SUMMARY:Qui Tam Section: [VIRTUAL] False Claims Act Today – District of Utah
DESCRIPTION:**Program hosted in (ET) time zone** \nHosted by the FBA’s Qui Tam Section\, often in cooperation with local FBA chapters\, “The False Claims Act Today” is a discussion series that examines the details of real-life FCA practice in specific jurisdictions. Sessions typically focus on a single federal district and feature an experienced local panel that includes an Assistant U.S. Attorney for the district; a federal judge; a relator-side attorney; and a defense attorney. \nWe hope to resume in-person sessions of “The FCA Today” in 2022\, but for now we are conducting them online via the Zoom platform. For this session on the District of Utah\, attendees can expect a brief overview of the FCA process. \nThis webinar does not carry CLE credit. Registrants will receive Zoom login details on the day before the event \nRegistration is closed. \n\nAbout the Presenters\nR. Scott Oswald – Chair\, FBA Qui Tam Section (moderator) \nScott Oswald is an accomplished trial lawyer who has brought more than 40 trials to verdict. His cases have recovered more than $300 million in judgments and settlements. A fellow of the prestigious College of Labor and Employment Lawyers\, he received his law degree from Howard University and honed his skills at Trial Lawyers College\, founded by the legendary Gerry Spence. Mr. Oswald litigates employment and whistleblower actions nationwide. Among his results: \n\nFirst jury verdict under new whistleblower protections in the National Defense Authorization Act of 2013|\nFirst Sarbanes-Oxley Act liability verdict to withstand appeal\nFirst jury verdict under 2009 anti-retaliation provisions of False Claims Act\nFirst Dodd-Frank Act retaliation lawsuit to reach discovery in federal court\n\nMr. Oswald is chair of the Federal Bar Association’s Qui Tam Section and immediate past chair of the FBA’s Professional Ethics Committee. Lawdragon ranks him as one of the top 500 plaintiff-side employment lawyers in the country. \nGregory Goldberg\, Partner\, Holland & Hart \nGreg is chair of Holland & Hart’s Government Investigations practice group and a partner in its complex civil litigation practice group. He defends companies and individuals in government investigations by grand juries\, the U.S. Department of Justice and state attorneys general. He also represents clients in investigations and litigation under the False Claims Act (FCA). Mr. Goldberg previously served as an Assistant U.S. Attorney\, where he received the Director’s Award\, and has tried more than 20 federal criminal and civil trials. He is a graduate of Dartmouth College and Columbia Law School. \nBrandon J. Mark\, Shareholder\, Parson Behle & Latimer \nBrandon Mark is co-chair of the litigation department and works on the firm’s litigation\, healthcare\, and real estate practice teams. Mr. Mark has represented clients in state and federal trial courts around the country. In recent years\, Mr. Mark has focused his practice on the many legal issues involving government contracts\, including representing whistleblowers who have information about fraud committed on government programs. His FCA practice has included cases involving fraud in higher education\, healthcare\, and defense contracting. \nSandra L. Steinvoort\, Assistant U.S. Attorney\, U.S. Attorney’s Office for the District of Utah  \nSandra Steinvoort was hired by Judge David Barlow in February 2013 as the Affirmative Civil Enforcement Officer and Civil Healthcare Fraud Coordinator for the District of Utah. Previously\, Ms. Steinvoort was an Assistant Attorney General for the Utah Attorney General’s office in the Litigation Division\, Tort Section\, defending state agencies and employees in negligence cases. She was also an associate with Kipp & Christian\, PC in Salt Lake City prior to joining the AG’s office. \nMs. Steinvoort received her undergraduate and law degrees at the University of Utah in 1985 and 1988\, respectively. He has spent time during his career in the US Marine Corps and various private sector agencies with the goal of protecting the United States from security threats. \nBrian is a Board Member and Strategic Advisor to many great companies. \nSonya Proctor\, Assistant Administrator for Surface Operations\, Transportation Security Administration \nSonya T. Proctor is the Assistant Administrator for Surface Operations\, which aligns surface transportation security operations under direct executive leadership to provide the most effective and efficient security solutions for the four modes of land-based transportation: mass transit\, freight rail\, highway motor carrier and pipeline.  Serving in TSA\, Ms. Proctor’s executive accomplishments have spanned the policy\, law enforcement and security operations areas. \nShe brings to TSA an extensive operational background in law enforcement and transportation security.  