SUMMARY:Webinar: A SCOTUS Review of IP Cases in the Recent 2020 Term and its Implications for Constitutional Jurisprudence in Other Areas of Law
DESCRIPTION:As has been the case in several of the past terms\, the U.S. Supreme Court has rendered decisions involving intellectual property law issues that have broader implications which also touch upon other areas of law. So too\, in this most recent term\, with the Court’s opinions in United States v. Arthrex\, Inc. et al.\, 141 S.Ct. 1970 (2021) (Constitutionality of APJs under the Appointments Clause); Google LLC v. Oracle America\, Inc.\, 141 S.Ct. 1183 (2021) (Copyright fair use and application programming interface software (“API”)); and Minerva Surgical\, Inc. v. Hologic\, Inc.\, et al. 141 S.Ct. 2298 (2021) (assignor estoppel). This webinar will discuss these Supreme Court decisions within the IP law context as well as the potential impact of the decisions on other areas of law. \nThe webinar will also take a forward look at the next term for a case that\, although it was not decided in the current term\, and the petition for certiorari is still pending\, the Court has invited the Solicitor General to weigh in on at the petition stage. The American Axle & Manufacturing\, Inc. v. Neapco Holdings LLC\, et al.\, No. 20-891\, U.S. Sup. Ct. (March 1\, 2021)\, has generated a considerable amount of attention since it concerns a highly controversial issue of patent eligibility that continues to stymie congressional patent law reform efforts\, and which has a direct impact on U.S. economic and national security interests as well as innovators\, investors\, and entrepreneurs across the entire spectrum of industries from Pharma to Big Tech. \nPresented by the Intellectual Property Section \n\nAbout the Presenter\nRobert J. Rando\, Partner\, Greenspoon Marder LLP \nRobert Rando is a partner with the Greenspoon Marder’s Intellectual Property Department. Mr. Rando focuses his practice on patent and other intellectual property infringement disputes and counseling. He is experienced in a wide range of current and emerging technologies\, including computer hardware and software\, silicon chip manufacturing\, biotechnology products\, medical devices\, pharmaceuticals\, chemical compounds\, food additives\, alternative energy products\, consumer electronics\, communications\, security\, Internet\, and e-commerce. \nMr. Rando has more than 30 years of federal civil litigation experience and has litigated disputes in the Southern District of New York (“SDNY”)\, the Eastern District of New York (“EDNY”)\, and several other United States District Courts across the country. In addition to intellectual property matters\, Mr. Rando has also handled litigation matters involving antitrust\, civil rights\, complex commercial disputes\, class action product liability\, employment discrimination and other employment disputes\, and ERISA cases.  Mr. Rando also has extensive appellate court experience\, including having served as counsel of record or co-counsel on numerous Amicus brief filings before the United States Supreme Court and Federal Circuit on various intellectual property\, constitutional and administrative law issues from 2006 to the present. \nMr. Rando began his legal career as an Associate with Skadden Arps\, later moving to Kenyon & Kenyon. Prior to joining Greenspoon Marder\, Mr. Rando founded and led his own firm for nearly 25 years. Before attending law school\, he served as a Systems Analysis Engineer at Sperry Corporation\, now a part of Lockheed Martin. SUMMARY:Webinar: The Use of International Law in Domestic Courts and International Tribunals
DESCRIPTION:Robert “Bob” Pauw\, a partner with Gibbs Houston Pauw in Seattle\, Washington\, will focus on the use of international law in U.S. domestic courts and at the Inter American Commission on Human Rights (IACHR). Mr. Pauw will discuss exhaustion of domestic remedies\, the procedure for bringing claims to the IACHR\, and the enforceability of decisions issued by international tribunals. Although under the Constitution international law is part of “the supreme Law of the Land\,” courts and agencies may be reluctant to follow requirements of international law. Often international law is not directly enforceable in United States courts and it can be difficult to convince courts and agencies to follow international law norms. Mr. Pauw will discuss how\, in spite of these difficulties\, international law may be useful for purposes of constitutional and statutory interpretation\, and ways to facilitate consideration of international law by courts and agencies. Ruge-Hudson serves as the Counselor to the Inspector General.  