With more than 30 years of experience\, his practice is centered on white collar\, antitrust\, and healthcare fraud defense. \nMr. Dillon strives to defend the needs of his clients by minimizing their exposure in state and federal white collar investigations. He represents top executives and company presidents and has prevailed on their behalf in matters of healthcare fraud; antitrust compliance; real estate foreclosure fraud; international cartel investigations; FCPA investigations in Latin America; the beverage industry; criminal pharmaceuticals; and more. \nHe handles a wide range of white collar cases including complex FCPA investigations\, criminal pharmaceutical and healthcare fraud matters\, SEC investigations\, international antitrust investigations\, federal public corruption cases\, mail fraud\, money laundering\, and domestic bribery cases. \nJames Backstrom \nFrom his office in Philadelphia\, James Backstrom defends individuals and firms in federal criminal\, civil and administrative inquiries and prosecutions including antitrust\, fraud\, tax\, trade control and national security matters. He has represented numerous executives and corporations in grand jury investigations and prosecutions conducted by antitrust division sections in Washington\, DC and all division field offices. He has appeared in antitrust proceedings in both the US and Canada and on behalf of citizens of 16 foreign nations. \nA prosecutor in the United States Department of Justice until 1987\, James was chief of the antitrust division’s Dallas office. In the division\, he also held the positions of special assistant\, office of operations\, in Washington and trial attorney in Philadelphia. James served as a special assistant United States attorney for the eastern district of Pennsylvania in 1981 and 1982. \nSince 2005\, James has been a member of the ABA’s international cartel task force\, which consults other nations on enforcement issues. He has written extensively on antitrust topics and spoken at the ABA’s section of antitrust law events. He is a principal author and editor of the Criminal Antitrust Litigation Handbook\, second edition\, published by the ABA section in 2007. He also appears as a panellist at corporate governance programmes. James has been qualified as an expert witness on the US Sentencing Guidelines and Justice Department charging decisions. \nJames is admitted to the District of Columbia\, Pennsylvania and Texas bars\, as well as in federal courts including the Supreme Court of the United States. He was educated at Northwestern University (BSS 1973) and the University of Pennsylvania Law School (JD 1976). \nRoxann Henry \nRoxann is an antitrust lawyer currently focusing on consulting\, compliance\, monitoring\, opinions\, representing individuals\, and assisting with corporate representations. In over 35 years of antitrust practice she has handled matters involving all aspects of competition law\, including criminal defense\, treble damage litigation\, compliance advice\, and merger and other civil investigations\, and have co-chaired the Global Competition Practice group of a major international law firm. As lead counsel\, she won a rare corporate criminal antitrust jury acquittal\, and clients\, domestic and foreign\, individuals and corporations\, have entrusted her with the defense of national and international investigations\, including ancillary debarment concerns. She regularly represent clients before both the Antitrust Division of the Department of Justice and the Federal Trade Commission. In her past roles as Chair of the Antitrust Section of the American Bar Association\, co-chair of its International Cartel Workshop and its International Officer\, Program Officer\, and co-chair of the Spring Meeting and as an invited Non-Government Advisor to the International Competition Network and invited speaker at the OECD\, she also has worked side-by-side on competition law initiatives and policies with the U.S. enforcers and those in key jurisdictions abroad. In addition\, she has strong relationships with experienced colleagues around the world who can assist with any competition related concern. \nPaul Coggins \nPaul Coggins is Co-Chair of Locke Lord’s White Collar Criminal Defense and Internal Investigations Practice Group. Paul was the U.S. Attorney for the Northern District of Texas from 1993-2001. \nHe focuses his practice on white collar criminal defense\, and has represented numerous Fortune 500 clients in high-stakes