DESCRIPTION:While many lawyers represent organizations or are engaged in litigation with organizations\, these engagements raise unique ethical issues. Fundamentally\, who is your client? From whom can you take direction? With whom are you allowed to speak? What are your obligations in communicating with former employees of an entity that has counsel? What are you able to do when your client has problems in jurisdictions where you are not admitted to practice? We will discuss these issues in our presentation\, “Ethical Responsibilities in Representing Corporate Clients.” \nSpeaker\nDan Gentry\, Esq.\, Attorney\, President\, and CEO of Coolidge Wall Co.\, L.P.A. \nAs a member of the litigation department\, Dan focuses his practice on business and employment litigation and dispute resolution. Prior to that time\, Judge Newman served as a United States Magistrate Judge in Dayton\, having been appointed to eight-year terms in both 2011 and 2019. \nUNITED STATES DISTRICT JUDGE WALTER H. RICE\nJudge Rice was born in Pittsburgh\, Pennsylvania. He is a graduate of Northwestern University\, receiving a B.A. degree in 1958. He attended the Columbia University School of Law and received a Juris Doctorate degree in 1962. On June 4\, 1980\, Judge Rice was sworn in as Judge of the United States District Court for the Southern District of Ohio\, at Dayton\, having been appointed to that position by President Carter. Judge Rice served as Chief Judge of the United States District Court for the Southern District of Ohio from October 13\, 1996 to October 12\, 2003. \nUNITED STATES DISTRICT JUDGE THOMAS M. ROSE\nJudge Rose attended Ohio University where he received a Bachelor of Science degree in Education in 1970. He then attended the University of Cincinnati College of Law where he received a Juris Doctor in 1973. Judge Rose served as Greene County Common Pleas Judge until June 20\, 2002. He was then sworn in as Judge of the United States District Court for the Southern District of Ohio on June 21\, 2002. \nUNITED STATES MAGISTRATE JUDGE PETER B. SILVAIN\, JR.\nJudge Peter B. Silvain\, Jr. was appointed as a United States Magistrate Judge for the Southern District of Ohio on May 10\, 2021. Prior to this he served as federal Administrative Law Judge for the Social Security Administration from 2009-2011 in Dayton\, Ohio\, and for U.S. Department of Labor’s Office of Administrative Law Judges from 2011-2021 in Cincinnati\, Ohio. \nUNITED STATES MAGISTRATE JUDGE CAROLINE H. GENTRY\nMagistrate Judge Gentry grew up in Yellow Springs\, Ohio. She is a graduate of Kalamazoo College (B.A.\, magna cum laude\, Phi Beta Kappa\, 1992) and Yale Law School (J.D. 1995)\, where she was a senior editor of the Yale Law Journal. Judge Gentry was assumed her office as a United States Magistrate Judge for the Southern District of Ohio on February 7\, 2022. \nUNITED STATES MAGISTRATE JUDGE MICHAEL R. MERZ\nMagistrate Judge Michael R. Merz is a life-long resident of Dayton\, Ohio\, where he was born in 1945. He is a 1967 graduate of Harvard College (A.B. cum laude) and received his J.D. degree from Harvard Law School in 1970. He was appointed United States Magistrate Judge in 1984 and in March 2011\, while serving his fourth term\, retired and was recalled to service. He served as Chief Magistrate Judge of the Southern District from 2004 to 2008. \nUNITED STATES BANKRUPTCY JUDGE GUY R. HUMPHREY\nJudge Humphrey was appointed as a Judge of the United States Bankruptcy Court for the Southern District of Ohio\, sitting in Dayton\, on October 2\, 2007. He is a 1981 graduate of Kent State University and a 1984 graduate of The Ohio State University Moritz College of Law. \nJEFFREY T. COX\, ESQ.\nJeff Cox is a partner at Faruki P.L.L.\, a complex business litigation boutique\, with offices in Cincinnati and Dayton\, Ohio. His practice covers a wide range of business and technology litigation ranging from class actions\, media\, privacy and intellectual property disputes to professional malpractice\, advertising and competition-related disputes. Mr. Cox graduated from Miami University in 1982 with a B.A. in Diplomacy & Foreign Affairs; he received his J.D. in 1991 from The University of Dayton where he was Editor-in-Chief of the Law Review. \nMICHAEL S. SUMMARY:Webinar: Rebuilding Lives: The Legal Community’s Role in Supporting Afghan Refugee-Lawyers in the United States
