SUMMARY:Webinar: Insights into the Two Most Popular Types of PTAB Proceedings: Appeals and Inter Partes Reviews
DESCRIPTION:Patent Trial and Appeal Board (PTAB) Appeals and PTAB Inter Partes Reviews are extremely valuable proceedings for inventors\, patent owners\, and the patent community generally. The pre-proceeding phase and decisions you make during that time are critical. Then\, your strategies and conduct during these proceedings will often lead to favorable results in the end for the client. This webinar will set forth data-driven\, thoughtful and specific insights for the two most-employed proceedings at the PTAB\, i.e.\, Appeals and Inter Partes Reviews. \nPresented by the Intellectual Property Law Section \n\n \nPanelists\nJoseph G. Piccolo \nIn 1985\, Joe Piccolo graduated from the University of Notre Dame with honors and received a B.S.E.E. From 1985-87\, Joe worked for the General Electric Company and then went on to law school. In 1988\, Joe began working in the intellectual property law field for the U.S. International Trade Commission. In 1990\, Joe graduated from NYU Law School and from 1990-91\, he clerked for the Honorable Alan D. Lourie at the U.S. Court of Appeals for the Federal Circuit. In 1991\, Joe was admitted to the USPTO Patent Bar and the New York State Bar. \nJoe then went on to practice law at the USPTO Solicitor’s Office\, where he orally argued 50 Federal Circuit appeals and drafted 88 Federal Circuit briefs for the USPTO. He was also co-counsel in 66 additional Federal Circuit appeals. Joe won scores of appeals\, including such significant appeals as In re Schreiber (1997 patent prosecution case cited innumerable times)\, In re Watts (USPTO achieving its long-sought victory on the legal doctrine of waiver)\, Zumbiel v. Kappos (a complicated inter partes patent reexamination appeal where Joe successfully argued both the patentability of certain claims and the unpatentability of other claims)\, and Shimano v. Rea (a complex inter partes patent reexamination appeal where Joe successfully defended the PTAB as to both its patentability and unpatentability determinations which centered on claim construction and written description). Joe also worked on approximately 90 district court civil actions involving the USPTO. Additionally\, Joe worked on multiple Supreme Court cases\, including Holmes v. Vornado (2002)\, MedImmune v. Genentech (2007)\, and SAS Institute v. Iancu (2018). While working at the USPTO\, Joe received an Exceptional Career Award and a Bronze Medal Award. \nIn 2021\, Joe became a partner at Davidson Berquist Jackson & Gowdey\, where he focuses largely on PTAB Appeals. In view of his thirty-year federal government career\, Joe is in a very strong position to analyze patent prosecution records to assess the viability of appealing USPTO examiner final rejection decisions to the PTAB. He can readily draft compelling appellate briefs and persuasively argue such appeals. Joe has given several presentations on the topic of PTAB Appeals. Joe also handles other types of prosecution matters \nJames T. Carmichael \nJames T. Carmichael is a former Administrative Patent Judge on the Board of Patent Appeals and Interferences (now the Patent Trial and Appeal Board). Jim was employed by the U.S. Patent and Trademark Office (PTO) for eight years\, including working in the electrical and computer division of the Board as an Examiner-in-Chief. Currently he represents inventors and patent challengers before the PTO in post-grant proceedings including Inter Partes Review and Reexamination. Jim regularly serves as an expert witness on PTO prosecution and post-grant procedures. \nBefore becoming a Judge\, Jim served for five years as an Associate Solicitor of the PTO. In that capacity\, he represented the agency in federal court litigation and argued more than thirty cases at the U.S. Court of Appeals for the Federal Circuit. The cases Jim handled included patentability and reexamination. He was also Coordinator of attorney discipline proceedings. Jim helped develop PTO procedures relating to the duty of disclosure as well as post-grant proceedings. \nPatexia scored Jim as one of the top three most-winning attorneys in IPRs at the PTAB (out of all 3\,462 attorneys representing patent owners) from 2014 to 2019\, while Carmichael IP was ranked the #1 firm. Jim graduated from Yale University in 1984\, and from University of Wisconsin Law School in 1987 with honors. Vasquez at the United States Tax Court. He previously worked as an associate at a small law firm representing clients in tax controversy matters. Roger received his LL.M in Taxation from New York University School of Law and his J.D. from Boston College Law School. \nDan Davidson \nDan is an experienced courtroom advocate\, having appeared in court at all stages of criminal litigation\, from arraignments to evidentiary hearings to sentencings. After receiving his J.D. cum laude from New York University School of Law in 2016\, Dan was hired as a prosecutor by visionary District Attorney Kenneth P. Thompson. \nHis practice at Kostelanetz & Fink\, LLP focuses