SUMMARY:Webinar: Bostock and The First Amendment: The Rights of LGBTQ+ Employees in the Religious Workplace
DESCRIPTION:In 2020\, the Supreme Court in Bostock v. Clayton County determined that discrimination against gay and transgender employees is discrimination on the basis of sex—leaving open the question whether\, and how\, this issue might be addressed in a case involving religious employers. In this session\, two civil-rights attorneys—both counsel for the plaintiff in Doe v. Catholic Relief Services\, a recent case in the District of Maryland—and counsel from Americans United for Separation of Church and State will provide an overview of the federal law protecting the rights of LGBTQ+ employees\, the defenses being raised by religious employers and the progress they are making in the courts\, and insight into the way some state courts are addressing these same issues. \nPresented by the Federal Bar Association’s LGBTQ+ Law Section and Civil Rights Law Section.   \n\nAbout the Presenters\n\nLauren DiMartino\, Associate\, Brown\, Goldstein & Levy LLP\nLauren A. SUMMARY:Qui Tam Section: [VIRTUAL] The Significance of SuperValu
DESCRIPTION:**Program hosted in (ET) time zone** \nOn April 18\, 2023\, the United States Supreme Court heard oral argument in U.S. ex rel. Schutte v. Supervalu\, Inc.\, 9 F.4th 455 (7th Cir. 2021). Circuit courts disagree over how the FCA’s scienter requirement works in cases in which the defendant’s claims are false because the defendant violated an ambiguous legal requirement. This roundtable will explore the current standard for knowledge under the FCA\, and whether and how Supervalu may change that standard. It will discuss the arguments presented to the Supreme Court\, in both the briefing and during oral argument.