litigation before federal courts and the SEC. Paul also has conducted internal investigations involving alleged tax\, fraud and securities violations. In addition\, he develops compliance and ethics programs for corporations and other business entities. \nJennifer McCoy \nJennifer McCoy represents employers in state and federal litigation involving claims of discrimination\, retaliation\, harassment and wage and hour violations. She also provides employment counseling to clients and assists them in developing and drafting policies; negotiating and drafting employment agreements\, separation and release agreements and restrictive covenant agreements; and ensuring compliance with immigration and other applicable laws. He went on to “do a lot of drugs” (as a special agent working gangs and narcotics in Southern California and Florida). After a long nuisance legal battle he initiated alleging the DOJ did not have a representative number of short bald Irishmen\, Ovie was ultimately was hired in 2006 by the DOJ to establish a cybercrime lab to support over 10\,000 needy and often unappreciated prosecutors across the DOJ. \nOvie is an internationally known speakers\, having just returned from SE Asia training judges and prosecutors in digital evidence. Ovie is requested as a speaker not necessarily because of his expertise in the field\, but rather because he is frequently mistaken as Brad Pitt or Chris Hemsworth. Scott Oswald – Chair\, FBA Qui Tam Section (moderator) \nScott Oswald is an accomplished trial lawyer who has brought more than 40 trials to verdict. His cases have recovered more than $300 million in judgments and settlements. Docherty\, U.S. Magistrate Judge\, District of Minnesota \nOn July 22\, 2021\, John F. Docherty was sworn in as a United States Magistrate Judge for the District of Minnesota. \nJudge Docherty served in the U.S. Attorney’s Office for the District of Minnesota as an Assistant U.S. Attorney from 2002 until his appointment. He prosecuted a wide range of cases\, but focused on international and domestic terrorism\, civil rights cases\, and cases involving the illegal export of sensitive U.S. technology. Between 2006 and 2008\, Judge Docherty left the U.S. Attorney’s Office to work as a prosecutor at the United Nations’ International Criminal Tribunal for the Former Yugoslavia in the Hague\, the Netherlands. There\, he was a senior member of the prosecution team at the trial of General Dragomir Milosevic\, who was convicted of war crimes and crimes against humanity for his actions as commander of the troops besieging Sarajevo from 1992 to 1994. Judge Docherty was also a senior member of the prosecution team in the case against the chief and deputy chief of Yugoslavia’s combined foreign intelligence and internal security service. \nPrior to joining the U.S. Attorney’s Office\, Docherty worked at the Antitrust Division of the Justice Department in Washington\, D.C. and in the Office of the Minnesota Attorney General\, where he worked in the Antitrust Division and the Criminal Division. \nJudge Docherty is a graduate of the University of Minnesota Law School\, where he served on the Law Review. Sutton\, Chief Judge of the Sixth Circuit Court of Appeals\, for a luncheon on Thursday\, May 26 at 12:30 in the Price Turpen Courtroom. The luncheon is free and open to the public. \n\nSpeakers\nJeffrey S. Sutton\, Chief Judge of the Sixth Circuit Court of Appeals \nChief Judge Sutton assumed the position of Chief Judge of the Sixth Circuit on May 1\, 2021. He was nominated to the court by President George Walker Bush and confirmed by the United States Senate in April 2003. He earned his law degree from The Ohio State University College of Law in 1990 and subsequently clerked for the Honorable Thomas Meskill of the United States Court of Appeals for the Second Circuit\, as well as two Supreme Court Justices — the Honorable Lewis F. Powell\, Jr.