DESCRIPTION:What is a federal judicial clerkship?  What do federal judicial clerks do?  How do you apply for a federal judicial clerkship and what materials are needed?  Our esteemed panelists aim to answer these and other related questions for you virtually on October 15\, 2021\, from 2-3 pm EST.  Please register to join us for the conversation. \nRegistration is Closed \n\nPanelists \n \nJudge Marcia M. Henry\, Former judicial clerk for the Fifth Circuit and U.S. District Court for the Eastern District of New York. \nMarcia M. Henry was appointed as a United States Magistrate Judge for the Eastern District of New York on May 10\, 2021. \nImmediately prior to her appointment\, Judge Henry was at the New York State Department of Financial Services in the Cybersecurity Division\, where she supervised policy initiatives related to cybersecurity regulation and enforcement in the financial services industry.  Before that\, Judge Henry served for over seven years as an Assistant U.S. Attorney with the U.S. Attorney’s Office for the Eastern District of New York\, where she prosecuted complex federal crimes\, including international narcotics trafficking\, money laundering\, and wire fraud\, and was the district’s first Opioids Coordinator.  Before joining the U.S. Attorney’s Office\, Judge Henry practiced labor and employment law at Seyfarth Shaw LLP and Rao Tiliakos LLP in New York.  Prior to law school\, she worked at J.P. Morgan Chase & Co. in human resources and diversity program management. \nJudge Henry earned her J.D. from New York University School of Law\, where she was Editor-in-Chief of the New York University Review of Law & Social Change\, and her B.A. in Psychology and Afro-American Studies\, cum laude\, from the University of Pennsylvania.  She served as a law clerk to the Honorable Carl E. Stewart of the U.S. Court of Appeals for the Fifth Circuit and to the Honorable Sterling Johnson\, Jr. of the U.S. District Court for the Eastern District of New York. \nJudge Henry is a native of Brooklyn\, New York\, and the daughter of immigrants from Trinidad and Tobago.  She is a member of the Metropolitan Black Bar Association and the Federal Bar Council.  She has served as a Director of the Federal Bar Foundation and a Team Liaison for the Federal Bar Council’s American Inn of Court. \nProfessor Joseph Thai\, Former judicial clerk for the Supreme Court and Tenth Circuit. \nProfessor Joseph Thai teaches and writes about constitutional law and the Supreme Court. \nProf. Thai served as law clerk to Justices John Paul Stevens and Byron White of the Supreme Court and Judge David Ebel of the U.S. Court of Appeals for the Tenth Circuit. \nHe frequently engages in civil rights litigation and served on the legal team that successfully challenged Oklahoma’s same-sex marriage ban a year before the Supreme Court upheld marriage equality nationwide. \nProf. Thai has often been named outstanding professor by students at the law school and once by students university-wide.  He is consistently named outstanding dad by his goldendoodle\, Bach. \nJorge Gonzalez\, Former judicial clerk for the Federal Circuit \nJorge F. Gonzalez is a former judicial clerk to Judge Jimmie V. Reyna of the U.S. Court of Appeals for the Federal Circuit (2019-2020). After completing his clerkship\, Jorge returned to Finnegan\, LLP\, in Washington\, D.C.\, where he had worked as a patent litigation associate since 2015. \nJorge recently accepted an in-house position at AbbVie\, Inc.\, where he serves as patent litigation counsel. Jorge manages biopharmaceutical patent litigations\, both offensively and defensively\, in courts and tribunals worldwide. Before attending law school\, Jorge worked at Gilead Sciences as a formulations specialist developing pharmaceuticals to treat Hepatitis B and C and HIV/AIDS. \nJorge is co-chair of the Intellectual Property Law Section for the Hispanic National Bar Association\, and his family is from Puerto Rico.” \nRacheal M. White Hawk\, Former judicial clerk for the Ninth Circuit \nRacheal M. White Hawk is a former judicial clerk of the U.S. Court of Appeals for the Ninth Circuit (2017-18) and the Arizona Supreme Court (2016-17).  Racheal graduated magna cum laude and Order of the Coif from the Sandra Day O’Connor College of Law at Arizona State University. \nAfter she completed her judicial clerkships\, Racheal practiced Federal Indian Law and Tribal Law as an Associate Attorney at Procopio\, a law firm based in San Diego\, California. \nRacheal is currently an Associate Attorney at Earthjustice\, the premier nonprofit public interest environmental law organization\, where she advocates for the protection of endangered species and the environment on behalf of tribes and other clients. \nRacheal is a member of the Rosebud Sioux Tribe and she grew up in Grand Island\, Nebraska.  