In this role\, she provides legal and policy advice to the Inspector General on a wide variety of topics\, including issues related to protecting the office’s independence.  Her primary duty is to support and assist the Inspector General as he executes his oversight responsibilities under the GPO Inspector General Act of 1988 and the Inspector General Act of 1978.  She also works closely with the Assistant Inspector’s General on matters related to audits\, inspections\, investigations\, and other oversight activities. \nRuge-Hudson has been in the Inspector General Community since 2010\, when she joined the U.S. Office of Personnel Management Office of the Inspector General.  While at OPM OIG\, she was the Senior Counsel for Legislative and External Affairs and oversaw all Congressional and media outreach efforts.  She left OPM OIG in 2019 to join the Defense Digital Service\, a small office reporting directly to the Secretary of Defense\, charged with bringing IT practices from the private sector to the Department of Defense. \nPrior to joining the Federal Government\, Ruge-Hudson worked at private law firms\, specializing in tax law.  She has a Bachelor of Science in Politics from Washington & Lee University\, a J.D. from Columbia Law School\, and an LL.M in Taxation from Georgetown University Law Center. \nTanner Horton-Jones\, Senior Counsel with U.S. Agency for International Development OIG’s Office of General Counsel \nAs senior counsel with USAID OIG’s Office of General Counsel\, Tanner leads a team of three attorneys with a primary focus on meeting the legal needs of the Office of Audit and Office of Management.  The team supplies research and advice to each audit from its inception through the closure of its recommendations\, along with support for OIG’s contracting unit\, learning and development program\, IT team\, internal policy management\, and other core administrative functions.  Additionally\, Tanner is the legal liaison for USAID OIG’s unique work providing oversight of U.S. overseas contingency operations in partnership with the Inspectors General for the Departments of State and Defense.  He also serves as the OIG’s Whistleblower Protection Coordinator\, ensuring that the OIG fulfills its obligation to educate employees about whistleblower rights and properly respond to retaliation complaints.  He is actively involved in the OIG community\, including teaching courses through the CIGIE Training Institute. \nTanner holds a J.D. from American University Washington College of Law and is licensed to practice law by the State of Maryland.  He completed his undergraduate studies at Sewanee\, where he studied French and Political Science. \nKevin Miller\, Counsel to the Inspector General\, Farm Credit Administration \nKevin T. Miller serves as Counsel to the Inspector General at the Farm Credit Administration\, an independent agency tasked with regulating and supervising the Farm Credit System\, a nationwide network of borrower-owned financial institutions that provide credit and related services to agriculture and rural America. He provides legal and other advice to the Inspector General and Office of Inspector General staff concerning audits\, inspections\, evaluations\, investigations\, and other matters relevant to the office’s oversight responsibilities. \nBefore joining the FCA OIG in 2018\, Miller worked as an attorney-advisor in the U.S. Office of Personnel Management OIG. Previously\, Steve served as a law clerk to Judge Harry Edwards of the D.C. Circuit and to Judge Jesse Furman of the Southern District of New York. He holds a J.D. from New York University School of Law\, where he was a Root-Tilden-Kern public interest scholar and Articles Editor of the Law Review\, and a B.A. from Princeton University. \nJason Tulley\, Supervising Attorney and Former Training Director\, Trial Division \nJason D. Tulley is currently a Supervisor in the Trial Division at the Public Defender Service for the District of Columbia (PDS). Prior to that he was the Training Director where he trained all the new attorney at PDS for five years and trained over one hundred of the court appointed private attorneys in Superior Court. For the five years before that\, Mr. Tulley was Special Counsel for Forensics and Expert services where he led the organization’s nationally renowned Forensic Practice Group which focuses on litigation of science issues from DNA to fingerprints to the psychology of eyewitness identification and manages the agency’s budget for expert witnesses.  Mr. Tulley has been at PDS for eighteen years where he has tried murder\, sexual assault\, and other major felony cases as well as worked on the forensic issues for the D.C. exoneration cases which led to the FBI Hair review.  