SUMMARY:Webinar: False Claims Act Trial - Lessons Learned
DESCRIPTION:Although the United States government recovers billions of dollars per year under the federal False Claims Act (FCA)\, the vast majority of that recovery is the result of voluntary settlements\, and very few FCA cases proceed to trial\, let alone verdict. Panelist will discuss their experiences preparing for and trying these cases and provide tips to other FCA attorneys on how to prepare for an FCA trial\, including tips for conducting effective discovery\, recurring issues subject to motions practice\, and preparing effective arguments for a judge and jury. \n  \nPresented by the Health Law Section \n\nPresenters\nBrittany Cambre \nBrittany represents individuals and companies in complex civil litigation\, internal investigations\, and white collar criminal defense. She has represented clients in various complex business litigation matters involving antitrust\, RICO\, and the False Claims Act. She also counsels clients in a wide array of issues including commercial business disputes and business torts. \nBefore joining Chilivis\, Cochran\, Larkins & Bever\, Brittany was an associate with Eversheds Sutherland (US)’s Litigation Practice Group\, focusing her practice on complex business litigation\, government investigations\, and class action defense. \nBrittany graduated in 2013 from the University of Georgia School of law\, she served as the Editor in Chief of the Georgia Journal of International and Comparative Law\, as an Intern for Superior Court judges of Barrow and Jackson counties\, and as a member of the Appellate Litigation Clinic. \nScott Grubman \nScott is a former Assistant United States Attorney (AUSA) and Department of Justice Trial Attorney who represents businesses and individuals across a wide variety of industries in connection with government and internal investigations\, False Claims Act litigation\, and white collar criminal defense. \nAlthough Scott represents clients across industries\, a substantial portion of his practice involves representing healthcare providers of all types and sizes in connection with high-stakes government investigations – both criminal and civil – by agencies such as the U.S. Department of Justice\, HHS-OIG\, the FBI\, and state Medicaid Fraud Control Units.  Scott also has extensive experience representing healthcare providers in connection with administrative proceedings\, payor audits\, and general healthcare regulatory matters\, particularly those related to the False Claims Act (including qui tam whistleblower actions)\, Stark Law\, and Anti-Kickback Statute.  He has represented healthcare clients ranging from multi-hospital health systems to individual physicians\, ancillary providers\, and every type and size in between.  He served as lead trial counsel in Georgia’s first-ever False Claims Act trial\, which resulted in a favorable settlement after 4 days of testimony. \nIn addition to his healthcare clients\, Scott also regularly represents clients who are being investigated for\, or who have been charged with\, white collar crimes\, including fraud\, embezzlement\, theft\, and public corruption.  He has first-chaired numerous criminal and civil jury trials in both federal and state courts\, and has handled criminal and civil appeals.  Scott is skilled and experienced in handling high-profile investigations as his matters have garnered substantial attention by the international\, national\, and local news media. He has also represented individuals in connection with Congressional investigations\, including the representation of a key witness before the Select Committee to Investigate the January 6th Attack on the United States Capitol (the “January 6 Committee”).  Scott has a reputation for passionately defending his clients both inside and outside of the courtroom. \nAfter graduating from law school with highest honors and then clerking for two federal judges (both U.S. District and U.S. Circuit Courts)\, Scott was accepted into the Attorney General Honor’s Program\, first serving as a Trial Attorney for the U.S. Department of Justice in Washington\, D.C.\, and then as an AUSA in Savannah\, Georgia\, where he investigated and prosecuted healthcare and other white collar fraud cases\, and was a member of his district’s Healthcare Fraud Task Force.  He also represented the United States as lead counsel in dozens of cases in both federal District Court and before the Eleventh Circuit\, including felony criminal investigations and prosecutions\, criminal and civil appeals\, habeas\, constitutional claims\, and asset forfeiture.  He was awarded a Special Commendation by the DOJ\, and was recognized by HHS-OIG for his government service. \nScott has published dozens of articles on healthcare fraud and white collar crime topics in nationally-recognized journals and publications\, and regularly presents at healthcare and white collar crime conferences and seminars nationwide. He  serves as an Adjunct Professor of Law at both Emory University and Georgia State University law schools\, where he teaches courses on white collar crime and healthcare fraud and abuse.  