Before attending law school\, Racheal completed a Fulbright research grant in Chengdu\, China. \nModerator \nJason Kurtyka\, Current judicial clerk for the U.S. District Court for the Southern District of Ohio. \nJason A. DESCRIPTION:This CLE presents a unique training opportunity led by Dr. Artika Tyner\, author of the award-winning book\, The Lawyer as Leader: How to Plant People and Grow Justice\, for newer and younger attorneys to support their efforts and participation in the FBA Younger Lawyer Division’s Annual StepUp Pro Bono Challenge. In FY2020\, then-YLD Chair Adine S. Momoh led a Call to Action following George Floyd’s tragic death and the civil unrest across Minnesota\, the country and world. The YLD issued a statement and provided resources to help younger attorneys respond. The YLD then initiated a national pro bono challenge\, the StepUp Pro Bono Challenge\, and encouraged younger attorneys to step up and perform pro bono specifically addressing issues of systemic racism\, socio-economic injustice\, and access to justice. The YLD Board has since adopted it as an annual program.  In the training\, Dr. Tyner will explore her book and discuss tangible ways lawyers can use their legal skills to advocate for change in marginalized communities. Participants will learn how they can use their skills\, position\, and authority to create equal access to justice. Scott Oswald – Chair\, FBA Qui Tam Section (moderator) \nScott Oswald is an accomplished trial lawyer who has brought more than 40 trials to verdict. His cases have recovered more than $300 million in judgments and settlements. A fellow of the prestigious College of Labor and Employment Lawyers\, he received his law degree from Howard University and honed his skills at Trial Lawyers College\, founded by the legendary Gerry Spence. Mr. Oswald litigates employment and whistleblower actions nationwide. Among his results: \n\nFirst jury verdict under new whistleblower protections in the National Defense Authorization Act of 2013|\nFirst Sarbanes-Oxley Act liability verdict to withstand appeal\nFirst jury verdict under 2009 anti-retaliation provisions of False Claims Act\nFirst Dodd-Frank Act retaliation lawsuit to reach discovery in federal court\n\nMr. Oswald is chair of the Federal Bar Association’s Qui Tam Section and immediate past chair of the FBA’s Professional Ethics Committee. Lawdragon ranks him as one of the top 500 plaintiff-side employment lawyers in the country. \nKatherine Armstrong\, Affirmative Civil Enforcement Coordinator\, U.S. Attorney’s Office for the Western District of North Carolina  \nKatherine Armstrong joined the United States Attorney’s Office for the Western District of North Carolina in July of 2016 as an Assistant United States Attorney (AUSA) in the office’s Civil Division. Ms. Armstrong was appointed as Affirmative Civil Enforcement (ACE) Coordinator in January of 2020 and is primarily responsible for handling ACE litigation and civil fraud investigations under the False Claims Act\, 31 U.S.C. §§ 3729-3733\, civil enforcement investigations and actions under the Controlled Substances Act\, 21 § U.S.C. 801 et seq. Additionally\, Ms. Armstrong deals with enforcement of other federal statutes that provide for the recovery of monetary damages by\, or injunctive relief on behalf of the United States. \nMs. Armstrong also serves as the Civil Rights Coordinator and has experience in the enforcement of federal statutes prohibiting discrimination in the provision of housing\, and based on disability\, among others.  Before joining the federal government\, Ms. Armstrong practiced at a Charlotte law firm specializing in civil litigation\, primarily in the areas of commercial and business litigation and insurance defense. During her time tenure there\, she represented clients in the courts of Mecklenburg and surrounding counties\, and the federal district courts of North Carolina.  Ms. Armstrong obtained her J.D. from the University of Kentucky College of Law and her undergraduate degree from the University of North Carolina at Chapel Hill. \nMark T. Calloway\, Partner\, Alston & Bird LLP \nMark T. Calloway is a partner with Alston & Bird LLP.  He concentrates his practice in the areas of white-collar criminal defense with an emphasis on health care matters\, internal corporate investigations\, and the defense of False Claims Act matters around the country. Mr. Calloway served for seven years as the United States Attorney for the Western District of North Carolina (February 1994 to March 2001). During his tenure with the Department of Justice\, Mr. Calloway also served as Director of the Executive Office for United States Attorneys in Washington\, D.C.