SUMMARY:Oklahoma City Chapter: Considering and Reconsidering Qualified Immunity

SUMMARY:Webinar: Private\, DOJ\, and HUD Enforcement of the Fair Housing Act: Landlord Liability for Tenant-on-Tenant Harassment Based on a Protected Characteristic
DESCRIPTION:A landlord who\, without justification\, enforces lease provisions in a manner that discriminates against a tenant because of the tenant’s race\, color\, religion\, sex\, disability\, familial status\, or national origin can be liable under the FHA. Both HUD and an increasing number of federal courts agree that liability also extends to a landlord for tenant-on-tenant discriminatory harassment when the landlord\, without justification\, fails to enforce lease provisions that could curtail or even end the harassment.  The landlord is not liable for the tenant’s misconduct\, but for its own in failing to take reasonable steps to remedy discriminatory wrongdoing.  Landlords have pushed back against this use of the Fair Housing Act.  The Second Circuit has been divided enough on the question that it decided to rehear it en banc. \nSasha Samberg-Champion\, Counsel at Relman\, Dane & Colfax PLLC\, will discuss FHA enforcement through a private lawsuit.  Mr. Samberg-Champion will specifically discuss his pending case in the Second Circuit Court of Appeals\, Francis v. Kings Park Manor\, Inc.  In that case\, the court will decide en banc whether a landlord can be liable under the FHA for failing to take action to stop another tenant from harassing him based on his race\, despite being informed by Mr. Francis and local law enforcement and even though the landlord had intervened in prior situations regarding non-race related lease and law violations for other residents. \nElise Sandra Shore\, Senior Trial Attorney in the Department of Justice’s Civil Rights Division\, Housing and Civil Enforcement Section\, will discuss FHA enforcement by the DOJ and specifically address landlord liability in the context of sex discrimination and sexual harassment\, including tenant-on-tenant harassment. \nJake Gray\, Trial Attorney for Region IV of the U.S. Department of Housing and Urban Development Office of General Counsel will discuss FHA enforcement by HUD\, who published its final rule codifying its longstanding FHA interpretation that housing providers should be held liable for tenant-on-tenant harassment under a negligence standard and without regard to whether the housing provider’s conduct was motivated by animus (“HUD’s 2016 Rule”). \nRobin B. Wagner\, Civil Rights Section/Division Chair-Elect\, will moderate and provide further insights from her experiences serving as a cooperating attorney for the Fair Housing Centers of Metro Detroit and Southeast and Mid-Michigan. \nPresented by the Civil Rights Law Section \nRegistration for this event is now closed. \n\nAbout the Presenters:\nSasha Samberg-Champion\, Counsel\, Relman\, Dane & Colfax PLLC \nSasha Samberg-Champion is Counsel at Relman\, Dane & Colfax PLLC\, where his practice concentrates on litigation under the Fair Housing Act and other civil rights laws. Mr. Samberg-Champion’s practice has covered a wide variety of civil rights topics\, including fair housing and lending\, employment and labor law\, disability rights\, LGBT rights\, voting\, immigration\, affirmative action\, and religious liberty. His recent matters include challenges to Department of Housing & Urban Development suspension of important civil rights regulations; municipal nuisance ordinances that cause tenants to be evicted because of police calls; and Uber’s inaccessibility to wheelchair users. Prior to joining Relman\, Dane & Colfax\, Mr. Samberg-Champion was a senior attorney in the Appellate Section of the Civil Rights Division of the U.S. Department of Justice.  In that capacity\, he briefed and argued appeals in the U.S. courts of appeals\, assisted the Office of the Solicitor General in the briefing of cases before the U.S. Supreme Court\, and provided legal counsel to the Division’s trial sections\, front office\, and client agencies.  Previously\, Mr. Samberg-Champion was an assistant solicitor general for the New York Attorney General’s Office\, where he played a similar role. He has argued dozens of appeals in state and federal court and has been principal or supporting drafter of numerous briefs in trial and appellate courts\, including several in the Supreme Court of the United States. Mr. Samberg-Champion is a graduate of Haverford College and Columbia Law School. He clerked for the Hon. Jed S. Rakoff of the U.S. District Court for the Southern District of New York and for the Hon. Robert A. Katzmann of the U.S. Court of Appeals for the Second Circuit. Oklahoma was a landmark win for Indian country that confirmed time-honored Indian law principles in how Indian law cases are handled by the US Supreme Court. This acknowledgement is historic because of the geographic and possibly substantive reach of the decision. The decision is a significant and helpful clarification of Solem v. Bartlett\, one that dispels the notion that de facto diminishment/disestablishment is possible independent of statutory language. Justice Neil Gorsuch grasped the gravity of the ruling. He wrote\, “On the far end of the Trail of Tears was a promise…Today we are asked whether the land these treaties promised remains an Indian reservation for purposes of federal criminal law. Because Congress has not said otherwise\, we hold the government to its word.”  