Please join us in honoring Justice Breyer’s incredible career. \nPresented by the Professional Development Committee \n\nPresenters\nHon. Stephen G. Breyer (Retired)\, Associate Justice\, Supreme Court of the United States\nThe Honorable Stephen Breyer is a retired Associate Justice of the Supreme Court of the United States. Born in San Francisco in 1938\, he is a graduate of Stanford\, Oxford\, and Harvard Law School. He taught law for many years as a professor at Harvard Law School and at the Kennedy School of Government. He has also worked as a Supreme Court law clerk (for Justice Arthur Goldberg)\, a Justice Department lawyer (antitrust division)\, an Assistant Watergate Special Prosecutor\, and Chief Counsel of the Senate Judiciary Committee. In 1980\, he was appointed to the U.S. Court of Appeals for the First Circuit by President Carter\, becoming Chief Judge in 1990. In 1994\, he was appointed to the Supreme Court by President Clinton. He has written books and articles about a range of legal topics\, including administrative law\, economic regulation\, and the U.S. Constitution.  His books include Active Liberty (2005)\, Making Our Democracy Work: A Judge’s View (2010)\, The Court and the World (2015)\, and The Authority of the Court and the Peril of Politics (2021). His wife\, Joanna\, was born in Great Britain and is a retired clinical psychologist. They have three children—Chloe\, Nell\, and Michael—and six grandchildren. \n \nKaren L. Dunn\, Partner\, Paul\, Weiss\, Rifkind\, Wharton & Garrison LLP\nKaren L. Dunn is one of the nation’s top trial lawyers.  She has successfully tried some of the largest and most high-profile cases in recent years\, including Epic v. Apple\, Waymo v. Uber\, Malden v. Uber\, and Oracle v. Rimini Street.  Recently\, she won an historic victory in Sines v. Kessler\, the landmark civil rights trial against neo-Nazis and white supremacists responsible for the violence in Charlottesville\, Virginia in 2017.   A veteran of all three branches of government\, and former debate adviser to President Obama\, Secretary of State Hillary Clinton and Vice President Harris\, Karen is also a skilled crisis manager helping companies and executives navigate reputation-threatening events.  Karen was recently named a “Litigator of the Year” by The American Lawyer for handling “high-stakes\, high-profile and hard-fought” cases.  She has also been named a “Litigator of the Week” five times; one of the National Law Journal’s “Outstanding Women Lawyers”; one of Benchmark Litigation’s “Top-10 Women in Litigation” and “Top 100 Trial Lawyers”; and one of Elle Magazine’s “Most Compelling Women in Washington Now.”  Earlier in her career\, Karen served as an Assistant United States Attorney\, Associate Counsel to the President\, and law clerk to Justice Stephen G. Breyer and Judge Merrick B. Garland. \nNeal Katyal\, Partner\, Hogan Lovells\nNeal Katyal is the Paul and Patricia Saunders Professor of Law at Georgetown University and a Partner at Hogan Lovells. He previously served as Acting Solicitor General of the United States.  He has argued 45 cases before the Supreme Court of the United States\, with 45 of them in the last 15 years\, and his 46th argument is expected in October 2022 and his 47th in November 2022. His cases include successfully striking down the Guantanamo military tribunals\, successfully defending the constitutionality of the Voting Rights Act\, successfully defending the Peace Cross in Maryland\, and a landmark personal jurisdiction win for Bristol Meyers Squibb.  At the age of 52\, he has already argued more Supreme Court cases in U.S. history than has any minority attorney\, recently breaking the record held by Thurgood Marshall. His numerous distinctions include: the Edmund Randolph Award (the highest civilian award given by U.S. Department of Justice)\, The Litigator of the Year by American Lawyer (2017 and 2018\, chosen as the sole Grand Prize Winner of all the lawyers in the United States)\, Appellate MVP by Law360 numerous times (most recently in 2017)\, winner of Financial Times Innovative Lawyer Award in two different categories (both private and public law) (2017)\, one of GQ’s Men of the Year (2017)\, 40 Most Influential Lawyers of the Last Decade Nationwide by National Law Journal (2010)\, and 90 Greatest Washington Lawyers Over the Last 30 Years by Legal Times (2008).  