\, and as Chair of the Attorney General’s Advisory Committee of United States Attorneys and was a member of the Attorney General’s White Collar Crime Council. \nAs Director of the Executive Office of the United States Attorneys in Washington\, D.C.\, Mr. Calloway had responsibility for support and oversight of all 94 United States Attorney’s Offices and a key role in management and policy implementation for the Department of Justice.  In January 2001\, Attorney General Reno awarded Mr. Calloway the Edmund J. Randolph Award for outstanding service to the Department of Justice. \nHon. Robert J. Conrad Jr.\, U.S. District Judge\, Western District of North Carolina  \nRobert (“Bob”) J. Conrad\, Jr. serves as a District Judge for the Western District of North Carolina. Judge Conrad was confirmed in 2005 and he was Chief Judge from 2006-2013. He served as the Fourth Circuit’s district court representative on the United States Judicial Conference from 2014-2020. Judge Conrad was appointed by Chief Justice John Roberts to the seven-judge Executive Committee of the Judicial Conference.  He chaired the Conference of District Judge Representatives in 2019-2020. In addition to his full caseload and governance role\, he has supervised the construction of a $165 million courthouse. \nJames F. Wyatt III\, Partner\, Wyatt & Blake\, L.L.P. \nJames F. Wyatt\, III is recognized as one of North Carolina’s leading trial lawyers. He is a member of the International Academy of Trial Lawyers\, the American College of Trial Lawyers\, and the Best Lawyers in America\, has a Band 1 Ranking with Chambers and Partners\, and has been named on numerous occasions as the best white-collar defense and civil trial lawyer in both Charlotte and the State of North Carolina. Sessions typically focus on a single federal district and feature an experienced local panel that includes an Assistant U.S. Attorney for the district; a federal judge; a relator-side attorney; and a defense attorney. \nWe hope to resume in-person sessions of “The FCA Today” in 2022\, but for now we are conducting them online via the Zoom platform. For this session on the District of Utah\, attendees can expect a brief overview of the FCA process. \nThis webinar does not carry CLE credit. Scott Oswald – Chair\, FBA Qui Tam Section (moderator) \nScott Oswald is an accomplished trial lawyer who has brought more than 40 trials to verdict. His cases have recovered more than $300 million in judgments and settlements. A fellow of the prestigious College of Labor and Employment Lawyers\, he received his law degree from Howard University and honed his skills at Trial Lawyers College\, founded by the legendary Gerry Spence. Mr. Oswald litigates employment and whistleblower actions nationwide. Among his results: \n\nFirst jury verdict under new whistleblower protections in the National Defense Authorization Act of 2013|\nFirst Sarbanes-Oxley Act liability verdict to withstand appeal\nFirst jury verdict under 2009 anti-retaliation provisions of False Claims Act\nFirst Dodd-Frank Act retaliation lawsuit to reach discovery in federal court\n\nMr. Oswald is chair of the Federal Bar Association’s Qui Tam Section and immediate past chair of the FBA’s Professional Ethics Committee. Lawdragon ranks him as one of the top 500 plaintiff-side employment lawyers in the country. \nGregory Goldberg\, Partner\, Holland & Hart \nGreg is chair of Holland & Hart’s Government Investigations practice group and a partner in its complex civil litigation practice group. He defends companies and individuals in government investigations by grand juries\, the U.S. Department of Justice and state attorneys general. He also represents clients in investigations and litigation under the False Claims Act (FCA). Mr. Goldberg previously served as an Assistant U.S. Attorney\, where he received the Director’s Award\, and has tried more than 20 federal criminal and civil trials. He is a graduate of Dartmouth College and Columbia Law School. \nBrandon J. Mark\, Shareholder\, Parson Behle & Latimer \nBrandon Mark is co-chair of the litigation department and works on the firm’s litigation\, healthcare\, and real estate practice teams. Mr. Mark has represented clients in state and federal trial courts around the country. In recent years\, Mr. Mark has focused his practice on the many legal issues involving government contracts\, including representing whistleblowers who have information about fraud committed on government programs. His FCA practice has included cases involving fraud in higher education\, healthcare\, and defense contracting. \nSandra L. Steinvoort\, Assistant U.S. Attorney\, U.S. Attorney’s Office for the District of Utah  \nSandra Steinvoort was hired by Judge David Barlow in February 2013 as the Affirmative Civil Enforcement Officer and Civil Healthcare Fraud