SUMMARY:Immigration Law Section: Immigration Leadership Virtual Luncheon Meeting with Charlie Oppenheim
DESCRIPTION:Please join us for a virtual discussion with Charlie Oppenheim\, the recently retired Chief of the Immigrant Visa Control and Reporting Division of the U.S. Department of State. He served as Chief of the Division for 23 of his 43 years of public service. We expect that he will share insights on the process as well as changes to the reporting process during his tenure. This discussion will include a Question-and-Answer session with Mr. Oppenheim and we hope participants will ask questions regarding his thoughts on forward movement or retrogression of both family and employment-based preference categories and other related issues. \nPresented by: Immigration Law Section & District of Columbia Chapter \nRegistration is Closed \n\nAbout the Presenter\nCharles (Charlie) Oppenheim \nCharlie Oppenheim worked for the U.S. Department of State for over 43 years\, as a consular officer in the Bureau of Consular Affairs since 1979. He was the Chief of the Immigrant Visa Control and Reporting Division in the Office of Domestic Operations from January 1998 through December 3\, 2021\, when he retired. \nAs Chief of the Immigrant Control and Reporting Division his main responsibility was the administration of the complex series of annual numerical limitations on immigrants\, subdivided by preference category and country\, which are set by the Immigration and Nationality Act. The decisions which he made in this regard have resulted in applicants having used over nine million numerically controlled immigrant visas numbers. In addition\, he regularly provided analysis and assessment of the impact of proposed legislation on visa availability and workload impact for overseas posts. \nOn a monthly basis he was responsible for determining the number of visas which could be allocated in each visa category\, and to each country on a worldwide basis. The goal was to have the issuance level through September come as close as possible to the annual limit without exceeding it. The Division maintained a database containing workload statistics for immigrant and nonimmigrant visas issued at Foreign Service posts worldwide. It also compiled statistics on immigrant numbers provided to USCIS for adjustment of status cases in the numerically limited categories. \nThe division annually issued the Report of the Visa Office\, a yearly compilation of statistical data on visas issued at consular offices around the world. On a monthly basis\, the division also issued the Visa Bulletin a periodical\, which summarizes the availability of visas numbers for the coming month\, as well as other visa related information.  The division also provides statistical data on the Consular Affairs Web Site (travel.state.gov). \nHe also provided a monthly YouTube “Chat with Charlie” which was hosted by the Consular Affairs Press Office. \nThe division routinely provided statistical data in response to inquiries from congressional offices\, offices within the State Department\, other governmental agencies\, and the general public.  Charlie spoke at a variety of government events dealing with immigration related issues\, and those sponsored by groups such as the Federal Bar Association\, American Immigration Lawyers Association\, Council for Global Immigration\, IIUSA\,  and others. In addition\, he regularly provided analysis regarding various immigration reform proposals speaking with White House and Congressional representatives as well as other groups to present the Department’s position. In June 2007\, and April 2008\, he represented the Department of State testifying before Senate subcommittees which were looking into the issue of immigration reform. \n\nRegistration\n[Register Online] \nFBA Members – $0\nNonmembers – $15 \nRegistrants will receive Zoom login details on the day before the event \nCancellation Policy \nNo refunds will be made for cancellations received after the close of business on February 7\, 2022. No-shows will be billed. Substitutions may be made at any time upon notification. Please contact Daniel Hamilton at dhamilton@fedbar.org with cancellation and/or substitution requests. \n\nCLE\nPlease note that CLE credit is not offered for this webinar. \n\nEmail Communication Policy \nBy registering for this event\, you agree to receive email communications from the Federal Bar Association and affiliated sponsors of the program concerning event details\, Continuing Legal Education certification\, programming changes\, upcoming events\, surveys\, and post-event communications. \nRecording Disclaimer \nBy registering for an FBA webinar\, you agree to the recording of audio and visual content presented during the live event and consent to subsequent use of the recording by the FBA. SUMMARY:[Virtual] Art Litigation and Fashion Law Conference