Ms. Proctor started her law enforcement career in the Nation’s Capital\, with the Washington\, D.C. Metropolitan Police Department. During her twenty-five-year tenure she served in the patrol and investigative ranks\, directing and leading the department through many city wide challenges\, including crime reduction\, civil disturbances\, sensitive investigations and significant departmental reorganization. She rose to command many key positions\, among them\, the Human Resources Bureau for the Department\, the Office of Internal Affairs\, and the Special Events Unit of the Special Operations Division\, which handles all major events\, Presidential escorts\, parades\, marches\, and demonstrations – scheduled and unscheduled – in the Nation’s Capital. She also served as Commander of the Third Police District\, often recognized for its broad diversity and model community policing approach she developed with her community partners. She served in every rank from patrol officer to Chief of Police\, retiring from the department\, after serving as the Chief of Police\, in an interim capacity. \nMs. Proctor went on to serve as the Chief of Police for the national Amtrak Police Department\, developing a new strategic blend of city policing in a passenger railroad environment. In conjunction with NYPD Commissioner Ray Kelly\, Ms. Proctor co-chaired the Northeast Corridor Coalition\, a group of law enforcement leaders along the Amtrak route between Washington\, DC and New York City to enhance post 9-11 security for passengers on that heavily travelled route. \nA graduate of the 130th session of the FBI National Academy and a life member of the International Association of Chiefs of Police\, she remains active in the national and international law enforcement community. Ms. Proctor earned her bachelor’s and master’s degrees from the Johns Hopkins University. \nMichael Stephens\, General Counsel and Executive Vice-President\, Tampa International Airport \nMichael A. Stephens serves as General Counsel & Executive Vice President for the Hillsborough County Aviation Authority and Tampa International Airport. In addition to being a member of the Authority’s executive leadership team\, he oversees all legal\, regulatory\, compliance and information technology matters. He is responsible for providing legal opinions and advice to the CEO and Board Members on a wide variety of legal matters related to all aspects of the Aviation Authority’s governance and operation of Tampa International\, Peter O Knight\, Plant City\, and Tampa Executive Airports. \nMichael has over 20 years of experience managing complex legal\, compliance\, human resources\, risk management and information technology issues. Prior to joining the Aviation Authority\, he served as the Chief Legal Counsel for the Hillsborough Regional Transit Authority (HART). Michael also served on active duty as a Captain and Trial Counsel in the U.S. Army Judge Advocate General Corp\, where he was appointed as a Special Assistant U.S. Attorney. Kathryn has worked for Prairie State Legal Services since 1991\, first as a staff attorney. From 2005 until 2020 she served as managing attorney of the Fox Valley office. She is now Director of Family Advocacy and supervises family law litigation across Prairie State’s offices. Kathryn has concentrated her work in family law\, and in particular in representation of victims of domestic violence. She has represented numerous clients in contested hearings and trials of family law matters. She also has served as supervisor of Prairie State’s domestic violence project located at the Kane County Courthouse. Kathryn is recognized as a leader among domestic violence advocates and attorneys in Kane County. She also has experience representing clients in other matters such as evictions and Social Security disability claims. \nTeri Dimmick\, Volunteer Court Appointed Special Advocate\nTeri Dimmick is an attorney who has volunteered as a Court Appointed Special Advocate (CASA) in a child abuse and neglect case since the summer of 2018. She is currently one of seven pro se law clerks in the United States District Court for the Central District of Illinois managing all cases prisoners file challenging the conditions of their confinement. As a pro se law clerk\, Teri has worked with all judges within the Central District\, but now primarily works for Judge James Shadid. Before joining the Central District\, she worked as an associate at Benassi & Benassi\, P.C. and handled complex labor and employment litigation. Teri’s first job after graduating from the University of Illinois College of Law\, magna cum laude\, was as an Assistant McLean County State’s Attorney handling cases ranging from misdemeanors to child sex abuse\, reckless homicide\, murder\, and a death penalty case. She also established the McLean County Domestic Violence Unit and was the first domestic violence prosecutor. Before becoming an attorney\, Teri earned a Bachelor’s Degree in journalism from the University of Missouri in Columbia and was a news anchor for WHOI-TV in Peoria\, Illinois. \nThe Honorable Sara Darrow\, Chief United States District Judge of the Central District of Illinois\nJudge Darrow has served as a district court judge in the Rock Island Division of the Central District of Illinois since 2011. She was nominated by President Barack Obama\, on the recommendation of Senator Dick Durbin. She was appointed Chief Judge in 2019. Judge Darrow has