While this event may be especially interesting to younger lawyers and law students\, all attendees are welcome. \nPresented by the Senior Lawyers Division\, Federal Career Services Division & Younger Lawyers Division \nRegistration is Closed \n\nPanelists\n \nErin McAdams Franzblau\, Partner\, Freeborn & Peters (Moderator) \nErin McAdams Franzblau is a Partner in the Litigation Practice Group of Freeborn & Peters in Chicago\, focusing her practice on employment litigation and counseling. Erin helps companies navigate employment laws\, and defends employers in a wide range of class\, collective\, and single-plaintiff disputes before federal and state courts. She is experienced in all stages of litigation\, from inception through trial and post-trial appeals. \nEarlier in her career\, Erin clerked for the Honorable William J. Zloch\, United States District Judge of the Southern District of Florida. She also practiced employment litigation at Morgan\, Lewis & Bockius. Erin is active with her local Federal Bar Association chapter\, having served on the board for four years. \nAlbert Jacobs\, Chair\, Senior Lawyers Division \nWith more than 40 years of experience in every phase of Patent Law\, Mr. Jacobs has spent the last 30 years litigating Biotech\, Pharmaceutical\, and Medical Device Patents\, for multinational companies both before the Federal District Courts\, the Court of Appeals for the Federal Circuit (CAFC) and the International Trade Commission (ITC). He was the first of a group of attorneys to participate in the ITC’s first 100 Day Proceeding dealing with the issue of whether or not there was a Domestic Industry in the subject matter of the Patent. He was successful in proving there was not. He successfully sued a number of large well known foreign companies in one of the largest ITC cases ever filed when he brought an action against 44 companies. He has appeared before the CAFC from its outset and is the only attorney ever to invalidate a Patent for his client on an appeal from an improvidently granted Preliminary Injunction. \nMr. Jacobs has participated in numerous Mediations both in the Federal Courts and in the ITC. He was appointed by the Secretary of Commence to a 3-year term on the Patent Public Advisory Committee. He is a Certified Mediator under New York State Statutes and has participated in a wide range of Domestic Family Matters. He has served as a coach for the Association of the Bar of the City of New York in their Mediation Program.\nA graduate of Harvard College and Columbia Law School where he was a Stone Scholar\, he is a member of numerous Bars as well as the Supreme Court of the United States. \nHe is currently Chair Elect of the Maricopa County Bar Association Litigation Section and is the Chair of the Senior Lawyers Division of the Federal Bar Association (FBA)\, and Chair of the Senior Lawyers Committee of the Phoenix Chapter of the FBA as well as member of that Chapter’s Executive Committee. \nKaren King\, Chair\, Federal Career Service Division \nKaren King joined the FBA in 2015 and served as the Lafayette/Acadiana Chapter President in 2019. She has also served the FBA on the Chapter Activity Fund Committee and is a member the Constitution\, Bylaws\, Rules\, and Resolutions Committee. She is the Chair of the Federal Career Service Division. \nKaren has been a Civil Assistant United States Attorney in the Western District of Louisiana for 19 years. Prior to joining the U.S. Attorney’s Office\, Karen spent time in private practice where she handled workers’ compensation\, insurance defense\, and municipal and police liability cases. She currently handles a wide variety of civil cases spanning the areas of civil rights\, employment discrimination\, general tort\, medical malpractice\, eminent domain\, affirmative civil enforcement\, defensive commercial litigation\, Bivens\, and immigration. She also serves the U.S. Attorney’s Office as the Civil eLitigation Coordinator\, Civil Civil Rights Coordinator\, and District Election Officer (Lafayette Office). \nKaren is a Fellow of both the Foundation of the Federal Bar Association and the Louisiana State Bar Foundation\, where she serves on the Governance Committee. As an FBA Foundation Fellow she participated in the selection of the 2021 recipient of the Dr. J. Clay Smith Jr. Diversity in the Legal Profession Scholarship. \nAdditionally\, she is the Immediate Past President of the Lafayette Bar Association and a member of the Board of Directors for the Lafayette Bar Foundation. In 2021\, as President of the Lafayette Bar Association\, Karen created two initiatives: Lafayette Bar Cares and Let’s Talk About It. Lafayette Bar Cares focuses on the health and well-being of attorneys and connects the association to the community through outreach and service. Let’s Talk About It provides a forum for bar members to discuss current issues that affect the practice and the community. Most recently\, Karen has implemented the American Bar Association’s Grit Project within the Lafayette Bar Association to use grit and growth mindset to advance women in the law. \nMarj Leaming\, Board Member\, Senior Lawyers Division \nMarj Leaming provides consulting\, training\, and assistance on individual\, or group projects related to privacy\, system risk management\, and business law compliance.  