SUMMARY:Section on Taxation: Tax Practice and Procedure Roundtable: Tax Legislative Update -  Employer Tax Credits Under the CARES and HEALS Acts; 2020 Presidential Election Considerations
DESCRIPTION:This roundtable will address refundable payroll tax credits made available to employers by CARES and HEALS.  The focus will be on the Employee Retention Tax Credit and the Safe and Healthy Workplace Tax Credit.   The panel will also offer a more general legislative outlook\, particularly in light of the upcoming election\, which will highlight candidates’ policy proposals and discuss potential impacts on existing tax policy. \n\nAbout the Speakers\nAndre J. Barnett is Tax Counsel for the Senate Finance Committee where he is responsible for corporate and international tax matters. Before joining the Senate Finance Committee\, Andre was part of the transaction tax team at Ernst & Young\, LLP where he focused on the tax aspects of corporate transactions\, including U.S. and cross-border mergers and acquisitions\, spin-offs\, bankruptcy and corporate restructuring. Andre received his LL.M from Georgetown University Law Center\, his J.D. from the University of the District of Columbia David A. Clarke School of Law and his B.A. from the University of North Carolina at Charlotte. \nLoren Ponds\, member of Miller & Chevalier\, centers her practice on providing strategic counsel to clients on legislative\, regulatory\, and other tax policy issues\, as well as advising on technical tax matters related to transfer pricing and other international tax topics.  She advises clients on the impacts of tax policy\, such as the implementation of the Tax Cuts and Jobs Act of 2017 (TCJA)\, and issues related to technical corrections\, administrative guidance\, and legislative amendments to various provisions. Prior to joining Miller & Chevalier\, Loren served as Majority Tax Counsel to the U.S. House of Representatives Committee on Ways and Means\, where she developed\, analyzed\, and refined the international tax provisions of the TCJA. Loren received her LL.M. from Georgetown University Law Center and her J.D. from American University Washington College of Law. \nMonisha Santamaria is a Legislation Counsel at the Joint Committee of Taxation\, assisting congressional tax-writing committees and members of Congress with the development and analysis of legislative proposals.  Her primary focus is on domestic businesses.  Previously\, Monisha was a senior manager in Ernst & Young LLP’s National Tax Department\, advising clients on a wide range of U.S. federal income tax issues impacting domestic and foreign partnerships; a tax associate at Skadden\, Arps\, Slate\, Meagher & Flom LLP\, primarily counseling multinational corporations on the U.S. federal income tax aspects of joint ventures\, mergers\, acquisitions\, and divestitures; and a tax planning associate at Bingham McCutchen LLP\, chiefly serving Fortune 50\, financial sector\, and energy industry clients. SUMMARY:Qui Tam Section: [VIRTUAL] False Claims Act Today - District of New Jersey
DESCRIPTION:Hosted by the FBA’s Qui Tam Section\, often in cooperation with local FBA chapters\, “The False Claims Act Today” is a discussion series that examines the details of real-life FCA practice in specific jurisdictions. Sessions typically focus on a single federal district and feature an experienced local panel that includes an Assistant U.S. Attorney for the district; a federal judge; a relator-side attorney; and a defense attorney. \nWe hope to resume in-person sessions of “The FCA Today” in 2021\, but for now we’re conducting them online via the Zoom platform. For this session on the District of New Jersey\, attendees can expect a brief overview of the FCA process\, including a review of case law in the Third Circuit\, and a detailed look at: \n\nThe types of FCA case most welcomed by the district’s U.S. Attorney Office;\nHow D.N.J. prosecutors work with Main Justice to investigate complaints and weigh intervention;\nHow D.N.J. judges evaluate seal extensions and seal violations;\nThe local impact of the Supreme Court’s recent FCA decisions; and\nWhere D.N.J. prosecutors fall in national debates over the viability of medical necessity cases\, DOJ dismissal of relator-led cases\, and other issues.