Neal also won the National Law Journal’s pro bono award in 2004. He has appeared on virtually every major American news program\, as well as on Stephen Colbert’s Late Show. He has also performed on Netflix’s House of Cards and Showtime’s Billions (where he played himself in both series).  In 2021\, Neal was named a Trustee of Dartmouth College. In 2022\, he was named a Trustee of the Whitney Museum in New York City. \nAlexander A. Reinert\, Max Freund Professor of Litigation & Advocacy and Director\, Center for Rights and Justice\, Benjamin N. Cardozo School of Law\nAlex Reinert is the Max Freund Professor of Litigation and Advocacy and the Director of the Center for Rights and Justice at the Benjamin N. Cardozo School of Law.  Alex joined Cardozo’s faculty in 2007\, after working as an associate at Koob & Magoolaghan for six years\, where he focused on the rights of people confined in prisons and jails\, employment discrimination\, and disability rights. Alex teaches and conducts research in the areas of Civil Procedure\, Constitutional Law\, Criminal Law\, Federal Courts\, and Law of Prisons and Jails.  His articles have appeared in the California Law Review\, Northwestern University Law Review\, Stanford Law Review\, the University of Pennsylvania Law Review\, and the University of Virginia Law Review\, among other journals.  He has appeared on behalf of parties and amicus curiae in many significant civil rights cases.  In 2016 he became the director of the Center for Rights and Justice\, which brings together the scholarship\, programs and clinics at Cardozo engaged in public service\, client advocacy and academic scholarship dealing with issues of fairness\, equality\, access to justice and transparency.  Alex graduated magna cum laude from New York University School of Law in 1999\, after which he clerked first with the Hon. Harry T. Edwards\, D.C. Circuit Court of Appeals\, and then with Justice Breyer. \nPratik A. Shah\, Partner\, Head of Supreme Court & Appellate Practice\, Akin Gump Strauss Hauer & Feld LLP\nPratik Shah is a partner at Akin Gump Strauss Hauer & Feld LLP and heads the firm’s Supreme Court and appellate practice.  Pratik\, who previously served as an Assistant to the Solicitor General in the U.S. Department of Justice\, has argued 16 cases before the U.S. Supreme Court and 60 more in other federal and state appellate courts—including in every circuit.  Pratik has also taught constitutional law\, and clerked for Justice Stephen G. Breyer on the U.S. Supreme Court and Judge William A. Fletcher on the U.S. Court of Appeals for the 9th Circuit. \nModerator: Sara A. Solow\, AUSA\, U.S. Attorney’s Office for the Eastern District of Pennsylvania\nSara Solow is a federal prosecutor at the U.S. Attorney’s Office for the Eastern District of Pennsylvania and served as Senior Counsel to the Deputy Attorney General.  Previously\, she worked as a Senior Associate at Hogan Lovells in their appellate and litigation groups\, with a focus on public interest litigation and global technology legal challenges.  She also served as an adjunct faculty member at NYU Law School\, co-teaching a course on supreme court litigation.  Sara served as a law clerk to Justice Stephen G. SUMMARY:Indian Law & TTSL Sections: Tribal Transportation Equity Panel
DESCRIPTION:This program\, jointly hosted by the FBA Indian Law and Transportation and Transportation Security Law sections\, is designed to share information with transportation and Tribal law practitioners regarding opportunities to use transportation programs to enhance Tribal sovereignty and address equity challenges in Indian country. Historically\, transportation infrastructure in Tribal communities has been underfunded\, which has resulted in hardships to Tribal communities. In recognition of this underinvestment and its consequences\, the Bipartisan Infrastructure Law (BIL or Infrastructure Investment and Jobs Act) increased investment in Tribal community transportation infrastructure. This program will highlight transportation programs in the BIL specifically designed to support Tribes\, as well as select other programs in the BIL that Tribes are eligible to apply for funding under\, and which may be used to advance equity and Tribal sovereignty. The discussion will also focus on the Tribal Transportation Self-Governance Program\, which was authorized by the FAST Act and provides Tribes with greater control\, flexibility\, and decision-making authority over federal funds used to carry out Tribal transportation programs\, functions\, services and activities in Tribal communities. These webinars enable attendees to receive education and mentoring from seasoned immigration attorneys or specialists in specific areas of immigration law. Panelists Shadi Karimi\, Peter Roudik\, and Barbara Bavis will provide a general overview of the Library of Congress Law Library and its services on foreign and comparative law. This webinar will also include a discussion of the online products available to lawyers and how these materials have been used when working with individual clients from Iran and Afghanistan. \nPresented by: Immigration Law Section & Younger Lawyers Division \nRegistration is Closed \n\nPresenters\nShadi Karimi\, Esq.