These powerful words necessitate us to ask where do we go from here? This esteemed panel discusses the potential future of Indian law after McGirt. \n\nSarah Crawford\, Associate\, Clause Law PLLC(Moderator)\nRiyaz Kanji\, Founding Member\, Kanji & Katzen PLLC\nArlinda Locklear\nJoel Williams\, Staff Attorney\, Native American Rights Fund (NARF)\n\n2:30 – 4:00 p.m. ET\nEthics and Racial Disparities in the Legal Profession   \nIn 2015\, the National Native American Bar Association published a first-of-its-kind study on the experiences of Native American attorneys across the legal profession\, shedding light on disparate experiences and widespread exclusion. This dynamic panel will address the report’s stark findings\, individual experiences in the professional setting\, as well as the mental health impacts of discrimination and racial trauma. \n\nAllie Greenleaf Maldonado\, Chief Judge\, Little Traverse Bay Bands of Odawa Indians (Moderator)\nStephanie McIver\, Counseling Director\, University of New Mexico\nThomasina Real Bird\, President\, National Native American Bar Association & Partner\, Patterson Earnhart Real Bird & Wilson LLP\n\n\n\n\n\n\n\n\n\n\n\nRegistration\nRegistration is now closed. SUMMARY:Law Student Series: Racial Equity and the SDGs: A Certification Training Program for Law Students(3-Part Program)
DESCRIPTION:The urgency for racial equality is a clarion call for the legal profession. As practitioners consider how best to support this global movement\, the FBA Diversity and Inclusion (D & I) Committee aims to equip its members with a broad and practical understanding of human rights and how their work can contribute to a more just nation and planet. \nIn collaboration with UN Global Compact\, we are offering a ‘Certification Program’ promoting understanding and action aimed at member law students and the wider US legal community. The program will address how lawyers can draw on their problem-solving skills to contribute to civil justice. Importantly\, it will also introduce a framework for international human rights as enshrined in the UN Sustainable Development Goals. \nThis universally accepted agenda offers a comprehensive and quantifiable framework for the issues that continue to disproportionately impact minority and impoverished communities throughout the world. For young lawyers to have a voice in this conversation\, they must understand how these objectives and their underpinning principles\, can guide progress for governments\, businesses and even the law firms in which many of these students will soon begin their legal careers. \nRegistration for this event is now closed. \n\n\n\nSession 3: The Legislative Horizon – An International View of Human Rights Protections\nNovember 13\, 2020 ⋅ 2:00 – 3:30 ET \nWhile many governments have shown disappointing commitment\, we do see increased momentum towards state protection of both people and planet. Cepeda Derieux & Neil C. Weare  \nThe Court’s recent failure to overrule the Insular Cases represents a missed opportunity to move past the racially motivated doctrine of territorial incorporation. Three cases involving the denial of citizenship\, warrantless searches\, and unequal benefits in U.S. territories demonstrate the Insular Cases’ continuing harm while offering hope for their reconsideration. \nPolitical Wine in a Judicial Bottle: Justice Sotomayor’s Surprising Concurrence in Aurelius \nby Christina D. Ponsa-Kraus  \nThis Essay criticizes Justice Sotomayor’s concurring opinion in Financial Oversight and Management Board for Puerto Rico v. Aurelius Investment\, LLC. for offering a one-sided and misleading explanation of the island’s constitutional status\, and thereby taking sides in Puerto Rico’s decolonization debate. \nHow We Study the Constitution: Rethinking the Insular Cases and Modern American Empire \nby Aziz Rana  \nThis Essay defends the importance of the Insular Cases in American constitutional development. It explores the extent to which the United States has from the founding been a project of empire as well as the centrality of events surrounding those cases to basic transformations in twentieth century legal-political practice. \nFor media inquiries or more information about the event\, please contact ylj@yalelawjournal.org.