\n\n\nAbout the Presenters\nR. Scott Oswald – Chair\, FBA Qui Tam Section (moderator) \nScott Oswald is an accomplished trial lawyer who has brought more than 40 trials to verdict. His cases have recovered more than $300 million in judgments and settlements. A fellow of the prestigious College of Labor and Employment Lawyers\, he received his law degree from Howard University and honed his skills at Trial Lawyers College\, founded by the legendary Gerry Spence. Mr. Oswald litigates employment and whistleblower actions nationwide. Among his results: \n\nFirst jury verdict under new whistleblower protections in the National Defense Authorization Act of 2013|\nFirst Sarbanes-Oxley Act liability verdict to withstand appeal\nFirst jury verdict under 2009 anti-retaliation provisions of False Claims Act\nFirst Dodd-Frank Act retaliation lawsuit to reach discovery in federal court\n\nMr. Oswald is chair of the Federal Bar Association’s Qui Tam Section and immediate past chair of the FBA’s Professional Ethics Committee. Lawdragon ranks him as one of the top 500 plaintiff-side employment lawyers in the country. \nKen Abell \nKen Abell is a founding partner of Abell Eskew Landau LLP (AEL)\, a boutique law firm specializing in qui tam defense and False Claims Act Litigation\, government enforcement matters and white collar criminal defense. AEL represents numerous entities and individuals in connection with qui tam matters under the False Claims Act\, including several large hospital systems and healthcare providers. Until 2018\, Ken served as Chief of Healthcare Fraud for the United States Attorney’s Office for the Eastern District of New York\, Civil Division. In his ten years as an Assistant United States Attorney\, Ken litigated and resolved some of the Eastern District’s most significant FCA matters\, including some of the nation’s largest healthcare and mortgage fraud cases. Ken began his legal career as a commercial litigator at a prominent litigation boutique in Chicago. Thereafter\, he was a law clerk to the Honorable Theodore H. Katz in the Southern District of New York\, before joining the United States Attorney’s Office in 2008. \nLee Cortes \nLee is an Assistant United States Attorney at the U.S. Attorney’s Office for the District of New Jersey. Lee currently serves as the Chief of the Health Care Fraud Unit\, supervising a team of approximately 12 AUSAs and directing all of the Office’s criminal and civil investigations and prosecutions of health care fraud offenses.  Before Lee was promoted to that role in January 2020\, he served as the Deputy Chief of the Special Prosecutions Division since July 2017\, where he oversaw approximately 12 prosecutors who investigate and prosecute public corruption matters. Before then\, Lee was a line assistant in the General Crimes Unit in 2010 and in the Special Prosecutions Division from 2011 until 2017. Prior to joining the U.S. Attorney’s Office\, Lee worked at Kaye Scholer in New York from 2003 to 2010\, focusing on white collar defense\, life sciences\, products liability\, and commercial litigation. Lee graduated from King’s College and Fordham Law School. \nDave Dauenheimer \nDavid Dauenheimer is a Deputy Chief in the Government Fraud Unit of the Criminal Division at the United States Attorney’s Office for the District of New Jersey. He serves as the Affirmative Civil Enforcement Coordinator and previously served as the Health Care Fraud Coordinator from 2011 until 2015. Mr. Dauenheimer is responsible for civil investigations of government fraud offenses including violations of the False Claims Act\, FIRREA\, and other federal laws. Since joining the office in 2008\, he has been responsible for numerous large-scale qui tam/civil investigations\, including resolutions involving a multinational device manufacturer\, pharmaceutical companies\, and companies contracting with numerous federal agencies including the Department of Defense. \nMr. Dauenheimer previously served as a Senior Litigation Counsel handling appellate and class action matters in the Office of Immigration Litigation at the Department of Justice. Prior to joining the Department of Justice in 2002\, Mr. Dauenheimer served for seven years with the Judge Advocate General’s Corps of the U.S. Army\, where he was a criminal prosecutor\, claims attorney\, deployed to Bosnia in support of Operation Joint Guard\, and was selected to be the Army’s liaison to the Department of Justice’s Torts Branch where he served as a trial