SUMMARY:Webinar: Holocaust and the Rule of Law
DESCRIPTION:Michael Taylor participated in the French Resistance and the Polish Refugee Resistance during World War II. He will speak about how the Holocaust came about within the rule of law as well as his role as a French Resistance and Polish Refugee Resistance fighter.    \nPresented by the International Law Section and Senior Lawyers Division  \nRegistration for this event is now closed. \n\nAbout the Presenters:\nMichael Taylor\, WWII Veteran\, French Resistance and Polish Refugee Resistance Fighter  \nMichael fought in the Polish Refugee Army\, French Resistance\, American\, and French World War II armies. After the Allies liberated France\, he visited Patton’s Rainbow Brigade\, which liberated Dachau and Buchenwald in Germany. Following the war\, he acquired four very rare legal certificates to take his three surviving sisters\, all under the age of 12\, with him to lead new lives in Palestine on a ship of 1000 refugees\, including Dr Ruth. Michael’s sisters had survived separately in Vichy\, France thanks in part to being hidden in a Catholic grade school\, aided by future Mime Marcel Marceau. \nUpon arriving in Israel\, Michael joined the elite Givati Reprisal Brigade. As a trained machine gunner\, he helped Israel attain independence. This took 9 months\, and 10 percent of Jews were killed. The Tzeuchneider (pron. Tuchschneider) family had all their property stolen from Belgium except rare photos\, which are included in today’s power point presentation\, along with family and archival military photos. \nMichael met his wife\, Rita\, when she came as tourist in 1952 to his Tel Aviv Main Street magazine store. They married after one month and communicated in Yiddish. Rita’s family members were socialist refugees from Tsarist Russia who had fled the 1905 pogrom. Michael’s family had fled similar murderous pogroms in Warsaw in 1924 and traveled across Europe\, spending ten peaceful years as religious Jews in Brussels. \nAlthough married and an American veteran\, Michael was not issued a visa during the Cold War to join his wife until he translated his Polish name Tzeuchneider to Taylor at the advice of Rita’s cousin working at the State Department. \nMichael now tells his story through lectures and webinars with his son\, Shannon. \nShannon Taylor\, Son to Michael Taylor \nShannon was born in 1955. He graduated Tufts University magna cum laude in 1976. He has practiced law since graduating Temple Law with Hebrew University Law in 1979. Shannon was a civil and criminal trial lawyer in New York City and Hackensack. \nHe is published\, has lectured for over thirty-five years\, and led a decade of 92nd Street Y tours at most of NYC’s private university and entertainment clubs. He is an award-winning photojournalist\, solarian\, percussionist and mineralogist. \nShannon has hosted a weekly prime time TV interview and commentary with his father called “The Conversation” for the past ten years. FBA Senior Lawyer Section Chair Steven Miller and many distinguished jurists\, refugees\, emigres\, entertainers\, authors\, political figures\, and scholars have all been guests. \n\nRegistration\nRegistration for this event is now closed. \nRegistration Fees \n\nFBA Member: $0\nAmerican Association of Jewish Lawyers and Jurists: $10\nNonmember: $75\n\nLive Captioning\nShould you request live captioning or another accommodation in order to participate in this webinar\, please contact meetings@fedbar.org at least 10 days before the event so we may make the necessary arrangements. \nCancellation Policy\nNo refunds will be made for cancellations received after the close of business on November 19\, 2020. SUMMARY:[Virtual] Fashion Law Conference
DESCRIPTION:The fashion industry is one of the world’s biggest fiscal heavyweights\, and this past year it has faced exceptional challenges.  The COVID pandemic has upended business as usual\, and has forced fundamental changes in supply chain strategies to adapt to the “new normal.”  It has also caused a boom in counterfeit products\, as the pandemic has created what some have described as a ‘perform storm” for the growth of counterfeits in the global market.  Bankruptcies and reorganizations have also dominated headlines\, as Neiman Marcus\, Brooks Brothers\, Lucky Brands\, JC Penney\, J. Crew and many others seek court protection to continue doing business.  Things are changing\, and with a new administration around the corner\, some are anticipating a tougher stance on social media\, advertising and ecommerce platforms.   