McClendon\, a recent\, highly cited qualified immunity opinion\, and Kyle Kaiser\, Assistant Utah Attorney General and former federal law clerk\, will offer a practical guide to those new the area of law\, or those who might just need a little refresher. \nPanelists will cover: \n\nA comparison of qualified immunity with other immunities and doctrines applicable to constitutional and civil rights lawsuits;\nA brief history of the doctrine;\nRecent Supreme Court and other case law updates;\nSome practical considerations when drafting\, responding to\, or reviewing a qualified immunity motion; and\nThoughts about the future of the doctrine.\n\nPresented by the Civil Rights Law Section\nCo-Sponsored by the Federal Judicial Law Clerk Committee of the Judiciary Division \nRegistration for this event is now closed. \n\nAbout the Speakers\n \nKyle Kaiser\, Assistant Utah Attorney General and Senior Trial Attorney\, Utah Attorney General’s Office \nKyle Kaiser is an Assistant Attorney General and Senior Trial Counsel in the Litigation Division of the Utah Attorney General’s Office.  He has been with the office since July 2011.  Kyle is also appointed as a judge pro tempore for the Salt Lake City Justice Court\, presiding over civil small claims matters. \nKyle’s practice centers on defending claims of constitutional or civil rights violations brought against the State of Utah\, its agents\, agencies\, and subdivisions\, and Utah colleges and school districts.  Before working for the Utah AG’s Office\, Kyle was employed as Staff Attorney for Justice Dale Wainwright of the Supreme Court of Texas.  Before that\, Kyle was a litigation and intellectual property associate with the law firm of Winthrop & Weinstine\, P.A. in Minneapolis\, Minnesota\, and served as a law clerk for Richard Dorr\, United States District Judge for the Western District of Missouri\, in Springfield. \nKyle received his J.D.\, with high distinction\, from the University of Iowa College of Law in 2003\, where he was Senior Managing Editor of the Iowa Law Review\, was awarded the Hancher-Finkbine Medallion\, and was inducted into Order of the Coif.  Kyle received his bachelor’s degree in journalism from Drake University\, summa cum laude\, in 2000. \nAway from work\, Kyle enjoys spending time with his wife Pearl\, their daughter Cora\, and their cat Milo; camping around Utah in a 1983 Chevy RV; competing in pub trivia events (mostly virtually this year); playing percussion with the local community band and piano in the privacy of his own home; and judging mock trial competitions. \n \nHon. Carlton W. Reeves\, U.S. District Court Judge\, Southern District of Mississippi \nHon. Carlton W. Reeves\, a native of Yazoo City\, Mississippi\, assumed office on December 30\, 2010. Immediately prior to his nomination by President Barack Obama\, Judge Reeves was engaged in the private practice of law with Pigott Reeves Johnson\, P.A.\, a law firm he co-founded in 2001. The focus of his practice was state and federal litigation where he represented individuals\, public institutions\, and private businesses. \nJudge Reeves’s career began as law clerk to Justice Reuben V. Anderson of the Mississippi Supreme Court. He also served as staff attorney to the court\, and then was an associate with the Phelps Dunbar law firm (1991-95) before serving as Assistant United States Attorney\, Chief of the Civil Division for the Southern District of Mississippi (1995-2001). \nA 1986 graduate of Jackson State University with a Bachelor of Arts in Political Science\, magna cum laude\, and the University of Virginia School of Law (1989)\, Judge Reeves is a former President of the Magnolia Bar Association and Magnolia Bar Foundation. Judge Reeves has been awarded the Magnolia Bar’s highest honor\, the R. Jess Brown Award\, and received the Mississippi Bar’s Curtis E. Coker Access to Justice Award and the Hind County Pro Bono Award. He was named Distinguished Jurist of the Year (2014-15) by the Mississippi Association of Justice and received the Mississippi State University Department of Political Science & Public Administration and the Pre-Law Society Distinguished Jurist Award (2016). Anh has been an active member of the FBA since the start of her legal career in 2001. Her involvement with the FBA began with the Minnesota Chapter\, where she was a member of the Executive Committee and served in