SUMMARY:Webinar: Protecting Clients’ Information and Data in Your Practice
DESCRIPTION:This panel will discuss a variety of ethical questions relating to data security and best practices using electronic media in IRS examinations and other tax matters.   Examples of specific areas that the panelists will cover include\, among others\, data privacy and ethical issues related to social media and other related business issues\, use of email\, the cloud\, and other media\, tax return related identify theft\, and concerns in interacting with the IRS via online portals or other electronic means. \nLearning Objectives \n\nLearn how Circular 230\, the ABA model rules\, and other ethical rules impose a mandate that a tax practitioner focus on data security and related concerns.\nUnderstand best practices when dealing with secure collaboration spaces\, encryption and cyber security\, social media and other related sites\, identity theft\, and the use of electronic media in IRS exams/appeals.\nDiscuss various hypotheticals and how tax practitioners need to apply these rules to practicing in today’s electronic age.\n\nPresented by the Section on Taxation \n\nAbout the Presenters\nFred Murray\, Special Counsel\, Office of Chief Counsel\, Internal Revenue Service (moderator) \nFred Murray currently serves as a Special Counsel and Lead Professor-in-Residence in the Office of Chief Counsel of the Internal Revenue Service\, as well as Director of the Talent Management Division. Before he returned to Chief Counsel\, he was Director of the Graduate Tax Program and a Professor teaching international tax and tax procedure at the University of Florida Levin College of Law (the Graduate Tax Program is ranked 2nd by U.S. News & World Report). Before that\, he was a tax partner in both a large law firm and the U.S. firm of the 5th largest international public accounting firm\, and taught part-time in law schools and in graduate business schools for more than 30 years. In the large international accounting firm where he was before the University of Florida\, among other duties\, he was a partner-level member of Firm’s TARAS tax accounting services team. His previous government experience also includes service as Deputy Assistant Attorney General in the Tax Division at the U.S. Department of Justice and as a Special Counsel to the Chief Counsel for the U.S. Internal Revenue Service. Fred Murray is an attorney (District of Columbia\, Maryland\, New York\, and Texas (Board Certified in Tax Law\, Texas Board of Legal Specialization)\, and various federal courts) and C.P.A. (Florida\, Texas\, and Maryland). B.A.\, Rice University; J.D. University of Texas at Austin. \nSharyn Fisk\, Director\, Office of Professional Responsibility\, Internal Revenue Service \nSharyn M. Fisk was named Director of the IRS Office of Professional Responsibility (OPR) in January 2020. As Director\, she is responsible for the IRS’ oversight of tax professionals who practice before the IRS as set out in Treasury Circular 230. Sharyn’s extensive background in the tax community brings over 20 years of tax experience to the OPR position. Before coming to the IRS\, Sharyn was Professor of Tax at Cal Poly Pomona and Director of the University’s VITA program. Prior to teaching\, Sharyn was in private practice specializing in tax controversies. As a private practitioner\, Sharyn represented hundreds of individuals\, businesses\, and corporate taxpayers before the IRS\, the Department of Justice Tax Division\, federal and state courts\, and state taxing authorities. These matters involved civil examinations and appeals\, criminal investigations\, and tax collection issues. Before becoming a private practitioner\, Sharyn clerked for the Honorable Maurice Foley\, Judge\, U.S. Tax Court. Sharyn has held leadership roles in several professional organizations. She served as a former Chair of the Tax Policy\, Practice and Legislation Committee for the American Bar Association (ABA). She is a past Chair of the Taxation Section of the Los Angeles County Bar Association and the Taxation Section of the Beverly Hills Bar Association. In 2019\, Sharyn concluded a three-year term as a member of the IRS Advisory Council (IRSAC). She chaired a task force on unenrolled return preparers on behalf of the Standards of Tax Practice Committee for the ABA Taxation Section. She is also a Fellow of the American College of Tax Counsel. Sharyn wrote and spoke extensively before national\, state\, and local tax professional organizations on all aspects of civil and criminal tax controversy issues and ethics in tax practice. Sharyn earned a B.A. in Journalism from San Diego State University\, a J.D. from Rutgers University\, and an LL.M in taxation from the New York University School of Law. \nRobb Longman\, Partner\, Longman & Van Grack\, LLC \nMr. Longman is a managing member at the Bethesda\, Maryland law firm Longman & Van Grack\, LLC. Mr. Longman practice areas include representing his clients’ business matters\, tax planning and litigation\, as well as estate planning. Mr. Longman regularly assists businesses with the drafting of corporate documents\, drafting contracts\, negotiating contracts\, addressing employee agreements\, and formulating succession planning. Additionally\, Mr. Longman has successfully represented many business\, individuals\, and non-profits before the Internal Revenue Service and state taxing agencies. Mr. Longman represents his clients in tax audits\, in the United States Tax Court\, the Maryland Tax Court. He is currently a Council Director of the American Bar Association’s Tax Section and has been the Chair of the Maryland State Bar Association’s Tax Section. \nChristopher S. Rizek\, Member\, Caplin & Drysdale\, Chartered \nChristopher S. Rizek is a member of the law firm of Caplin & Drysdale\, Chartered\, in Washington\, D.C.  He formerly served as Associate Tax Legislative Counsel in the U.S. Treasury Department\, Office of Tax Policy\, where he helped write tax procedural guidance and legislation\, including particularly the Taxpayer Bill of Rights 2 (1996) and the IRS Restructuring and Reform Act of 1998.  He has also previously worked in other Washington law firms and as a Trial Attorney in the U.S. Department of Justice\, Tax Division.  Mr. Rizek has a bachelor’s degree in philosophy from Dartmouth College and received his J.D. and his LL.M. in Taxation from Georgetown University Law Center\, where he is currently an Adjunct Professor.  He has chaired committees and served in numerous other capacities in the D.C. Bar’s Taxation Section\, the American Bar Association Section of Taxation\, and the American College of Tax Counsel.  Mr. Rizek served for eleven years as General Counsel of Caplin & Drysdale\, and for five years as a member and later chairman of the Anne Arundel County Ethics Commission\, and he frequently speaks and writes about tax practice and ethics issues. \nAnita Soucy\, Chief Quality Officer\, Deloitte Tax LLP \nAs Chief Quality Officer of Deloitte Tax LLP\, Anita is responsible for leading the Deloitte’s activities related to matters involving risk\, quality assurance\, and professional and ethical standards applicable to the firm’s tax practitioners. Anita is responsible for consultations regarding tax quality assurance and risk matters\, coordinating quality assurance reviews\, and development of risk and professional practice policies applicable to Deloitte Tax LLP. She is the firm’s lead regulatory liaison with regulators of the tax profession\, including the Internal Revenue Service and the U.S. Department of Treasury. She is responsible for matters pertaining to client confidentiality and privacy for the tax business. She is also responsible for COVID-related business continuity and reopening efforts for Deloitte US Tax. The discussion will focus on the most recently issued prosecutorial discretion memorandums\, what this means for those individuals in removal proceedings and those wishing to submit prosecutorial discretion requests to their local OPLA office. \nPresented by: Immigration Law Section \nRegistration is Closed \n\nAbout the Presenter\nKaren Lundgren\, Chief Counsel\, Chicago\, Office of the Principal Legal Advisor  \nIn July 2005\, Karen became the Office of the Principal Legal Advisor (OPLA) Chicago Chief Counsel\, and in June 2016\, she was appointed to the Senior Executive Service in the same position. As Chief Counsel\, Karen manages OPLA Chicago which includes offices in Chicago\, Illinois\, and Kansas City\, Missouri. The OPLA Chicago area of responsibility includes Illinois\, Indiana\, Kansas\, Kentucky\, Missouri\, and Wisconsin. Karen also leads OPLA’s Denaturalization Program.  Prior to joining the United States Government\, Karen began her legal career in the private sector working with the Law Offices of James J. Clayton\, Co-Founder & Vice President\, Lawyers Depression Project \nJulia has worked in the public sector for over 16 years\, with her most recent work representing state health and welfare agencies in federal and state litigation.  As a co-founder of the Lawyers Depression Project (LDP)\, Julia works to provide peer-support to others in the legal profession who\, like herself\, are dealing with mental health conditions. David presides as judicial referee in New York Supreme Court\, 9th Judicial District. His past public service roles include special counsel to the Chief Judge of New York\, special counsel to the New York Senate Majority\, deputy director of voter protection for Pres. Barack Obama’s 2008 campaign\, justice policy counsel to New York Gov. Eliot Spitzer’s transition\, and senior law secretary to the New York Court of Appeals. David served as faculty in graduate public administration at Pace University\, and political science at Fordham University. David is co-founder\, executive officer\, training director and peer counselor for the nonprofit Lawyers Depression Project\, a national platform