nJudge Goldberg’s career as a practicing attorney started at the Philadelphia District Attorney’s Office where he worked in both the trial and appellate divisions. He later joined the law firm of Cozen O’Connor\, where his practice focused on commercial litigation. Judge Goldberg was eventually promoted to senior partner\, and also served as the manager of Cozen’s Arson and Fraud Unit. Judge Goldberg returned to the public sector in 1997\, serving as an Assistant United States Attorney for the Eastern District of Pennsylvania where he handled mostly white collar crime cases\, both before the District Court and the United Stated Court of Appeals for the Third Circuit. \nJudge Goldberg is a graduate of Temple Law School (1986) where he was a member of Temple’s first trial team. He presently serves as an Adjunct Professor at Temple Law teaching federal law and civil/criminal advanced trial advocacy. In May of 2017\, the Chief Judge of the Third Circuit appointed Judge Goldberg as a visiting judge for the District of Delaware to assist in the handling of patent case \nCharlene K. Fullmer\, Assistant United States Attorney\, E.D. Pa. \nAssistant United States Attorney Charlene Keller Fullmer is the Deputy Chief for Affirmative Litigation in the Civil Division of the United States Attorney’s Office in the Eastern District of Pennsylvania\, where she supervises and prosecutes health care and affirmative fraud matters. Ms. Fullmer led the Philadelphia civil prosecution team that investigated and resolved allegations of off-label promotion of the atypical antipsychotic drug Risperdal by Johnson and Johnson and its subsidiary Janssen Pharmaceuticals\, which resulted in a $2.2 billion global settlement with the Department of Justice\, the largest paid for a single drug. \nIn 2009\, Ms. Fullmer served on the team that investigated and resolved allegations of off-label promotion and kickbacks by Pfizer\, Inc. The $2.3 billion civil and criminal resolution was at the time the largest health care fraud settlement in the history of the Department of Justice. For her efforts in these matters\, she was the recipient of the 2014 Attorney General’s Award for Fraud Prevention\, an Award of Commendation from the Assistant Attorney General for the Civil Division\, Tony West\, and the 2014 National Health Care Anti-Fraud Association’s Investigation of the Year. In October 2010\, Attorney General Eric Holder presented Ms. Fullmer with the Attorney General Award for Exceptional Service\, the Department of Justice’s highest commendation. \nMs. Fullmer returned to the Justice Department in 2007 after six years in private practice at Duane Morris LLP in Philadelphia\, where she litigated defensive matters\, including False Claims Act\, health care\, white collar\, antitrust\, and insurance coverage litigation. Prior to that time\, she served as an Attorney Advisor in Washington\, DC and Quantico\, VA with the Federal Bureau of Investigation\, Office of Professional Responsibility\, the Bureau’s Internal Affairs. \nMs. Fullmer is a 1993 graduate of Lehigh University\, cum laude\, and a 1996 graduate of Temple University School of Law\, cum laude\, where she served on the Law Review. \nMeredith S. Auten\, Partner\, Morgan\, Lewis & Bockius LLP \nAs part of her comprehensive white collar litigation practice\, trial lawyer Meredith Auten concentrates her practice on defending civil False Claims Act (FCA) and qui tam investigations and litigation involving a range of corporate clients\, including those in the pharmaceutical\, healthcare\, and defense contracting industries. Over the course of her 20-plus-year career\, Ms. Auten has secured numerous DOJ declinations and has successfully defended on motions to dismiss and/or favorably resolved every FCA matter she has handled in jurisdictions across the country\, including the Eastern District of Pennsylvania. Ms. Auten is a frequent speaker on FCA matters and is the co-chair of the ABA’s Qui tam Subcommittee. Ms. Auten is also a former member of the Criminal Justice Appointment Panel for the US District Court for the Eastern District of Pennsylvania\, and formerly served as a hearing committee member of the Disciplinary Board of the Supreme Court of Pennsylvania. \nMarc S. Raspanti\, Partner\, Pietragallo Gordon Alfano Bosick & Raspanti\, LLP \nMarc Stephen Raspanti is a seasoned litigator with over 38 years of experience focusing on complex\, high-stakes matters in Government Enforcement\, Compliance\, Internal Investigations\, Federal and State White Collar Litigation; Federal and State Qui Tam Litigation; Criminal\, Civil and Administrative Health Care Fraud Litigation; and Complex Commercial Litigation. Mr. Raspanti is a