\, and the Honorable Antonin Scalia. Chief Judge Sutton was in private practice in Columbus from 1992 to 1995 and 1998 to 2003\, and served as Solicitor General of Ohio from 1995 to 1998. He has also served as an adjunct professor of law at the Ohio State University College of Law and as a visiting lecturer at Harvard Law School. \nChief Judge Sutton has authored numerous books and articles on a wide variety of topics including state constitutional law and federalism. His recently published book is “Who Decides? States as Laboratories of Constitutional Experimentation.” Before his confirmation to the court\, he argued twelve cases in the United States Supreme Court and numerous cases in the state supreme courts and the federal courts of appeal. He served as the Chair of the Judicial Conference of the United States Committee on Rules of Practice and Procedure from 2012 to 2016\, and served as the Chair of the Advisory Committee on Appellate Rules. New criminal prosecutions of no poach/wage fix agreements have been upheld under per se analysis but the first two trials resulted in acquittals. Both agencies continue litigation against Big Tech\, Google and Facebook specifically\, and support new legislation reigning in platforms. Pronouncements now criminalize monopolies. DOJ leniency policy is tweaked\, raising requirements\, and plea carve-ins of individuals are restricted. \nPresented by Antitrust & Trade Regulation Section \n\nAbout the Speakers\nLisa M. Phelan\, former Chief of the National Criminal Enforcement and Washington Criminal I Sections of the Antitrust Division of the U.S. Department of Justice (DOJ)\, is a partner and Co-Chair of Morrison & Foerster’s Global Antitrust Law Practice and Investigations + White Collar Group. DESCRIPTION:While historically\, much focus on civil rights for LGBTQ+ persons has focused on the Supreme Court and national debates—the raft of measures coming out of state legislatures attacking various aspects of LGBTQ+ personhood are being challenged locally in federal district court and circuit court actions across the country. This webinar will focus on the experiences\, strategies\, and mechanism of representing clients in such actions in private\, pro bono and public interest practices. \nPresented by the Civil Rights Law Section and the LGBTQ+ Law Section \n\nAbout the Presenters\nWesley D. Bizzell\, Senior Assistant General Counsel\, Altria; Past President\, National LGBTQ+ Bar Association \nWesley Bizzell serves as Senior Assistant General Counsel and Managing Director of Political Law & Ethics Programs for Altria Client Services. Overseeing a comprehensive compliance system covering the regulation of government affairs\, Mr. Bizzell provides advice and guidance on political law compliance for more than 75 jurisdictions. Mr. Bizzell also heads the legal team that supports Altria’s public policy activities\, providing services related to legislative and regulatory drafting and interpretation. \nMr. Bizzell is an authority on political law compliance\, serving as co-chair of the Conference Board’s Committee on Corporate Political Spending\, a committee of leading American corporations dedicated to education and engagement on issues of corporate political activity. For four years\, he served as co-chair of the Council on Governmental Ethics Laws’ (“COGEL”) annual conference. In 2018\, COGEL awarded Mr. Bizzell its highest honor\, the COGEL Award\, for making a “demonstrable and positive contribution to the fields of campaign finance\, ethics\, elections\, lobbying and freedom of information over a significant period of time.” \nPreviously\, Mr. Bizzell was an attorney in Winston & Strawn LLP’s Federal Government Relations and Regulatory Affairs Practice Group. His career also includes more than six years on Capitol Hill\, where he served as an aide to Arkansas Senators David Pryor and Dale Bumpers. \nMr. Bizzell is extremely active in promoting diversity and inclusion within the legal and corporate communities. He is a founding member and serves on the steering committee for Altria’s LGBTQ+ Employee Resource Group and is the immediate past president of the National LGBTQ+ Bar Association\, after serving a two-year term. He has been named by London’s Financial Times (2017 and 2018) and Yahoo Finance (2019 and 2020) as one of the 100 worldwide OUTstanding Leading LGBT+ Corporate Executives\, and Chambers and Partners also named him the 2019 LGBT+ Equality Lawyer of the Year for his dedication and commitment to LGBT diversity programs and his efforts to advance LGBT+ professionals in the law. In 2021\, he was appointed to serve as a commissioner for the American Bar Association’s Sexual Orientation and Gender Identity (SOGI) Commission. \nMr. Bizzell graduated with a B.A. in Justice\, magna cum laude\, from the American University in Washington\, D.C. and received a Master of Social Work with a focus in public policy from the Catholic University of America. He received his J.D.