a number of leadership roles before serving as the Circuit Vice President for the Eighth Circuit. \nAnh served as the Eighth Circuit CVP for two terms and received the Outstanding Service Award in 2011 for her work. Guidry and Professor Holger Spamann present a CLE on The Art and Science of Judging. \nThis CLE will discuss the judicial decision-making process\, both from the perspective of an esteemed professor who has conducted research on the topic\, as well as that of a seasoned jurist now sitting on the federal bench. The panel will explore topics\, including how judges decide cases\, what personal experiences influence their rulings\, and how they approach and educate themselves regarding implicit bias\, as well as reforms aimed to promote impartiality and accountability in the judicial branch. \nThis CLE is free for all interested participants\, but is only pre approved for CLE credit in Louisiana. \n\nAbout the Presenters\nJudge Guidry is a two-time LSU graduate\, as well as a graduate of the National Judicial College\, who has an unparalleled perspective on the judicial process and judicial decision-making after seeing it from every from virtually every vantagepoint. Judge Guidry started his legal career in private practice before serving as an Assistant Attorney General for the State of Louisiana and later becoming an Assistant U.S. Attorney in the Eastern District of Louisiana. Judge Guidry then started his tenure as a jurist in 2000 in the 24th Judicial District of Louisiana and has since served at every level of Louisiana’s judiciary\, including as a Justice on the Louisiana Supreme Court from 2009-2019 . In 2019\, Judge Guidry was appointed and confirmed to the bench of the Eastern District of Louisiana\, where he now serves. \nHolger Spamann is the Lawrence R. Grove Professor of Law at Harvard Law School\, where he teaches corporate law and corporate finance. His research focuses on judicial behavior\, as well as the law and economics of corporate governance and financial markets\, and comparative law. Before embarking on his academic career\, he practiced with Debevoise & Plimpton in New York and clerked for two years in Europe. Jason Steed breaks it all down in this lively session and previews the\nbig issues the U.S. Supreme Court will tackle in the October 2021 term. \n10:30 AM – 11:45 AM: Citizens to Preserve Overton Park at 50 and the Byhalia Pipeline \n\nCharlie Newman\, Scott Crosby\n Sarah Stuart – Burch\, Porter\, and Johnson\nJosh Whitehead – Zoning Administrator\, Memphis and Shelby County Division of Planning and Development\, Adjunct Professor\, U of M School of Law\n\nIn 1971\, the U.S. Supreme Court sided with Citizens to Preserve Overton Park and helped\nprevent an interstate highway from being constructed through the middle of the midtown\nMemphis gem. Fifty years later\, the Mid-South was embroiled in a similar battle\, with citizens\nworking to prevent the Byhalia Pipeline from being constructed and bisecting nearly all-Black\ncommunities in southwest Memphis. This panel will discuss what happens when land\ndevelopment collides with social and environmental justice. \n12:15 PM – 1:15 PM: Brown v. Board of Education and Why It Matters to Your Practice Today \n\nMichael Rafferty – Harris Shelton\n\nIn its opinion in Brown v. Board of Education\, the Supreme Court chose to omit a discussion\nof the facts of the case and focus instead on the effects of racial segregation in public\nschools. In so doing\, the Court missed an opportunity to thoroughly describe the poor\nconditions of the “colored” schools and paint the full picture of how omnipresent segregation\nwas not only in public schools\, but also in society in general. In this session\, we will revisit the\nunderlying facts of the consolidated cases and contemporaneous accounts of other aspects of\ndaily life in the state-mandated segregated South at that time and examine how today’s\npractitioners can help put the finishing touches on the end of the Jim Crow era by considering\nwhether the segregationist mentality might still exist and be hidden in current laws. The\nsession will also examine how the composition of the Court and lead counsel contributed to\nthe outcome of the case. \n1:30 PM – 3:00 PM: Artificial Intelligence as Evidence \n\nThe Honorable Paul W. Grimm\, U.S. District Judge for the District of Maryland\nMaura R. Grossman\, Research Professor in the School of Computer Science at the University\nof Waterloo\, Adjunct Professor at Osgoode Hall Law School\, affiliate faculty member of the\nVector Institute\, Ontario\, Canada\, principal at Maura Grossman Law\n\nIn the ever-changing landscape of eDiscovery and modern forms of evidence\, understanding\ncutting-edge topics relating to Artificial Intelligence (AI) has become essential for\nlitigators. SUMMARY:Webinar: Conflict of Interest Restrictions After Government Employment