He is also past Chair of NACDL’s Forensic Science Committee\, where he worked on a national level to ensure scientifically sound forensic practices and education for the defense bar in all forensic disciplines.  Prior to working in D.C.\, Mr. Tulley was an attorney in the Trial Division of New York City’s Capital Defender Officer\, where as a Deputy Capital Defender he represented indigent persons facing death penalty charges.  Before moving to New York\, Mr. Tulley was an associate for Bennett & Nathans\, LLP\, a small Maryland law firm that handled state and federal civil and criminal cases\, including a substantial capital defense practice.  He graduated from the State University of New York at Binghamton in 1992\, and then the University of Maryland School Of Law in 1995. \nJennifer Williams\, Staff Attorney\, Appeals \nInterested in one of our other PDSDC divisions – Parole\, Juvenile Services\, Prisoner Reentry Legal Services\, Mental Health\, Civil Legal Services (including special education and immigration)? She also worked on various domestic policy issues at the White House where she served as a staff assistant in both the Domestic Policy Council and Presidential Correspondence offices. She received her MBA in International Business from the University of Edinburgh and a BA in Political Science from the University of California\, Irvine. \nDonna M. Murphy\, Deputy Comptroller for Compliance Risk Policy\, Office of the Comptroller of the Currency\, U.S. Department of the Treasury \nDonna Murphy is Deputy Comptroller for Compliance Risk Policy at the Office of the Comptroller of the Currency\, where she oversees the development of policy and examination procedures for Bank Secrecy Act and anti-money laundering issues\, as well as consumer compliance\, fair lending\, and the Community Reinvestment Act.  She regularly represents the OCC in these areas\, including on the Treasury Secretary’s Bank Secrecy Act Advisory Committee (BSAAG).  Previously\, Donna served as Director of the OCC’s Community and Consumer Law Division\, overseeing legal interpretations\, advice and support on consumer protection\, fair lending\, and community reinvestment issues for the agency.  She also served for more than two decades in the Civil Rights Division of the United States Justice Department\, including as deputy chief in the Housing\, Special Litigation and Voting Sections.  She received her degrees from Yale Law School and the American University in Washington\, D.C. \nAndrea Sharrin\, Managing Director\, Head of Financial Crimes\, Americas and Investment Bank\, Barclays \nAndrea Sharrin is a Managing Director and Head of Financial Crime for the Americas and Investment Bank at Barclays. She is responsible for overseeing the Anti-Money Laundering\, Sanctions and Anti-Bribery and Corruption Compliance programs for businesses operating within the Americas region and for the Investment Bank globally. The panel will also provide practical tips and considerations for LGBTQ+ employees facing discrimination issues in the workplace. \nPresented by the LGBTQ+ Law Section \n\nAbout the Presenters\nChristine E. Dieter\, Associate\, Hinckley Allen (Moderator) \nChristine is an Associate in the firm’s Environmental and Energy Practice Groups and Litigation practice. She has experience litigating in state and federal courts and before administrative agencies. Christine has worked on permitting matters for offshore wind farms and worked on litigation relating to the cleanup of contaminated land. \nChinyere Ezie\, Senior Staff Attorney\, Center for Constitutional Rights \nChinyere Ezie is a Senior Staff Attorney at the Center for Constitutional Rights\, where she advocates for racial justice\, gender justice\, Lesbian\, Gay\, Bisexual\, Transgender\, Queer\, and Intersex (LGBTQI) rights\, and challenges governmental abuses of power. Chinyere is lead counsel for transgender rights activist Ashley Diamond in her pathbreaking lawsuits against the Georgia Department of Corrections. She is also the originator of #BoycottPrada\, a viral campaign that led luxury fashion house Prada to change the way it does business when it comes to racial equity and inclusion. Prior to joining the Center for Constitutional Rights\, Chinyere worked at the Southern Poverty Law Center where she brought cases defending the rights of LGBTQI Southerners. She also served as a Trial Attorney at the U.S. Equal Employment Opportunity Commission\, where she litigated employment discrimination cases and secured a $5.1 million jury verdict and historic injunction on behalf of workers who were subjected to religious harassment. Chinyere is a frequent speaker at law