SUMMARY:Webinar: Targeting Big Tech: The Antitrust Push Against Big Tech
DESCRIPTION:Over the past 5 years there has a been an increasing focus and push at both the federal and state level to use the antitrust laws to attempt to restrain technology companies and their alleged anticompetitive power and growing power over consumers’ everyday life.  Those attempts\, however\, have run into the “consumer welfare” standard\, that has guided antitrust law for more than 40 years with a focus solely on whether alleged actions will result in higher prices to consumers.  This session will explore the current issues posed by “Big Tech”\, whether these issues actually cause harm to consumers\, whether existing laws are sufficient to address potential competition concerns\, and whether changes are necessary to the current antitrust laws. \nPresented by the Antitrust & Trade Regulation Section \n\nAbout the Presenters\nRobert Hauberg\, Senior Counsel\, Baker Donelson (Moderator) \nAs former chair of the firm’s Government Enforcement and Investigations practice group\, Robert concentrates his practice in antitrust\, securities\, False Claims Act and RICO litigation and white collar crime\, including congressional investigations and internal investigations. \nHe has handled dozens of grand jury investigations\, criminal trials\, civil trials involving mergers\, price fixing\, anticompetitive conduct\, financial institutions\, RICO\, false claims by government contractors\, whistleblowers\, and bribery of public officials.  Before private practice\, Robert served as a federal prosecutor: AUSA in DC; senior official in the Antitrust Division (Communications and Finance Section) and Criminal Division (Fraud Section\, Dallas Bank Fraud Task Force) of DOJ. \nRobert is chair of the Federal Bar Association Antitrust and Trade Regulation Section.  Previously he served as chair of the District of Columbia Bar’s Antitrust and Consumer Law Community and the American Bar Association’s Antitrust Section Committees on Compliance and Ethics and on Financial Institutions. \nJames Tierney\, Partner\, Orrick Herrington & Sutcliffe LLP \nJim served in the Department of Justice’s Antitrust Division for more than 25 years\, the last 10 of which he ran the Technology & Financial Services section (formerly the Networks and Technologies Section or Net Tech) that oversaw the review\, investigation and litigation of every major strategic technology transaction and conduct issue\, including those involving the big 5 tech industry leaders. Reaching beyond just technology\, Jim also oversaw matters in the areas of financial services\, securities industries\, and professional associations. \nJim brings this vast experience to Orrick’s large technology clients and advises them on navigating the tricky waters of government investigations of business activities with antitrust implications like mergers\, joint ventures\, and single-firm conduct. He knows how the DOJ will view proposed transactions\, what issues are likely to trip up a deal or investigation and has relationships throughout the DOJ to get things done. And while Jim served as head of Technology & Financial Services\, he worked closely with his counterparts in competition agencies around the world and is able to draw on those invaluable relationships in foreign jurisdictions. His ability to anticipate problems that he saw while sitting on the other side of the table has allowed him to successfully gain merger clearance for Microsoft’s acquisition of GitHub and Cisco’s acquisition of Viptela\, as well as resolving numerous technology matters for AT&T\, Cerence\, eBay\, Netflix\, Sonos and others. \n\n\nEric Grannon\, Partner\, White & Case LLP \nEric helps clients with antitrust matters\, including civil and criminal defense as well as counseling for mergers and acquisitions\, settlements of pharmaceutical patent litigation\, and strategic planning. Since 2001\, he also has helped clients with concerns under the Foreign Corrupt Practices Act (FCPA) and other anti-corruption issues. Eric began at the firm as a summer associate in 1997 and has been a partner since 2007. \nFor clients with needs outside Eric’s areas of specialization\, he often serves as a relationship partner\, ensuring that the client receives the firm’s best work and advice\, efficiently and cost-effectively. In that role\, Eric also works to ensure that a client’s work streams create opportunities for attorneys at