DESCRIPTION:Many federal government employees who retire\, establish a consulting practice\, or take up employment in the private sector\, using their skills and experience to support the business needs of their clients and employers. There are restrictions\, however\, on the ability of these former government professionals to approach the U.S. government\, particularly their former agencies\, on behalf of clients or employers. There are additional restrictions\, where the principal is a foreign entity. The key federal statute and regulations governing these restrictions are 18 U.S.C. § 207 (Restrictions on former officers\, employees\, and elected officials of the executive and legislative branches) and 5 C.F.R. § 2641 (Post-employment conflict of interest restrictions). \nThis presentation will examine the general provisions of the statute and regulations\, discuss the prohibitions they stipulate\, and the applicable exceptions and waivers. The presentation will offer a special focus on the restrictions relating to foreign entities\, and the relationship of these restrictions to the Foreign Agents Registration Act of 1938 (FARA). The presentation will also offer an overview of key federal agency components and other resources relevant to the compliance with\, and enforcement of the statute and its implementing regulations. \nPresented by the Senior Lawyers Division \n\nAbout the Presenters\n \nArmen Kharazian is the owner of a small law practice in the District of Columbia specializing in white-collar criminal defense (Foreign Corrupt Practices Act and anti-money laundering statutes)\, export control and sanctions\, Foreign Agents Registration Act (FARA) and Lobbying Disclosure Act\, 18 U.S.C. § 207 (Restrictions on former officers\, employees\, and elected officials of the executive and legislative branches)\, and corporate formation. Prior to establishing his law practice\, Armen served as a Law Fellow at the U.S. Department of Energy’s Office of the General Counsel\, where he worked on U.S. Atomic Energy Act-related nuclear contamination litigation\, and an Honors Law Clerk at the U.S. Environmental Protection Agency\, where he worked on regional enforcement programs related to the Comprehensive Environmental Response\, Compensation\, and Liability Act (CERCLA). He holds a JD from the University of the District of Columbia David A. Clarke School of Law\, MA in Security Studies from Georgetown University School of Foreign Service\, and BA in Middle Eastern Studies from Yerevan State University in Armenia. His article on the constitutional implications of Congress’s enactment of the Religious Freedom Restoration Act of 1993 (RFRA)\, and RFRA’s applicability to federal law appeared in the September/October 2020 issue of The Federal Lawyer magazine. Henry was appointed as a United States Magistrate Judge for the Eastern District of New York on May 10\, 2021. \nImmediately prior to her appointment\, Judge Henry was at the New York State Department of Financial Services in the Cybersecurity Division\, where she supervised policy initiatives related to cybersecurity regulation and enforcement in the financial services industry.  Before that\, Judge Henry served for over seven years as an Assistant U.S. Attorney with the U.S. Attorney’s Office for the Eastern District of New York\, where she prosecuted complex federal crimes\, including international narcotics trafficking\, money laundering\, and wire fraud\, and was the district’s first Opioids Coordinator.  Before joining the U.S. Attorney’s Office\, Judge Henry practiced labor and employment law at Seyfarth Shaw LLP and Rao Tiliakos LLP in New York.  Prior to law school\, she worked at J.P. Morgan Chase & Co. in human resources and diversity program management. \nJudge Henry earned her J.D. from New York University School of Law\, where she was Editor-in-Chief of the New York University Review of Law & Social Change\, and her B.A. in Psychology and Afro-American Studies\, cum laude\, from the University of Pennsylvania.  