\, magna cum laude\, from Georgetown University Law Center\, where he was elected to the Order of the Coif and served as an editor for the Georgetown Law Journal. \nJay Kaplan\, LGBT Project Staff Attorney\, ACLU of Michigan \nJay Kaplan has been the staff attorney for the ACLU of Michigan’s LGBT Project since its founding in 2001. \nHe has worked on cases including challenging undercover sting operations targeting gay men\, fighting Michigan’s constitutional amendment prohibiting same-sex couples from marrying\, defending the validity of second parent adoptions granted in Michigan\, and recently advocating for a transgender high school student to be able to run for prom court. Jay was honored with the 2006 Unsung Hero Award from the Michigan State Bar and the 2010 Virginia Uribe Civil Rights Award from the National Education Association (NEA). \n  \n  \nRobin B. Thank you! \n\nAbout the Presenters\nSenior Judge Royce C. Lamberth \nRoyce C. Lamberth was appointed United States District Judge for the District of Columbia on November 16\, 1987.  He served as Chief Judge from May 1\, 2008 to July 15\, 2013\, at which time he became a Senior Judge. \nJudge Lamberth\, a native of San Antonio\, Texas\, graduated from the University of Texas\, receiving a B.A. degree in 1966 and from the University of Texas School of Law\, receiving an LL.B degree in 1967.  He served as a Captain in the Judge Advocate General’s Corps of the United States Army from 1968 to 1974.  After service at Fort Bragg\, North Carolina\, and in Vietnam\, Judge Lamberth served in the Litigation Division of the Office of the Judge Advocate General of the Army at the Pentagon from 1971 to 1974. \nJudge Lamberth served as an Assistant United States Attorney for the District of Columbia from 1974 to 1987.  He was Chief of the Civil Division of the United States Attorney’s Office\, 1978 – 1987. \nJudge Lamberth is married to the former Janis K. Jost of San Antonio.  He is former Chairman of the Federal Litigation Section of the Federal Bar Association\, and a member of the American Bar Association and the Bar Association of the District of Columbia\, and the District of Columbia Bar. \nJudge Lamberth is also former Chairman of the Professional Ethics Committee of the Federal Bar Association.  The Federal Bar Association’s Model Rules of Professional Conduct for Federal Lawyers\, finally approved in October 1990\, were drafted by Judge Lamberth’s Committee. \nJudge Lamberth was appointed by Chief Justice Rehnquist to be Presiding Judge of the United States Foreign Intelligence Surveillance Court on May 19\, 1995.  That appointment ended May 19\, 2002. \nJudge Lamberth served as a member of the Judicial Conference of the United States from May 2008 to July 2013.  He also served as a member of the Judicial Conference’s Committee on Automation and Technology from 1990 to 1996\, and from 2003 to 2008\, served as Chairman of the Judicial Conference’s Committee on Inter-Circuit Assignments.  Chief Justice Roberts appointed him to again Chair the Inter-Circuit Assignment Committee\, effective October 1\, 2013. \nColonel Luis O. Erin helps companies navigate employment laws\, and defends employers in a wide range of class\, collective\, and single-plaintiff disputes before federal and state courts. She is experienced in all stages of litigation\, from inception through trial and post-trial appeals. \nEarlier in her career\, Erin clerked for the Honorable William J. Zloch\, United States District Judge of the Southern District of Florida. She also practiced employment litigation at Morgan\, Lewis & Bockius. Erin is active with her local Federal Bar Association chapter\, having served on the board for four years. \nAlbert Jacobs\, Chair\, Senior Lawyers Division \nWith more than 40 years of experience in every phase of Patent Law\, Mr. Jacobs has spent the last 30 years litigating Biotech\, Pharmaceutical\, and Medical Device Patents\, for multinational companies both before the Federal District Courts\, the Court of Appeals for the Federal Circuit (CAFC) and the International Trade Commission (ITC). He was the first of a group of attorneys to participate in the ITC’s first 100 Day Proceeding dealing with the issue of whether or not there was a Domestic Industry in the subject matter of the Patent. He was successful in proving there was not. He successfully sued a number of large well known foreign companies in one of the largest ITC cases ever filed when he brought an action against 44 companies. He has appeared before the CAFC from its outset and is the only attorney ever to invalidate a Patent for his client on an appeal from an improvidently granted Preliminary Injunction. \nMr. Jacobs has participated in numerous Mediations both in the Federal Courts and in the ITC. He was appointed by the Secretary of Commence to a 3-year term on the Patent Public Advisory Committee. He is a Certified Mediator under New York State Statutes and has participated in a wide range of Domestic Family Matters. He has served as a coach for the Association of the Bar of the City of New York in their Mediation Program.