served on the Judicial Conference Committee on the Administration of the Bankruptcy System since 2017 and in 2019\, U.S. Supreme Court Chief Justice John Roberts appointed her Chair of the Committee. Prior to her judicial appointment\, Judge Darrow worked at the United States Attorney’s Office in Rock Island\, Illinois\, for eight years where she prosecuted significant federal crimes involving firearms\, drugs\, gangs\, fraud\, money laundering\, and corruption. She also coordinated the federal programs Project Safe Neighborhoods\, designed to reduce gun violence\, and Organized Crime Drug Enforcement Task Force\, designed to target major drug trafficking organizations. From 1999 to 2003\, Judge Darrow worked in the Henry County State’s Attorney’s Office in Cambridge\, Illinois\, where she became First Assistant State’s Attorney and tried major felony\, domestic violence\, and child exploitation cases. Judge Darrow also worked as a low-income community organizer in Washington\, DC\, between college and law school. Judge Darrow received her undergraduate degree from Marquette University and her law degree from Saint Louis University School of Law. Judge Darrow lives in Rock Island with her husband Clarence Darrow\, who serves as a Fourteenth Judicial Circuit Judge in Rock Island County. They have six children—three recent college graduate\, two current college students\, and one still living at home. \nMarcy Jacobs\, Third Judicial Circuit Family Violence Prevention Council and Oasis Women’s Center\nMarcy Jacobs has a bachelor’s degree in Liberal Arts from Western Illinois University. She began at Oasis Women’s Center in Alton\, Illinois as a volunteer in 1983. She has worked as a clerk\, a night manager\, a volunteer coordinator and now serves as Client Service Coordinator. She has had the privilege of working with thousands of victims of domestic violence over the years. Marcy is a licensed and certified Domestic Violence Professional with the State of Illinois. \nMeg Robertie\, Clerk of Court for the United States District Court for the Southern District of Illinois\nMeg Robertie is the Clerk of Court for the United States District Court for the Southern District of Illinois and a graduate of Bates College\, and St. Louis University School of Law. Upon graduation\, she worked in the U.S. Attorney’s Office for the Southern District of Illinois. In 1994\, Meg joined the U.S. District Court in East St. Louis as a law clerk\, working for district and magistrate judges. She later worked on the Court’s pro se team. In 2016\, Meg became Counsel to the Court and Director of Operations. In 2018\, she became Clerk of Court\, while continuing her role as Counsel to Chief Judge Nancy J. Rosenstengel. \nThe Honorable Nancy J. Rosenstengel\, Chief United States District Judge of the Southern District of Illinois \nJudge Rosenstengel is the Chief United States District Judge in the Southern District of Illinois. She received a Bachelor of Arts degree\, cum laude\, in 1990 from the University of Illinois at Urbana-Champaign and a Juris Doctorate\, cum laude\, in 1993 from Southern Illinois University School of Law. Before joining the bench\, she was a member of the Illinois and Missouri bars\, practicing litigation in state and federal courts in St. Louis\, Missouri. She later served as a career law clerk to United States District Judge G. Patrick Murphy\, and as Clerk of Court in the Southern District of Illinois\, a high-level administrative position. On November 7\, 2013\, President Obama nominated Judge Rosenstengel to serve as a United States District Judge. The Senate voted 95-0 for final confirmation on May 8\, 2014\, and she received her judicial commission on May 12\, 2014. Judge Rosenstengel is the first female district judge to serve in the Southern District of Illinois (and also was the first female to serve as Clerk of Court). In April 2019\, Judge Rosenstengel became Chief Judge for the Southern District of Illinois. She is the Past President of the local chapter of the Federal Bar Association and serves on several committees for the Seventh Circuit United States Court of Appeals. \nPhillip J. Voss\, Madison County Assistant State’s Attorney\, Domestic Violence Division\nPhillip J. Voss is an Assistant State’s Attorney in the Madison County State’s Attorney’s Office. He is in the specialized domestic violence unit and a member of the new Intimate Partner Violence (IPV) Task Force. Phillip has trained many people regarding domestic violence and increasing victim and community safety\, including law enforcement personnel with the Southern Illinois Law Enforcement Commission (SILEC).\nDebra Ward\, Counsel to the Clerk\, United States District Court\, Southern District of Illinois Debra Ward graduated from the University of Illinois at Urbana-Champaign with a bachelor’s degree in psychology and speech communications in 2001 and from Southern Illinois University School of Law in 2006. She has been working for the United States District Court for the Southern District of Illinois since 2009. During her employment with the court\, she has served as a judicial law clerk\, pro se staff attorney\, and is currently the court attorney. DESCRIPTION:Over the past 5 years there has a been an increasing focus and push at both the federal and state level to use the antitrust laws to attempt to restrain technology companies and their alleged anticompetitive power and growing power over consumers’ everyday life.  