White & Case in line with the client company’s values. \nA former prosecutor\, Eric returned to White & Case after serving as Counsel to the Assistant Attorney General in charge of the Antitrust Division of the United States Department of Justice (DOJ) in 2003-04\, where he helped formulate US antitrust enforcement policy and manage the civil and criminal investigations and court cases brought by the Antitrust Division. He ended his DOJ service with a detail as a Special Assistant US Attorney in the District of Columbia\, trying twenty bench and jury trials as lead counsel. \nDana Vogel\, Competition\, Innovation & Privacy Unit Chief\, Civil Litigation Division\, Office of the Attorney General \n\n\nDana Vogel currently serves as the Unit Chief Counsel for the Competition\, Innovation & Privacy Unit within the Consumer Protection & Advocacy Section of the Arizona Attorney General’s Office. Dana works on and oversees antitrust matters as well as data breach and Arizona’s Fintech Sandbox program. These antitrust matters include the Generic Drug Pharmaceuticals litigation alongside other State Attorneys General\, the Facebook antitrust litigation alongside other State Attorneys General and the FTC\, and the Google litigation alongside other State Attorneys General and the DOJ. Dana has also participated in Arizona-specific antitrust investigations and litigation such as the investigation into whether dental suppliers were illegally preventing a new entrant from entering the market. Dana has also worked on Class Action Fairness Act matters in the US Supreme Court and the US Court of Appeals for the Ninth\, Sixth\, and Third Circuit. \n  \nDana joined the Arizona Attorney General’s Office in 2013 as an Assistant Attorney General in the Antitrust Unit of the Civil Litigation Division. She made a name for herself within the office for her antitrust expertise and her drive to help Arizona consumers\, becoming Antitrust Unit Chief Counsel in 2019. Later\, data breach and the Fintech Sandbox program were added to the Antitrust Unit\, creating the Competition\, Innovation & Privacy Unit. Prosnitz serves as Acting Deputy Assistant Administrator for Operations Support with the Transportation Security Administration.  Operations Support oversees various offices\, including policy\, intelligence and analysis\, vetting\, and technology capabilities. Ms. Prosnitz is temporarily assigned to Operations Support from her permanent post as Deputy Chief Counsel for Regulations and Security Standards.  In this role\, Ms. Prosnitz advises the Chief Counsel on matters related to TSA’s broad regulatory program including federal rulemaking actions and development of security-related policies and programs.  She became a member of the Senior Executive Service in 2014. \nBefore joining the federal government\, Ms. Prosnitz worked at Suffolk University Law School\, where she was the first Executive Director of the Rappaport Center for Law and Public Service.   She also served as the General Counsel to the Executive Office of Public Safety and Security\, Executive Director and General Counsel for the Special Advisory Task Force on Massport\, Chief Counsel to the Massachusetts Highway Department\, and as Chief of Litigation for the Boston Police Department.  Ms. Prosnitz was appointed to several other task forces including the Massachusetts Supreme Judicial Court’s Task Force on Hiring Practices in the Judiciary\, the Governor’s Task Force on Hate Crimes (co-chair) and the Statewide Racial and Gender Profiling Committee co-chair). Prior to her public service career\, Ms. Prosnitz worked as an associate with the law firm of Hinckley\, Allen\, and Snyder and as a law clerk for the Superior Court of Massachusetts. \nShe is a graduate of Amherst College and Duke University School of Law and received executive leadership certificates from the Harvard Kennedy School\, Georgetown University and American University. \nPanelists (Listed Alphabetically) \nNathan Bryant\, Attorney-Advisor\, Litigation\, Transportation Security Administration \nNathan is an Attorney-Advisor in the TSA Office of Chief Counsel (CC) Federal Court Litigation section. Nathan joined CC in February 2013 after completing the DHS Office of General Counsel (OGC) Honors Attorney Program. He is admitted to the bar in New York. \n \nDaniel Farkas\, Executive Vice-President & General Counsel\, Norwegian Cruise Line Holdings Ltd. \nDaniel S. Farkas is the Executive Vice President and General Counsel of Norwegian Cruise Line Holdings Ltd.