Coordinator for the District of Utah. Previously\, Ms. Steinvoort was an Assistant Attorney General for the Utah Attorney General’s office in the Litigation Division\, Tort Section\, defending state agencies and employees in negligence cases. He has spent time during his career in the US Marine Corps and various private sector agencies with the goal of protecting the United States from security threats. \nBrian is a Board Member and Strategic Advisor to many great companies. \nSonya Proctor\, Assistant Administrator for Surface Operations\, Transportation Security Administration \nSonya T. Proctor is the Assistant Administrator for Surface Operations\, which aligns surface transportation security operations under direct executive leadership to provide the most effective and efficient security solutions for the four modes of land-based transportation: mass transit\, freight rail\, highway motor carrier and pipeline.  Serving in TSA\, Ms. Proctor’s executive accomplishments have spanned the policy\, law enforcement and security operations areas. \nShe brings to TSA an extensive operational background in law enforcement and transportation security.  Ms. Proctor started her law enforcement career in the Nation’s Capital\, with the Washington\, D.C. Metropolitan Police Department. During her twenty-five-year tenure she served in the patrol and investigative ranks\, directing and leading the department through many city wide challenges\, including crime reduction\, civil disturbances\, sensitive investigations and significant departmental reorganization. She rose to command many key positions\, among them\, the Human Resources Bureau for the Department\, the Office of Internal Affairs\, and the Special Events Unit of the Special Operations Division\, which handles all major events\, Presidential escorts\, parades\, marches\, and demonstrations – scheduled and unscheduled – in the Nation’s Capital. She also served as Commander of the Third Police District\, often recognized for its broad diversity and model community policing approach she developed with her community partners. She served in every rank from patrol officer to Chief of Police\, retiring from the department\, after serving as the Chief of Police\, in an interim capacity. \nMs. Proctor went on to serve as the Chief of Police for the national Amtrak Police Department\, developing a new strategic blend of city policing in a passenger railroad environment. In conjunction with NYPD Commissioner Ray Kelly\, Ms. Proctor co-chaired the Northeast Corridor Coalition\, a group of law enforcement leaders along the Amtrak route between Washington\, DC and New York City to enhance post 9-11 security for passengers on that heavily travelled route. \nA graduate of the 130th session of the FBI National Academy and a life member of the International Association of Chiefs of Police\, she remains active in the national and international law enforcement community. Ms. Proctor earned her bachelor’s and master’s degrees from the Johns Hopkins University. \nMichael Stephens\, General Counsel and Executive Vice-President\, Tampa International Airport \nMichael A. Stephens serves as General Counsel & Executive Vice President for the Hillsborough County Aviation Authority and Tampa International Airport. In addition to being a member of the Authority’s executive leadership team\, he oversees all legal\, regulatory\, compliance and information technology matters. He is responsible for providing legal opinions and advice to the CEO and Board Members on a wide variety of legal matters related to all aspects of the Aviation Authority’s governance and operation of Tampa International\, Peter O Knight\, Plant City\, and Tampa Executive Airports. \nMichael has over 20 years of experience managing complex legal\, compliance\, human resources\, risk management and information technology issues. Prior to joining the Aviation Authority\, he served as the Chief Legal Counsel for the Hillsborough Regional Transit Authority (HART). Michael also served on active duty as a Captain and Trial Counsel in the U.S. Army Judge Advocate General Corp\, where he was appointed as a Special Assistant U.S. Attorney. Michael also served on active duty as an Air Traffic Controller in the U.S. Air Force. \nMichael graduated from Morehouse College with a B.A. in International Relations. DESCRIPTION:Explore ways to represent vulnerable populations\, including domestic violence survivors\, and the resources available to them. \n* 1.25 hours of Illinois MCLE credit pending \n\n\n\n\n\n\n\n\n\n\nAbout the Presenters\nKathryn Bettcher\, Director of Victim Services at Prairie State Legal Services\nKathryn Bettcher graduated from the Northern Illinois University College of Law in 1991 and was licensed in Illinois that same year. Kathryn