attorney for two years. \nMr. Dauenheimer received his JD from the University of Colorado\, Boulder School of Law\, and his BA in Civil Engineering from Lafayette College\, Easton PA. \nJay P. Holland \nA principal in Joseph\, Greenwald & Laake’s Civil Litigation Group and chair of the firm’s Labor\, Employment\, and Qui Tam Whistleblower practice\, Jay Holland is a renowned employment and qui tam litigator known for taking on tough cases and achieving exceptional results. Jay counsels clients in individual and class action cases involving gender and race discrimination and sexual harassment\, violations of the wage and hour laws\, and wrongful termination. Anderson\, Jr. was appointed United States District Judge by President Ronald Reagan in October 1986. Prior to that\, Judge Anderson practiced law in Edgefield\, South Carolina\, and represented Edgefield and Aiken Counties in the South Carolina General Assembly. He is a graduate of Clemson University and the University of South Carolina School of Law. When appointed at age 36\, Judge Anderson became the youngest federal judge in South Carolina history and the second youngest in the country. He has served on the federal bench for 34 years\, seven of those years as Chief Judge. A strong advocate of legal education\, Judge Anderson has taken part in more than 200 CLE and law-related programs\, committees and associations\, including a six-year seat on the Federal Rules of Evidence Committee of the United States Judicial Conference. He also has authored two books on trial advocacy for lawyers. Ms. Brecht serves as Chair of the firm’s national Qui Tam/False Claims Act Practice Group. She is also experienced in white-collar criminal litigation\, employment law\, internal investigations\, and complex health care litigation. Ms. Brecht has litigated many of the most complex False Claims Act cases filed in the United States. Her cases have included alleged fraud by a large multi-state Medicaid managed care contractor\, FCA violations by three of the largest hospital corporations in the country\, and dissecting complex financial relationships among healthcare providers including Stark and Anti-Kickback issues. He was in private practice from 1974 to 1998. \nHon. Amiena Khan\, NAIJ \nHon. Amiena Khan was appointed by Attorney General Eric Holder in December\, 2010.  Judge Khan is seated at the New York Immigration Court and is a member of the New York State Bar.  She is the Executive Vice President of the National Association of Immigration Judges (NAIJ) and serves as the co-chair of the NAIJ Vulnerable Populations Committee. NAIJ is the collective bargaining unit for U.S. Immigration Judges nationwide. In her personal capacity\, she is a member of the Federal Bar Association and is a Board Member and the Programs Chair of the Federal Bar Association Immigration Law Section. DESCRIPTION:The Committee on Foreign Investment in the United States (“CFIUS”) is an interagency committee authorized to review certain transactions involving foreign investment in the United States and certain real estate transactions by foreign persons\, in order to determine the effect of such transactions on the national security of the U.S. CFIUS operates pursuant to section 721 of the Defense Production Act of 1950. The authority of the President to suspend or prohibit certain transactions was created through the 1988 Exon-Floria Amendment and has been revised by subsequent regulations. \nThe regulations governing the CFIUS review process are codified at 31 C.F.R. Chapter VIII. Effective February 13\, 2020\, changes to CFIUS’s jurisdiction and process were implemented which affect the access\, rights or involvement of foreign persons to U.S. businesses. CFIUS operates pursuant to section 721 of the Defense Production Act of 1950. \nThis webinar will address the events which led to the formation of CFIUS\, how it works\, and how to balance national security and business interests. Please contact meetings@fedbar.org for assistance.  \n\nAbout the Presenters:\nDr. Bijan Kasraie\, Partner\, KF Law LLC \nUpon receiving his Ph.D. degree in engineering from Pennsylvania State University\, Bijan Kasraie went to Iran\, where he served as Vice President of Operations for one of the largest cement complexes in Iran\, with over 15\,000 employees. Shortly afterward\, he was promoted to Executive Vice President.  