Scott has helped to train lawyers on trial advocacy skills both domestically and internationally\, including serving on the faculty of a week-long NITA trial advocacy training program in Lagos\, Nigeria.  He also serves in leadership positions in state and national organizations\, including the American Health Law Association (AHLA)\, the Federal Bar Association\, the American Bar Association\, and the State Bar of Georgia.  He has been quoted by both national and local news organizations on issues related to healthcare fraud and abuse and white collar crime\, including the New York Times\, Washington Post\, Wall Street Journal\, Bloomberg\, MSNBC\, and the Atlanta Journal Constitution. \nLauren Warner \nLauren A. Warner is an equity partner at Chilivis\, Grubman\, Warner & Berry LLP in Atlanta\, Georgia.  Lauren is an experienced trial attorney who represents companies and individuals in complex civil litigation\, government and internal investigations\, and white-collar criminal defense.  Lauren is a strong advocate who spent years honing her litigation skills\, representing both behemoth corporations in bet-the-company litigation and individual clients alike.  Lauren is known for displaying fervor and pragmatism in the courtroom.  Lauren also frequently represents clients in mediations and arbitrations\, and her negotiating acumen has saved countless clients the significant time\, expense\, and stress associated with protracted litigation.  Lauren has worked extensively with medical doctors\, both as clients and as expert witnesses.  Lauren has a strong working knowledge of various medical specialties and understands how to present complicated medical issues to judges and juries. \nLauren is licensed in Georgia\, Pennsylvania\, and Florida and has extensive experience with civil jury trials\, representing both plaintiffs and defendants in state and federal courts throughout the country.  A New Orleans native\, Lauren made Atlanta her home after working in Philadelphia and developing her expertise as a trial attorney for nearly a decade.  Before advancing her career at Chilivis Grubman\, Lauren worked in King & Spalding’s Atlanta office as a Senior Associate\, where she served as an active member of the Tort and Environmental practice group representing businesses in complex product liability actions.  Lauren specialized in developing and presenting state-of-the-art medical defenses for trials with particularly difficult medical issues\, including working extensively with medical experts regarding pulmonary and oncological diseases related to cigarette smoking. \nLauren graduated from Villanova University School of Law with honors having received a full academic scholarship.  After clerking for the Honorable Eduardo C. SUMMARY:Section on Taxation: New Guidance - Temporary Relief from Recent Regulations on Foreign Tax Creditability
DESCRIPTION:This panel will discuss IRS Notice 2023-55 and its impact on U.S. multinational entities. IRS Notice 2023-55 provides temporary relief for taxpayers determining whether a foreign tax is eligible for a foreign tax credit under sections 901 and 903. Section 901 allows a credit for foreign income\, war profits\, and excess profits taxes; section 903 allows a credit for taxes paid in lieu of a generally imposed foreign income\, war profits\, or excess profits tax. 2022 regulations revised the rules for determining whether a foreign levy is a creditable foreign income tax under sections 901 and 903. The temporary relief offered through IRS Notice 2023-55 allows taxpayers to apply certain portions to of the prior regulations under section 901 rather than the 2022 regulations\, and also turns off portions of the new regulations under section 903. She chairs the Ninth Circuit Workplace Environment Committee and is a member of the National Workplace Conduct Working Group. SUMMARY:Webinar: Remedies\, Court Access\, and Beyond: Life after Cummings
DESCRIPTION:This webinar will discuss the remedies options available for persons with disabilities post Cummings under a variety of different laws and how attorneys are navigating the post Cummings landscape. More specifically\, the webinar will zero in on Cummings v. Premier Rehab Keller\, Perez v. Sturgis Public Schools\, and Health and Hospital Corporation of Marion County v. Talevski. By the end of the session\, attendees will gain an understanding of three critical Supreme Court cases affecting persons with disabilities. They will also gain an understanding of the possible remedies persons with disabilities may utilize after facing disability discrimination in non-employment situations. \nPresented on behalf of the Civil Rights Law Section. \n\nPresenters\nWilliam D. Goren\, Esq.\, J.D.\, LL.M.\nWilliam D. Goren\, Esq.\, of William D. Goren\, J.D.