Those attempts\, however\, have run into the “consumer welfare” standard\, that has guided antitrust law for more than 40 years with a focus solely on whether alleged actions will result in higher prices to consumers.  This session will explore the current issues posed by “Big Tech”\, whether these issues actually cause harm to consumers\, whether existing laws are sufficient to address potential competition concerns\, and whether changes are necessary to the current antitrust laws. \nPresented by the Antitrust & Trade Regulation Section \n\nAbout the Presenters\nRobert Hauberg\, Senior Counsel\, Baker Donelson (Moderator) \nAs former chair of the firm’s Government Enforcement and Investigations practice group\, Robert concentrates his practice in antitrust\, securities\, False Claims Act and RICO litigation and white collar crime\, including congressional investigations and internal investigations. \nHe has handled dozens of grand jury investigations\, criminal trials\, civil trials involving mergers\, price fixing\, anticompetitive conduct\, financial institutions\, RICO\, false claims by government contractors\, whistleblowers\, and bribery of public officials.  Before private practice\, Robert served as a federal prosecutor: AUSA in DC; senior official in the Antitrust Division (Communications and Finance Section) and Criminal Division (Fraud Section\, Dallas Bank Fraud Task Force) of DOJ. \nRobert is chair of the Federal Bar Association Antitrust and Trade Regulation Section.  Previously he served as chair of the District of Columbia Bar’s Antitrust and Consumer Law Community and the American Bar Association’s Antitrust Section Committees on Compliance and Ethics and on Financial Institutions. \nJames Tierney\, Partner\, Orrick Herrington & Sutcliffe LLP \nJim served in the Department of Justice’s Antitrust Division for more than 25 years\, the last 10 of which he ran the Technology & Financial Services section (formerly the Networks and Technologies Section or Net Tech) that oversaw the review\, investigation and litigation of every major strategic technology transaction and conduct issue\, including those involving the big 5 tech industry leaders. Reaching beyond just technology\, Jim also oversaw matters in the areas of financial services\, securities industries\, and professional associations. \nJim brings this vast experience to Orrick’s large technology clients and advises them on navigating the tricky waters of government investigations of business activities with antitrust implications like mergers\, joint ventures\, and single-firm conduct. He knows how the DOJ will view proposed transactions\, what issues are likely to trip up a deal or investigation and has relationships throughout the DOJ to get things done. And while Jim served as head of Technology & Financial Services\, he worked closely with his counterparts in competition agencies around the world and is able to draw on those invaluable relationships in foreign jurisdictions. His ability to anticipate problems that he saw while sitting on the other side of the table has allowed him to successfully gain merger clearance for Microsoft’s acquisition of GitHub and Cisco’s acquisition of Viptela\, as well as resolving numerous technology matters for AT&T\, Cerence\, eBay\, Netflix\, Sonos and others. \n\n\nEric Grannon\, Partner\, White & Case LLP \nEric helps clients with antitrust matters\, including civil and criminal defense as well as counseling for mergers and acquisitions\, settlements of pharmaceutical patent litigation\, and strategic planning. Dana works on and oversees antitrust matters as well as data breach and Arizona’s Fintech Sandbox program. These antitrust matters include the Generic Drug Pharmaceuticals litigation alongside other State Attorneys General\, the Facebook antitrust litigation alongside other State Attorneys General and the FTC\, and the Google litigation alongside other State Attorneys General and the DOJ. Dana has also participated in Arizona-specific antitrust investigations and litigation such as the investigation into whether dental suppliers were illegally preventing a new entrant from entering the market. Dana has also worked on Class Action Fairness Act matters in the US Supreme Court and the US Court of Appeals for the Ninth\, Sixth\, and Third Circuit. \n  \nDana joined the Arizona Attorney General’s Office in 2013 as an Assistant Attorney General in the Antitrust Unit of the Civil Litigation Division. SUMMARY:Webinar: A SCOTUS Review of IP Cases in the Recent 2020 Term and its Implications for Constitutional Jurisprudence in Other Areas of Law