In that position\, he doubled the company’s revenue by lowering the cost and improving the efficiency of the company. He was then hired as Executive Vice President for the second-largest bank in the country\, with over 6\,600 branches. During his ten years with the bank\, he transformed the entire operation from old-fashioned paper banking to fully automated systems.  In 1979 he returned to the U.S. and formed the Midcontinental Bank\, a privately owned bank with a presence in England\, Italy\, Switzerland\, the Caribbean\, and the U.S.  He served as President of the bank until its dissolution in 1991. During this period\, he also formed an independent oil and gas company with operations in the Appalachian Basin. Dr. Kasraie then formed the Midcontinental Group Company (“MGC”)\, a company involved with the  pharmaceutical\, import-export\, and recycling businesses\, among others. In 1997\, Dr. Kasraie obtained his law degree and formed the law firm of Marchman and Kasraie\, where he served as Managing Partner. The firm was active in corporate and security law\, international law\, and family law.  In 2012\, Dr. Kasraie co-founded the law firm of Kasraie & Fodor\, LLC. \nModerated By\nBeth S. During this time\, West was twice elected to serve as the Chair of the Circuit Vice Presidents. In 2013\, while serving as Government Relations Committee chair\, West testified before the U.S. Senate Judiciary Committee regarding the effect of sequestration on the federal courts. He helped institute the FBA’s annual “Capitol Hill Day” and taught at the FBA’s annual leadership training. Prior to serving as an FBA national officer\, West was the Nevada Chapter president from 2000 to 2001 and co-chair of the 2006 FBA National Convention held in Las Vegas. West has been a Life Fellow with the FBA Foundation since 2009. \nOver the years\, West has worked with many FBA leaders and committees. He was appointed to serve on the FBA’s National Council from 2001 to 2007. He was reappointed to this committee by the chief judge in 2009 and in 2011\, at which time he drafted the local patent rules for the District of Nevada. Carolina Chavez is the General Counsel and Deputy Commissioner for Policy at the New York City Mayor’s Office of Immigrant Affairs (MOIA)\, the primary policy advisor to the Mayor on all immigration related matters. In that capacity\, she oversees the Office’s legislative efforts to advocate for immigrant inclusive policies and programs at all levels of government\, as well as enforcement of the City’s local laws limiting law enforcement and government from cooperating with ICE on civil immigration enforcement. Carolina’s responsibilities also include advising on the City’s approach to immigration-related litigation\, both affirmative and defensive. She joined MOIA after serving as a Senior Counsel at the Mayor’s Office of Criminal Justice\, where her responsibilities included advising and operationalizing reforms aimed at reducing the over-policing and criminalization of communities of color. Prior to joining the Mayor’s Office\, Carolina was a Senior Counsel at the New York City Law Department\, where she litigated on behalf of the City and its employees in federal suits filed in the Southern and Eastern District Courts. She has served as an Administrative Law Judge for New York State\, and started her career at the New York County District Attorney’s Office. In addition\, she is an adjunct faculty member in the Lawyering and Legal Writing Program at Cardozo Law. Carolina is the proud daughter of immigrants. \n  \nArash Jahanian is the Director of Policy and Civil Rights Litigation at the Meyer Law Office\, PC.  He advises lawmakers\, advocates\, and stakeholders on proposed policies\, through the lens of the impact those policies will have on members of vulnerable communities including immigrants and people impacted by the justice system.  His litigation practice includes representation of victims of governmental abuse and employment discrimination. Prior to joining the Meyer Law Office\, Arash worked as a staff attorney at the ACLU of Colorado\, where he litigated and advocated on behalf of immigrants\, LGBTQ individuals\, prisoners\, victims of police racial profiling\, and people experiencing homelessness.  