McMurry\, Partner\, Dinsmore & Shohl LLP (Moderator) \nGlen focuses his practice on federal and commercial litigation. His experience includes handling business\, finance and contract disputes\, employment issues\, construction claims\, insurance claims/defense\, and mergers and acquisitions. \nHe attended Kansas State University and graduated with a B.S. degree in Political Science in 2004 before continuing his education at the University of Dayton School of Law\, where he received his J.D. in 2007. Glen was a staff writer for the University of Dayton Law Review and a member of the Moot Court board. In 2017\, he attended Pepperdine Law School’s Straus Institute for Dispute Resolution and received intensive mediation training. \nHis scholarly writings have been published in several local and national publications\, including the University of Dayton Law Review\, the Dayton Bar Association’s Bar Briefs\, the Federal Bar Association’s Divisions Digest\, the Federal Bar Association’s Federal Lawyer and Wolters Kluwer’s Computer & Internet Lawyer. \nGlen is active in several local and national bar associations. He serves as one of the chairs of the Dayton Bar Association’s Federal Practice Committee and is a member of the Certified Grievance Committee. He is a past president of the Dayton Chapter of the Federal Bar Association. He currently serves as a national director of the Federal Bar Association and is the former chair of the Federal Bar Association’s Younger Lawyer Division. He also maintains membership in the Ohio State Bar Association and Miami County Bar Association. \nBob Bacharach\, Judge of the Tenth Circuit Court of Appeals \nJudge Bacharach was appointed in February 2013 as a United States Circuit Judge for the Tenth Circuit Court of Appeals. He graduated with High Honors from the University of Oklahoma with  B.A. in History and the Tom Lottinville Award for the Best Essay submitted in the History Department. He obtained his Juris Doctorate from Washington University School of Law in St. Louis in 1985\, where he graduated order of the coif and was awarded the Breckenridge Scholarship for the second highest grade average in his senior year of law school. In law school at Washington\nUniversity\, he also served as the Developments Editor of the Washington University Law Quarterly (now named the Washington University Law Review) and was awarded the Mary Collier Hitchcock Prize for writing for the best Note (student article) in the law review. \nUpon graduation from law school\, Judge Bacharach clerked from 1985 to 1987 for Judge William J. Holloway\, Jr.\, who was then the Chief Judge of the Tenth Circuit Court of Appeals. After completing this clerkship\, Judge Bacharach practiced civil litigation at Crowe & Dunlevy in Oklahoma City\, Oklahoma from 1987 to 1999. He then served as a U.S. Magistrate Judge in the Western District of Oklahoma until 2013\, when he was appointed to the Tenth Circuit Court of Appeals. \nJudge Bacharach authored the recently published book on legal writing\, Legal Writing: A Judge’s Perspective on the Science and Rhetoric of the Written Word\, published by ABA Press. He has also authored “Section 1983 and the Availability of a Federal Forum: A Reappraisal of the Police Brutality Cases\,” 16 Memphis State University Law Review 353 (1986); “Section 1983 and an\nAdministrative Exhaustion Requirement\,” 40 Oklahoma Law Review 407 (1987); “Motions in Limine in Oklahoma State and Federal Courts\,” 24 Oklahoma City University Law Review 113 (1999); “Dirks v. SEC=s Footnote Fourteen: Horizontal and Vertical Reach\,” 62 Washington University Law Quarterly 477 (1984); and “Post-Trial Juror Interviews by the Press: The Fifth Circuit= Approach\,” 62 Washington University Law Quarterly 783 (1985). Sessions typically focus on a single federal district and feature an experienced local panel that includes an Assistant U.S. Attorney for the district; a federal judge; a relator-side attorney; and a defense attorney. \n“FCA Today” sessions currently are being conducted online via Zoom\, and do not offer CLE credit. This session will focus on FCA practice in the District of Massachusetts. \n\nAbout the Presenters\nR. Scott Oswald – Chair\, FBA Qui Tam Section (moderator) \nScott Oswald is an accomplished trial lawyer who has brought more than 40 trials to verdict. His cases have recovered more than $300 million in judgments and settlements. A fellow of the prestigious College of Labor and Employment Lawyers\, he received his law degree from Howard University and honed his skills at Trial Lawyers College\, founded by the legendary Gerry Spence. Mr. Oswald litigates employment and whistleblower actions nationwide. Among his results: \n\nFirst jury verdict under new whistleblower protections in the National Defense Authorization Act of 2013|\nFirst Sarbanes-Oxley Act liability verdict to withstand appeal\nFirst jury verdict under 2009 anti-retaliation provisions of False Claims Act\nFirst Dodd-Frank Act retaliation lawsuit to reach discovery in federal court\n\nMr. Oswald