Fellow of the American College of Trial Lawyers and a former Assistant District Attorney at the Philadelphia District Attorney’s Office where he tried a wide range of criminal cases to verdict. Scott Oswald \nScott Oswald is an accomplished trial lawyer who has brought more than 40 trials to verdict and recovered more than $300 million in judgments and settlements for his clients\, in cases ranging from wrongful termination to employer fraud. \nMr. Oswald litigates employment lawsuits nationwide\, with a special focus on whistleblower matters – including qui tam law\, which can deliver monetary rewards to employees who expose fraud against the government. He has spoken up for workers before federal agencies and on Capitol Hill\, and has broken new ground in whistleblower law: \n\nFirst jury verdict (more than $2 million) under new whistleblower protections introduced in the National Defense Authorization Act of 2013;\nFirst Sarbanes-Oxley Act liability verdict to withstand appeal;\nFirst reported successful jury verdict under 2009 anti-retaliation provisions of False Claims Act and;\nFirst Dodd-Frank Act retaliation lawsuit to reach discovery in federal court.\n\nMr. Oswald is the current programming chair for the Federal Bar Association’s Qui Tam Section and has served in the past as both section chair and chair of its Professional Ethics Committee. SUMMARY:Webinar: Rebuilding Lives: The Legal Community’s Role in Supporting Afghan Refugee-Lawyers in the United States
DESCRIPTION:Presented by the Federal Bar Association’s Diversity and Inclusion Committee \nMore than a year after the United States withdrew from Afghanistan\, about 88\,500 Afghans have resettled across this country.  Refugees require support on many different levels—evacuation\, immigration assistance\, and resettlement.  Among the many who have resettled here are lawyers and judges from Afghanistan whose human rights and rule of law work – or whose very existence as a symbol of women’s equality – put their lives at risk.  These professionals face a daunting task rebuilding their lives and livelihoods in a foreign place.  What role does our legal community have in supporting this transition?  Why should lawyers and judges get involved\, and what can we do to help?  Through this one-hour presentation\, you will learn why this work matters\, meet an Afghan refugee-lawyer now employed as a paralegal\, and hear about a project started by the South Asian Bar Association of San Diego.  Attendees will leave with a clearer sense of the refugee experience and what they personally can do to effect change. \n\nPresenters\nModerator: Alejandro Del Carmen\, Ph.D.\, Tarleton State University (a member of the Texas A&M University System)  \nAlejandro (Alex) del Carmen migrated to the United States as a refugee from war-torn Nicaragua at the age of 12.  He received a Ph.D. in Criminology from the College of Criminology at the Florida State University. He is considered an authority on the topic of race and crime with particular emphasis on racial profiling in law enforcement. Dr. del Carmen has written numerous articles in internationally recognized journals and published several books. His most recent book is titled “Racial Profiling in Policing: Beyond the Basics” with Kendall Hunt. Dr. del Carmen has presented his research findings on racial profiling\, throughout the world (Scotland\, Belgium\, Slovenia\, Spain\, United Arab Emirates\, and Italy). He has trained thousands of police officers including all of the Texas Police Chiefs since 2001. In addition\, he is responsible for creating the Texas racial profiling statistical template widely used by law enforcement agencies throughout the state. He is often a guest on Fox\, CNN\, Fox News Radio\, Telemundo\, Univision and NBC\, among other media outlets. He is also an instructor at the FBI National Academy in Quantico where he teaching police accountability. \nDr. del Carmen is an Associate Dean at the School of Criminology\, Criminal Justice and Public Administration at Tarleton State University (a member of the Texas A&M University System) in Fort Worth\, Texas.   