has worked for Prairie State Legal Services since 1991\, first as a staff attorney. From 2005 until 2020 she served as managing attorney of the Fox Valley office. She is now Director of Family Advocacy and supervises family law litigation across Prairie State’s offices. Kathryn has concentrated her work in family law\, and in particular in representation of victims of domestic violence. She has represented numerous clients in contested hearings and trials of family law matters. She also has served as supervisor of Prairie State’s domestic violence project located at the Kane County Courthouse. Kathryn is recognized as a leader among domestic violence advocates and attorneys in Kane County. She also has experience representing clients in other matters such as evictions and Social Security disability claims. \nTeri Dimmick\, Volunteer Court Appointed Special Advocate\nTeri Dimmick is an attorney who has volunteered as a Court Appointed Special Advocate (CASA) in a child abuse and neglect case since the summer of 2018. She is currently one of seven pro se law clerks in the United States District Court for the Central District of Illinois managing all cases prisoners file challenging the conditions of their confinement. As a pro se law clerk\, Teri has worked with all judges within the Central District\, but now primarily works for Judge James Shadid. Before joining the Central District\, she worked as an associate at Benassi & Benassi\, P.C. and handled complex labor and employment litigation. Teri’s first job after graduating from the University of Illinois College of Law\, magna cum laude\, was as an Assistant McLean County State’s Attorney handling cases ranging from misdemeanors to child sex abuse\, reckless homicide\, murder\, and a death penalty case. She also established the McLean County Domestic Violence Unit and was the first domestic violence prosecutor. Before becoming an attorney\, Teri earned a Bachelor’s Degree in journalism from the University of Missouri in Columbia and was a news anchor for WHOI-TV in Peoria\, Illinois. \nThe Honorable Sara Darrow\, Chief United States District Judge of the Central District of Illinois\nJudge Darrow has served as a district court judge in the Rock Island Division of the Central District of Illinois since 2011. She was nominated by President Barack Obama\, on the recommendation of Senator Dick Durbin. She was appointed Chief Judge in 2019. Judge Darrow has served on the Judicial Conference Committee on the Administration of the Bankruptcy System since 2017 and in 2019\, U.S. Supreme Court Chief Justice John Roberts appointed her Chair of the Committee. Prior to her judicial appointment\, Judge Darrow worked at the United States Attorney’s Office in Rock Island\, Illinois\, for eight years where she prosecuted significant federal crimes involving firearms\, drugs\, gangs\, fraud\, money laundering\, and corruption. She also coordinated the federal programs Project Safe Neighborhoods\, designed to reduce gun violence\, and Organized Crime Drug Enforcement Task Force\, designed to target major drug trafficking organizations. From 1999 to 2003\, Judge Darrow worked in the Henry County State’s Attorney’s Office in Cambridge\, Illinois\, where she became First Assistant State’s Attorney and tried major felony\, domestic violence\, and child exploitation cases. Judge Darrow also worked as a low-income community organizer in Washington\, DC\, between college and law school. Judge Darrow received her undergraduate degree from Marquette University and her law degree from Saint Louis University School of Law. Judge Darrow lives in Rock Island with her husband Clarence Darrow\, who serves as a Fourteenth Judicial Circuit Judge in Rock Island County. They have six children—three recent college graduate\, two current college students\, and one still living at home. \nMarcy Jacobs\, Third Judicial Circuit Family Violence Prevention Council and Oasis Women’s Center\nMarcy Jacobs has a bachelor’s degree in Liberal Arts from Western Illinois University. She began at Oasis Women’s Center in Alton\, Illinois as a volunteer in 1983. She has worked as a clerk\, a night manager\, a volunteer coordinator and now serves as Client Service Coordinator. She has had the privilege of working with thousands of victims of domestic violence over the years. Rosenstengel\, Chief United States District Judge of the Southern District of Illinois \nJudge Rosenstengel is the Chief United States District Judge in the Southern District of Illinois. She received a Bachelor of Arts degree\, cum laude\, in 1990 from the University of Illinois at Urbana-Champaign and a Juris Doctorate\, cum laude\, in 1993 from Southern Illinois University School of Law. Before joining the bench\, she was a member of the Illinois and