DESCRIPTION:This session will teach attendees what forensic meteorology is and the type of cases a forensic meteorologist is retained in. Our course will also discuss the qualifications of a forensic meteorologist expert and the admissibility of a weather expert in court. We will cover data sources a forensic meteorologist relies on and the pitfalls/limitations of the data. The latest science and technology available for a meteorologist will also be presented. Finally\, we will provide real-life case examples where a forensic meteorologist was utilized. \nPresented by the Admiralty Law Section and Federal Litigation Section \n\nAbout the Presenters\nCharlie Davant\, Attorney\, Davant Law \nCharlie\, a Florida native\, has been working on\, in and around boats his whole life. He saw maritime law as an opportunity to combine his passion with his profession. A panel of tax practitioners will speak about the nature of their jobs\, their experience in different areas of tax law\, and what young tax professionals and aspiring students might expect from a career in tax law. \nPresented by the Section on Taxation & Younger Lawyers Division \nRegistration is Closed \n\nPanelists\nRoger Mahon (Moderator) \nRoger Mahon is an Attorney Advisor to the Honorable Juan F. Vasquez at the United States Tax Court. He previously worked as an associate at a small law firm representing clients in tax controversy matters. Roger received his LL.M in Taxation from New York University School of Law and his J.D. from Boston College Law School. \nDan Davidson \nDan is an experienced courtroom advocate\, having appeared in court at all stages of criminal litigation\, from arraignments to evidentiary hearings to sentencings. After receiving his J.D. cum laude from New York University School of Law in 2016\, Dan was hired as a prosecutor by visionary District Attorney Kenneth P. Thompson. \nHis practice at Kostelanetz & Fink\, LLP focuses on white-collar criminal defense and civil and criminal tax controversies. While Dan does not consider himself a tax lawyer\, he is a perfect example of how non-tax lawyers must still have expertise in\, as well as an understanding of\, tax law\, practice\, and procedure. \nNick Zemil \nNick Zemil is a Director in PwC’s Washington National Tax Services group\, specializing in international tax. Nick advises clients and local PwC teams on a variety of international tax planning and controversy issues arising from pre- and post-tax reform provisions\, with a focus on outbound transactions. Prior to joining PwC\, Nick was an associate with a large\, international law firm. Nick is also an experienced adjunct professor\, with a teaching focus in tax and accounting. In addition to teaching\, Nick is a frequent speaker on international tax at various internal and external forums and has authored several publications on domestic and international tax issues. \nTeisha Ruggiero \nTeisha Ruggiero is an attorney with the IRS Office of Associate Chief Counsel (International)\, Branch 3\, where she focuses on developing and drafting foreign tax credit guidance. Before joining the Chief Counsel’s office in July 2021\, she worked at KPMG for seven years. While at KPMG she focused on the substantial statutory and regulatory changes to foreign tax credits and other international tax rules related to the Tax Cuts and Jobs Act. SUMMARY:Webinar: U.S. Trade Law in the Age of Multipolarity
DESCRIPTION:This webinar will provide an overview of US trade laws which have their roots in the United States Constitution. The main Tariff Acts will be examined as will be the various administrative authorities created by law. The presenters will discuss specific issues of importance in connection with American trade laws such as Rules of Origin Determination\, Valuation Determination\, Anti-Dumping Determination and Penalties\, and Countervailing Duties Determination. There will be a brief discussion of regional initiatives\, Bilateral Treaties\, and Free Trade Agreements. Finally\, the recent conflict in Ukraine has prompted the imposition of a number of trade and other sanctions. The authority for these actions will be examined and discussed. \nPresented by the International Law Section \n\nAbout the Presenters\nDavid Wemhoff  is the Chair of the International Trade and Customs Law Committee of the International Law Section.  Mr. Wemhoff holds an LLM in International and Comparative Law from the McKinney School of Law\, Indiana University\, and a JD from the McGeorge School of Law\, University of the Pacific.  