\nA graduate of Harvard College and Columbia Law School where he was a Stone Scholar\, he is a member of numerous Bars as well as the Supreme Court of the United States. \nHe is currently Chair Elect of the Maricopa County Bar Association Litigation Section and is the Chair of the Senior Lawyers Division of the Federal Bar Association (FBA)\, and Chair of the Senior Lawyers Committee of the Phoenix Chapter of the FBA as well as member of that Chapter’s Executive Committee. \nKaren King\, Chair\, Federal Career Service Division \nKaren King joined the FBA in 2015 and served as the Lafayette/Acadiana Chapter President in 2019. She has also served the FBA on the Chapter Activity Fund Committee and is a member the Constitution\, Bylaws\, Rules\, and Resolutions Committee. She is the Chair of the Federal Career Service Division. \nKaren has been a Civil Assistant United States Attorney in the Western District of Louisiana for 19 years. Prior to joining the U.S. Attorney’s Office\, Karen spent time in private practice where she handled workers’ compensation\, insurance defense\, and municipal and police liability cases. She currently handles a wide variety of civil cases spanning the areas of civil rights\, employment discrimination\, general tort\, medical malpractice\, eminent domain\, affirmative civil enforcement\, defensive commercial litigation\, Bivens\, and immigration. She also serves the U.S. Attorney’s Office as the Civil eLitigation Coordinator\, Civil Civil Rights Coordinator\, and District Election Officer (Lafayette Office). \nKaren is a Fellow of both the Foundation of the Federal Bar Association and the Louisiana State Bar Foundation\, where she serves on the Governance Committee. As an FBA Foundation Fellow she participated in the selection of the 2021 recipient of the Dr. J. Clay Smith Jr. Diversity in the Legal Profession Scholarship. \nAdditionally\, she is the Immediate Past President of the Lafayette Bar Association and a member of the Board of Directors for the Lafayette Bar Foundation. In 2021\, as President of the Lafayette Bar Association\, Karen created two initiatives: Lafayette Bar Cares and Let’s Talk About It. Lafayette Bar Cares focuses on the health and well-being of attorneys and connects the association to the community through outreach and service. Let’s Talk About It provides a forum for bar members to discuss current issues that affect the practice and the community. Most recently\, Karen has implemented the American Bar Association’s Grit Project within the Lafayette Bar Association to use grit and growth mindset to advance women in the law. \nMarj Leaming\, Board Member\, Senior Lawyers Division \nMarj Leaming provides consulting\, training\, and assistance on individual\, or group projects related to privacy\, system risk management\, and business law compliance.  Previously\, she provided these services in Federal and State government\, non-profit\, and private sectors. Prior to becoming a consultant\, she served as the Chief Privacy Officer (CPO) for the U.S. Department of Agriculture\, where she approved deliverables from 20 agencies comprising the Privacy Council; issued case decisions; and conducted individual and group technical assistance and specialized training through meetings\, consultations\, and teleconferences.  