\, LL.M.\, is a New York licensed attorney\, educated in both Civil Law and Common Law systems. She provides affirmative asylum representation\, through Human Rights First’s Project Afghan Legal Assistance (PALA)\, and serves as a Foreign and Comparative Law Consultant to the Law Library of Congress.  Ms. Karimi is active in offering pro bono immigration services\, including removal defense.  She is a graduate of American University\, Washington College of Law\, and Azad University of Tehran. Ms. Karimi is a member of the Federal Bar Association Immigration Law Section (FBA ILS)\, and American Immigration Lawyers Association (AILA). \nPeter Roudik is an Assistant Law Librarian of Congress for Legal Research. He coordinates research on all issues of U.S.\, foreign\, comparative\, and international law for Congress and other branches of government. He also provides research on the laws of Russia and other former Soviet republics.  Before joining the Law Library in 1996\, Dr. Roudik worked as a research scholar at the University of Chicago Law School\, served as a legal advisor to the Russian Parliament\, and taught law at the Moscow Institute of Technology.  He holds an MA from the U.S. Naval War College\, a JSD from the Institute of State and Law of the Russian Academy of Science\, and a JD from the State University of Moscow.  Dr. Roudik is a member of the DC Bar. He has been a guest lecturer at Howard and Tufts Universities.  He has been featured at various professional conferences and his articles on legal developments in the countries of his jurisdiction have been published in legal periodicals in the U.S. and abroad. \nBarbara Bavis is the Bibliographic and Research Instruction Librarian for the Law Library of Congress. In this position\, she organizes the Law Library’s legal and legislative research class offerings\, provides presentations to a wide range of patrons¾congressional staff members\, federal government employees\, and members of the public. She also provides legal research services to patrons\, both at the reference desk in the Law Library Reading Room and via the Law Library’s Ask a Librarian service. Before joining the Law Library of Congress in 2012\, Ms. Bavis was a practicing attorney at LeClairRyan\, a former National Law Journal Top 250 firm\, where she represented clients in a range of immigration\, labor and employment\, and civil cases. Ms. Bavis then went on to provide reference services for the Department of Justice Libraries system before serving as the Faculty Services Librarian at Lincoln Memorial University’s Duncan School of Law. There\, she was responsible for assisting faculty members with the publication process\, administrating the Student Research Assistant Program\, and teaching in the Lawyering Skills Program\, where she provided classes on legal research and writing. Sullivan\, Circuit Judge\, U.S. Court of Appeals for the Second Circuit \nRichard J. Sullivan was sworn in as a Judge on the United States Court of Appeals for the Second Circuit in October 2018.  Before that\, Judge Sullivan served for eleven years as a trial judge on the United States District Court for the Southern District of New York in Manhattan. Prior to becoming a judge\, he was General Counsel and Managing Director of Marsh Inc.\, the world’s leading risk management and insurance brokerage firm. From 1994 to 2005\, he served as an Assistant United States Attorney in the Southern District of New York\, where he was Chief of the International Narcotics Trafficking Unit and Director of the New York/New Jersey Organized Crime Drug Enforcement Task Force. In 2003\, he was awarded the Henry L. Stimson Medal from the Association of the Bar of the City of New York. In 1998\, he was named the Federal Law Enforcement Association’s Prosecutor of the Year. \nAlee Scott\, Chief\, Civil Enforcement Division\, Medicaid Fraud Control Unit\, Office of the New York State Attorney General \nAlee N. Scott is Chief of Civil Enforcement for the New York Attorney General’s Medicaid Fraud Control Unit (“MFCU”).  