DESCRIPTION:Presented by the Federal Bar Association’s Diversity and Inclusion Committee \nMore than a year after the United States withdrew from Afghanistan\, about 88\,500 Afghans have resettled across this country.  Refugees require support on many different levels—evacuation\, immigration assistance\, and resettlement.  Among the many who have resettled here are lawyers and judges from Afghanistan whose human rights and rule of law work – or whose very existence as a symbol of women’s equality – put their lives at risk.  These professionals face a daunting task rebuilding their lives and livelihoods in a foreign place.  What role does our legal community have in supporting this transition?  Why should lawyers and judges get involved\, and what can we do to help?  Through this one-hour presentation\, you will learn why this work matters\, meet an Afghan refugee-lawyer now employed as a paralegal\, and hear about a project started by the South Asian Bar Association of San Diego.  Attendees will leave with a clearer sense of the refugee experience and what they personally can do to effect change. \n\nPresenters\nModerator: Alejandro Del Carmen\, Ph.D.\, Tarleton State University (a member of the Texas A&M University System)  \nAlejandro (Alex) del Carmen migrated to the United States as a refugee from war-torn Nicaragua at the age of 12.  He received a Ph.D. in Criminology from the College of Criminology at the Florida State University. He is considered an authority on the topic of race and crime with particular emphasis on racial profiling in law enforcement. Dr. del Carmen has written numerous articles in internationally recognized journals and published several books. His most recent book is titled “Racial Profiling in Policing: Beyond the Basics” with Kendall Hunt. Dr. del Carmen has presented his research findings on racial profiling\, throughout the world (Scotland\, Belgium\, Slovenia\, Spain\, United Arab Emirates\, and Italy). He has trained thousands of police officers including all of the Texas Police Chiefs since 2001. In addition\, he is responsible for creating the Texas racial profiling statistical template widely used by law enforcement agencies throughout the state. He is often a guest on Fox\, CNN\, Fox News Radio\, Telemundo\, Univision and NBC\, among other media outlets. He is also an instructor at the FBI National Academy in Quantico where he teaching police accountability. \nDr. del Carmen is an Associate Dean at the School of Criminology\, Criminal Justice and Public Administration at Tarleton State University (a member of the Texas A&M University System) in Fort Worth\, Texas.   Dr. del Carmen has been appointed as a Fulbright Specialist by the United  States Department of State. He has served as a Federal Monitor for two of the most significant police reform cases in the United States. Currently\, Dr. del Carmen is serving as a Special Master for the United States District Court for the District of Puerto Rico\, on the Puerto Rico Police reform case. \n  \n \nHon. M. Margaret McKeown \nMargaret McKeown has served almost twenty-five years as a judge on the U.S. Court of Appeals for the Ninth Circuit. She is a member of the American Academy of Arts and Sciences\, an affiliated scholar at the Center for the American West at Stanford University\, and jurist-in-residence at the University of San Diego School of Law. As a former White House Fellow\, she served as special assistant at the White House and as special assistant to the Secretary of the Interior. A Wyoming native\, she serves on the board of Teton Science Schools and was a member of the first American expedition to Mt. Shishapangma in Tibet. \nJudge McKeown recently published Citizen Justice: The Environmental Legacy of William O. Douglas—Public Advocate and Conservation Champion (Potomac Press\, 2022). \nJudge McKeown graduated from Georgetown University Law Center and holds an honorary doctorate from Georgetown University.  Before her appointment\, she was the first woman partner at Perkins Coie in Seattle and Washington\, D.C. \nJudge McKeown is a member of the US Judicial Conference Committee on Judicial Conduct and Disability.  She chairs the Ninth Circuit Workplace Environment Committee and is a member of the National Workplace Conduct Working Group.  She is on the Council of the American Law Institute\, the Judicial Advisory Board of the American Society of International Law\, and the editorial board of Litigation magazine. She served as Chair of the ABA Commission on the 19th Amendment\, past President of the Federal Judges Association\, and former chair of the US Judicial Conference Codes of Conduct Committee (ethics). \nJudge McKeown is on the board of the World Justice Project and is Vice Chair of the ABA Rule of Law Initiative and a current special advisor.  