Dr. del Carmen has been appointed as a Fulbright Specialist by the United  States Department of State. He has served as a Federal Monitor for two of the most significant police reform cases in the United States. Currently\, Dr. del Carmen is serving as a Special Master for the United States District Court for the District of Puerto Rico\, on the Puerto Rico Police reform case. \n  \n \nHon. M. Margaret McKeown \nMargaret McKeown has served almost twenty-five years as a judge on the U.S. Court of Appeals for the Ninth Circuit. She is a member of the American Academy of Arts and Sciences\, an affiliated scholar at the Center for the American West at Stanford University\, and jurist-in-residence at the University of San Diego School of Law. As a former White House Fellow\, she served as special assistant at the White House and as special assistant to the Secretary of the Interior. A Wyoming native\, she serves on the board of Teton Science Schools and was a member of the first American expedition to Mt. Shishapangma in Tibet. \nJudge McKeown recently published Citizen Justice: The Environmental Legacy of William O. Douglas—Public Advocate and Conservation Champion (Potomac Press\, 2022). \nJudge McKeown graduated from Georgetown University Law Center and holds an honorary doctorate from Georgetown University.  Before her appointment\, she was the first woman partner at Perkins Coie in Seattle and Washington\, D.C. \nJudge McKeown is a member of the US Judicial Conference Committee on Judicial Conduct and Disability.  She chairs the Ninth Circuit Workplace Environment Committee and is a member of the National Workplace Conduct Working Group.  She is on the Council of the American Law Institute\, the Judicial Advisory Board of the American Society of International Law\, and the editorial board of Litigation magazine. She served as Chair of the ABA Commission on the 19th Amendment\, past President of the Federal Judges Association\, and former chair of the US Judicial Conference Codes of Conduct Committee (ethics). \nJudge McKeown is on the board of the World Justice Project and is Vice Chair of the ABA Rule of Law Initiative and a current special advisor.  She has lectured throughout the world on international law\, intellectual property\, human rights\, ethics\, and constitutional law and has participated in numerous rule of law initiatives with judges and lawyers. \nJudge McKeown received the ABA Margaret Brent Women Lawyers of Achievement award\, the ABA John Marshall Award\, the Inns of Court Ninth Circuit Professionalism Award\, the Washington Women Lawyers President’s Award\, and the Girl Scouts Cool Woman Award\, among others. \n \nMasooda Qazi\, San Diego County Public Defender’s Office \nMasooda Qazi is a temporary paralegal at the San Diego County Public Defender’s Office.  She resettled in San Diego in 2022 with her husband and children after a difficult journey from Kabul\, Afghanistan.  Before the Taliban takeover\, she worked for the U.S. Embassy in Kabul.  Previously\, she advised the U.N. and E.U. on rule of law projects in Afghanistan that supported the new Anti-Corruption Justice Center and women-centered reforms to the Penal Code.  Masooda graduated first in her law school class at Kabul University\, where she met her husband.  Passionate about women’s rights\, she began her legal career advising the now-shuttered Ministry of Women’s Affairs. \nMasooda and her family had a difficult journey escaping Afghanistan\, spending 9 months in prison-turned-refugee camp in the Netherlands before coming to the United States.  She and her husband Hamid then worked to find legal sector employment through the South Asian Bar Association of San Diego; they are mentored by a tight-knit team of judges and lawyers eager to support their professional development. \n \n\nMytili Bala\, California Court of Appeal\, Fourth District\, Division One \nMytili Bala is a senior research attorney for the California Court of Appeal\, Fourth District\, Division One in San Diego\, where she handles a wide range of civil and criminal appeals.  She joined the court from a human rights nonprofit\, where she pursued accountability for violations of international human rights and humanitarian law.  A graduate of Yale Law School\, Mytili spent the initial part of her legal career as a law firm litigation associate. \nIn 2022 while serving as President of the South Asian Bar Association of San Diego\, Mytili launched the Afghan Outreach Project to help Afghan judges and lawyers find legal sector employment and learn about our courts.  In partnership with the National Association of Women Judges\, she set up mentor pods for six Afghan women judges in California.  Through sweat equity and collective volunteer efforts\, Mytili has helped 11 Afghan lawyers and judges find jobs and fellowships.  For this work\, she will receive the 2023 San Diego County Bar Association Community Service Award.  