\, operator of Norwegian Cruise Line\, Oceania Cruises\, and Regent Seven Seas Cruises.  In this position\, Mr. Farkas oversees all aspects of the Legal\, Risk Management\, Securities Compliance\, Corporate Governance\, Regulatory Compliance\, Passenger and Crew Claims and the Government Affairs areas of the Company.  Mr. Farkas is the Company’s Chief Ethics Officer and currently serves on the board of directors of the Steamship Mutual Underwriting Association Limited and serves as Chairman of the Cruise Industry Charitable Foundation and sits on various other committees within the Norwegian Group. \nPrior to joining Norwegian\, Mr. Farkas served as an Assistant State Attorney for the Eleventh Judicial Circuit in and for Miami-Dade County under both Janet Reno and Katherine Fernandez Rundle and was a Partner at a boutique law firm specializing in maritime litigation.  Mr. Farkas joined Norwegian in January 2004 and previously held the positions of Senior Vice President\, Vice President and Assistant General Counsel. \nMr. Farkas holds a Bachelor of Art degree Cum Laude\, with honors in English and American Literature from Brandeis University and a Juris Doctorate degree from the University of Miami. \nJohn Havranek\, Associate General Counsel of Operations and Enforcement\, Office of General Counsel\, Department of Homeland Security \nJohn F. Havranek is the Associate General Counsel for Operations and Enforcement at the Department of Homeland Security\, Office of General Counsel. John is responsible for providing legal advice concerning DHS enforcement matters\, international law\, national security matters\, operations\, and all-hazards incident management\, including the provision of legal support to aid in the development and management of policies\, plans\, exercises\, training\, crises\, and incident management. \nJohn is also an Appellate Judge for the U.S. Coast Guard Court of Criminal. SUMMARY:Webinar: A SCOTUS Review of IP Cases in the Recent 2020 Term and its Implications for Constitutional Jurisprudence in Other Areas of Law
DESCRIPTION:As has been the case in several of the past terms\, the U.S. Supreme Court has rendered decisions involving intellectual property law issues that have broader implications which also touch upon other areas of law. So too\, in this most recent term\, with the Court’s opinions in United States v. Arthrex\, Inc. et al.\, 141 S.Ct. 1970 (2021) (Constitutionality of APJs under the Appointments Clause); Google LLC v. Oracle America\, Inc.\, 141 S.Ct. 1183 (2021) (Copyright fair use and application programming interface software (“API”)); and Minerva Surgical\, Inc. v. Hologic\, Inc.\, et al. 141 S.Ct. 2298 (2021) (assignor estoppel). This webinar will discuss these Supreme Court decisions within the IP law context as well as the potential impact of the decisions on other areas of law. \nThe webinar will also take a forward look at the next term for a case that\, although it was not decided in the current term\, and the petition for certiorari is still pending\, the Court has invited the Solicitor General to weigh in on at the petition stage. The American Axle & Manufacturing\, Inc. v. Neapco Holdings LLC\, et al.\, No. 20-891\, U.S. Sup. Ct. (March 1\, 2021)\, has generated a considerable amount of attention since it concerns a highly controversial issue of patent eligibility that continues to stymie congressional patent law reform efforts\, and which has a direct impact on U.S. economic and national security interests as well as innovators\, investors\, and entrepreneurs across the entire spectrum of industries from Pharma to Big Tech. \nPresented by the Intellectual Property Section \n\nAbout the Presenter\nRobert J. Rando\, Partner\, Greenspoon Marder LLP \nRobert Rando is a partner with the Greenspoon Marder’s Intellectual Property Department. Mr. Rando focuses his practice on patent and other intellectual property infringement disputes and counseling. He is experienced in a wide range of current and emerging technologies\, including computer hardware and software\, silicon chip manufacturing\, biotechnology products\, medical devices\, pharmaceuticals\, chemical compounds\, food additives\, alternative energy products\, consumer electronics\, communications\, security\, Internet\, and e-commerce. \nMr. Rando has more than 30 years of federal civil litigation experience and has litigated disputes in the Southern District of New York (“SDNY”)\, the Eastern District of New York (“EDNY”)\, and several other United States District Courts across the country. In addition to intellectual property matters\, Mr. Rando has also handled litigation matters involving antitrust\, civil rights\, complex commercial disputes\, class action product liability\, employment discrimination and other employment disputes\, and ERISA cases.  