on white-collar criminal defense and civil and criminal tax controversies. While Dan does not consider himself a tax lawyer\, he is a perfect example of how non-tax lawyers must still have expertise in\, as well as an understanding of\, tax law\, practice\, and procedure. \nNick Zemil \nNick Zemil is a Director in PwC’s Washington National Tax Services group\, specializing in international tax. Nick advises clients and local PwC teams on a variety of international tax planning and controversy issues arising from pre- and post-tax reform provisions\, with a focus on outbound transactions. Prior to joining PwC\, Nick was an associate with a large\, international law firm. Nick is also an experienced adjunct professor\, with a teaching focus in tax and accounting. In addition to teaching\, Nick is a frequent speaker on international tax at various internal and external forums and has authored several publications on domestic and international tax issues. \nTeisha Ruggiero \nTeisha Ruggiero is an attorney with the IRS Office of Associate Chief Counsel (International)\, Branch 3\, where she focuses on developing and drafting foreign tax credit guidance. Before joining the Chief Counsel’s office in July 2021\, she worked at KPMG for seven years. While at KPMG she focused on the substantial statutory and regulatory changes to foreign tax credits and other international tax rules related to the Tax Cuts and Jobs Act. Cutler & Dana Tippin Cutler\, Trial Lawyers at James W. Reynolds\, Deputy Director for Aviation and Space Policy\, U.S. Senate Committee on Commerce\, Science and Transportation \nMichael Reynolds is a Deputy Policy Director on the staff of the Senate Committee on Commerce\, Science\, and Transportation and is the team lead for aviation for Ranking Member Roger Wicker (R-MS).  Prior to joining the Commerce Committee in 2015 (under then-Chairman Thune) as aviation counsel\, Mr. Reynolds was a stay-at-home parent living with his family in the Netherlands. \nMike previously worked for Booz Allen Hamilton as an Executive Advisor and at DOT as the Deputy Assistant Secretary of Transportation for Aviation and International Affairs from October 2002 until January 2009.  While at DOT\, he served as the Acting Assistant Secretary for more than two years. \nBefore joining the DOT\, Mr. Reynolds spent seven and a half years serving as aviation counsel on the Senate Commerce Committee. In 1997\, Mr. Reynolds took a six-month leave of absence from his Senate position to serve as General Counsel to the National Civil Aviation Review Commission (also known as the Mineta Commission). Prior to joining the public sector\, Mr. Reynolds worked as a litigator in a prominent law firm in the San Francisco Bay Area. \nMr. Reynolds has an undergraduate degree in Political Science from Stanford University and a law degree from the College of William and Mary. \nJill Harrelson\, Chief Counsel\, Democratic\, Committee on Transportation and Infrastructure\, U.S. House of Representatives \nJill Harrelson is the Chief Counsel for the House Committee on Transportation and Infrastructure Majority Staff\, where she manages Committee activities including hearings\, markups\, and consideration of legislation on the House floor\, and advises on how to implement the legislative priorities of the Chair. She joined the Committee in 2019 as the Director of Budget/Deputy Counsel before serving in her current role. Prior to joining the T&I Committee\, Jill worked for the Senate Budget Committee for five years\, holding a variety of positions including Counsel and Analyst for Transportation and Revenue. Jill’s career on Capitol Hill spans almost 14 years and prior to her committee work includes serving as a Legislative Assistant for Congresswoman Matsui and a Legislative Correspondent for Senator Bingaman. \nJill holds a B.A. from the University of New Mexico\, a J.D. from American University\, Washington College of Law\, and an L.L.M. in Taxation from Georgetown University. She is currently barred in Virginia and Colorado. \nCorey E. Cooke\, Republican General Counsel\, Committee on Transportation and Infrastructure\, U.S. House of Representatives \nCorey E. Cooke serves as the Republican General Counsel for the U.S. House of Representatives’ Committee on Transportation and Infrastructure. In this capacity\, she provides strategic guidance on policies and legislation related to the Committee’s portfolio and the priorities of Ranking Member Sam Graves (R-MO-06)\, oversees Committee operations\, and serves as the lead on matters related to oversight and investigations. \nPrior to this role\, Ms. Cooke served as the Regional Administrator for the Northwest/Arctic Region of the U.S. General Services Administration (GSA). Prior to joining GSA\, Ms. Cooke served in several positions in both the U.S. House of Representatives and U.S. Senate\, including as Counsel and Deputy Parliamentarian for the Committee on Oversight and Government Reform. \nShe earned a Bachelor of Arts from the University of Massachusetts\, Amherst and a J.D. from the University of New Hampshire School of Law.