\, LL.M. LLC in Decatur\, GA\, has been dealing with the ADA as an Attorney since 1990. His law and consulting practice\, https://www.understandingtheada.com/\, as well as his blog\, Understanding the ADA\, (a member of the ABA Top 100 for five consecutive years\, 2014-2018- there was no ABA 100 in 2019-2022)\, all focus on understanding the ADA so that the client understands what it means to comply with that law and related laws. In particular\, he provides consulting\, counseling\, representation\, and training services involving compliance with the Americans with Disabilities Act\, Rehabilitation Act of 1973\, and related laws- such as the Air Carrier Access Act and the Fair Housing Act\, among others. Mr. Goren also brings a deep\, personal understanding of what it means to have a disability\, equipping him with exceptional insight on how the ADA actually works. He is deaf with a congenital bilateral hearing loss of 70–90+ decibels\, but functions entirely in the hearing world thanks to hearing aids\, Bluetooth technology\, automatic speech recognition\, and lip-reading. For reasons independent of his deafness\, he also uses voice dictation technology to access his computer. He is also a frequent presenter\, a trained mediator\, a FINRA arbitrator (Chairperson eligible)\, and an arbitrator on the CPR employment panel. Finally\, he is the author of Understanding the ADA\, now in its 4th edition (ABA 2013)\, and numerous other articles on the rights of persons with disabilities. He is a member of various committees of the American Bar Association\, including: Legal Technology Resource Center Board (2017-2023); ABA Law Practice Section Client Development and Marketing Committee; ABA Law Practice Section Ethics and Professionalism Committee and the ABA’s Law Practice Section DEI committee. He is also a member of various committees of the Federal Bar Association\, including: the Federal Bar Association (FBA) Diversity and Inclusion committee; the FBA’s Civil Rights section and its Governing Board; FBA’s Civil Rights Amicus committee; and the Chair of the FBA’s Disability Best Practices Committee\, which in its first year formulated an accessibility manual for the FBA and its chapters. He is also a member of the Deaf and Hard of Hearing Bar Association Advocacy Committee and its Amicus committee. He has an A.B. from Vassar College\, a J.D. from University of San Diego School of Law\, and was one of the first in the entire country to receive the LL.M. in health law\, in his case from DePaul University College of Law. Interesting fact: He trained his miniature poodle to be a hearing dog while he practices virtually. \nAndrew Rozynski\, Esq.\nAndrew Rozynski is a distinguished partner at Eisenberg & Baum\, LLP. He harnesses his extensive experience as a civil rights attorney to passionately advocate for his client’s rights. His successful advocacy efforts have set legal precedents that have a positive ripple effect on numerous lives nationwide. In addition to his litigation work\, he is the co-director of the Eisenberg & Baum Law Center for Deaf and Hard of Hearing and also leads the firm’s appellate practice. Equipped with the dual skill sets of being both a formidable trial court litigator and an accomplished appellate lawyer\, Mr. Rozynski stands out in the legal field. Mr. Rozynski is unique in his willingness to tackle problems other lawyers shy away from and uses creativity to find winning strategies that aren’t readily apparent. He has a well-earned reputation for successfully litigating cases of first impression. Mr. Rozynski also has a strong national presence\, with admissions to over 40 Federal District and Appellate Courts spanning across more than 25 states. In his impactful career\, he has obtained over 25 favorable verdicts from juries\, judges\, and arbitrators\, testifying to his deep-seated commitment to his clients’ cause. Mr. Rozynski’s experience in both state and federal appellate courts is widespread\, he has argued dozens of cases in appellate and trial courts throughout the country\, including the United States Supreme Court. He has championed the rights of his clients by obtaining numerous positive decisions from Courts of Appeals nationwide\, overturning unfavorable rulings and affirming beneficial judgments. In addition to his broad work on various civil rights cases\, Mr. Rozynski has a wide array of experience of litigating cases involving Deaf discrimination. A personal connection to the Deaf community lends Mr. Rozynski a unique perspective when litigating Deaf discrimination cases. As a CODA (Child of Deaf Adults) with three Deaf relatives\, he is not only fluent in sign language\, but also possesses a deep understanding of Deaf culture\, making him an invaluable advocate for the Deaf community. A testament to his influence\, Mr. Rozynski has handled numerous nationally significant cases across varied contexts\, including hospitals\, businesses\, housing providers\, government entities\, courts\, nursing homes\, prisons\, colleges\, and workplaces.