This year\, legal professionals and leading industry representatives will thus explore diverse cutting-edge topics such as changes anticipated with the new Biden Presidency; the growth of counterfeits in ecommerce; issues pertaining to contract termination; liquidations and reorganizations; and what our path to returning to the office will look like in the employment and labor context. Although the arena of fashion has broadened in scope\, our lens of focus remains sharper than ever. \n\nAgenda\nMonday\, February 8 | 12:00 – 1:00 pm ET\nPandemic\, eCommerce\, and the Perfect Storm:  The Upsurge in Counterfeits\nThis panel will explore the pandemic’s effect on the sale of counterfeits online\, the existing framework to address it\, brand protection strategies and what we can anticipate with the new incoming Biden administration. \n\nModerator: Olivera Medenica\, Partner\, Dunnington Bartholow & Miller LLP\nJonathan Lasken\, Senior Trial Counsel\, Federal Trade Commission\nChristina Mitropoulos\, Manager\, Brand Protection & Manufacturing Initiatives\, American Apparel and Footwear Association\nCheryl Wang\, Counsel\, IP & Brand Enforcement\, David Yurman Enterprises LLC\n\nTuesday\, February 9 | 12:00 – 1:00 pm ET\nCutting Strings and Starting Anew:  Termination and Force Majeure Clauses\nThe first days of the pandemic\, lawyers were focused on force majeure clauses and how relationships could be instantly terminated using the pandemic as an excuse.  We are now almost a year into the pandemic\, and business relationships are still unstable.  Our panelists will explore how various business relationships have been impacted\, and will provide a general discussion of pending litigation addressing termination issues\, from licensing to commercial leases. \n\nModerator: Maria Vathis\, Of Counsel\, Bryan Cave Leighton Paisner LLP\nAnuj Kumar\, Founder & Editor in Chief\, Legal Desire\nDanielle C. Lesser\, Partner & Chair\, Business Litigation\, Morrison Cohen LLP\nBen Van Peperstraete\, Senior Legal Advisor\, European Center for Constitutional and Human Rights\n\nWednesday\, February 10 | 12:00 – 1:00 pm ET\nCustoms and Trade in 2021: China and Section 301 Tariffs\, Forced Labor\, USMCA\, Covid-19\, and the Biden Administration. What does the Future Hold?\nThis panel will include attorneys and fashion industry representatives discussing what they can expect with the new Biden Presidency\, USMCA\, and the ongoing trade war with China. What can the Fashion Industry expect to change in 2021 from and what will remain the same? What opportunities for tariff and duty reduction are on the horizon?  Panelists will also break down any expected trade benefits as a consequence of the new administration.  We will also discuss how U.S. and foreign companies should continue to prepare for the impacts of Covid-19 and what effect it will have on the import and export of goods in the U.S. \n\nModerator: Frances Hadfield\, Counsel – International Trade\, Crowell & Moring LLP\nMichael Khorsandi\, Vice President\, Trade and Regulatory Counsel\, Ross Stores\, Inc.\nWilliam (Randy) Rucker\, Partner\, Faegre Drinker Biddle & Reath LLP\n\nThursday\, February 11 | 12:00 – 1:00 pm ET\nMain Street Bankruptcies:  How to Navigate a Retailer’s Reorganization\n2020 has seen its share of bankruptcies in the fashion industry.  But while debtors might walk into court armed with counsel\, some creditors are caught by surprise as to how they should navigate the bankruptcy process.  Our panelists shed light on the complex world of bankruptcy law. \n\nModerator: Olivera Medenica\, Partner\, Dunnington Bartholow & Miller LLP\nJoseph T. SUMMARY:[Virtual] Labor and Employment Law Conference
DESCRIPTION:The Labor and Employment Law Section’s 2021 Biennial Conference returns virtually on February 26\, 2021.  While we all wish we could reconnect in Puerto Rico\, the virtual conference will provide the same informative panels on cutting-edge labor and employment law subjects from a diverse array of practitioners.  This year’s conference will present panels on arising issues involving the employee’s duty of loyalty\, FFCRA and other COVID-19 leave of absence issues\, and a discussion of best practices in evaluating requests for reasonable accommodations in the COVID-19 context. \n\n\n\nAgenda\nFriday\, February 26 \n12:00 – 1:00 p.m. ET\nHot Issues in Title I of the ADA \nCovid-19 has changed the reasonable accommodation process under title I of the ADA. Further\, those exposed to Covid-19 may have long-term effects they have to deal with. This presentation will discuss common issues arising from the reasonable accommodation process with respect to those who have\, have had\, or those who associate with someone at high risk. \n\nWilliam D. Goren\, Attorney\, William D Goren JD LLM LLC (Moderator)\nRobin Shea\, Partner\, Constangy Brooks\, Smith & Prophete LLP\n\n1:30 – 2:30 p.m. ET\nThe FFCRA\, FMLA\, and Leaves of Absence for Pandemic-Related Issues \nThe COVID-19 pandemic has birthed a plethora of legal issues related to employee leaves of absence.  The need for leave could arise from an employee’s own sickness\, immunocompromised state\, the sickness of a family member\, childcare issues relating to school closings\, and more.  Laws implicated include but are not limited to the Family and Medical Leave Act\, the Family First Coronavirus Response Act\, the Americans with Disabilities Act.  These laws will be analyzed in the context of COVID-19 related leaves and related adverse employment actions.    The panel will feature experienced leave law experts and trial lawyers representing both plaintiffs and defendants\, as well as a third party benefits administrator. \n\nAlejandro Caffarelli\, Founding Shareholder\, Caffarelli & Associates Ltd.