Mr. Rando also has extensive appellate court experience\, including having served as counsel of record or co-counsel on numerous Amicus brief filings before the United States Supreme Court and Federal Circuit on various intellectual property\, constitutional and administrative law issues from 2006 to the present. \nMr. Rando began his legal career as an Associate with Skadden Arps\, later moving to Kenyon & Kenyon. Prior to joining Greenspoon Marder\, Mr. Rando founded and led his own firm for nearly 25 years. Before attending law school\, he served as a Systems Analysis Engineer at Sperry Corporation\, now a part of Lockheed Martin. SUMMARY:Webinar: The Use of International Law in Domestic Courts and International Tribunals
DESCRIPTION:Robert “Bob” Pauw\, a partner with Gibbs Houston Pauw in Seattle\, Washington\, will focus on the use of international law in U.S. domestic courts and at the Inter American Commission on Human Rights (IACHR). Mr. Pauw will discuss exhaustion of domestic remedies\, the procedure for bringing claims to the IACHR\, and the enforceability of decisions issued by international tribunals. Although under the Constitution international law is part of “the supreme Law of the Land\,” courts and agencies may be reluctant to follow requirements of international law. Often international law is not directly enforceable in United States courts and it can be difficult to convince courts and agencies to follow international law norms. Mr. Pauw will discuss how\, in spite of these difficulties\, international law may be useful for purposes of constitutional and statutory interpretation\, and ways to facilitate consideration of international law by courts and agencies. Putnam has been appointed as the Deputy General Counsel for the U.S. Department of Transportation\, and will serve as the Acting General Counsel.  In this role\, he works closely with the Department’s senior leadership and nearly 500 attorneys to manage legal and policy matters concerning all of the Department’s operating administrations. \nPrior to joining the Biden Administration\, John worked most of his career as a transportation\, environment\, and energy attorney in Denver and Washington\, DC. He represented State departments of transportation\, local governments\, transportation agencies\, and private entities in Colorado and nationwide on a range of transportation\, energy\, environmental issues under the Federal transportation laws\, the Clean Air Act\, the National Environmental Policy Act\, and the Clean Water Act. \nMost recently\, John was the Director of Environmental Programs for the Colorado Department of Public Health and Environment (CDPHE). Ruge-Hudson serves as the Counselor to the Inspector General.  In this role\, she provides legal and policy advice to the Inspector General on a wide variety of topics\, including issues related to protecting the office’s independence.  Her primary duty is to support and assist the Inspector General as he executes his oversight responsibilities under the GPO Inspector General Act of 1988 and the Inspector General Act of 1978.  She also works closely with the Assistant Inspector’s General on matters related to audits\, inspections\, investigations\, and other oversight activities. \nRuge-Hudson has been in the Inspector General Community since 2010\, when she joined the U.S. Office of Personnel Management Office of the Inspector General.  While at OPM OIG\, she was the Senior Counsel for Legislative and External Affairs and oversaw all Congressional and media outreach efforts.  She left OPM OIG in 2019 to join the Defense Digital Service\, a small office reporting directly to the Secretary of Defense\, charged with bringing IT practices from the private sector to the Department of Defense. \nPrior to joining the Federal Government\, Ruge-Hudson worked at private law firms\, specializing in tax law.  