She has lectured throughout the world on international law\, intellectual property\, human rights\, ethics\, and constitutional law and has participated in numerous rule of law initiatives with judges and lawyers. \nJudge McKeown received the ABA Margaret Brent Women Lawyers of Achievement award\, the ABA John Marshall Award\, the Inns of Court Ninth Circuit Professionalism Award\, the Washington Women Lawyers President’s Award\, and the Girl Scouts Cool Woman Award\, among others. \n \nMasooda Qazi\, San Diego County Public Defender’s Office \nMasooda Qazi is a temporary paralegal at the San Diego County Public Defender’s Office.  She resettled in San Diego in 2022 with her husband and children after a difficult journey from Kabul\, Afghanistan.  Before the Taliban takeover\, she worked for the U.S. Embassy in Kabul.  Previously\, she advised the U.N. and E.U. on rule of law projects in Afghanistan that supported the new Anti-Corruption Justice Center and women-centered reforms to the Penal Code.  Masooda graduated first in her law school class at Kabul University\, where she met her husband.  Passionate about women’s rights\, she began her legal career advising the now-shuttered Ministry of Women’s Affairs. \nMasooda and her family had a difficult journey escaping Afghanistan\, spending 9 months in prison-turned-refugee camp in the Netherlands before coming to the United States.  She and her husband Hamid then worked to find legal sector employment through the South Asian Bar Association of San Diego; they are mentored by a tight-knit team of judges and lawyers eager to support their professional development. \n \n\nMytili Bala\, California Court of Appeal\, Fourth District\, Division One \nMytili Bala is a senior research attorney for the California Court of Appeal\, Fourth District\, Division One in San Diego\, where she handles a wide range of civil and criminal appeals.  She joined the court from a human rights nonprofit\, where she pursued accountability for violations of international human rights and humanitarian law.  A graduate of Yale Law School\, Mytili spent the initial part of her legal career as a law firm litigation associate. \nIn 2022 while serving as President of the South Asian Bar Association of San Diego\, Mytili launched the Afghan Outreach Project to help Afghan judges and lawyers find legal sector employment and learn about our courts.  In partnership with the National Association of Women Judges\, she set up mentor pods for six Afghan women judges in California.  Through sweat equity and collective volunteer efforts\, Mytili has helped 11 Afghan lawyers and judges find jobs and fellowships.  For this work\, she will receive the 2023 San Diego County Bar Association Community Service Award.  There is tremendous need\, and Mytili enthusiastically welcomes your participation and support. \n\nRegistration\nRegistration for this webinar is now closed \nAttendees will receive the zoom streaming link in their confirmation email. Sessions typically focus on a single federal district and feature an experienced local panel that includes an Assistant U.S. Attorney for the district; a federal judge; a relator-side attorney; and a defense attorney. This online-only event will be conducted via Zoom and will spotlight the Eastern District of Pennsylvania. \nThis event does not offer CLE credit. Registrants will receive Zoom login details on the day before the event. \nRegistration is Closed \n\nAbout the Presenters\nHon. Mitchell S. Goldberg\, District Judge\, E.D. Pa. \nJudge Goldberg was appointed to the United States District Court for the Eastern District of Pennsylvania on October 31\, 2008. He had previously served on the Bucks County Court of Common Pleas. \nJudge Goldberg’s career as a practicing attorney started at the Philadelphia District Attorney’s Office where he worked in both the trial and appellate divisions. He later joined the law firm of Cozen O’Connor\, where his practice focused on commercial litigation. Judge Goldberg was eventually promoted to senior partner\, and also served as the manager of Cozen’s Arson and Fraud Unit. Judge Goldberg returned to the public sector in 1997\, serving as an Assistant United States Attorney for the Eastern District of Pennsylvania where he handled mostly white collar crime cases\, both before the District Court and the United Stated Court of Appeals for the Third Circuit. \nJudge Goldberg is a graduate of Temple Law School (1986) where he was a member of Temple’s first trial team. He presently serves as an Adjunct