conferences and her advocacy has been reported on by the New York Times\, Washington Post\, CNN\, NBC\, and NPR\, among others. \nOmar Gonzalez-Pagan\, Senior Attorney and Health Care Strategist\, Lambda Legal (Speaker) \nOmar Gonzalez-Pagan is a Senior Attorney and the Health Care Strategist at Lambda Legal\, the oldest and largest national legal organization committed to achieving full recognition of the civil rights of LGBTQ people and people living with HIV. He has played a critical role in advancing the rights of LGBTQ people under the U.S. Constitution and federal civil rights laws in virtually every aspect of our lives\, including education\, employment\, health care\, and housing. \nJennifer L. Levi\, Transgender Rights Project Director\, GLAD (Speaker) \nJennifer L. Levi is the director of GLAD’s Transgender Rights Project and a nationally recognized expert on transgender legal issues.  Levi’s precedent-setting transgender rights cases include: O’Donnabhain v. Commissioner of Internal Revenue (2010)\, which established that medical care relating to gender transition qualifies for a medical tax deduction; Adams v. Bureau of Prisons (2011)\, which successfully challenged a federal prison policy excluding medical care for transgender inmates who came into the system without a transition-related medical plan; and Doe v. DESCRIPTION:Have you wondered what pro bono work is going on with respect to the LGBTQ+ community?  Are you interested in hearing about some of the frontline work ongoing around the country in various organizations?  This webinar will feature prominent speakers who perform legal work for members of the LGBTQ+ community who are facing issues in areas such as immigration\, asylum\, gender identity\, and child custody\, among others.  The goal of this presentation is to provide the audience an insider’s view as to what LGBTQ+ focused pro bono work looks like in different areas of law\, show how legal organizations partner with law firms to provide meaningful representation to LGBTQ+ individuals and families\, and offer practical tips for those who want to engage in this work\, regardless of their practice setting. \nPresented by the LGBTQ+ Law Section’ \n\nAbout the Presenters:\nChirag G. Badlani\, Partner\, Hughes Socol Piers Resnick & Dym\, Ltd; Section Immediate Past Chair\nChirag is a Partner of Hughes Socol Piers Resnick & Dym\, Ltd in Chicago\, Illinois. He represents clients in a wide variety of civil matters\, with a focus in the areas of civil rights\, constitutional law\, labor and employment\, and commercial litigation. He also represents clients in asylum and refugee matters. He joined the firm in 2012. Mr. Badlani graduated magna cum laude from New York University School of Law (J.D. 2008)\, where he served as a Production Editor for the Journal of International Law and Politics and as a Competitions Research and Writing Editor for the Moot Court Board. During law school\, Mr. Badlani worked at NYU’s Immigrant Rights Clinic. He received his B.A. from Yale College (B.A. 2003). Prior to joining the firm\, Mr. Badlani was a law clerk to the Honorable Ann Claire Williams\, United States Court of Appeals for the Seventh Circuit\, and to the Honorable Allyne Ross\, the United States District Court for the Eastern District of New York. He also worked as a Planning Associate at the Vera Institute of Justice\, in the Center on Immigration and Justice. \nCurrey Cook\, Senior Counsel and Youth in Out-of-Home Care Project Director\, Lambda Legal \nCurrey Cook is the Director of the Youth in Out-of-Home Care Project and Counsel in the National Headquarters Office of Lambda Legal\, the oldest and largest national legal organization committed to achieving full recognition of the civil rights of lesbians\, gay men\, bisexuals\, transgender people and people with HIV. \n  \nBrandon King\, Associate\, Baker & McKenzie LLP; Section Chair\nBrandon King is an associate in Baker McKenzie’s Tax Practice Group in Washington\, DC. He focuses on tax controversy and tax planning. Prior to joining the Firm\, Brandon was a law clerk for the Honorable Albert G. Lauber at the United States Tax Court. He also served as a Presidential Personnel Associate in the Obama administration\, where he was the tax advisor on the vetting team for presidential nominations. \n  \nTania Linares Garcia\, Senior Litigation Attorney\, National Immigrant Justice Center \nA senior attorney with NIJC’s Federal Litigation Project and LGBT Immigrant Rights Initiative. Prior to joining NIJC\, Tania served as a staff attorney at the Northwest Immigrant Rights Project in Granger\, Washington. She earned her J.D.\, magna cum laude\, from Southern Illinois University.