DESCRIPTION:The newly merged Art Litigation & Fashion Law Conference brings two global industries into one compelling program. This year’s conference will be held virtually over two days\, with four educational panels each day. Experts in commercial transactions\, employment law\, international trade\, and intellectual property will collaborate for panels at the advanced and primer level. The conference is designed for attorneys and non-attorneys who are interested in the intersection of art\, fashion\, and the law. \nThursday evening’s reception at The National Arts Club has been cancelled. There will be no in-person programming for this conference. All panels will remain virtual at the below posted times. \n\n\nAgenda\n\nART LAW: Thursday – February 10\n12:00 – 12:20 pm ET | Welcome Remarks \n\nRaymond J. Dowd\, Partner\, Dunnington Bartholow & Miller LLP; Conference Chair\n\n12:30 – 1:30 pm ET | Restitution – The Return of Cultural Artefacts:  A New Paradigm for the Legal System? \nDecades-old debates about the restitution of cultural objects have acquired a new urgency recently with the intensification of scrutiny of European museum collections acquired in the colonial period. Alexander Herman’s new\, fascinating and accessible book Restitution – The Return of Cultural Artefacts covers a wide range of current controversies over the return of cultural treasures: why it is demanded\, how it is negotiated\, and where it might lead\, forcing us to confront an often-dark history\, and the difficult application of our contemporary conceptions of justice to the past. Should we allow plundered artefacts to rest where they lie—often residing there by the imbalances of history? Herman questions whether we are entering a new ‘restitution paradigm\,’ one that could have an indelible impact on national legal systems for many years to come. \n\nAlex Herman\, Director\, Institute of Art & Law (London)\nHon. Loretta Preska\, Senior U.S. District Judge\, Southern District of New York\nIntroduction by John Cahill\, Partner\, Olsoff | Cahill | Cossu LLP\n\n1:40 – 2:40 pm ET | Visual Intelligence for Lawyers and Investigators      \n\nAmy Herman\, Attorney & Art Historian\, Art of Perception\, Inc.\nIntroduction by Ben Hartley\, Executive Director\, The National Arts Club\n\n2:50 – 3:50 pm ET | Robert Jackson and The Birth of the National Gallery \nIn 1935\, Robert H. Jackson\, Assistant General Counsel of the U.S. Treasury Department’s Bureau of Internal Revenue (and later U.S. Solicitor General\, U.S. Attorney General\, U.S. Supreme Court justice\, and U.S. chief prosecutor at Nuremberg of Nazi war criminals) prosecuted Andrew W. Mellon\, former Treasury secretary\, in a civil tax deficiency and fraud case. Some of the issues concerned Mr. Mellon’s fabulous art collection. The next year\, while the case was ongoing\, Mellon donated paintings and funds that became the National Gallery of Art in Washington\, D.C. To this day\, we all benefit from Jackson’s law enforcement work and Mellon’s late in life generosity. \n\nJohn Q. Barrett\, Professor of Law\, St. John’s University\nIntroduction by Stephen Crane (Ret.)\, Mediator and Arbitrator\, JAMS\n\n4:00 – 5:00 pm ET | Art & IP:  A Practitioner’s Overview       \nThe intersection of art & intellectual property (“IP”) can be complex and difficult to navigate.  Who owns the artwork?  How much of another artist’s work can be used?  How can an artist best protect their rights? This panel will provide an overview of how copyrights\, patents\, and trademarks can be used to help artists and art collectors.  We explore the proactive steps that can be taken\, the limits of IP rights\, and when and how third-party intellectual property can be used without liability.  