is chair of the Federal Bar Association’s Qui Tam Section and immediate past chair of the FBA’s Professional Ethics Committee. Lawdragon ranks him as one of the top 500 plaintiff-side employment lawyers in the country. \n \nAmy Crafts\, Division Chief\, False Claims Division\, Massachusetts Office of the Attorney General \nAmy Crafts is an Assistant Attorney General and Chief of AG Healey’s False Claims Division\, which enforces the Massachusetts False Claims Act to achieve accountability and fair and honest conduct from providers of government services in health care\, information technology\, environmental protection\, employment practices\, public construction and beyond. Ms. Crafts has also served as Deputy Chief of the False Claims Division\, as an Assistant Attorney General in the Consumer Protection Division and as a Special Assistant District Attorney in the Suffolk County District Attorney’s Office.  Prior to joining the Massachusetts Attorney General’s Office\, Ms. Crafts was an associate in the Boston office of Proskauer Rose LLP. \nErica Blachman Hitchings\, Member\, Whistleblower Law Collaborative LLC \nErica Blachman Hitchings became a member of the Whistleblower Law Collaborative\, LLC after nearly nine years in the U.S. Department of Justice where she successfully investigated\, litigated\, and settled a wide range of False Claims Act cases. \nMs. Hitchings joined the Department of Justice as a member of the Attorney General’s Honors Program in 2009\, after spending two years clerking for the Honorable Patti B. Saris\, United States District Judge of the United States District Court for the District of Massachusetts.  She first served as a Trial Attorney in the Civil Fraud section in Washington\, D.C. and then as an Assistant U.S. Attorney in the Northern District of California.  Over the course of her career at DOJ\, Ms. Hitchings conducted dozens of health care\, procurement\, and other fraud investigations that resulted in the recovery of hundreds of millions of dollars by the United States.  Ms. Hitchings is a frequent speaker on False Claims Act topics and teaches Health Care Fraud and Abuse at Boston University School of Law. \nGregg Shapiro\, Civil Enforcement Chief\, U.S. Attorney’s Office for the District of Massachusetts  \nGregg Shapiro is Chief of the Affirmative Civil Enforcement Unit in the United States Attorney’s Office for the District of Massachusetts.  During his DOJ career\, he has served as lead counsel on matters that resulted in over $3 billion in health care fraud recoveries\, and he has overseen RMBS and other enforcement matters that generated over $5 billion in additional recoveries.  For part of 2020\, Mr. Shapiro was on detail to the Special Inspector General for Pandemic Recovery. \n \nIan Marinoff\, Managing Attorney\, Medicaid Fraud Division\, Massachusetts Office of the Attorney General \nIan Marinoff is a Managing Attorney in the Office of Attorney General Maura Healey\, Medicaid Fraud Division\, which he joined in 2011. During his tenure\, he has conducted investigations and brought enforcement actions involving various provider types\, including nursing homes\, personal care attendants\, physicians\, and transportation providers. Mr. Marinoff has also prosecuted multimillion-dollar criminal cases\, including MFD’s first indictments for money laundering. Before joining the Attorney General’s Office\, Mr. Marinoff was an associate at a large Boston firm and prosecutor at the Suffolk County District Attorney’s Office. \nHon. Patti B. Saris\, U.S. District Judge\, D. Mass. \nUnited States District Judge Patti B. Saris served as Chief Judge of the United States District Court for the District of Massachusetts from 2013-2019. She became Chair of the United States Sentencing Commission in Washington\, DC in January\, 2011 and served until 2017. In 1986\, Judge Saris became a United States Magistrate Judge\, and in 1989\, she was appointed as an Associate Justice of the Massachusetts Superior Court. Sabrina’s scholarship focuses on the intersection of gender\, race\, and citizenship in immigration policy and enforcement; her previous law review articles focus on trafficking\, labor exploitation\, and derivative visa status issues. \nKevin A. Gregg is a partner with Kurzban Kurzban Tetzeli & Pratt\, practicing in all areas of immigration law\, including removal defense\, appellate advocacy\, federal court litigation\, and USCIS representation. Prior to joining KKTP\, Kevin was a Judicial Clerk with the Honorable Beth F. With the passage of the Defend Trade Secrets Act (“DTSA”)\, more of these types of cases are being filed in federal court by employers against former employees. The law regarding duty of loyalty differs from state to state\, but in most jurisdictions an employee cannot compete with their employer while still employed but may prepare to compete. There can be confusion as to whether a duty of loyalty exists in the absence of any fiduciary duty. There is also uncertainty as to available remedies\, including damages\, disgorgement\, and