She has a Bachelor of Science in Politics from Washington & Lee University\, a J.D. from Columbia Law School\, and an LL.M in Taxation from Georgetown University Law Center. \nTanner Horton-Jones\, Senior Counsel with U.S. Agency for International Development OIG’s Office of General Counsel \nAs senior counsel with USAID OIG’s Office of General Counsel\, Tanner leads a team of three attorneys with a primary focus on meeting the legal needs of the Office of Audit and Office of Management.  The team supplies research and advice to each audit from its inception through the closure of its recommendations\, along with support for OIG’s contracting unit\, learning and development program\, IT team\, internal policy management\, and other core administrative functions.  Additionally\, Tanner is the legal liaison for USAID OIG’s unique work providing oversight of U.S. overseas contingency operations in partnership with the Inspectors General for the Departments of State and Defense.  He also serves as the OIG’s Whistleblower Protection Coordinator\, ensuring that the OIG fulfills its obligation to educate employees about whistleblower rights and properly respond to retaliation complaints.  He is actively involved in the OIG community\, including teaching courses through the CIGIE Training Institute. \nTanner holds a J.D. from American University Washington College of Law and is licensed to practice law by the State of Maryland.  He completed his undergraduate studies at Sewanee\, where he studied French and Political Science. \nKevin Miller\, Counsel to the Inspector General\, Farm Credit Administration \nKevin T. Miller serves as Counsel to the Inspector General at the Farm Credit Administration\, an independent agency tasked with regulating and supervising the Farm Credit System\, a nationwide network of borrower-owned financial institutions that provide credit and related services to agriculture and rural America. He provides legal and other advice to the Inspector General and Office of Inspector General staff concerning audits\, inspections\, evaluations\, investigations\, and other matters relevant to the office’s oversight responsibilities. \nBefore joining the FCA OIG in 2018\, Miller worked as an attorney-advisor in the U.S. Office of Personnel Management OIG. Tulley is currently a Supervisor in the Trial Division at the Public Defender Service for the District of Columbia (PDS). Prior to that he was the Training Director where he trained all the new attorney at PDS for five years and trained over one hundred of the court appointed private attorneys in Superior Court. For the five years before that\, Mr. Tulley was Special Counsel for Forensics and Expert services where he led the organization’s nationally renowned Forensic Practice Group which focuses on litigation of science issues from DNA to fingerprints to the psychology of eyewitness identification and manages the agency’s budget for expert witnesses.  Mr. Tulley has been at PDS for eighteen years where he has tried murder\, sexual assault\, and other major felony cases as well as worked on the forensic issues for the D.C. exoneration cases which led to the FBI Hair review.  He is also past Chair of NACDL’s Forensic Science Committee\, where he worked on a national level to ensure scientifically sound forensic practices and education for the defense bar in all forensic disciplines.  Prior to working in D.C.\, Mr. Tulley was an attorney in the Trial Division of New York City’s Capital Defender Officer\, where as a Deputy Capital Defender he represented indigent persons facing death penalty charges.  Before moving to New York\, Mr. Tulley was an associate for Bennett & Nathans\, LLP\, a small Maryland law firm that handled state and federal civil and criminal cases\, including a substantial capital defense practice.  He graduated from the State University of New York at Binghamton in 1992\, and then the University of Maryland School Of Law in 1995. \nJennifer Williams\, Staff Attorney\, Appeals \nInterested in one of our other PDSDC divisions – Parole\, Juvenile Services\, Prisoner Reentry Legal Services\, Mental Health\, Civil Legal Services (including special education and immigration)? Mancusi\, Partner\, Arnold & Porter (Moderator)  \nMichael Mancusi represents domestic and foreign banks\, credit unions\, and other financial services clients in a wide range of state and federal regulatory\, compliance\, and enforcement matters. He also has substantial experience representing clients in government and corporate internal investigations\, including entities subject to anti-money