DESCRIPTION:As has been the case in several of the past terms\, the U.S. Supreme Court has rendered decisions involving intellectual property law issues that have broader implications which also touch upon other areas of law. So too\, in this most recent term\, with the Court’s opinions in United States v. Arthrex\, Inc. et al.\, 141 S.Ct. 1970 (2021) (Constitutionality of APJs under the Appointments Clause); Google LLC v. Oracle America\, Inc.\, 141 S.Ct. 1183 (2021) (Copyright fair use and application programming interface software (“API”)); and Minerva Surgical\, Inc. v. Hologic\, Inc.\, et al. 141 S.Ct. 2298 (2021) (assignor estoppel). This webinar will discuss these Supreme Court decisions within the IP law context as well as the potential impact of the decisions on other areas of law. \nThe webinar will also take a forward look at the next term for a case that\, although it was not decided in the current term\, and the petition for certiorari is still pending\, the Court has invited the Solicitor General to weigh in on at the petition stage. The American Axle & Manufacturing\, Inc. v. Neapco Holdings LLC\, et al.\, No. 20-891\, U.S. Sup. Ct. (March 1\, 2021)\, has generated a considerable amount of attention since it concerns a highly controversial issue of patent eligibility that continues to stymie congressional patent law reform efforts\, and which has a direct impact on U.S. economic and national security interests as well as innovators\, investors\, and entrepreneurs across the entire spectrum of industries from Pharma to Big Tech. \nPresented by the Intellectual Property Section \n\nAbout the Presenter\nRobert J. Rando\, Partner\, Greenspoon Marder LLP \nRobert Rando is a partner with the Greenspoon Marder’s Intellectual Property Department. Mr. Rando focuses his practice on patent and other intellectual property infringement disputes and counseling. He is experienced in a wide range of current and emerging technologies\, including computer hardware and software\, silicon chip manufacturing\, biotechnology products\, medical devices\, pharmaceuticals\, chemical compounds\, food additives\, alternative energy products\, consumer electronics\, communications\, security\, Internet\, and e-commerce. \nMr. Rando has more than 30 years of federal civil litigation experience and has litigated disputes in the Southern District of New York (“SDNY”)\, the Eastern District of New York (“EDNY”)\, and several other United States District Courts across the country. Mr. Pauw will discuss exhaustion of domestic remedies\, the procedure for bringing claims to the IACHR\, and the enforceability of decisions issued by international tribunals. Although under the Constitution international law is part of “the supreme Law of the Land\,” courts and agencies may be reluctant to follow requirements of international law. Often international law is not directly enforceable in United States courts and it can be difficult to convince courts and agencies to follow international law norms. Mr. Pauw will discuss how\, in spite of these difficulties\, international law may be useful for purposes of constitutional and statutory interpretation\, and ways to facilitate consideration of international law by courts and agencies. Putnam has been appointed as the Deputy General Counsel for the U.S. Department of Transportation\, and will serve as the Acting General Counsel.  In this role\, he works closely with the Department’s senior leadership and nearly 500 attorneys to manage legal and policy matters concerning all of the Department’s operating administrations. \nPrior to joining the Biden Administration\, John worked most of his career as a transportation\, environment\, and energy attorney in Denver and Washington\, DC. He represented State departments of transportation\, local governments\, transportation agencies\, and private entities in Colorado and nationwide on a range of transportation\, energy\, environmental issues under the Federal transportation laws\, the Clean Air Act\, the National Environmental Policy Act\, and the Clean Water Act. \nMost recently\, John was the Director of Environmental Programs for the Colorado Department of Public Health and Environment (CDPHE). Ruge-Hudson serves as the Counselor to the Inspector General.  In this role\, she provides legal and policy advice to the Inspector General on a wide variety of topics\, including issues related to protecting the office’s independence.  Her primary duty is to support and assist the Inspector General as he executes his oversight responsibilities under the GPO Inspector General Act of 1988 and the Inspector General Act of 1978.  She also works closely with the Assistant Inspector’s General on matters related to audits\, inspections\, investigations\, and other oversight activities. \nRuge-Hudson has been in the Inspector General Community since 2010\, when she joined the U.S. Office of Personnel Management Office of the Inspector General.  While at OPM OIG\, she was the Senior Counsel for Legislative and External Affairs and oversaw all Congressional and media outreach efforts.  She left OPM OIG in 2019 to join the Defense Digital Service\, a small office reporting directly to the Secretary of Defense\, charged with bringing IT practices from the private sector to the Department of Defense. \nPrior to joining the Federal Government\, Ruge-Hudson worked at private law firms\, specializing in tax law.  