Previously\, she provided these services in Federal and State government\, non-profit\, and private sectors. Prior to becoming a consultant\, she served as the Chief Privacy Officer (CPO) for the U.S. Department of Agriculture\, where she approved deliverables from 20 agencies comprising the Privacy Council; issued case decisions; and conducted individual and group technical assistance and specialized training through meetings\, consultations\, and teleconferences.  Previously\, she served as Director- IT Systems Privacy and Security Division/Privacy Officer for the Department of Homeland Security (DHS) Office of Inspector General during which she conducted inspections and evaluations related to privacy\, system security\, risk management\, and business law compliance. She is experienced in working closely with General Counsel\, CIO\, CISO\, Chief Physical Security\, Data Officer\, Communications\, and customer communities for program planning and evaluation\, as well as to consult in how best to respond\, report\, investigate\, and remediate data breaches. \nSteven Miller\, Immediate Past Chair\, Senior Lawyers Division\, and Officer for the Federal Career Service Division \nSteven Miller is a Deputy Assistant General Counsel for Environment in the Office of the Assistant General Counsel for the Environment\, in the Office of General Counsel at the U.S. Department of Energy (DOE)\, in Washington\, D.C. In that position\, Steve is responsible for providing advice and counsel to various DOE offices on environmental conflict resolution\, uranium mill tailings\, remedial action\, CERCLA\, including natural resource damage issues\, long-term stewardship and other environmental matters. He assisted in the drafting of provisions of the 1986 CERCLA amendments and the subsequent executive order delegating the President’s authorities to the various federal agencies and received an award for that effort.  He also has served as a mentor to DOE employees\, law students\, college and high school students as part of various DOE-sponsored mentoring and internship programs. Steve has served with the Department of Energy and its predecessor agency\, the Energy Research and Development Administration\, since 1977.  In addition to his DOE responsibilities\, Steve is also the Immediate Past Chair of the Senior Lawyers Division of the Federal Bar Association\, where he has had numerous leadership roles.  Steve holds a J.D. degree from the New York University School of Law\, a M.U.P. SUMMARY:Maryland Chapter: Supreme Court Update
DESCRIPTION:The Supreme Court has had one of its most monumental terms in years\, with plenty of important developments in criminal and civil law. In addition to several high-profile cases involving capital punishment\, including the Boston marathon bombing case\, the Court tackled cases ranging from the constitutionality of pre-viability prohibitions on elective abortions\, whether the Second Amendment protects concealed carry licenses for firearms\, vaccine mandates\, school prayer\, opioid prosecution standards\, and what constitutes a “crime of violence” under federal criminal law. Jason Medinger\, Appellate Chief at the United States Attorney’s Office for the District of Maryland\, Paresh Patel\, Appellate Chief at the Office of the Federal Public Defender for the District of Maryland\, and Professor and Legal Analyst Kim Wehle will discuss these and other significant cases from the Supreme Court’s 2021-2022 term and how these decisions affect our practice. \n\nSpeaker\nJason D. Medinger \nJason D. Medinger has been serving as the Appellate Chief for the U.S. Attorney’s Office in Maryland since 2017. Prior to that\, he served as an Assistant United States Attorney in Maryland prosecuting narcotics and violent crime cases. He has also served as a civil AUSA\, defending the United States government and its agencies against civil actions alleging torts and employment discrimination. Prior to entering government service\, Mr. Medinger worked at a law firm in Atlanta\, Georgia. Mr. Medinger has been an adjunct professor of law at Stevenson University since 2011. He clerked for the Honorable Stanley F. Birch\, Jr.\, on the U.S. Court of Appeals for the Eleventh Circuit from 2004-2005. He received his law degree from the Emory University School of Law in 2004\, and his undergraduate degree from the University of Notre Dame in 2000. \nParesh Patel \nParesh Patel is currently the Appellate Chief at the Office of the Federal Public Defender for the District of Maryland. He has been at the Federal Public Defender since 2003. Before then\, he worked as a staff attorney at the Public Defender Service in Washington\, D.C. and the Office of the Appellate Defender in New York\, New York. In 1999-2000\, he clerked for the Honorable Ancer L. Haggerty of the United States District Court for the District of Oregon in Portland. Paresh earned his J.D. from American University in 1996\, and he received his undergraduate degree from the University of Southern California in 1993. \nKimberly L. Wehle \nKimberly L. Wehle is a tenured law professor at the University of Baltimore School of Law and former CBS News legal analyst. She writes on the separation of powers\, outsourcing government\, and the federal administrative state. She is also an op-Ed contributor for Politico\, The Atlantic\, The Hill and The Bulwark\, and a regular commentator on CNN\, MSNBC\, and NPR’s Morning Edition. DESCRIPTION:If you take even a cursory glance at the news\, you know that the U.S. Supreme Court’s October 2021 term will go down in history as one of the most consequential terms this century\, impacting the civil rights of millions of Americans.  