DESCRIPTION:With new aggressive enforcers at both DOJ and FTC\, the Biden Administration has changed many antitrust priorities. An interactive exchange between moderator and panelists will cover criminal\, civil\, and legislative initiatives. New criminal prosecutions of no poach/wage fix agreements have been upheld under per se analysis but the first two trials resulted in acquittals. Both agencies continue litigation against Big Tech\, Google and Facebook specifically\, and support new legislation reigning in platforms. Pronouncements now criminalize monopolies. DOJ leniency policy is tweaked\, raising requirements\, and plea carve-ins of individuals are restricted. \nPresented by Antitrust & Trade Regulation Section \n\nAbout the Speakers\nLisa M. Phelan\, former Chief of the National Criminal Enforcement and Washington Criminal I Sections of the Antitrust Division of the U.S. Department of Justice (DOJ)\, is a partner and Co-Chair of Morrison & Foerster’s Global Antitrust Law Practice and Investigations + White Collar Group. With more than 25 years of service at the DOJ as one of the leading authorities in criminal antitrust matters\, Ms. Phelan draws upon her unmatched criminal investigations\, litigation\, and enforcement experience to guide clients through sensitive matters pertaining to international cartel actions and white collar investigations\, and to rapidly assess and address their total exposure to potential claims of unlawful collusion. \nAs Chief of the National Criminal Enforcement and Washington Criminal I Sections of the Antitrust Division\, Ms. Phelan supervised and coordinated all investigative and litigation work on international and national criminal cartel cases. Bizzell\, Senior Assistant General Counsel\, Altria; Past President\, National LGBTQ+ Bar Association \nWesley Bizzell serves as Senior Assistant General Counsel and Managing Director of Political Law & Ethics Programs for Altria Client Services. Overseeing a comprehensive compliance system covering the regulation of government affairs\, Mr. Bizzell provides advice and guidance on political law compliance for more than 75 jurisdictions. Mr. Bizzell also heads the legal team that supports Altria’s public policy activities\, providing services related to legislative and regulatory drafting and interpretation. \nMr. Bizzell is an authority on political law compliance\, serving as co-chair of the Conference Board’s Committee on Corporate Political Spending\, a committee of leading American corporations dedicated to education and engagement on issues of corporate political activity. For four years\, he served as co-chair of the Council on Governmental Ethics Laws’ (“COGEL”) annual conference. In 2018\, COGEL awarded Mr. Bizzell its highest honor\, the COGEL Award\, for making a “demonstrable and positive contribution to the fields of campaign finance\, ethics\, elections\, lobbying and freedom of information over a significant period of time.” \nPreviously\, Mr. Bizzell was an attorney in Winston & Strawn LLP’s Federal Government Relations and Regulatory Affairs Practice Group. His career also includes more than six years on Capitol Hill\, where he served as an aide to Arkansas Senators David Pryor and Dale Bumpers. \nMr. Bizzell is extremely active in promoting diversity and inclusion within the legal and corporate communities. He is a founding member and serves on the steering committee for Altria’s LGBTQ+ Employee Resource Group and is the immediate past president of the National LGBTQ+ Bar Association\, after serving a two-year term. He has been named by London’s Financial Times (2017 and 2018) and Yahoo Finance (2019 and 2020) as one of the 100 worldwide OUTstanding Leading LGBT+ Corporate Executives\, and Chambers and Partners also named him the 2019 LGBT+ Equality Lawyer of the Year for his dedication and commitment to LGBT diversity programs and his efforts to advance LGBT+ professionals in the law. In 2021\, he was appointed to serve as a commissioner for the American Bar Association’s Sexual Orientation and Gender Identity (SOGI) Commission. \nMr. Bizzell graduated with a B.A. in Justice\, magna cum laude\, from the American University in Washington\, D.C. and received a Master of Social Work with a focus in public policy from the Catholic University of America. He received his J.D.\, magna cum laude\, from Georgetown University Law Center\, where he was elected to the Order of the Coif and served as an editor for the Georgetown Law Journal. \nJay Kaplan\, LGBT Project Staff Attorney\, ACLU of Michigan \nJay Kaplan has been the staff attorney for the ACLU of Michigan’s LGBT Project since its founding in 2001. \nHe has worked on cases including challenging undercover sting operations targeting gay men\, fighting Michigan’s constitutional amendment prohibiting same-sex couples from marrying\, defending the validity of second parent adoptions granted in Michigan\, and recently advocating for a transgender high school student to be able to run for prom court. Jay was honored with the 2006 Unsung Hero Award from the Michigan State Bar and the 2010 Virginia Uribe Civil Rights Award from the National Education Association (NEA). \n  \n  \nRobin B. Thank you! \n\nAbout the Presenters\nSenior Judge Royce C. Lamberth \nRoyce C. Lamberth was appointed United States District Judge for the District of Columbia on November 16\, 1987.  He served as Chief Judge from May 1\, 2008 to July 15\, 2013\, at which time he became a Senior Judge. \nJudge Lamberth\, a native of San Antonio\, Texas\, graduated from the University of Texas\, receiving a B.A. degree in 1966 and from the University of Texas School of Law\, receiving an LL.B degree in 1967.  He served as a Captain in the Judge Advocate General’s Corps of the United States Army from 1968 to 1974.  After service at Fort Bragg\, North Carolina\, and in Vietnam\, Judge Lamberth served in the Litigation Division of the Office of the Judge Advocate General of the Army at the Pentagon from 1971 to 1974. \nJudge Lamberth served as an Assistant United States Attorney for the District of Columbia from 1974 to 1987.  He was Chief of the Civil Division of the United States Attorney’s Office\, 1978 – 1987. \nJudge Lamberth is married to the former Janis K. Jost of San Antonio.  He is former Chairman of the Federal Litigation Section of the Federal Bar Association\, and a member of the American Bar Association and the Bar Association of the District of Columbia\, and the District of Columbia Bar. \nJudge Lamberth is also former Chairman of the Professional Ethics Committee of the Federal Bar Association.  The Federal Bar Association’s Model Rules of Professional Conduct for Federal Lawyers\, finally approved in October 1990\, were drafted by Judge Lamberth’s Committee. \nJudge Lamberth was appointed by Chief Justice Rehnquist to be Presiding Judge of the United States Foreign Intelligence Surveillance Court on May 19\, 1995.  That appointment ended May 19\, 2002. \nJudge Lamberth served as a member of the Judicial Conference of the United States from May 2008 to July 2013.  He also served as a member of the Judicial Conference’s Committee on Automation and Technology from 1990 to 1996\, and from 2003 to 2008\, served as Chairman of the Judicial Conference’s Committee on Inter-Circuit Assignments.  Chief Justice Roberts appointed him to again Chair the Inter-Circuit Assignment Committee\, effective October 1\, 2013. \nColonel Luis O. Rodriguez\, Director\, Office of Diversity\, Equity\, and Inclusion\, Office of the Judge Advocate General\, U.S. Army\nColonel (COL) Luis O. Rodriguez assumed his current duties as director of the U.S. Army Judge Advocate General’s Corps’ Office of Diversity\, Equity\, and Inclusion (ODEI) in June 2021\, leading efforts to improve DEI across the Corps.