As MFCU’s Civil Chief\, she is part of the management team responsible for directing the implementation of MFCU’s Strategic Plan and stated mission:  to pursue civil recoveries arising from Medicaid provider fraud; to protect all New York State (“NYS”) nursing home residents from abuse and neglect; and to protect the integrity of the NYS Medicaid Program. Ms. Scott supervises attorneys and other team members\, such as auditors and investigators\, to develop effective investigative planning techniques\, optimize efficient use of the Unit’s resources\, and evaluate and analyze civil claims and resolutions consistent with the MFCU Strategic Plan. In 2021\, MFCU’s civil recoveries totaled approximately $73 Million. \nPrior to her appointment to Chief in 2019\, Ms. Scott served as Special Assistant Attorney General in the Civil Enforcement Division and worked with interdisciplinary teams to investigate and prosecute complex Medicaid provider fraud schemes.  Before she joined the Office of the Attorney General in 2014\, she worked as an associate at Constantine Cannon\, LLP in the firm’s antitrust and commercial litigation practice\, and represented clients in all stages of federal litigation. \nRebecca S. Tinio\, Co-Chief\, Civil Frauds Unit\, U.S. Attorney’s Office\, Southern District of New York \nRebecca S. Tinio is Co-Chief of the Civil Frauds Unit in the U.S. Attorney’s Office for the Southern District of New York. In that capacity\, Ms. Tinio supervises nearly two hundred active investigations and litigations involving alleged fraud on the Government and on financial institutions\, including in the areas of health care\, federal grants and special programs\, contracts\, customs\, and many more. Ms. Tinio also has substantial experience in handling significant defensive matters on behalf of the United States. Before joining the U.S. Attorney’s Office\, Ms. Tinio was an associate at a New York litigation boutique\, and clerked for Judge Keith P. Ellison in the Southern District of Texas and Judge Barrington D. Parker\, Jr. on the Second Circuit. Norman Acker III\, Of Counsel\, K&L Gates\nNorman Acker is of counsel in the firm’s Research Triangle Park office. Norman brings more than three decades of experience as an Assistant United States Attorney to help guide clients facing government False Claims Act investigations or other allegations of fraud or abuse of government programs. He is a member of the Health Care and FDA practice. Prior to joining the firm\, Norman served as acting U.S. attorney\, the chief federal law enforcement officer in the Eastern District of North Carolina. That office is responsible for prosecuting all federal crimes in the district\, including drug crimes\, violent crimes\, white collar fraud\, terrorism\, and public corruption. The U.S. Attorney’s Office (USAO) also represents the United States in civil court\, handling a wide variety of civil litigation. He previously served as an assistant U.S. attorney for more than 30 years\, focusing his practice on the investigation and civil prosecution of health care fraud and other fraud against the government. In this capacity\, he worked closely with the Health and Human Services Office of Inspector General (HHS-OIG)\, the North Carolina Medicaid Investigations Division (NC-MID)\, the Department of Defense Criminal Investigation Service (DCIS)\, the Drug Enforcement Administration (DEA)\, the FBI\, and other law enforcement agencies. For 17 years\, he served as the Deputy Chief of the Civil Division\, where he both handled his own case load of civil fraud and health care fraud cases\, and supervisedas well as supervising all of the civil fraud\, health care fraud\, and False Claims Act cases for the Eastern District of North Carolina. He has received numerous awards and commendations from federal and state agencies in recognition of his collection of more than $100 million in connection with False Claims Act litigation. He served briefly as the civil chief\, supervising all civil litigation for the USAO\, before becoming the first assistant\, supervising all civil\, criminal\, and appellate litigation in the office. Dec. 10\, 2020)\, vacating a Board of Immigration Appeals decision suggesting that “typical families” and landowners could not be protected by the asylum laws;\nLM.