In this CLE\, on July 13\, at 2:00 p.m. Eastern time\, we’ll go beyond the headlines to identify and discuss not only the potentially groundbreaking Supreme Court decisions in the areas of abortion and gun rights\, but also the Court’s deep docket of civil rights cases affecting the First Amendment\, equal protection\, police procedures\, qualified immunity\, remedies under federal civil rights statutes\, education and disability rights\, standing\, and more.  The panelists will talk about important holdings and share their insights about what the cases from the term mean and their perspectives about future civil rights decisions at the Court.  The CLE will be perfect for civil rights practitioners\, or just the civil-rights-curious who’d like to have a more comprehensive look at civil rights cases and trends at the Supreme Court.  The panelists of this CLE feature Tulane Assistant Clinical Professor of Law Sam Brandao and MacArthur Justice Center’s Supreme Court and Appellate Program Deputy Director Devi Rao\, and Utah Attorney General Kyle Kaiser will be the moderator. The CLE is sponsored by the Civil Rights Section of the Federal Bar Association. \nPresented by Civil Rights Law Section \n\nAbout the Presenters\nKyle Kaiser\, Assistant Utah Attorney General and Senior Trial Attorney\, Utah Attorney General’s Office (Moderator) \nKyle Kaiser is an Assistant Attorney General and Senior Trial Counsel in the Litigation Division of the Utah Attorney General’s Office.  He has been with the office since July 2011.  Kyle is also appointed as a judge pro tempore for the Salt Lake City Justice Court\, presiding over civil small claims matters. \nKyle’s practice centers on defending claims of constitutional or civil rights violations brought against the State of Utah\, its agents\, agencies\, and subdivisions\, and Utah colleges and school districts.  Before working for the Utah AG’s Office\, Kyle was employed as Staff Attorney for Justice Dale Wainwright of the Supreme Court of Texas.  Before that\, Kyle was a litigation and intellectual property associate with the law firm of Winthrop & Weinstine\, P.A. in Minneapolis\, Minnesota\, and served as a law clerk for Richard Dorr\, United States District Judge for the Western District of Missouri\, in Springfield. \nKyle received his J.D.\, with high distinction\, from the University of Iowa College of Law in 2003\, where he was Senior Managing Editor of the Iowa Law Review\, was awarded the Hancher-Finkbine Medallion\, and was inducted into Order of the Coif.  Kyle received his bachelor’s degree in journalism from Drake University\, summa cum laude\, in 2000. \nAway from work\, Kyle enjoys spending time with his wife Pearl\, their daughter Cora\, and their cat Milo; camping around Utah in a 1983 Chevy RV; competing in pub trivia events (mostly virtually this year); playing percussion with the local community band and piano in the privacy of his own home; and judging mock trial competitions. \n \nSamuel T. Brandao\, Clinical Assistant Professor of Law\, Tulane University Law School – Civil Rights and Federal Practice Clinic \nSam Brandao is a Clinical Assistant Professor of Law with experience enforcing civil rights including fair housing\, rights protected by the Fourth Amendment\, and disability rights. He joined the Tulane Civil Rights and Federal Practice Clinic in 2016 after completing a two-year Skadden Fellowship\, during which he served as a staff attorney at Southeast Louisiana Legal Services in New Orleans. At SLLS\, he litigated housing discrimination cases and advocated for policy changes on behalf of people with disabilities. Brandao clerked for United States District Judge Eldon E. Fallon of the Eastern District of Louisiana and for Circuit Judge Jacques L. Wiener\, Jr. of the United States Court of Appeals for the Fifth Circuit. In the Civil Rights and Federal Practice Clinic\, he assists Director Lucia Blacksher Rainer in supervising student-attorneys in a range of client representation\, including federal cases involving the civil rights of incarcerated citizens\, police misconduct\, employment discrimination\, housing discrimination\, and other constitutional claims. \nDevi M. Rao\, Director\, Roderick & Solange MacArthur Justice Center \nDevi M. Rao is the Director of the Washington D.C. office and Deputy Director of the Supreme Court and Appellate Program at the MacArthur Justice Center. She briefs and argues important civil rights and criminal justice issues in federal appeals courts across the country\, and in the U.S Supreme Court\, including qualified immunity\, excessive force\, municipal liability issues\, habeas\, access to the courts\, and federal sentencing issues. She also teaches at Harvard Law School\, co-directing the law school’s Criminal Justice Appellate Clinic and Seminar. \nPrior to joining the MacArthur Justice Center\, Devi was a partner in the Supreme Court and Appellate practice at a major law firm. \nDevi previously served as a law clerk for Justice Ruth Bader Ginsburg on the U.S. Supreme Court and for Judge M. Margaret McKeown on the U.S. Court of Appeals for the Ninth Circuit. SUMMARY:Webinar: Insights into the Two Most Popular Types of PTAB Proceedings: Appeals and Inter Partes Reviews
