DESCRIPTION:In the wake of the police accountability problems that are confronting America\, it is even more vital that we are educated on issues surrounding law enforcement’s liability.  The third installment of this program will shed light on police and municipal liability arising from encounters with people who have a disability.  The panelists will discuss how Section 1983 has been applied in these encounters and law enforcement compliance with and best practices under the Americans With Disabilities Act. \nThe panelists will be Bill Goren\, the first president of the National Association of Attorneys With Disabilities and a national expert on Americans With Disabilities Act compliance\, Julie Chovanes\, a transgender woman who owns her own firm focusing on civil rights impact litigation\, Sergeant Cheryl Dorsey\, who became a social justice advocacy consultant after serving in the Los Angeles Police Department for more than 20 years\, and Jeff Rothman\, a New York City attorney specializing in representing plaintiffs in police and law enforcement misconduct cases\, including cases arising from arrests during Occupy Wall Street and Black Lives Matter protests. \nPrevious installments of this webinar series addressed both the prosecution and defense points of view. Part One shared insights on how law enforcement is trained\, special considerations that arise during their prosecution\, and solutions for the problems we face. Part Two featured a panel of defense attorneys with expertise in representing officers. \nThe programs will be moderated by Kiera Murphy and Ann Motl\, who are both attorneys involved with Federal Bar Association diversity and inclusion efforts. Tara Norgard\, Chair of the National Diversity & Inclusion Committee\, also provided vital support in developing the programs. \nPresented by the Diversity & Inclusion Standing Committee \nEndorsed by: \n\nCivil Rights Law Section\nMinnesota Chapter\n\n\nAbout the Presenters\nJulie Chovanes\, Attorney\, Chovanes Law\nJulie Chovanes graduated from Villanova University\, Villanova\, PA with four degrees including law.  She founded Chovanes Law after she left her partnership in the largest law firm in the world\, DLA Piper\, in order to better serve her clients.  Julie practices civil rights law and advocacy and has practiced in commercial areas\, ranging from business law and litigation to patent law.  She has changed the law to force recognition of the rights of trans people\, including practicing at the intersection of trans rights and the Americans With Disabilities Act.  Julie is also one of the few trans women to have her own firm and engage in impact litigation matters for trans and other people.   \nSgt. Cheryl Dorsey\, Los Angeles Police Department (ret.)\nCheryl Dorsey is a Los Angeles native and joined the LAPD in 1980. During her career\, she worked exclusively in patrol and specialized units in all four Bureaus within the City of Los Angeles; South\, Central\, West and Valley. In addition to various patrol division assignments\, Sgt. Dorsey was assigned to the infamous gang unit in Operations South Bureau; known as Community Resources Against Street Hoodlums (C.R.A.S.H.) under the command of Police Chief Daryl F. Gates. Sgt Dorsey also chronicled her LAPD career and social justice advocacy in an autobiography; “Black and Blue\, Creation of A Social Advocate”. \nWilliam D. Goren\, Attorney\, William D. Goren JD LLM LLC\nWilliam D. Goren has 30 years of experience dealing with the ADA as an Attorney. His law practice and consulting practice as well as his blog\, Understanding the ADA (an ABA 100 blog from 2014-2018). There was no ABA 2019)\, focus on understanding the ADA so that the client understands what it means to comply with that law. In particular\, he provides consulting (which includes but is not limited to: training and serving as an ADA compliance expert witness; consulting expert; or consultant on ADA and related laws on matters in litigation)\, representation (providing counseling or co-counseling services)\, those involving compliance with the Americans with Disabilities Act\, Rehabilitation Act of 1973\, and related laws. He is also a trained mediator\, a FINRA arbitrator\, and an arbitrator on the CPR employment law panel. Finally\, he is the author of Understanding the ADA\, now in its 4th edition (ABA 2013)\, and numerous other articles on the rights of persons with disabilities. Mr. Goren has an A.B. in Political Science from Vassar College\, a J.D. from University of San Diego School of Law\, and an LL.M. in Health Law from DePaul University College of Law. Interesting fact: he trained his miniature poodle to be a hearing dog for when he is in his virtual office.  \nJeffrey A. Rothman\, Attorney at Law\, Solo Practitioner\nJeffrey A. Rothman is a solo practitioner in New York City\, concentrating in the area of civil rights litigation\, mostly involving police and other law enforcement misconduct.  