the ability to seek injunctive relief. We survey the law of various states and how they differ\, including recent federal and state court decisions in this area. We will also discuss topics particular to federal practice\, such as which state’s laws apply for common law claims in conjunction with a breach of contract claim containing a choice-of-law provision; whether the DTSA preempts certain duty-of-loyalty claims; and whether a claimed breach of the duty of loyalty can be a “faithless servant” defense to a wage claim under the Fair Labor Standards Act. DESCRIPTION:Thursday\, February 25 | 5:30 PM – 7:30 PM CST\nPlease join the Oklahoma City Chapter of the Federal Bar Association for its Virtual CLE – Black Wall Street and the 1921 Tulsa Race Massacre\, featuring Hannibal B. Johnson. This program will take place from 5:30-7:00 p.m. on Thursday\, February 25. Registrants will be provided a Zoom link for the event. \nThis CLE will focus on the events surrounding the 1921 Tulsa race massacre and destruction of the Greenwood District\, also known as Black Well Street. In addition to providing his unique insights into the massacre\, attorney Hannibal B. Johnson will bring awareness to the continuing legal ramifications of this racial violence and its impacts on the descendants of those who experienced it directly. Mr. Johnson’s presentation will be followed by a panel discussion moderated by Melvin C. Hall. \nA portion of the proceeds from this program will be donated to the Ada Lois Sipuel Fisher Chair at the University of Oklahoma College of Law and social justice programs at Oklahoma City University School of Law. \n\nAbout the Speakers\nHannibal B. Johnson \nHannibal B. Johnson is an attorney\, author\, and independent consultant specializing in diversity & inclusion/cultural competence issues and nonprofit governance. He is a graduate of Harvard Law School and The University of Arkansas\, where he completed a double major in economics and sociology. Mr. Johnson has also served as an adjunct professor at The University of Tulsa College of Law\, Oklahoma State University\, and the University of Oklahoma. \nMr. Johnson serves on the federal 400 Years of African-American History Commission\, a body charged with planning\, developing\, and implementing activities appropriate to the 400th anniversary of the arrival\, in 1619\, of Africans in the English colonies at Point Comfort\, Virginia. He chairs the Education Committee for the 1921 Tulsa Race Massacre Centennial Commission. Hall \nMelvin C. Hall is an attorney with Riggs\, Abney\, Neal\, Turpen\, Orbison & Lewis. After an eight-year public service career with the Cleveland County District Attorney’s Office (1980-1983) and as Executive Director of the Oklahoma Human Rights Commission (1983-1987)\, Melvin joined the Riggs\, Abney January 1\, 1988. He was elected shareholder partner on January 1\, 1992. Since joining the firm\, Melvin has focused his practice on civil litigation of matters relating to employment law\, business and commercial law\, and civil rights law. Melvin has tried cases before administrative tribunals\, in state district courts and in each of the three U.S. District Courts of Oklahoma. He has also argued several cases before the Tenth Circuit Court of Appeals in Denver\, Colorado. \nIn addition to his law practice\, Melvin is a nationally sought-after speaker and lecturer on employment law and civil rights issues. He is currently an adjunct professor at the University of Oklahoma teaching classes regarding employment law and the civil rights movement. Melvin was a featured speaker at the 2018 Office of Civil Rights Enforcement Employment Law Conference and the Guide to 42 U.S.C. § 1983 Principals and Litigation Conference. Both conferences were held in Oklahoma City. \nMelvin also presented at the National Conference on Race and Ethnicity in Higher Education (NCORE) conference in New Orleans in 2018. Melvin has served on numerous boards and commissions such as a seven year term as a regent on the University of Oklahoma Board of Regents from 1992 through 1999. Currently\, Melvin serves on the LegalShield Board of Directors\, the Arvest Bank Board of Directors\, the Executive Committee of the Southwest Center for Human Relations Studies\, the Women’s and Gender Studies (WGS) Board of Advocates\, the Board of Visitors of the University of Oklahoma College of Law\, and the Oklahoma Innocence Project Advisory Board. \nMelvin is an AV rated attorney who has received numerous awards\, honors and appointments. In 2019 Melvin was presented with the Oklahoma City Association of Black Lawyers\, Opio Toure Champion of Justice Award. In 2017\, Melvin was presented with the Spirit of the Community Award from the Fairview Missionary Baptist Church\, and in 2013 he received the Oklahoma Bar Association Diversity Committee’s Ada Lois Sipuel Fisher Diversity Award. Melvin received his Bachelor of Arts in Education degree from Langston University and his Juris Doctorate from the University of Oklahoma College of Law.