DESCRIPTION:Patent Trial and Appeal Board (PTAB) Appeals and PTAB Inter Partes Reviews are extremely valuable proceedings for inventors\, patent owners\, and the patent community generally. The pre-proceeding phase and decisions you make during that time are critical. Then\, your strategies and conduct during these proceedings will often lead to favorable results in the end for the client. This webinar will set forth data-driven\, thoughtful and specific insights for the two most-employed proceedings at the PTAB\, i.e.\, Appeals and Inter Partes Reviews. \nPresented by the Intellectual Property Law Section \n\n \nPanelists\nJoseph G. Piccolo \nIn 1985\, Joe Piccolo graduated from the University of Notre Dame with honors and received a B.S.E.E. From 1985-87\, Joe worked for the General Electric Company and then went on to law school. In 1988\, Joe began working in the intellectual property law field for the U.S. International Trade Commission. In 1990\, Joe graduated from NYU Law School and from 1990-91\, he clerked for the Honorable Alan D. Lourie at the U.S. Court of Appeals for the Federal Circuit. In 1991\, Joe was admitted to the USPTO Patent Bar and the New York State Bar. \nJoe then went on to practice law at the USPTO Solicitor’s Office\, where he orally argued 50 Federal Circuit appeals and drafted 88 Federal Circuit briefs for the USPTO. He was also co-counsel in 66 additional Federal Circuit appeals. Joe won scores of appeals\, including such significant appeals as In re Schreiber (1997 patent prosecution case cited innumerable times)\, In re Watts (USPTO achieving its long-sought victory on the legal doctrine of waiver)\, Zumbiel v. Kappos (a complicated inter partes patent reexamination appeal where Joe successfully argued both the patentability of certain claims and the unpatentability of other claims)\, and Shimano v. Rea (a complex inter partes patent reexamination appeal where Joe successfully defended the PTAB as to both its patentability and unpatentability determinations which centered on claim construction and written description). Joe also worked on approximately 90 district court civil actions involving the USPTO. Additionally\, Joe worked on multiple Supreme Court cases\, including Holmes v. Vornado (2002)\, MedImmune v. Genentech (2007)\, and SAS Institute v. Iancu (2018). While working at the USPTO\, Joe received an Exceptional Career Award and a Bronze Medal Award. \nIn 2021\, Joe became a partner at Davidson Berquist Jackson & Gowdey\, where he focuses largely on PTAB Appeals. In view of his thirty-year federal government career\, Joe is in a very strong position to analyze patent prosecution records to assess the viability of appealing USPTO examiner final rejection decisions to the PTAB. He can readily draft compelling appellate briefs and persuasively argue such appeals. Joe has given several presentations on the topic of PTAB Appeals. Joe also handles other types of prosecution matters \nJames T. Carmichael \nJames T. Carmichael is a former Administrative Patent Judge on the Board of Patent Appeals and Interferences (now the Patent Trial and Appeal Board). Jim was employed by the U.S. Patent and Trademark Office (PTO) for eight years\, including working in the electrical and computer division of the Board as an Examiner-in-Chief. Currently he represents inventors and patent challengers before the PTO in post-grant proceedings including Inter Partes Review and Reexamination. Jim regularly serves as an expert witness on PTO prosecution and post-grant procedures. \nBefore becoming a Judge\, Jim served for five years as an Associate Solicitor of the PTO. In that capacity\, he represented the agency in federal court litigation and argued more than thirty cases at the U.S. Court of Appeals for the Federal Circuit. The cases Jim handled included patentability and reexamination. He was also Coordinator of attorney discipline proceedings. Jim helped develop PTO procedures relating to the duty of disclosure as well as post-grant proceedings. \nPatexia scored Jim as one of the top three most-winning attorneys in IPRs at the PTAB (out of all 3\,462 attorneys representing patent owners) from 2014 to 2019\, while Carmichael IP was ranked the #1 firm. Jim graduated from Yale University in 1984\, and from University of Wisconsin Law School in 1987 with honors. Our course will also discuss the qualifications of a forensic meteorologist expert and the admissibility of a weather expert in court. We will cover data sources a forensic meteorologist relies on and the pitfalls/limitations of the data. The latest science and technology available for a meteorologist will also be presented. Finally\, we will provide real-life case examples where a forensic meteorologist was utilized. \nPresented by the Admiralty Law Section and Federal Litigation Section \n\nAbout the Presenters\nCharlie Davant\, Attorney\, Davant Law \nCharlie\, a Florida native\, has been working on\, in and around boats his whole life.