for legal professional wellness\, support and advocacy. He teaches nationally on practice management\, ethics and systemic dynamics of attorney wellness for both bar and bench. On the “clergy side\,” David is senior rabbi of Temple Beth El (City Island\, NY)\, Board chair and senior builder for Bayit: Building Jewish (innovation incubator)\, and trustee of the Center of Theological Inquiry at Princeton (leveraging theology to address global concerns). He is seminary faculty for the Academy for Jewish Religion\, and maintains an active private counseling practice. David earned a Juris Doctor magna cum laude from Harvard Law School\, a Masters in Public Policy from Harvard University’s John F. DESCRIPTION:Pablo Picasso’s artworks and estate have sparked controversies requiring U.S. courts to grapple with issues of foreign law. In de Fontbrune v. Wofsy\, 838 F.3d 992 )(9th Cir. 2016) a decision involving a U.S. enforcement proceeding Picasso’s copyrights\, the Ninth Circuit Court of Appeals accused other federal circuit courts of “semantic sloppiness” in requiring parties seeking to apply foreign law to bear the burden of proving it. The Ninth Circuit looked to Rule 44.1 of the Federal Rules of Civil Procedure (enacted in 1966) which permits a court to consider “any relevant source” of foreign law and treats the court’s determination of foreign law as a ruling on a question of law. In Zuckerman v. The Metropolitan Museum of Art\, 307 F.Supp.3d 304 (S.D.N.Y. 2018) aff’d 928 F.3d 186 (2d Cir. 2019) Judge Loretta Preska considered a claim of duress made by victims of Nazi persecution under the Italian law of duress to recover Picasso’s The Actor from the Metropolitan Museum following transactions in Switzerland\, Italy\, France and ultimately New York. In Zuckerman\, Judge Preska analyzed the choice of law issues\, including (i) whether Italian law and New York law conflicted and (ii) how New York’s “interest analysis” applied to the jurisdictions through which the artwork had passed and (iii) how choice of law rules differ in contracts versus torts. This program will provide an analytical framework for attorneys nationwide seeking to navigate issues of foreign law and choice of law. \nPresented by the Federal Litigation Section \n\nAbout the Presenters\nRaymond J. Dowd is a litigation partner with Dunnington Bartholow & Miller LLP in New York City.  He has litigated a number of landmark art restitution cases in the state and federal courts.  He is the author of Copyright Litigation Handbook (Thomson Reuters West 14th Ed. 2020-21) and currently serves on the Board of Governors of  the National Arts Club\, as President of the American Foreign Law Association and on the Board of the Fordham Law Alumni Association.  He has held numerous leadership positions in the Federal Bar Association and was the 2020 recipient of the Earl W. Rodriguez\, U.S. District Judge\, District of Colorado \nJudge Rodriguez is the newest member of the Colorado federal district court bench. DESCRIPTION:The doctrine of qualified immunity is complex\, controversial\, and ever-changing.  It can be a quagmire for new practitioners and for law clerks helping to evaluate qualified immunity motions.  Judge Carlton Reeves\, United States District Judge for the Southern District of Mississippi and author of Jamison v. McClendon\, a recent\, highly cited qualified immunity opinion\, and Kyle Kaiser\, Assistant Utah Attorney General and former federal law clerk\, will offer a practical guide to those new the area of law\, or those who might just need a little refresher. \nPanelists will cover: \n\nA comparison of qualified immunity with other immunities and doctrines applicable to constitutional and civil rights lawsuits;\nA brief history of the doctrine;\nRecent Supreme Court and other case law updates;\nSome practical considerations when drafting\, responding to\, or reviewing a qualified immunity motion; and\nThoughts about the future of the doctrine.\n\nPresented by the Civil Rights Law Section\nCo-Sponsored by the Federal Judicial Law Clerk Committee of the Judiciary Division \nRegistration for this event is now closed. \n\nAbout the Speakers\n \nKyle Kaiser\, Assistant Utah Attorney General and Senior Trial Attorney\, Utah Attorney General’s Office \nKyle Kaiser is an Assistant Attorney General and Senior Trial Counsel in the Litigation Division of the Utah Attorney General’s Office.  He has been with the office since July 2011.  Kyle is also appointed as a judge pro tempore for the Salt Lake City Justice Court\, presiding over civil small claims matters. \nKyle’s practice centers on defending claims of constitutional or civil rights violations brought against the State of Utah\, its agents\, agencies\, and subdivisions\, and Utah colleges and school districts.  Before working for the Utah AG’s Office\, Kyle was employed as Staff Attorney for Justice Dale Wainwright of the Supreme Court of Texas.  