Missouri bars\, practicing litigation in state and federal courts in St. Louis\, Missouri. She later served as a career law clerk to United States District Judge G. Patrick Murphy\, and as Clerk of Court in the Southern District of Illinois\, a high-level administrative position. On November 7\, 2013\, President Obama nominated Judge Rosenstengel to serve as a United States District Judge. The Senate voted 95-0 for final confirmation on May 8\, 2014\, and she received her judicial commission on May 12\, 2014. Judge Rosenstengel is the first female district judge to serve in the Southern District of Illinois (and also was the first female to serve as Clerk of Court). Voss\, Madison County Assistant State’s Attorney\, Domestic Violence Division\nPhillip J. Voss is an Assistant State’s Attorney in the Madison County State’s Attorney’s Office. He is in the specialized domestic violence unit and a member of the new Intimate Partner Violence (IPV) Task Force. DESCRIPTION:Over the past 5 years there has a been an increasing focus and push at both the federal and state level to use the antitrust laws to attempt to restrain technology companies and their alleged anticompetitive power and growing power over consumers’ everyday life.  Those attempts\, however\, have run into the “consumer welfare” standard\, that has guided antitrust law for more than 40 years with a focus solely on whether alleged actions will result in higher prices to consumers.  This session will explore the current issues posed by “Big Tech”\, whether these issues actually cause harm to consumers\, whether existing laws are sufficient to address potential competition concerns\, and whether changes are necessary to the current antitrust laws. \nPresented by the Antitrust & Trade Regulation Section \n\nAbout the Presenters\nRobert Hauberg\, Senior Counsel\, Baker Donelson (Moderator) \nAs former chair of the firm’s Government Enforcement and Investigations practice group\, Robert concentrates his practice in antitrust\, securities\, False Claims Act and RICO litigation and white collar crime\, including congressional investigations and internal investigations. \nHe has handled dozens of grand jury investigations\, criminal trials\, civil trials involving mergers\, price fixing\, anticompetitive conduct\, financial institutions\, RICO\, false claims by government contractors\, whistleblowers\, and bribery of public officials.  Before private practice\, Robert served as a federal prosecutor: AUSA in DC; senior official in the Antitrust Division (Communications and Finance Section) and Criminal Division (Fraud Section\, Dallas Bank Fraud Task Force) of DOJ. \nRobert is chair of the Federal Bar Association Antitrust and Trade Regulation Section.  Previously he served as chair of the District of Columbia Bar’s Antitrust and Consumer Law Community and the American Bar Association’s Antitrust Section Committees on Compliance and Ethics and on Financial Institutions. \nJames Tierney\, Partner\, Orrick Herrington & Sutcliffe LLP \nJim served in the Department of Justice’s Antitrust Division for more than 25 years\, the last 10 of which he ran the Technology & Financial Services section (formerly the Networks and Technologies Section or Net Tech) that oversaw the review\, investigation and litigation of every major strategic technology transaction and conduct issue\, including those involving the big 5 tech industry leaders. Reaching beyond just technology\, Jim also oversaw matters in the areas of financial services\, securities industries\, and professional associations. \nJim brings this vast experience to Orrick’s large technology clients and advises them on navigating the tricky waters of government investigations of business activities with antitrust implications like mergers\, joint ventures\, and single-firm conduct. He knows how the DOJ will view proposed transactions\, what issues are likely to trip up a deal or investigation and has relationships throughout the DOJ to get things done. And while Jim served as head of Technology & Financial Services\, he worked closely with his counterparts in competition agencies around the world and is able to draw on those invaluable relationships in foreign jurisdictions. His ability to anticipate problems that he saw while sitting on the other side of the table has allowed him to successfully gain merger clearance for Microsoft’s acquisition of GitHub and Cisco’s acquisition of Viptela\, as well as resolving numerous technology matters for AT&T\, Cerence\, eBay\, Netflix\, Sonos and others. \n\n\nEric Grannon\, Partner\, White & Case LLP \nEric helps clients with antitrust matters\, including civil and criminal defense as well as counseling for mergers and acquisitions\, settlements of pharmaceutical patent litigation\, and