laundering requirements. She is responsible for overseeing the Anti-Money Laundering\, Sanctions and Anti-Bribery and Corruption Compliance programs for businesses operating within the Americas region and for the Investment Bank globally. Prior to joining Barclays\, Andrea served as the Associate Director of the Policy Division in the Financial Crimes Enforcement Network (FinCEN)\, where she led all aspects of FinCEN’s regulatory and strategic policy functions. Prior to this role\, Andrea was Director of FinCEN’s Office of Compliance and Enforcement\, Enforcement Division. Andrea came to FinCEN from the U.S. Department of Justice (DOJ) where she served as Deputy Chief of the Computer Crime and Intellectual Property Section\, Criminal Division; Senior Counsel to the Federal Programs Branch\, Civil Division; and\, as an Assistant U.S. Attorney for the District of Columbia. The session will also address FBA policies and policy-making relevant to member participation in ECOSOC. \nPresented by the International Law Section \nRegistration for this event is now closed. \nAbout the Presenters\nMichele Forzley\, Forzley & Associates \nMichele Forzley is a special advisor to the President of the Federal Bar Association on its status as an accredited entity to the UN Economic\, Social and Cultural Council and active in multilateral affairs and health through her work as the Editor in Chief of UN Health Update.  She is also a practicing lawyer whose work is focused on regulatory systems strengthening and governance in the health and pharmaceutical sectors through law\, regulation\, and institutional capacity building. Her projects have been on behalf of the WHO\, World Bank\, EU\, national governments\, advocacy organizations\, and trade associations in WHO/AFRO\, SEARO\, WPRO\, EMRO\, EURO and PAHO regions\, in individual countries\, and in emerging economies. She is a member of the WHO IHR Roster of Experts on Health Law\, Ethics and Human Rights\, author\, and is an adjunct law professor teaching law and pandemics and global public health law. \nRachel V. Rose\, Chair\, FBA Government Relations Committee  \nMs. Rose has a unique background. Throughout her career\, she has accumulated knowledge in a multitude of fields\, with an emphasis on various facets of healthcare. Her experiences include: \n\nworking on Wall Street and at one of the “Big Four” consulting firms;\nproducing for the Chairman of the Reform and Oversight Committee on Capitol Hill;\ninterning at the Department of Health and Human Services;\ncompiling policy papers at the Royal College of Nursing in London;\nconsultative work as a top performing representative for the pharmaceutical and medical device industry; ​\nclerking for the Honorable Linda R. Allan (6th Judicial Circuit\, FL).\n\nPrior to opening her law firm\, she was Director of Business Development and Assistant General Counsel for a healthcare advisory company. \nShe is extensively published and presents on a variety of healthcare\, False Claims Act\, Dodd-Frank\, and securities law topics including: cybersecurity\, qui tam\, physician reimbursement\, ICD-10\, access to care\, anti-kickback and Stark laws\, U.S. Supreme Court cases impacting the medical device industry\, international comparative healthcare laws\, and the HIPAA/the HITECH Act. \nPresently\, she is the chair of the Federal Bar Association’s Government Relations Committee. DESCRIPTION:This roundtable will discuss the Biden Administration’s political appointment process and Senate confirmation process\, and will provide commentary on the Transition. \n[Register Online] \n\nAbout the Presenter\nAndrew Strelka is currently the Senior Tax Counsel in the Biden-Harris White House. \nIn 2008\, Strelka began his legal career at the Internal Revenue Service through the Presidential Management Fellows Program. Strelka was subsequently detailed to the office of the United States Attorney for the District of Columbia in 2009. In 2010\, Strelka joined the United States Department of Justice Tax Division through the Attorney General’s Honors Program. While at the DOJ Tax Division\, Strelka was named national chair of the FBA’s Tax Section and received the Federal Bar Association’s Younger Federal Lawyer Award. In 2013\, Strelka received the Tax Division’s Outstanding Attorney Award and was detailed to the Obama White House. In 2014\, Strelka left the government and eventually joined the tax controversy group at Latham & Watkins.