He is a 2001 graduate of the University of Pennsylvania Law School. Mr. Rothman was one of the attorneys who represented arrestees in the civil rights litigation stemming from the mass arrests during the 2004 Republican National Convention demonstrations in New York City.  He has also represented a number of arrestees from other political demonstrations\, including those associated with the Occupy Wall Street movement and the Black Lives Matter movement\, other political activists\, and numerous others whose rights have been violated by law enforcement or other branches of the government\, or by private entities acting in conjunction with the government\, in myriad circumstances.  Mr. Rothman has also litigated extensively on behalf of prisoners and detainees\, concerning abuses they suffered while incarcerated and concerning their wrongful imprisonment in jail\, prison\, or in immigration detention. \nModerated By:\nAnn Motl\, Associate\, Maslon LLP\nAnn Motl is a registered patent attorney with the U.S. Patent and Trademark Office and represents clients in complex intellectual property litigation. Her substantial experience includes all phases of pre-trial civil litigation and motion practice in the federal courts. Committed to advancing the profession through leadership and pro bono service\, Ann is actively involved in the Minnesota Chapter of the Federal Bar Association where she currently serves as co-chair of the Digital Communications Committee. She has represented a pro bono client in a Social Security disability appeal while working with the Minnesota Chapter’s Pro Se Project\, and has also represented pro bono clients in housing and habeas matters while working with Volunteer Lawyers Network and Mid-Minnesota Legal Aid. \nKiera K. Ballentine\, Associate Attorney\, DSK Law (de Beaubien\, Simmons\, Knight\, Mantzaris & Neal\, LLP) \nAndrew Ballentine is an Associate Attorney in the Firm’s Orlando office.  Prior to joining the Firm\, Andrew was a Law Clerk for the Honorable Eduardo V. Rodriguez\, United States Bankruptcy Judge for the Southern District of Texas. Andrew was born and raised in Largo\, Florida before he left for Gainesville to attend the University of Florida where he earned a Bachelor of Science in Food & Resource Economics from the College of Agriculture and Life Sciences.  Additionally\, Andrew earned a Master of Arts from the Graduate School at the University of Florida in Agribusiness\, during which time he was a graduate assistant for Finance and Investment courses taught by Professor P.J. van Blokland. Andrew received his Juris Doctor degree\, cum laude\, from Florida Agricultural and Mechanical University College of Law.  During law school\, Andrew was a member of Law Review and served as a supervising editor.  Andrew was also the Vice President and Treasurer for the school’s Federalist Society chapter\, and the school’s liaison to the Orlando Chapter of the Federal Bar Association.  Andrew earned the top grade in Property I and Public International Law. Prior to graduating from law school\, Andrew was a financial planner with Nelson Financial Planning and a FINRA registered representative and principal with Nelson Ivest Brokerage Services Inc.  Andrew also serves as the Vice President of Programming for the Orlando Chapter of the Federal Bar Association and the Chair of the State and Local Government Relations Section of the Federal Bar Association. Additionally\, Andrew serves on a Federal Bar Association task force charged with determining ways to encourage opportunities for lesser experienced attorneys in federal court. \nTara L. DESCRIPTION:This roundtable will address refundable payroll tax credits made available to employers by CARES and HEALS.  The focus will be on the Employee Retention Tax Credit and the Safe and Healthy Workplace Tax Credit.   The panel will also offer a more general legislative outlook\, particularly in light of the upcoming election\, which will highlight candidates’ policy proposals and discuss potential impacts on existing tax policy. \n\nAbout the Speakers\nAndre J. Barnett is Tax Counsel for the Senate Finance Committee where he is responsible for corporate and international tax matters. Before joining the Senate Finance Committee\, Andre was part of the transaction tax team at Ernst & Young\, LLP where he focused on the tax aspects of corporate transactions\, including U.S. and cross-border mergers and acquisitions\, spin-offs\, bankruptcy and corporate restructuring. DESCRIPTION:Hosted by the FBA’s Qui Tam Section\, often in cooperation with local FBA chapters\, “The False Claims Act Today” is a discussion series that examines the details of real-life FCA practice in specific jurisdictions. Sessions typically focus on a single federal district and feature an experienced local panel that includes an Assistant U.S. Attorney for the district; a federal judge; a relator-side attorney; and a defense attorney. \nWe hope to resume in-person sessions of “The FCA Today” in 2021\, but for now we’re conducting them online via the Zoom platform. For this session on the District of New Jersey\, attendees can expect a brief overview of the FCA process\, including a review of case law in the Third Circuit\, and a detailed look at: \n\nThe types of FCA case most welcomed by the district’s U.S. Attorney Office;\nHow D.N.J. prosecutors work with Main Justice to investigate complaints and weigh intervention;\nHow D.N.J. judges evaluate seal extensions and seal violations;\nThe local impact of the Supreme Court’s recent FCA decisions; and\nWhere D.N.J. prosecutors fall in national debates over the viability of medical necessity cases\, DOJ dismissal of relator-led cases\, and other issues.