Before that\, Kyle was a litigation and intellectual property associate with the law firm of Winthrop & Weinstine\, P.A. in Minneapolis\, Minnesota\, and served as a law clerk for Richard Dorr\, United States District Judge for the Western District of Missouri\, in Springfield. \nKyle received his J.D.\, with high distinction\, from the University of Iowa College of Law in 2003\, where he was Senior Managing Editor of the Iowa Law Review\, was awarded the Hancher-Finkbine Medallion\, and was inducted into Order of the Coif.  Kyle received his bachelor’s degree in journalism from Drake University\, summa cum laude\, in 2000. \nAway from work\, Kyle enjoys spending time with his wife Pearl\, their daughter Cora\, and their cat Milo; camping around Utah in a 1983 Chevy RV; competing in pub trivia events (mostly virtually this year); playing percussion with the local community band and piano in the privacy of his own home; and judging mock trial competitions. \n \nHon. Carlton W. Reeves\, U.S. District Court Judge\, Southern District of Mississippi \nHon. Carlton W. Reeves\, a native of Yazoo City\, Mississippi\, assumed office on December 30\, 2010. Immediately prior to his nomination by President Barack Obama\, Judge Reeves was engaged in the private practice of law with Pigott Reeves Johnson\, P.A.\, a law firm he co-founded in 2001. The focus of his practice was state and federal litigation where he represented individuals\, public institutions\, and private businesses. \nJudge Reeves’s career began as law clerk to Justice Reuben V. Anderson of the Mississippi Supreme Court. He also served as staff attorney to the court\, and then was an associate with the Phelps Dunbar law firm (1991-95) before serving as Assistant United States Attorney\, Chief of the Civil Division for the Southern District of Mississippi (1995-2001). \nA 1986 graduate of Jackson State University with a Bachelor of Arts in Political Science\, magna cum laude\, and the University of Virginia School of Law (1989)\, Judge Reeves is a former President of the Magnolia Bar Association and Magnolia Bar Foundation. Judge Reeves has been awarded the Magnolia Bar’s highest honor\, the R. Jess Brown Award\, and received the Mississippi Bar’s Curtis E. Coker Access to Justice Award and the Hind County Pro Bono Award. He was named Distinguished Jurist of the Year (2014-15) by the Mississippi Association of Justice and received the Mississippi State University Department of Political Science & Public Administration and the Pre-Law Society Distinguished Jurist Award (2016). DESCRIPTION:Covid – 19 has brought radical changes to the already challenged immigration adjudication and processing systems and agencies. SUMMARY:Minnesota Chapter: November Monthly Luncheon
DESCRIPTION:November 10\, 2021 | 12:00-1:00 p.m. CT  \n\n\n\n\nOur virtual meetings are designed to emulate our Chapter’s signature monthly luncheon events. Using Zoom\, participants will enter small-group breakout rooms\, where they can socialize and catch up with friends and colleagues. Participants will then convene in the virtual “main room” to hear from FBA leaders\, judges\, and our distinguished speakers. \nOur November 10\, 2021 meeting will feature remarks from Anh Le Kremer\, the first National President of the FBA from the Minnesota Chapter. \n\nAbout the Presenter\nAnh Le Kremer is the Chief Operating Officer and General Counsel at Nystrom & Associates\, Ltd. Anh has been an active member of the FBA since the start of her legal career in 2001. Her involvement with the FBA began with the Minnesota Chapter\, where she was a member of the Executive Committee and served in a number of leadership roles before serving as the Circuit Vice President for the Eighth Circuit. \nAnh served as the Eighth Circuit CVP for two terms and received the Outstanding Service Award in 2011 for her work. She served on the FBA Board of Directors from 2013 to 2016 and was appointed by then-President Judge Newman in January 2017 to fill a vacancy on the Board from January through September 2017. Anh served on the Sections and Divisions Council. She is also a past chair of the Professional Ethics Committee\, where she assisted with the development of a Standards of Professional Ethics and Conduct Policy\, which was adopted by the Board and sets the standards of conduct expected of our leadership. Anh is a past chair of the Audit Committee\n(2015)\, past chair of the Shaw Younger Lawyers Public Service Award and Grant Committee (2017)\, and past chair of the Constitution\, Bylaws\, Rules and Resolutions Committee (2018)\, and she has served on other FBA committees\, including the Nominations and Elections Committee\, the Sarah T. Hughes Awards Committee\, the Women and the Law Conference Planning Committee\, and the Rising Professionals Symposium Planning Committee. Anh also served as the General Counsel for the FBA for FY2019. Anh was elected as the Treasurer in FY2020 and has progressed through the leadership ladder and was installed as President for FY2022.