He is a lawyer and taught college level courses in Business Law and American Constitutional Law. \n  \n  \nProfessor Doctor Frank Emmert\, LLM\, FCIArb\, John S. Grimes Professor of Law and Executive Director of the Center for International and Comparative Law at Indiana University Robert H. McKinney School of Law\, Fellow of the Chartered Institute of Arbitrators. \nFrank Emmert became a professor of law and the Executive Director of the Center for International and Comparative Law beginning in the summer of 2003. He is the founder and managing editor of the European Journal of Law Reform (since 1997). Before his appointment at IU he was a visiting professor at Benjamin N. Cardozo School of Law in New York. He has also served as Dean of Concordia International University Estonia School of Law\, Executive Director of the Academy of European Law at the European University Institute\, Lecturer in European and International Law at the European institute of Basle University. He has taught courses at the Universities of Strasbourg (France)\, Amsterdam (the Netherlands)\, Warsaw and Krakow (Poland)\, Ljubljana and Maribor (Slovenia)\, Prague (Czech Republic)\, St. Gall (Switzerland)\, the College of Europe (Poland)\, as well as Stanford Law School and Rutgers University School of Law. \nProf. Emmert is fluent in German and English\, conversant in French and Italian\, and speaks some Spanish and Estonian. Questions are encouraged! \nScheduled as a pre-event session for the 2022 Annual Meeting & Convention. \nPresented by the Diversity and Inclusion Standing Committee \n\nAbout the Presenters\nDenise Avant\, Chair\, ABA Commission on Disability Rights; Affiliate President\, National Federation of the Blind of Illinois\nDenise Renee Avant graduated from the University of Missouri-Columbia in 1980 with a B.A. in political science\, and in 1983 with a J.D. She was admitted to practice law in Illinois in 1984. Almost two decades later\, Denise earned an M.A. in journalism from Roosevelt University. Denise worked for the Will County Legal Assistance Program\, Inc. for two years\, and then worked in the appellate and post-conviction units of the Office of the Cook County Public Defender for 30 years. Currently\, Denise is the Affiliate President of the National Federation of the Blind of Illinois\, and serves on the Board of Directors of the National Federation of the Blind (NFB)\, as well as on the National Association of Blind Lawyers\, a division of the NFB. Before being appointed as Chair of the ABA Commission on Disability Rights\, Denise served three years as a Commissioner. She also was appointed to the ABA’s Center on Racial and Ethnic Diversity and the Commission on Youth At Risk\, both for two-year terms. Denise serves as a Member at Large/Disability to the ABA’s nominating committee for the House of Delegates\, the policy-making body of the ABA. Denise also participated in the Implicit Bias video series sponsored by the ABA. Additionally\, the Government and Public Sectors Lawyers Division presented her with the Nelson Award at the ABA Annual Meeting in August 2018.  Denise was raised in and resides in Chicago. She enjoys reading\, exercising\, running\, and cross-country skiing\, and is a longtime member and a deaconess at Christian Tabernacle Church on the south side of Chicago. \nWilliam D. Goren\, Attorney\, William D. Goren JD LLM LLC\nWilliam D. Goren\, Esq.\, of William D. Goren\, J.D.\, LL.M. LLC in Decatur\, GA\, has been dealing with the ADA as an Attorney since 1990. His law and consulting practice\, https://www.understandingtheada.com/\, as well as his blog\, Understanding the ADA\,  (a member of the ABA Top 100 for five consecutive years\, 2014-2018- there was no ABA 100 in 2019-2021)\, all focus on understanding the ADA so that the client understands what it means to comply with that law and related laws. In particular\, he provides consulting\, counseling\, representation\, and training services involving compliance with the Americans with Disabilities Act\, Rehabilitation Act of 1973\, and related laws- such as the Air Carrier Access Act and the Fair Housing Act\, among others. Mr. Goren also brings a deep\, personal understanding of what it means to have a disability\, equipping him with exceptional insight on how the ADA actually works. He is deaf with a congenital bilateral hearing loss of 65–90+ decibels\, but functions entirely in the hearing world thanks to hearing aids\, Bluetooth technology\, and lip-reading. For reasons independent of his deafness\, he also uses voice dictation technology to access his computer. He is also a frequent presenter\, a trained mediator\, a FINRA arbitrator (Chairperson eligible)\, and an arbitrator on the CPR employment panel. Finally\, he is the author of Understanding the ADA\, now in its 4th edition (ABA 2013)\, and numerous other articles on the rights of persons with disabilities. He is a member of various committees of the American Bar Association and is also a member of: the Federal Bar Association (FBA) Diversity and Inclusion committee; the FBA’s Civil Rights committee and its Governing Board; FBA’s Civil Rights Amicus committee; and the Chair of the FBA’s Working Group on Disability Best Practices\, which formulated an accessibility manual for the FBA and its chapters. He is also a member of the Deaf and Hard of Hearing Bar Association and its lead for its Amicus committee. He has an A.B. from Vassar College\, a J.D. from University of San Diego School of Law\, and was one of the first in the entire country to receive the LL.M. in health law\, in his case from DePaul University College of Law. SUMMARY:Webinar: FLSA Overview and Recent Developments