Arash contributed to lawsuits in Colorado that ended sheriffs’ practices of holding individuals at ICE’s request\, challenged a 287(g) program that would allow deputies to enforce immigration law\, and sought accountability for the death of man in ICE custody at the detention facility run by GEO Group\, Inc. Arash previously worked at the civil rights firm Rathod Mohamedbhai LLC\, where he represented victims of police brutality\, prison abuse\, and employment discrimination. Arash was one of the attorneys in the Wyoming marriage equality cases and has served as chair of the Denver LGBTQ Commission and president of the Colorado LGBT Bar Association. He is currently on the board of the Interfaith Alliance of Colorado and the Nomination Committee for the Denver Citizen Oversight Board. Arash was recognized as the Colorado Bar Association’s Outstanding Young Lawyer in 2015\, and was part of three different teams winning the Colorado Trial Lawyers Association’s Case of the Year Award. A graduate of Georgetown Law and the University of North Carolina\, Arash has also worked as an associate in Crowell & Moring LLP’s Washington\, DC office\, a judicial clerk for the Honorable Wiley Y. DESCRIPTION:Hosted by the FBA’s Qui Tam Section\, often in cooperation with local FBA chapters\, “The False Claims Act Today” is a discussion series that examines the details of real-life FCA practice in specific jurisdictions. In June 2020\, a majority of the U.S. Supreme Court held in Bostock v. Clayton County that the term “sex” in Title VII prohibits workplace discrimination on the basis of sexual orientation or gender identity. Panelists will discuss this decision and its implications for the LGBTQ+ community. \nPresented by the LGBT Law Section \n\nAbout the Presenters:\nChristine E. Dieter\, Associate\, Hinckley Allen (Moderator) \nChristine is an Associate in the firm’s Environmental and Energy Practice Groups and Litigation practice. She has experience litigating in state and federal courts and before administrative agencies. Christine has worked on permitting matters for offshore wind farms and worked on litigation relating to the cleanup of contaminated land. He has played an instrumental role in advancing the civil and constitutional rights of LGBT people under the U.S. Constitution and federal civil rights laws regarding education\, employment\, health care\, and housing. As a member of the legal team in Obergefell v. Hodges\, Gonzalez-Pagan helped secure marriage equality at the U.S. Supreme Court while representing four same-sex couples seeking respect for their out-of-state marriages and accurate birth certificates for their Ohio-born children. He was also lead counsel in Conde-Vidal v. Rius-Armendariz and co-counsel in Robicheaux v. Caldwell\, successfully challenging Puerto Rico’s and Louisiana’s marriage bans\, respectively. Gonzalez-Pagan helped secure two landmark decisions—the first and second appellate rulings in the country—holding that Title VII covers sexual orientation discrimination in Hively v. Ivy Tech Community College and Zarda v. Altitude Express\, Inc. As lead counsel in Smith v. Avanti\, he also obtained the first court decision in the country holding that the Federal Housing Act’s sex discrimination prohibition covers discrimination against LGBT people. As Health Care Strategist\, Gonzalez-Pagan has been a leading voice in the proper interpretation of the Affordable Care Act’s nondiscrimination provision\, particularly as it applies to LGBT people. Gonzalez-Pagan is also a key architect of Lambda Legal’s efforts to secure the ability of transgender people to obtain accurate identity documents\, including birth certificates. Gonzalez-Pagan received his law degree from the University of Pennsylvania Law School\, where he was an editor of the University of Pennsylvania Journal of Constitutional Law. He also possesses a Master’s in Environmental Studies from the University of Pennsylvania and a Bachelor of Science in Biology from Cornell University. Gonzalez-Pagan was born and raised in San Juan\, Puerto Rico. DESCRIPTION:The Oklahoma City Chapter of the Federal Bar Association is pleased to offer a virtual CLE addressing the doctrine of qualified immunity from civil rights claims brought under 42 U.S.C. § 1983 (part of the Civil Rights Act of 1871). \nAlthough the doctrine is widely applied\, scholars\, judges and even some Supreme Court justices have suggested that the doctrine is not grounded in the statute and is subject to question. SUMMARY:Webinar: Private\, DOJ\, and HUD Enforcement of the Fair Housing Act: Landlord Liability for Tenant-on-Tenant Harassment Based on a Protected Characteristic