She served as a law clerk to the Honorable Carl E. Stewart of the U.S. Court of Appeals for the Fifth Circuit and to the Honorable Sterling Johnson\, Jr. of the U.S. District Court for the Eastern District of New York. \nJudge Henry is a native of Brooklyn\, New York\, and the daughter of immigrants from Trinidad and Tobago.  She is a member of the Metropolitan Black Bar Association and the Federal Bar Council.  She has served as a Director of the Federal Bar Foundation and a Team Liaison for the Federal Bar Council’s American Inn of Court. \nProfessor Joseph Thai\, Former judicial clerk for the Supreme Court and Tenth Circuit. \nProfessor Joseph Thai teaches and writes about constitutional law and the Supreme Court. \nProf. Thai served as law clerk to Justices John Paul Stevens and Byron White of the Supreme Court and Judge David Ebel of the U.S. Court of Appeals for the Tenth Circuit. \nHe frequently engages in civil rights litigation and served on the legal team that successfully challenged Oklahoma’s same-sex marriage ban a year before the Supreme Court upheld marriage equality nationwide. \nProf. Thai has often been named outstanding professor by students at the law school and once by students university-wide.  He is consistently named outstanding dad by his goldendoodle\, Bach. \nJorge Gonzalez\, Former judicial clerk for the Federal Circuit \nJorge F. Gonzalez is a former judicial clerk to Judge Jimmie V. Reyna of the U.S. Court of Appeals for the Federal Circuit (2019-2020). After completing his clerkship\, Jorge returned to Finnegan\, LLP\, in Washington\, D.C.\, where he had worked as a patent litigation associate since 2015. \nJorge recently accepted an in-house position at AbbVie\, Inc.\, where he serves as patent litigation counsel. Jorge manages biopharmaceutical patent litigations\, both offensively and defensively\, in courts and tribunals worldwide. DESCRIPTION:This CLE presents a unique training opportunity led by Dr. Artika Tyner\, author of the award-winning book\, The Lawyer as Leader: How to Plant People and Grow Justice\, for newer and younger attorneys to support their efforts and participation in the FBA Younger Lawyer Division’s Annual StepUp Pro Bono Challenge. In FY2020\, then-YLD Chair Adine S. Momoh led a Call to Action following George Floyd’s tragic death and the civil unrest across Minnesota\, the country and world. The YLD issued a statement and provided resources to help younger attorneys respond. The YLD then initiated a national pro bono challenge\, the StepUp Pro Bono Challenge\, and encouraged younger attorneys to step up and perform pro bono specifically addressing issues of systemic racism\, socio-economic injustice\, and access to justice. The YLD Board has since adopted it as an annual program.  In the training\, Dr. Tyner will explore her book and discuss tangible ways lawyers can use their legal skills to advocate for change in marginalized communities. Sessions typically focus on a single federal district and feature an experienced local panel that includes an Assistant U.S. Attorney for the district; a federal judge; a relator-side attorney; and a defense attorney. \nWe hope to resume in-person sessions of “The FCA Today” in 2022\, but for now we are conducting them online via the Zoom platform. For this session on the Western District of North Carolina\, attendees can expect a brief overview of the FCA process. \nThis webinar does not carry CLE credit. Scott Oswald – Chair\, FBA Qui Tam Section (moderator) \nScott Oswald is an accomplished trial lawyer who has brought more than 40 trials to verdict. His cases have recovered more than $300 million in judgments and settlements. A fellow of the prestigious College of Labor and Employment Lawyers\, he received his law degree from Howard University and honed his skills at Trial Lawyers College\, founded by the legendary Gerry Spence. Mr. Oswald litigates employment and whistleblower actions nationwide. Among his results: \n\nFirst jury verdict under new whistleblower protections in the National Defense Authorization Act of 2013|\nFirst Sarbanes-Oxley Act liability verdict to withstand appeal\nFirst jury verdict under 2009 anti-retaliation provisions of False Claims Act\nFirst