Previously\, she served as Director- IT Systems Privacy and Security Division/Privacy Officer for the Department of Homeland Security (DHS) Office of Inspector General during which she conducted inspections and evaluations related to privacy\, system security\, risk management\, and business law compliance. She is experienced in working closely with General Counsel\, CIO\, CISO\, Chief Physical Security\, Data Officer\, Communications\, and customer communities for program planning and evaluation\, as well as to consult in how best to respond\, report\, investigate\, and remediate data breaches. \nSteven Miller\, Immediate Past Chair\, Senior Lawyers Division\, and Officer for the Federal Career Service Division \nSteven Miller is a Deputy Assistant General Counsel for Environment in the Office of the Assistant General Counsel for the Environment\, in the Office of General Counsel at the U.S. Department of Energy (DOE)\, in Washington\, D.C. In that position\, Steve is responsible for providing advice and counsel to various DOE offices on environmental conflict resolution\, uranium mill tailings\, remedial action\, CERCLA\, including natural resource damage issues\, long-term stewardship and other environmental matters. He assisted in the drafting of provisions of the 1986 CERCLA amendments and the subsequent executive order delegating the President’s authorities to the various federal agencies and received an award for that effort.  He also has served as a mentor to DOE employees\, law students\, college and high school students as part of various DOE-sponsored mentoring and internship programs. Steve has served with the Department of Energy and its predecessor agency\, the Energy Research and Development Administration\, since 1977.  In addition to his DOE responsibilities\, Steve is also the Immediate Past Chair of the Senior Lawyers Division of the Federal Bar Association\, where he has had numerous leadership roles.  Steve holds a J.D. degree from the New York University School of Law\, a M.U.P. Following Russia’s unprovoked attack on Ukraine\, attorneys from all over the world have collaborated to provide legal assistance to the Ukrainian government and its citizens. SUMMARY:Maryland Chapter: Supreme Court Update
DESCRIPTION:The Supreme Court has had one of its most monumental terms in years\, with plenty of important developments in criminal and civil law. In addition to several high-profile cases involving capital punishment\, including the Boston marathon bombing case\, the Court tackled cases ranging from the constitutionality of pre-viability prohibitions on elective abortions\, whether the Second Amendment protects concealed carry licenses for firearms\, vaccine mandates\, school prayer\, opioid prosecution standards\, and what constitutes a “crime of violence” under federal criminal law. Jason Medinger\, Appellate Chief at the United States Attorney’s Office for the District of Maryland\, Paresh Patel\, Appellate Chief at the Office of the Federal Public Defender for the District of Maryland\, and Professor and Legal Analyst Kim Wehle will discuss these and other significant cases from the Supreme Court’s 2021-2022 term and how these decisions affect our practice. \n\nSpeaker\nJason D. Medinger \nJason D. Medinger has been serving as the Appellate Chief for the U.S. Attorney’s Office in Maryland since 2017. Prior to that\, he served as an Assistant United States Attorney in Maryland prosecuting narcotics and violent crime cases. He has also served as a civil AUSA\, defending the United States government and its agencies against civil actions alleging torts and employment discrimination. Prior to entering government service\, Mr. Medinger worked at a law firm in Atlanta\, Georgia. Mr. Medinger has been an adjunct professor of law at Stevenson University since 2011. He clerked for the Honorable Stanley F. Birch\, Jr.\, on the U.S. Court of Appeals for the Eleventh Circuit from 2004-2005. He received his law degree from the Emory University School of Law in 2004\, and his undergraduate degree from the University of Notre Dame in 2000. \nParesh Patel \nParesh Patel is currently the Appellate Chief at the Office of the Federal Public Defender for the District of Maryland. He has been at the Federal Public Defender since 2003. Before then\, he worked as a staff attorney at the Public Defender Service in Washington\, D.C. and the Office of the Appellate Defender in New York\, New York. In 1999-2000\, he clerked for the Honorable Ancer L. Haggerty of the United States District Court for the District of Oregon in Portland. Paresh earned his J.D. from American University in 1996\, and he received his undergraduate degree from the University of Southern California in 1993. \nKimberly L. Wehle \nKimberly L. Wehle is a tenured law professor at the University of Baltimore School of Law and former CBS News legal analyst. She writes on the separation of powers\, outsourcing government\, and the federal administrative state. She is also an op-Ed contributor for Politico\, The Atlantic\, The Hill and The Bulwark\, and a regular commentator on CNN\, MSNBC\, and NPR’s Morning Edition.