There is tremendous need\, and Mytili enthusiastically welcomes your participation and support. \n\nRegistration\nRegistration for this webinar is now closed \nAttendees will receive the zoom streaming link in their confirmation email. Dever III\, U.S. District Judge\, Eastern District of North Carolina \nJudge James C. Dever III serves as a United States District Judge for the Eastern District of North Carolina. President George W. Bush nominated Judge Dever in May 2002\, and the United States Senate unanimously confirmed him. He served as Chief Judge from October 2011 through October 2018. Before serving as a United States District Judge\, Judge Dever served as a United States Magistrate Judge for fifteen months. \nMichael Anderson\, Chief\, Civil Division\, U.S. Attorney’s Office\, Eastern District of North Carolina \nMichael Anderson currently serves as Chief of the Civil Division in the United States Attorney’s Office for the Eastern District of North Carolina. As Civil Chief\, Mr. Anderson supervises the Asset Recovery Unit that is responsible for all affirmative civil enforcement (e.g.\, False Claims Act\, Controlled Substances Act)\, asset forfeiture\, restitution and other debt collection\, and bankruptcy cases in the Eastern District of North Carolina. Mr. Anderson also carries an active caseload in those areas. Phillips\, Special Deputy Attorney General\, Medicaid Investigations Division\, North Carolina Department of Justice \nLareena Phillips attended UNC Chapel Hill for her undergraduate and law school education before joining the Charlotte\, NC office of Ferguson\, Stein\, Chambers\, Gresham & Sumter\, in 2007. SUMMARY:Webinar:  The Future of Attorney-Client Privilege for In-House Counsel in the U.S.
DESCRIPTION:Although many lawyers assume that communications with clients are privileged\, exceptions to attorney-client privilege make certain categories of otherwise privileged communications discoverable. This presentation covers the attorney-client privilege under Model Rule of Professional Conduct 1.6 and two notable exceptions recognized by federal courts in employment litigation: the fiduciary exception in ERISA actions and reliance on attorney advice in asserting the good-faith defense in FLSA actions. Panelists will provide an overview of the attorney-client privilege and will discuss how federal courts apply these two exceptions in employment litigation. This presentation will also provide practical tips for asserting or challenging these two exceptions from the plaintiff and defendant standpoint. Lawyers will be able to (i) describe the two exceptions to the attorney-client privilege in employment litigation and articulate the logic behind these exceptions\, (ii) articulate when federal courts apply those exceptions\, and (iii) apply the ethics and caselaw surrounding these two exceptions into their employment litigation practice. \nPresented by the Federal Bar Association’s Labor and Employment Law Section and Corporate and Association Counsel Division. \n\nPresenters\nModerator: Lawson Fite\, Partner\, Marten Law\nLawson draws on a wealth of experience to address clients’ practical\, bottom-line business needs. DESCRIPTION:As of December 2022\, the Council of Foreign Relations reports that the United States of America has sent 12.7 billion worth of equipment and weapons to Ukraine to aid in their efforts to repel the invasion by Russia. All those munitions were either pulled from existing military stockpiles\, in which case they will need to be replaced\, or were manufactured expressly to be sent to Ukraine. While this is a fraction of the roughly 900 billion spent on health care it represents a significant increase in government spending on military. Those of us that have been doing the work know greed often fuels fraud\, and fraud follows money. DONALD was nominated to the United States Court of Appeals for the Sixth Circuit by President Barack Hussein Obama on December 1\, 2010 and re-nominated in January of 2011. She was confirmed by the Senate on September 6\, 2011\, becoming the first African American woman to serve on that court. Prior to joining the Sixth Circuit\, Judge Donald served as the first African American female jurist on the U.S. District Court for the Western District of Tennessee\, to which she was appointed by President William Jefferson Clinton in December of 1995. From June of 1988 to January of 1996\, Judge Donald served on the U.S. Bankruptcy Court for the Western District of Tennessee; she was the first African American woman to serve as a bankruptcy judge in the history of the United States. \nWhen she was elected to the Shelby County General Sessions Criminal Court in 1982\, Judge Donald became the first African American woman to serve as a judge in the history of the state of Tennessee. \nJudge Donald received her law degree from the University of Memphis Cecil C. Humphrey’s School of Law\, where she later served as a member of the Alumni and Law Alumni Boards of Directors and as an adjunct faculty member. She frequently serves on the faculty