DESCRIPTION:A landlord who\, without justification\, enforces lease provisions in a manner that discriminates against a tenant because of the tenant’s race\, color\, religion\, sex\, disability\, familial status\, or national origin can be liable under the FHA. Both HUD and an increasing number of federal courts agree that liability also extends to a landlord for tenant-on-tenant discriminatory harassment when the landlord\, without justification\, fails to enforce lease provisions that could curtail or even end the harassment.  The landlord is not liable for the tenant’s misconduct\, but for its own in failing to take reasonable steps to remedy discriminatory wrongdoing.  Landlords have pushed back against this use of the Fair Housing Act.  The Second Circuit has been divided enough on the question that it decided to rehear it en banc. \nSasha Samberg-Champion\, Counsel at Relman\, Dane & Colfax PLLC\, will discuss FHA enforcement through a private lawsuit.  Mr. Samberg-Champion will specifically discuss his pending case in the Second Circuit Court of Appeals\, Francis v. Kings Park Manor\, Inc.  In that case\, the court will decide en banc whether a landlord can be liable under the FHA for failing to take action to stop another tenant from harassing him based on his race\, despite being informed by Mr. Francis and local law enforcement and even though the landlord had intervened in prior situations regarding non-race related lease and law violations for other residents. \nElise Sandra Shore\, Senior Trial Attorney in the Department of Justice’s Civil Rights Division\, Housing and Civil Enforcement Section\, will discuss FHA enforcement by the DOJ and specifically address landlord liability in the context of sex discrimination and sexual harassment\, including tenant-on-tenant harassment. \nJake Gray\, Trial Attorney for Region IV of the U.S. Department of Housing and Urban Development Office of General Counsel will discuss FHA enforcement by HUD\, who published its final rule codifying its longstanding FHA interpretation that housing providers should be held liable for tenant-on-tenant harassment under a negligence standard and without regard to whether the housing provider’s conduct was motivated by animus (“HUD’s 2016 Rule”). \nRobin B. His recent matters include challenges to Department of Housing & Urban Development suspension of important civil rights regulations; municipal nuisance ordinances that cause tenants to be evicted because of police calls; and Uber’s inaccessibility to wheelchair users. Prior to joining Relman\, Dane & Colfax\, Mr. Samberg-Champion was a senior attorney in the Appellate Section of the Civil Rights Division of the U.S. Department of Justice.  In that capacity\, he briefed and argued appeals in the U.S. courts of appeals\, assisted the Office of the Solicitor General in the briefing of cases before the U.S. Supreme Court\, and provided legal counsel to the Division’s trial sections\, front office\, and client agencies.  Previously\, Mr. Samberg-Champion was an assistant solicitor general for the New York Attorney General’s Office\, where he played a similar role. He has argued dozens of appeals in state and federal court and has been principal or supporting drafter of numerous briefs in trial and appellate courts\, including several in the Supreme Court of the United States. Mr. Samberg-Champion is a graduate of Haverford College and Columbia Law School. He clerked for the Hon. Jed S. Rakoff of the U.S. District Court for the Southern District of New York and for the Hon. Robert A. Katzmann of the U.S. Court of Appeals for the Second Circuit. Prior to law school\, Mr. Samberg-Champion spent four years as a reporter covering telecommunications and Internet regulation and legislation. \nElise Shore\, Senior Trial Attorney\, Housing & Civil Enforcement Section\, Civil Rights Division\, U.S. Department of Justice \nElise Sandra Shore is a Senior Trial Attorney in the Department of Justice’s Civil Rights Division\, Housing and Civil Enforcement Section.  In that capacity\, she investigates\, litigates\, and tries cases under various civil rights statutes\, including the Fair Housing Act\, Title II of the Civil Rights Act of 1964\, and the Equal Credit and Opportunity Act.  