SUMMARY:Section on Taxation: Views on LB&I’s Proposal to Obsolete Revenue Procedure 94-69
DESCRIPTION:This roundtable will discuss the status of Revenue Procedure 94-69. In August\, the LB&I announced that it is considering rescinding Rev. Proc. 94-69. Rev. Proc. 94-69 provides special procedures for taxpayers that are subject to the former Coordinated Examination Program to show additional tax due or make disclosures to avoid the imposition of accuracy-related penalties for negligence\, disregard of rules or regulations\, or substantial understatement of income tax under IRC section 6662(b)(1) and (b)(2). Those who support retaining Rev. Proc. 94-69 argue that it ensures that taxpayers with large and complex returns are able to efficiently report and fix errors\, which encourages compliance. Critics have noted that Rev. Proc. 94-69 creates disparity among LB&I taxpayers and fails to support the broader tax administration effort to improve the accuracy and reliability of returns at the time of filing. The panel will discuss their views on how this proposed change would affect taxpayers and comments that were submitted to the IRS. \n\nAbout the Speakers\nLee Meyercord focuses her practice on federal\, state\, and local taxation of corporations\, partnerships\, individuals\, and nonprofit organizations. She provides clients with tax planning advice on mergers and acquisitions\, the operation and dispositions of partnerships and limited liability companies\, and private equity transactions\, and represents taxpayers in IRS audits\, appeals\, and federal income tax litigation. Lee also counsels clients on the organization\, operation\, and termination of nonprofit corporations and trusts\, and obtaining and maintaining exemptions for these organizations from federal income\, state franchise\, sales and use\, and local ad valorem taxes. \n  \nKevin Stults concentrates his practice on federal tax controversy and litigation. He represents large financial institutions\, multinational corporations and individuals at various stages of federal income tax controversies\, including audits\, administrative appeals and judicial proceedings. Mr. Stults’ substantive experience encompasses a variety of complex tax issues\, including foreign tax credits\, economic substance/business purpose\, corporate restructurings\, life insurance\, various partnership issues\, IRS promoter examinations\, pre-filing agreements\, and the TEFRA partnership audit and litigation procedures. \n  \n\nGround Rules\n\nStatements made by government employees are made in their personal capacity and may not be relied upon as an authorized statement of any government agency.\nNo recording devices allowed.\nFBA Tax Section membership is not required to participate\, but you are encouraged to visit https://www.fedbar.org/membership/for information on becoming a member.\n\n\nInterested in Speaking?\nIf you are interested in leading a future monthly call\, please contact cfederico@crowell.com or brandon.king@bakermckenzie.com \n\nIf you have any questions regarding this program\, please contact sections@fedbar.org

SUMMARY:Sponsor Webinar: How Bias Affects Your Case from Filing Through Verdict (and how to minimize its effect)
DESCRIPTION:The latest research on bias demonstrates that it affects everything including how clients select lawyers\, how judges decide motions\, and how lawyers pick juries. This course will provide an overview of the latest research\, but also teach ways to minimize its effect (without alienating the judge and jury). \nHosted by FBA Sponsor: Greene Espel PLLP \n\nAbout the Presenters\nSybil Dunlop (she/her/hers) is a national thought leader on Diversity\, Equity\, and Inclusion issues. She created and teaches award-winning Diversity & Inclusion programming which receives rave reviews. One City Attorney called her program “one of the most powerful\, thought-provoking\, and engaging presentations” ever attended. A Diversity & Inclusion Director reports\, “I have invited Sybil to speak on implicit bias four times\, and every time I get rave reviews from the audience. She touches people in a way that other\, more clinical speakers might not.” In recognition of her efforts\, Minnesota Lawyer selected Sybil as a Diversity & Inclusion Honoree in 2018\, and the Hennepin County Bar Association awarded her its Excellence Award for Advancing Diversity and Inclusion in 2019. \nBeyond her Diversity\, Equity\, and Inclusion work\, Sybil has conducted investigations and counseled clients regarding DEI policies. Clients praise her ability “to communicate well with a diverse array of people.” And another client says\, “She really is 100% client-focused. If I want to talk\, she will ring instantly. She is the most responsive lawyer I have ever met in my life and I feel like I am her only client.’” Based on this feedback\, Chambers USA: America’s Leading Lawyers for Business recognized Sybil as a notable practitioner in 2020. \nSybil attended Smith College and Vanderbilt University Law School where she graduated Order of the Coif. She is also the past president and a board member of the Infinity Project whose mission is to increase the gender diversity of the state and federal bench. \nAmran Farah (she/her/hers) is an experienced investigator\, litigator\, and speaker with a tenacious knack for identifying creative solutions to complex problems. Amran currently serves as President of the Minnesota Association of Black Lawyers\, spearheading the organization’s response to the murder of George Floyd. This response has included drafting and issuing press releases as well as running an overwhelmingly successful Silent Protest for attorneys standing in solidarity in the fight for justice. She is also leading a working group to end racial inequities in the legal profession and organizing pro-bono representation of protestors and impacted business owners in Minneapolis and St Paul. Amran’s talents are widely recognized. In December 2019\, Senators Amy Klobuchar and Tina Smith selected her to serve on the Judicial Selection Committee for an open seat on the federal court bench. \nBefore joining Greene Espel\, Amran worked at an insurance defense firm providing legal services to clients in Minnesota\, Wisconsin\, and North Dakota. After law school\, she clerked for the Honorable Franklin L. Noel in the United States District Court for the District of Minnesota\, and the Honorable Pamela G. Alexander in Hennepin County District Court. \nJenny Gassman-Pines (she/her/hers) regularly conducts internal investigations for employers to help them assess allegations of discrimination\, sexual harassment\, and other misconduct. In this arena\, she is known for her ability to connect with clients and witnesses\, particularly in matters involving sensitive issues or difficult personalities. Jenny also helps clients develop proactive and incisive strategies about how to avoid litigation and disputes in employment relationships\, offering recommendations to improve policies\, trainings\, and feedback. \nAs a member of Greene Espel’s Diversity\, Equity\, and Inclusion Practice\, Jenny specializes in helping organizations provide non-biased feedback to help improve the retention and development of diverse talent\, and she frequently teaches and advises on ways to improve feedback processes. \nJenny attended Wesleyan University and the University of Minnesota Law School where she graduated Order of\nthe Coif. \n\nRegistration\nRegistration for this event is now closed.