of the National Judicial College and the Federal Judicial Center (FJC)\, and she was a member of the FJC’s Board of Directors from 2003 through 2007. In 1996\, Chief Justice William H. Rehnquist appointed Judge Donald to the Judicial Conference Advisory Committee on Bankruptcy Rules\, where she served for six years. In 2011\, Chief Justice John G. Roberts appointed her to an indefinite term on the Judicial Branch Committee of the Judicial Conference of the United States. \nJudge Donald is extremely active in the American\, National\, Tennessee\, and Memphis Bar Associations\, as well as in the Ben F. Jones chapter of the National Bar Association\, serving in vital leadership roles on key committees. In August of 2014\, Judge Donald began serving Chair-Elect of the ABA Criminal Justice Section; she will become Chair in 2015. Judge Donald is also the 2014 Litigation Section Delegate to the ABA House of Delegates; co-chair of the Task Force on Implicit Bias for the ABA Litigation Section; co-chair of the Committee on Diversity for the ABA Tort\, Trial\, and Insurance Section; and co-chair of the Program Committee for the National Bar Association Judicial Council. Judge Donald currently serves as a member of the ABA House of Delegates\, the ABA Nominating Committee\, the ABA Africa Law Initiative\, and the section leadership for the ABA Criminal Justice and Labor and Employment Law Sections. \nShe previously served as the President of the American Bar Foundation\, where she was the first African American to hold that position. From 2003 through 2011\, Judge Donald served on the Board of Editors of the American Bar Journal. And in August of 2011\, she concluded a three-year term as Secretary of the 430\,000 member ABA\, where she was the first African American woman to serve as an officer since the organization’s founding in 1878. \nIn August of 2014\, Judge Donald received the 2014 John H. Pickering Achievement Award from the Senior Lawyers Division of the ABA. The Pickering Award is given to a lawyer or judge who has demonstrated outstanding legal ability throughout her career\, compiled a distinguished record of dedicated service to the profession and community at large\, and made significant contributions to the furtherance of access to justice for all. In January of 2014\, Judge Donald served as a Judge-in-Residence at Washington University in St. Louis\, Missouri and received the Justice William Brennan  Award from the University of Virginia. In 2013\, Judge Donald was elected to the Board of Directors of the American Judicature Society and was featured in the Federal Bar Association’s magazine\, The Federal Lawyer. She also received the Difference Makers Award from the Solo\, Small Firm & General Practice Division of the ABA and the Pioneer Award from her graduating class at East Side High. During the 2013 annual meeting of the National Bar Association\, Judge Donald received the Judicial Council’s William H. Hastie Award. The Hastie Award is the Judicial Council’s highest award and is presented to recognize excellence in legal and judicial scholarship and demonstrated commitment to justice under the law. She also has lectured in various republics of the former Soviet Union\, including Kazakhstan\, Kyrgyzstan\, Kazan\, Moscow\, Krasnodar\, and Batumi\, Georgia. In 2003\, Judge Donald led a People to People delegation to Johannesburg and Cape Town\, South Africa. She also traveled to Zimbabwe to monitor the trial of a judge accused of judicial misconduct. \nJudge Donald has served as President of the National Association of Women Judges and the Association of Women Attorneys. She has chaired numerous legal\, judicial\, and civic organizations and served a two-year term as Chair of The Memphis Diversity Institute. DESCRIPTION:Alternative dispute resolution (ADR) reference materials often cite “confidentiality” as a critical feature of ADR processes.  Confidentiality encourages candid discussions that open the door to negotiated resolutions-  but when ADR programs and neutrals promise confidentiality\, they must know the bounds of their promise under the law and applicable ADR agreements.  This presentation will review statutes\, caselaw\, and ADR agreements so mediators don’t promise more confidentiality than they can deliver.  The program will focus on federal administrative cases with an emphasis on FAA issues\, but will be useful to practitioners in all fields. \n  \nPresented by the Alternative Dispute Resolution Section & Transportation & Transportaion Law Section \n  \nRegistration is Closed \n\nPresenters\nIntroduction & Q&A – James Downey\, Chair\, ADR Section\n \nJames Downey is an Attorney/Advisor for the Department of the Army.