\nSara Elder\, Assistant Vice President\, Operations at Sedgwick Claims Management Services\nJeff Nowak\, Shareholder\, Littler\n\n3:00 – 4:00 p.m. ET\nEmployee Duty of Loyalty Litigation – A National Survey \nThe breach of an employee’s duty of loyalty is an increasingly common claim asserted by employers concerned about unfair competition. With the passage of the Defend Trade Secrets Act (“DTSA”)\, more of these types of cases are being filed in federal court by employers against former employees. The law regarding duty of loyalty differs from state to state\, but in most jurisdictions an employee cannot compete with their employer while still employed but may prepare to compete. There can be confusion as to whether a duty of loyalty exists in the absence of any fiduciary duty. There is also uncertainty as to available remedies\, including damages\, disgorgement\, and the ability to seek injunctive relief. We survey the law of various states and how they differ\, including recent federal and state court decisions in this area. We will also discuss topics particular to federal practice\, such as which state’s laws apply for common law claims in conjunction with a breach of contract claim containing a choice-of-law provision; whether the DTSA preempts certain duty-of-loyalty claims; and whether a claimed breach of the duty of loyalty can be a “faithless servant” defense to a wage claim under the Fair Labor Standards Act. This seminar will provide an overview of duty of loyalty litigation across the country and tips for litigating them from both the plaintiff and defendant standpoint. \n\nV. SUMMARY:Capitol Hill Chapter Presents: WHAT GIRLS NEED: How to Raise Bold\, Courageous\, and Resilient Women By Marisa Porges\, PhD.
DESCRIPTION:Known for her work on leadership\, education\, and national security\, Porges combines lessons she learned throughout her career with the practices she is developing at The Baldwin School\, to help today’s girls cultivate the skills they need to become tomorrow’s leading women. The ways we define leadership are changing\, and the women now stepping into leadership roles are mapping new paths to inhabiting traits such as grit\, resilience\, audacity\, and self-confidence. The lessons Porges shares in WHAT GIRLS NEED prepares the next generation to confidently hold their own later in life in whatever fields they enter and no matter what challenges they face. WHAT GIRLS NEED demonstrates how to celebrate and own the traits which might have been undervalued in the past but which are more critical than ever today and will make the biggest difference in decades to come – including empathy\, collaboration\, and adaptability. Given the added pressure now placed on children because of school closures and the unfolding public health crisis\, there is no better time to ensure parents know the most effective strategies for nurturing their daughters’ courage and resilience. \nAs a former student at The Baldwin School outside Philadelphia\, Porges was raised in a community designed to produce strong\, independent women. After earning a BA in geophysics from Harvard\, she fulfilled her childhood dream of flying jets off aircraft carriers for the U.S. Navy before serving as a counterterrorism expert in Afghanistan\, and as a senior advisor in the Obama White House. In 2016\, in an unexpected move for someone whose ambitions had taken her so far from home\, Porges returned to head The Baldwin School. In doing so\, she began to see with great clarity how small moments in her early education gave her the tools she would eventually sharpen and deploy to excel in areas that were traditionally perceived as “a man’s world.” \nSponsored by the Capitol Hill Chapter \nRegistration for this event has now closed.  \n\nAbout the Presenters\n \nDr. Marisa Porges is known for her work on leadership\, education\, and national security. SUMMARY:2021 [Virtual] Thurgood Marshall Moot Court Competition
DESCRIPTION:  \nThe Younger Lawyers Division of the Federal Bar Association is pleased to announce the\nAnnual Thurgood Marshall Memorial Moot Court Competition will be held virtually March 8-12\, 2021  \n\nSeveral aspects of the competition make it one of the premier moot court competitions in the country: Historically\, every round of the competition is held at a courthouse\, as opposed to a law school or office setting. The opportunity for law students to present oral arguments in actual courtrooms is an invaluable experience. While the 2021 competition will not meet in person this year\, all rounds will be hosted via Zoom – a widely used online meeting platform by courts and the profession at large.  Second\, all of the individuals who serve as judges in the competition are actual judges\, practitioners\, or scholars. This too reinforces the “real world” experience for competitors. Finally\, as an added bonus\, each participant in the competition receives a free one-year law student membership in the Federal Bar Association. \nDates & Deadlines\nWednesday\, January 6\, 2021: Registration & Entry Fee Deadline \nFriday\, January 15\, 2021: Problem & Rules Distributed \nWednesday\, February 24\, 2021: Briefs Due (must be received by 11:59pm (ET) \nMarch 8\, 2021: Welcome and Competitor Training* \nMarch 9-12\, 2021: Oral Arguments* \nALL TIMES (ET). *All times are subject to change \n\nRegistration is closed\nVolunteer to Judge!\n\nQuestions?