We will also explore the use of non-fungible tokens (“NFTs”) as a means for creating and selling works of art.  The panelists will familiarize and identify these issues for non-IP practitioners to develop an understanding of what can be protected or how a client can reduce risk of liability. \n\nApril M. Capati\, Partner\, Lerner David Littenberg Krumholz & Mentlik LLP\nMelanie A. Chernoff\, Associate\, Lerner David Littenberg Krumholz & Mentlik LLP\nStephen F. Roth\, Partner\, Lerner David Littenberg Krumholz & Mentlik LLP\nIntroduction by Elizabeth “Betsy” Dale\, Associate\, Dunnington Bartholow & Miller LLP; Conference Chair\n\nFASHION LAW: Friday – February 11\n12:00 – 12:20 pm ET | Welcome Remarks \n\nOlivera Medenica\, Partner\, Dunnington Bartholow & Miller LLP; Conference Chair\n\n12:30 – 1:30 pm ET | Luxury Meets Resale: Can the Two Peacefully Coexist or will Claims of Trademark Infringement Trump the Defenses of the First Sale Doctrine and Nominative Fair Use? \nThe sustainable fashion economy has been gaining momentum in an explosive way. Consumers are purchasing and maximizing the life of their luxury goods to minimize their impact on the environment\, and fashion houses and luxury brands are committing to sustainable practices to keep with market trends. The online luxury consignment market\, led by companies such as The Real Real (TRR) and What Goes Around Comes Around (WGACA)\, offers a consumer-focused platform that allows for the consignment and resale of luxury goods. In an ecosystem built on brand-consciousness and exclusivity\, can both luxury and resale coexist or will claims of trademark infringement\, counterfeiting and false advertising trump the defenses of the First Sale Doctrine and nominative fair use and arrest the development of this segment of the sustainable fashion economy? During this session\, we will explore recent lawsuits brought by Chanel against TRR and WGACA alleging various claims under the Lanham Act and antitrust counterclaims\, and how these competing interests will affect the consumer. \n\nModerator: Robert Weisbein\, Partner\, Foley & Lardner LLP\nLaura Ganoza\, Partner Foley & Lardner LLP\nGregg Meyer\, Chief Sustainability Officer\, Counsel and Head of Corporate Social Responsibility\, Steve Madden Ltd.\nStacy Raphael Stewart\, Associate General Counsel\, Trademarks – IP and Brand Protection\, Coty Inc.\n\n1:40 – 2:40 pm ET | A Discussion of Supply Chain Issues Relating to the Global Pandemic\, New Laws\, and Force Majeure Clauses \nThis panel will explore supply chain issues relating to the global pandemic\, new laws that have been enacted\, and contract claims caused by supply chain demands and delays.  The panelists will describe how supply chain issues have impacted the fashion industry\, including broken supply lines\, and what that means for the label and its consumers. The panelists will also discuss legal issues that fashion houses face relating to supply chain issues.  This will involve a discussion of contract claims and defenses\, including force majeure.  The panel will provide perspectives on these issues from the United States\, Europe and beyond. \n\nModerator: Maria Vathis\, Of Counsel\, Bryan Cave Leighton Paisner LLP\nDanielle C. Lesser\, Partner & Chair of Business Litigation\, Morrison Cohen LLP\nLena Saltos\, Associate General Counsel\, Global Director of Intellectual Property\, URBN (Urban Outfitters\, Anthropologie\, Free People\, Nuuly)\nBen Vanpeperstraete\, Sr. Legal Advisor\, European Center for Constitutional and Human Rights\nAlexandra Varla\, Attorney at Law\, Founder\, Tailored: Law & Business in the Fashion & Luxury Industry\n\n2:50 – 3:50 pm ET | Customs Exclusions and Counterfeits: Issues for Fashion Brands \nThis CLE will explore import violations such as forced labor and intellectual property as well as how to protect your supply chain and your brand. Part One of the panel will broadly discuss US Customs and Border Protection’s (CBP) Enforcement of Intellectual Property Rights (IPR) at the Border: Seizures vs. Exclusions. Part Two of the panel and using CBP to protect your IPR and combat gray goods. Part three will discuss Forced Labor Considerations and the Uyghur Forced Labor Prevention Act (UFLPA).