Dodd-Frank Act retaliation lawsuit to reach discovery in federal court\n\nMr. Oswald is chair of the Federal Bar Association’s Qui Tam Section and immediate past chair of the FBA’s Professional Ethics Committee. Lawdragon ranks him as one of the top 500 plaintiff-side employment lawyers in the country. \nKatherine Armstrong\, Affirmative Civil Enforcement Coordinator\, U.S. Attorney’s Office for the Western District of North Carolina  \nKatherine Armstrong joined the United States Attorney’s Office for the Western District of North Carolina in July of 2016 as an Assistant United States Attorney (AUSA) in the office’s Civil Division. Ms. Armstrong was appointed as Affirmative Civil Enforcement (ACE) Coordinator in January of 2020 and is primarily responsible for handling ACE litigation and civil fraud investigations under the False Claims Act\, 31 U.S.C. §§ 3729-3733\, civil enforcement investigations and actions under the Controlled Substances Act\, 21 § U.S.C. 801 et seq. Additionally\, Ms. Armstrong deals with enforcement of other federal statutes that provide for the recovery of monetary damages by\, or injunctive relief on behalf of the United States. \nMs. Armstrong also serves as the Civil Rights Coordinator and has experience in the enforcement of federal statutes prohibiting discrimination in the provision of housing\, and based on disability\, among others.  Before joining the federal government\, Ms. Armstrong practiced at a Charlotte law firm specializing in civil litigation\, primarily in the areas of commercial and business litigation and insurance defense. During her time tenure there\, she represented clients in the courts of Mecklenburg and surrounding counties\, and the federal district courts of North Carolina.  Ms. Armstrong obtained her J.D. from the University of Kentucky College of Law and her undergraduate degree from the University of North Carolina at Chapel Hill. \nMark T. Calloway\, Partner\, Alston & Bird LLP \nMark T. Calloway is a partner with Alston & Bird LLP.  He concentrates his practice in the areas of white-collar criminal defense with an emphasis on health care matters\, internal corporate investigations\, and the defense of False Claims Act matters around the country. Mr. Calloway served for seven years as the United States Attorney for the Western District of North Carolina (February 1994 to March 2001). During his tenure with the Department of Justice\, Mr. Calloway also served as Director of the Executive Office for United States Attorneys in Washington\, D.C.\, and as Chair of the Attorney General’s Advisory Committee of United States Attorneys and was a member of the Attorney General’s White Collar Crime Council. \nAs Director of the Executive Office of the United States Attorneys in Washington\, D.C.\, Mr. Calloway had responsibility for support and oversight of all 94 United States Attorney’s Offices and a key role in management and policy implementation for the Department of Justice.  In January 2001\, Attorney General Reno awarded Mr. Calloway the Edmund J. Randolph Award for outstanding service to the Department of Justice. \nHon. Robert J. Conrad Jr.\, U.S. District Judge\, Western District of North Carolina  \nRobert (“Bob”) J. Conrad\, Jr. serves as a District Judge for the Western District of North Carolina. Judge Conrad was confirmed in 2005 and he was Chief Judge from 2006-2013. He served as the Fourth Circuit’s district court representative on the United States Judicial Conference from 2014-2020. Judge Conrad was appointed by Chief Justice John Roberts to the seven-judge Executive Committee of the Judicial Conference.  He chaired the Conference of District Judge Representatives in 2019-2020. Steinvoort\, Assistant U.S. Attorney\, U.S. Attorney’s Office for the District of Utah  \nSandra Steinvoort was hired by Judge David Barlow in February 2013 as the Affirmative Civil Enforcement Officer and Civil Healthcare Fraud Coordinator for the District of Utah. Previously\, Ms. Steinvoort was an Assistant Attorney General for the Utah Attorney General’s office in the Litigation Division\, Tort Section\, defending state agencies and employees in negligence cases. She was also an associate with Kipp & Christian\, PC in Salt Lake City prior to joining the AG’s office. \nMs. Steinvoort received her undergraduate and law degrees at the University of Utah in 1985 and 1988\, respectively.