She has a Bachelor of Science in Politics from Washington & Lee University\, a J.D. from Columbia Law School\, and an LL.M in Taxation from Georgetown University Law Center. \nTanner Horton-Jones\, Senior Counsel with U.S. Agency for International Development OIG’s Office of General Counsel \nAs senior counsel with USAID OIG’s Office of General Counsel\, Tanner leads a team of three attorneys with a primary focus on meeting the legal needs of the Office of Audit and Office of Management.  The team supplies research and advice to each audit from its inception through the closure of its recommendations\, along with support for OIG’s contracting unit\, learning and development program\, IT team\, internal policy management\, and other core administrative functions.  Additionally\, Tanner is the legal liaison for USAID OIG’s unique work providing oversight of U.S. overseas contingency operations in partnership with the Inspectors General for the Departments of State and Defense.  He also serves as the OIG’s Whistleblower Protection Coordinator\, ensuring that the OIG fulfills its obligation to educate employees about whistleblower rights and properly respond to retaliation complaints.  He is actively involved in the OIG community\, including teaching courses through the CIGIE Training Institute. \nTanner holds a J.D. from American University Washington College of Law and is licensed to practice law by the State of Maryland.  He completed his undergraduate studies at Sewanee\, where he studied French and Political Science. \nKevin Miller\, Counsel to the Inspector General\, Farm Credit Administration \nKevin T. Miller serves as Counsel to the Inspector General at the Farm Credit Administration\, an independent agency tasked with regulating and supervising the Farm Credit System\, a nationwide network of borrower-owned financial institutions that provide credit and related services to agriculture and rural America. She served two years as the Acting Senior Legal Officer for Trial Chamber III at the Yugoslavia Tribunal.  As the Chief Court Management Services Section at the Lebanon and Yugoslavia Tribunals\, she was responsible for the electronic filing and evidence systems\, and the support teams comprised of lawyers and other legal support staff proving in court services which operated in English\, French and Arabic or Bosnian-Croatian-Serbian. While at the Special Tribunal for Lebanon she was also designated as the Independent Commissioner and\, upon assignment\, investigated allegations of misconduct involving defence (European spelling convention) counsel and legal representatives of victims who appear before the Tribunal. While at the Yugoslavia Tribunal\, she led teams totaling about 40 staff involved in the daily operation of the courtrooms in which the trials of alleged war criminals were being conducted under the mandate of the United Nations Security Council. Previously\, Steve served as a law clerk to Judge Harry Edwards of the D.C. Circuit and to Judge Jesse Furman of the Southern District of New York. He holds a J.D. from New York University School of Law\, where he was a Root-Tilden-Kern public interest scholar and Articles Editor of the Law Review\, and a B.A. from Princeton University. \nJason Tulley\, Supervising Attorney and Former Training Director\, Trial Division \nJason D. Tulley is currently a Supervisor in the Trial Division at the Public Defender Service for the District of Columbia (PDS). Prior to that he was the Training Director where he trained all the new attorney at PDS for five years and trained over one hundred of the court appointed private attorneys in Superior Court. For the five years before that\, Mr. Tulley was Special Counsel for Forensics and Expert services where he led the organization’s nationally renowned Forensic Practice Group which focuses on litigation of science issues from DNA to fingerprints to the psychology of eyewitness identification and manages the agency’s budget for expert witnesses.  Mr. Tulley has been at PDS for eighteen years where he has tried murder\, sexual assault\, and other major felony cases as well as worked on the forensic issues for the D.C. exoneration cases which led to the FBI Hair review.  He is also past Chair of NACDL’s Forensic Science Committee\, where he worked on a national level to ensure scientifically sound forensic practices and education for the defense bar in all forensic disciplines.  Prior to working in D.C.\, Mr. Tulley was an attorney in the Trial Division of New York City’s Capital Defender Officer\, where as a Deputy Capital Defender he represented indigent persons facing death penalty charges.  Before moving to New York\, Mr. Tulley was an associate for Bennett & Nathans\, LLP\, a small Maryland law firm that handled state and federal civil and criminal cases\, including a substantial capital defense practice.  He graduated from the State University of New York at Binghamton in 1992\, and then the University of Maryland School Of Law in 1995. \nJennifer Williams\, Staff Attorney\, Appeals \nInterested in one of our other PDSDC divisions – Parole\, Juvenile Services\, Prisoner Reentry Legal Services\, Mental Health\, Civil Legal Services (including special education and immigration)?