Ms. Shore has also worked as a trial attorney in the Civil Rights Division’s Voting Section. DESCRIPTION:The urgency for racial equality is a clarion call for the legal profession. As practitioners consider how best to support this global movement\, the FBA Diversity and Inclusion (D & I) Committee aims to equip its members with a broad and practical understanding of human rights and how their work can contribute to a more just nation and planet. \nIn collaboration with UN Global Compact\, we are offering a ‘Certification Program’ promoting understanding and action aimed at member law students and the wider US legal community. The program will address how lawyers can draw on their problem-solving skills to contribute to civil justice. Importantly\, it will also introduce a framework for international human rights as enshrined in the UN Sustainable Development Goals. \nThis universally accepted agenda offers a comprehensive and quantifiable framework for the issues that continue to disproportionately impact minority and impoverished communities throughout the world. For young lawyers to have a voice in this conversation\, they must understand how these objectives and their underpinning principles\, can guide progress for governments\, businesses and even the law firms in which many of these students will soon begin their legal careers. \nRegistration for this event is now closed. \n\n\n\nSession 3: The Legislative Horizon – An International View of Human Rights Protections\nNovember 13\, 2020 ⋅ 2:00 – 3:30 ET \nWhile many governments have shown disappointing commitment\, we do see increased momentum towards state protection of both people and planet. Progressive legislation by some G20 countries is driving worldwide human rights protections. Lawyers have an important role to play as they help to draft legislation or policy as well as how they advise their business clients about the impacts of these legislative trends. \nIn this session we look at human rights trends in the law\, including: How Modern Slavery Acts are driving due diligence and transparency along supply chains; What US racial equality legislation might look like;\nAnalyzing and advising on corporate risk in an evolving legislative and litigation landscape; and\, Advising clients on a human rights/equality approach to procurement. \nAbout the Presenters\nSteven Feldstein\, Senior Fellow\, Carnegie Endowment for International Peace in the Democracy\, Conflict and Governance Program \nSteven Feldstein is a senior fellow at the Carnegie Endowment for International Peace in the Democracy\, Conflict and Governance Program. Previously\, he was the holder of the Frank and Bethine Church Chair of Public Affairs and an associate professor at Boise State University. He served in the Obama administration as Deputy Assistant Secretary of State for Democracy\, Human Rights and Labor with responsibility for Africa policy\, international labor affairs\, and international religious freedom\, and as Director of Policy at the U.S. Agency for International Development. He has also served as Counsel on the U.S. Senate Foreign Relations Committee\, maintaining oversight of all foreign assistance agencies\, budgets and programs. His research interests include the intersection of technology\, democracy\, and human rights; U.S. foreign policy; and Africa policy. His articles and commentary have appeared in outlets such as the BBC\, Financial Times\, Foreign Affairs\, Foreign Policy\, Journal of Democracy\, MIT Technology Review\, The National Interest\, The Wall Street Journal\, War on the Rocks\, and The Washington Post. He received his B.A. from Princeton and his J.D. from Berkeley Law. In this capacity\, she leads UN Global Compact’s engagement with businesses\, Governments\, law firms and associations\, civil society\, and the UN system to promote the Global Compact’s human rights Principles and support the implementation of the UN Guiding Principles on Business and Human Rights with a view to enhance the corporate responsibility to respect and support human rights at the global and local level. \nBefore taking up this position\, Ms. Kofoed served in the Ministry of Foreign Affairs of Denmark\, most recently as the Senior Human Rights Policy Adviser with the Permanent Mission of Denmark to the United Nations in New York (2012 – 2019).