Professor at Temple Law teaching federal law and civil/criminal advanced trial advocacy. In May of 2017\, the Chief Judge of the Third Circuit appointed Judge Goldberg as a visiting judge for the District of Delaware to assist in the handling of patent case \nCharlene K. Fullmer\, Assistant United States Attorney\, E.D. Pa. \nAssistant United States Attorney Charlene Keller Fullmer is the Deputy Chief for Affirmative Litigation in the Civil Division of the United States Attorney’s Office in the Eastern District of Pennsylvania\, where she supervises and prosecutes health care and affirmative fraud matters. Ms. Fullmer led the Philadelphia civil prosecution team that investigated and resolved allegations of off-label promotion of the atypical antipsychotic drug Risperdal by Johnson and Johnson and its subsidiary Janssen Pharmaceuticals\, which resulted in a $2.2 billion global settlement with the Department of Justice\, the largest paid for a single drug. \nIn 2009\, Ms. Fullmer served on the team that investigated and resolved allegations of off-label promotion and kickbacks by Pfizer\, Inc. The $2.3 billion civil and criminal resolution was at the time the largest health care fraud settlement in the history of the Department of Justice. For her efforts in these matters\, she was the recipient of the 2014 Attorney General’s Award for Fraud Prevention\, an Award of Commendation from the Assistant Attorney General for the Civil Division\, Tony West\, and the 2014 National Health Care Anti-Fraud Association’s Investigation of the Year. In October 2010\, Attorney General Eric Holder presented Ms. Fullmer with the Attorney General Award for Exceptional Service\, the Department of Justice’s highest commendation. \nMs. Fullmer returned to the Justice Department in 2007 after six years in private practice at Duane Morris LLP in Philadelphia\, where she litigated defensive matters\, including False Claims Act\, health care\, white collar\, antitrust\, and insurance coverage litigation. Prior to that time\, she served as an Attorney Advisor in Washington\, DC and Quantico\, VA with the Federal Bureau of Investigation\, Office of Professional Responsibility\, the Bureau’s Internal Affairs. \nMs. Fullmer is a 1993 graduate of Lehigh University\, cum laude\, and a 1996 graduate of Temple University School of Law\, cum laude\, where she served on the Law Review. \nMeredith S. Auten\, Partner\, Morgan\, Lewis & Bockius LLP \nAs part of her comprehensive white collar litigation practice\, trial lawyer Meredith Auten concentrates her practice on defending civil False Claims Act (FCA) and qui tam investigations and litigation involving a range of corporate clients\, including those in the pharmaceutical\, healthcare\, and defense contracting industries. SUMMARY:Webinar: Bostock and The First Amendment: The Rights of LGBTQ+ Employees in the Religious Workplace
DESCRIPTION:In 2020\, the Supreme Court in Bostock v. Clayton County determined that discrimination against gay and transgender employees is discrimination on the basis of sex—leaving open the question whether\, and how\, this issue might be addressed in a case involving religious employers. In this session\, two civil-rights attorneys—both counsel for the plaintiff in Doe v. Catholic Relief Services\, a recent case in the District of Maryland—and counsel from Americans United for Separation of Church and State will provide an overview of the federal law protecting the rights of LGBTQ+ employees\, the defenses being raised by religious employers and the progress they are making in the courts\, and insight into the way some state courts are addressing these same issues. \nPresented by the Federal Bar Association’s LGBTQ+ Law Section and Civil Rights Law Section.   \n\nAbout the Presenters\n\nLauren DiMartino\, Associate\, Brown\, Goldstein & Levy LLP\nLauren A. DiMartino is an associate at Brown\, Goldstein & Levy\, LLP (“BGL”). Lauren represents clients across various areas of civil rights law\, including fair housing\, education and disability rights\, police misconduct\, and workplace discrimination. Much of Lauren’s legal experience has centered on education equity\, constitutional law\, anti-discrimination\, and government misconduct\, utilizing civil rights legislation like the Fair Housing Act and Title VII to assist individuals impacted by discriminatory conduct and to challenge systems perpetuating segregation. Prior to joining BGL\, Lauren was in Nashville clerking for Judge Martha Craig Daughtry on the Sixth Circuit Court of Appeals. She was previously the Legal Fellow at the