DESCRIPTION:This presentation will provide an overview of the federal Fair Labor Standards Act\, addressing both the substantive components of the statute – the pay practices regulated\, the jobs exempt from the statute’s purview\, and the remedies available for violations – as well as the unique procedural issues that arise in cases litigated under the statute. Our speakers will discuss the procedural oddity of an FLSA collective action as distinct from a Rule 23 class action\, and the types of motions and issues arising in the collective action context. The standard for certifying a collective action and sending class notice is currently the subject of a split among the circuits that could be heading to the U.S. Supreme Court. He also frequently serves as an arbitrator for single and triple panel\, binding and non-binding commercial arbitrations. \nExperienced as lead counsel in complex litigation\, Connor also frequently teams with lawyers from around the country and internationally who need access to Delaware’s Courts\, which are renowned as a primary forum for national and international corporate and complex litigation. \nJudge Christopher S. Sontchi \nChristopher S. Sontchi is an International Judge of the Singapore International Commercial Court and is the former Chief Judge of the United States Bankruptcy Court for the District of Delaware (from which he recently retired). He is a frequent speaker in the United States and abroad on issues relating to corporate reorganizations. He is a Lecturer in Law at The University of Chicago Law School and has taught restructuring to international judges through the auspices of the World Bank and INSOL International. He is also a member of the International Insolvency Institute\, Judicial Insolvency Network\, National Conference of Bankruptcy Judges\, American Bankruptcy Institute and INSOL International. He was recently appointed to the International Advisory Council of the Singapore Global Restructuring Initiative\, and the Founders’ Committee for The University of Chicago Law School’s Center on Law and Finance. \nJudge Sontchi has testified before Congress on the safe harbors for financial contracts. He has also published articles on creditors’ committees\, valuation\, asset sales and safe harbors. \nJudge Sontchi attended the University of North Carolina at Chapel Hill where he was elected to Phi Beta Kappa and obtained a B.A. with distinction in Political Science. He received his J.D. from The University of Chicago Law School\, after which he returned to his native Delaware to serve as a law clerk in the Delaware Supreme Court. \nAmy Boyle \nAmy Boyle currently serves as the Chair Elect of the National Board of Directors for the Federal Bar Association’s Young Lawyers Division and the Programming Co-Chair for the Federal Bar Association’s Alternative Dispute Resolution Section. Amy is a Founding Partner at MJSB Employment Justice in Minneapolis\, Minnesota. She handles all types of employment matters\, with a particular focus on representing women who have experienced sex discrimination\, sexual harassment and assault\, and retaliation at work and whistleblower clients who have reported illegal workplace practices or companies engaged in deceitful conduct. As a member of the Minnesota Women Lawyers\, Amy is also the Co-Chair of its Judicial Initiative. \nAngela Eastman \nAngela Eastman is the Chair of the Federal Bar Association’s Alternative Dispute Resolution Section. She is currently employed as Associate General Counsel for Asante Health System and Adjunct Professor at Pepperdine University Caruso School of Law. NFT creators use trademarked images they claim to be “art” and profit from their sale\, but the owners of these trademarks contend that the use of these images does in fact constitute infringement. A growing sector of these lawsuits relate to “greenwashing\,” the practice of selling investments as more sustainable or environmentally friendly than they actually are. \nAgencies in both the U.S. and the E.U. have begun new ESG initiatives. In the U.S.\, the Securities and Exchange Commission’s new ESG task force began regulating in April of this year\, and in the E.U.\, legislators have taken similar regulatory action to prosecute “greenwashing.” \nEnvironmental concerns have also instigated a growing number of climate cases alleging over-reliance on “negative emission” or greenhouse gas removal to “offset” high-emission activities.