-M. v. Cuccinelli\, 442 F. Supp. 3d 1 (D.D.C. 2020)\, declaring harmful anti-asylum policies to be void because the official who made the policies was unlawfully appointed; and\nMatter of Deang\, 27 I&N Dec. 57 (BIA 2017)\, setting a precedent that certain receiving stolen property offenses are not aggravated felonies that bar applicants from obtaining asylum or withholding of removal.\n\nBradley is a graduate of the University of Notre Dame and Harvard Law School. He is a member of the Maryland bar. \nNeela Chakravartula\, Managing Attorney\, Center for Gender and Refugee Studies \nNeela Chakravartula is a Managing Attorney at the Center for Gender and Refugee Studies (CGRS).  Neela provides legal technical assistance and training to advocates\, and engages in litigation to protect the rights of asylum seekers. Neela additionally oversees the Center ‘s Experts Witness Database which connects advocates with expert witnesses in fear-of-return claims for relief. \nNeela came to CGRS after working for four years as a staff attorney at the United States Court of Appeals for the Ninth Circuit\, where she researched and reviewed cases raising claims for asylum and related forms of relief. Neela also worked in New York City for three years\, representing clients in a variety of civil matters. SUMMARY:Webinar: The PACT Act and its Implications for Representing Veterans in VA Disability Cases
DESCRIPTION:Signed into law in August 2022\, the PACT Act was created to help provide generations of veterans and their families with the care and benefits they need and deserve.  The PACT Act expanded VA health care and benefits to veterans exposed to burn pits\, herbicides\, and other toxic substances.  This webinar will highlight the PACT Act’s provisions and the effects of those legal changes on the pursuit of VA disability benefits. \nPresented by the Veterans and Military Law Section \n\nAbout the Presenters\nMaura Jean Black\, Esq.\, Managing Attorney\, Chisholm Chisholm & Kilpatrick LTD\nMaura is a managing attorney at Chisholm Chisholm & Kilpatrick LTD in Providence\, Rhode Island\, where she specializes in representing disabled veterans and their families before the U.S. Court of Appeals for Veterans Claims\, the Board of Veterans’ Appeals\, and the Department of Veterans Affairs.  Throughout her career\, she has represented hundreds of veterans and their dependents in their pursuit of VA benefits.  She has presented and organized numerous continuing legal education events that have focused on service-connected VA benefits and appeals\, VA’s appeals reform legislation\, and petitions for writs of mandamus at the U.S. Court of Appeals for Veterans Claims.  In the spring of 2022\, Maura served as a panelist during an Appeals Modernization Act presentation at the Fifteenth Judicial Conference of the U.S. Court of Appeals for Veterans Claims. Maura is an active member of the Federal Bar Association.  From 2017 to 2022\, she served in leadership positions in the FBA’s Veterans and Military Law Section.  She is currently the deputy chair of the Sections and Divisions Council. Prior to joining Chisholm Chisholm & Kilpatrick in 2016\, Maura gained experience as an associate attorney in a civil litigation firm\, a judicial law clerk in the Rhode Island Superior Court\, and an intern with both the Rhode Island Public Defender’s office and Rhode Island Legal Services.  She is a member of the Massachusetts and Rhode Island state bars and is admitted to practice before the U.S. District Court for the District of Rhode Island and the U.S. Court of Appeals for Veterans Claims.  Maura spends her free time cooking\, fitness training\, spending time with her friends and family\, and enjoying Rhode Island’s East Bay Bike Path. \nNicholas A. M. Briggs\, Accredited VA Claims Agent\, Chisholm Chisholm & Kilpatrick LTD\nNicholas joined Chisholm Chisholm and Kilpatrick in June 2015 as a Veterans Claims Advocate.  As of February 2018\, Nicholas is an Accredited VA Claims Agent.  Nicholas’s practice focuses on representing disabled veterans and their families before the VA and the Board of Veterans’ Appeals.  He is also admitted to practice before the U.S. Court of Appeals for Veterans Claims as a non-attorney practitioner. Nicholas graduated from Brown University in 2014 with a B.A. in Political Science in the subfield of International and Comparative Politics.  During college\, Nicholas completed internships with the Worcester County Committee for Public Counsel Services\, the Office of Congressman James P.