University of Colorado School of Law’s Byron White Center for the Study of American Constitutional Law. Lauren graduated from the City University of New York School of Law\, a public-interest program\, with a concentration in Social Justice\, Equality\, and Civil Rights. She has been published in the Georgetown Journal on Poverty Law & Policy\, CUNY Law Review\, FBA Civil Rights Insider\, and Forbes Civic Nation. Prior to becoming an attorney\, Lauren worked in marketing before transitioning to work in New York City community colleges because of her commitment to racial and economic justice. She worked as an academic counselor and the Assistant Director of ASAP\, an accelerated education program aimed at removing systemic barriers to obtaining a degree. She was inspired by her students to attend law school as a tool to better advocate for marginalized communities. She remains active in higher education work and is on the Advisory Boards of the Urban Studies Program at Guttman Community College (CUNY) and of Baltimore Youth Arts. \n\nBradley Girard\, Litigation Counsel\, Americans United for Separation of Church and State\nBradley Girard is the Litigation Counsel for Americans United for Separation of Church and State (“AU”). Bradley returned to AU after serving as the Steven Gey Constitutional Litigation Fellow from 2015-17. He graduated cum laude from Georgetown Law in 2014. After law school he clerked for the Honorable Neal E. Kravitz on the D.C. Superior Court and on the United States Court of Appeals for the Sixth Circuit for the Honorable Martha Craig Daughtrey. Immediately before returning to AU\, Bradley was the clinical teaching fellow at Georgetown Law’s Appellate Courts Immersion Clinic\, where he taught students public-interest impact litigation in the federal courts of appeals and the U.S Supreme Court. In this presentation\, Professor Johnson will provide historical background from the pre- and post-Civil War eras and contemporary resonances stemming from the origin of Juneteenth and its present-day meanings. Additionally\, she will provide examples of racially motivated massacres of Black communities across eras from Rosewood\, FL\, Tulsa\, OK\, Wilmington\, NC\, Charleston\, SC\, and Buffalo\, NY\, in an interdisciplinary focus that includes historical\, legal\, racial\, and intersectional analysis. Brendan also works closely with the Northern District of Ohio FBA Chapter through his position as President of the Akron Law School FBA Chapter. She was appointed by President Barack Obama and unanimously confirmed by the United States Senate on June 24\, 2014 (her birthday). Judge Bloom currently serves as Vice-Chair of the Judiciary Division Board of the Federal Bar Association\, previously serving as Chairperson of the Article III Trial Judges Committee. She was elected and serves as the Eleventh Circuit Representative to the Board of Directors of the Federal Judges Association and is a Board Member of the South Florida Chapter of the Federal Bar Association. She Chairs the Southern District of Florida’s Local Rules Committee and is an active member of the Southern District’s Ad Hoc Committee on Rules and Procedure. Judge Bloom is a frequent lecturer for the Florida Bar\, local bar associations\, law schools\, and FBA chapters. She has presented at the 2018 New Judges College and the 2017 District Judges Conference. She served on the faculty of the Florida Judicial College for 19 years\, teaching newly elected and appointed judges; the faculty of the National Judicial College\, the College of Advanced Judicial Studies\, the Florida Conference of County Court Judges\, and is an adjunct faculty member of the Litigation Skills Program at the University of Miami School of Law. In 2015\, Judge Bloom established the Southern District of Florida’s Summer Intern Ethics and Orientation Program and oversees its annual Law Day and Constitution Day Programs. Judge Bloom oversees the SDFL’s Judicial Intern Program and\, since the pandemic\, has partnered with other districts throughout the country to provide remote learning opportunities for law students. She created the Judicial Intern Academy in 2021 to expand federal judicial internships to students and pairs former federal judicial law clerks with summer interns to enhance the students’ research and writing skills\, now a national program through the Federal Bar Association. Judge Bloom received her Bachelor of Science degree in public relations from the University of Florida in 1984 and her Juris Doctor degree (cum laude) from the University of Miami School of Law.