strategic planning. Since 2001\, he also has helped clients with concerns under the Foreign Corrupt Practices Act (FCPA) and other anti-corruption issues. He ended his DOJ service with a detail as a Special Assistant US Attorney in the District of Columbia\, trying twenty bench and jury trials as lead counsel. \nDana Vogel\, Competition\, Innovation & Privacy Unit Chief\, Civil Litigation Division\, Office of the Attorney General \n\n\nDana Vogel currently serves as the Unit Chief Counsel for the Competition\, Innovation & Privacy Unit within the Consumer Protection & Advocacy Section of the Arizona Attorney General’s Office. Dana works on and oversees antitrust matters as well as data breach and Arizona’s Fintech Sandbox program. These antitrust matters include the Generic Drug Pharmaceuticals litigation alongside other State Attorneys General\, the Facebook antitrust litigation alongside other State Attorneys General and the FTC\, and the Google litigation alongside other State Attorneys General and the DOJ. Dana has also participated in Arizona-specific antitrust investigations and litigation such as the investigation into whether dental suppliers were illegally preventing a new entrant from entering the market. Dana has also worked on Class Action Fairness Act matters in the US Supreme Court and the US Court of Appeals for the Ninth\, Sixth\, and Third Circuit. \n  \nDana joined the Arizona Attorney General’s Office in 2013 as an Assistant Attorney General in the Antitrust Unit of the Civil Litigation Division. She made a name for herself within the office for her antitrust expertise and her drive to help Arizona consumers\, becoming Antitrust Unit Chief Counsel in 2019. SUMMARY:Webinar: A SCOTUS Review of IP Cases in the Recent 2020 Term and its Implications for Constitutional Jurisprudence in Other Areas of Law
DESCRIPTION:As has been the case in several of the past terms\, the U.S. Supreme Court has rendered decisions involving intellectual property law issues that have broader implications which also touch upon other areas of law. So too\, in this most recent term\, with the Court’s opinions in United States v. Arthrex\, Inc. et al.\, 141 S.Ct. 1970 (2021) (Constitutionality of APJs under the Appointments Clause); Google LLC v. Oracle America\, Inc.\, 141 S.Ct. 1183 (2021) (Copyright fair use and application programming interface software (“API”)); and Minerva Surgical\, Inc. v. Hologic\, Inc.\, et al. 141 S.Ct. 2298 (2021) (assignor estoppel). This webinar will discuss these Supreme Court decisions within the IP law context as well as the potential impact of the decisions on other areas of law. \nThe webinar will also take a forward look at the next term for a case that\, although it was not decided in the current term\, and the petition for certiorari is still pending\, the Court has invited the Solicitor General to weigh in on at the petition stage. The American Axle & Manufacturing\, Inc. v. Neapco Holdings LLC\, et al.\, No. 20-891\, U.S. Sup. Ct. (March 1\, 2021)\, has generated a considerable amount of attention since it concerns a highly controversial issue of patent eligibility that continues to stymie congressional patent law reform efforts\, and which has a direct impact on U.S. economic and national security interests as well as innovators\, investors\, and entrepreneurs across the entire spectrum of industries from Pharma to Big Tech. \nPresented by the Intellectual Property Section \n\nAbout the Presenter\nRobert J. Rando\, Partner\, Greenspoon Marder LLP \nRobert Rando is a partner with the Greenspoon Marder’s Intellectual Property Department. Mr. Rando focuses his practice on patent and other intellectual property infringement disputes and counseling. SUMMARY:Webinar: The Use of International Law in Domestic Courts and International Tribunals
DESCRIPTION:Robert “Bob” Pauw\, a partner with Gibbs Houston Pauw in Seattle\, Washington\, will focus on the use of international law in U.S. domestic courts and at the Inter American Commission on Human Rights (IACHR). Mr. Pauw will discuss exhaustion of domestic remedies\, the procedure for bringing claims to the IACHR\, and the enforceability of decisions issued by international tribunals. Although under the Constitution international law is part of “the supreme Law of the Land\,” courts and agencies may be reluctant to follow requirements of international law. Often international law is not directly enforceable in United States courts and it can be difficult to convince courts and agencies to follow international law norms. Mr. Pauw will discuss how\, in spite of these difficulties\, international law may be useful for purposes of constitutional and statutory interpretation\, and ways to facilitate consideration of international law by courts and agencies.