\n\n\nAbout the Presenters\nR. Scott Oswald – Chair\, FBA Qui Tam Section (moderator) \nScott Oswald is an accomplished trial lawyer who has brought more than 40 trials to verdict. His cases have recovered more than $300 million in judgments and settlements. A fellow of the prestigious College of Labor and Employment Lawyers\, he received his law degree from Howard University and honed his skills at Trial Lawyers College\, founded by the legendary Gerry Spence. Mr. Oswald litigates employment and whistleblower actions nationwide. Among his results: \n\nFirst jury verdict under new whistleblower protections in the National Defense Authorization Act of 2013|\nFirst Sarbanes-Oxley Act liability verdict to withstand appeal\nFirst jury verdict under 2009 anti-retaliation provisions of False Claims Act\nFirst Dodd-Frank Act retaliation lawsuit to reach discovery in federal court\n\nMr. Oswald is chair of the Federal Bar Association’s Qui Tam Section and immediate past chair of the FBA’s Professional Ethics Committee. Lawdragon ranks him as one of the top 500 plaintiff-side employment lawyers in the country. \nKen Abell \nKen Abell is a founding partner of Abell Eskew Landau LLP (AEL)\, a boutique law firm specializing in qui tam defense and False Claims Act Litigation\, government enforcement matters and white collar criminal defense. AEL represents numerous entities and individuals in connection with qui tam matters under the False Claims Act\, including several large hospital systems and healthcare providers. Until 2018\, Ken served as Chief of Healthcare Fraud for the United States Attorney’s Office for the Eastern District of New York\, Civil Division. In his ten years as an Assistant United States Attorney\, Ken litigated and resolved some of the Eastern District’s most significant FCA matters\, including some of the nation’s largest healthcare and mortgage fraud cases. Ken began his legal career as a commercial litigator at a prominent litigation boutique in Chicago. Thereafter\, he was a law clerk to the Honorable Theodore H. Katz in the Southern District of New York\, before joining the United States Attorney’s Office in 2008. \nLee Cortes \nLee is an Assistant United States Attorney at the U.S. Attorney’s Office for the District of New Jersey. Lee currently serves as the Chief of the Health Care Fraud Unit\, supervising a team of approximately 12 AUSAs and directing all of the Office’s criminal and civil investigations and prosecutions of health care fraud offenses.  Before Lee was promoted to that role in January 2020\, he served as the Deputy Chief of the Special Prosecutions Division since July 2017\, where he oversaw approximately 12 prosecutors who investigate and prosecute public corruption matters. Before then\, Lee was a line assistant in the General Crimes Unit in 2010 and in the Special Prosecutions Division from 2011 until 2017. Prior to joining the U.S. Attorney’s Office\, Lee worked at Kaye Scholer in New York from 2003 to 2010\, focusing on white collar defense\, life sciences\, products liability\, and commercial litigation. Lee graduated from King’s College and Fordham Law School. \nDave Dauenheimer \nDavid Dauenheimer is a Deputy Chief in the Government Fraud Unit of the Criminal Division at the United States Attorney’s Office for the District of New Jersey. He serves as the Affirmative Civil Enforcement Coordinator and previously served as the Health Care Fraud Coordinator from 2011 until 2015. Mr. Dauenheimer is responsible for civil investigations of government fraud offenses including violations of the False Claims Act\, FIRREA\, and other federal laws. Since joining the office in 2008\, he has been responsible for numerous large-scale qui tam/civil investigations\, including resolutions involving a multinational device manufacturer\, pharmaceutical companies\, and companies contracting with numerous federal agencies including the Department of Defense. \nMr. Dauenheimer previously served as a Senior Litigation Counsel handling appellate and class action matters in the Office of Immigration Litigation at the Department of Justice. Prior to joining the Department of Justice in 2002\, Mr. Dauenheimer served for seven years with the Judge Advocate General’s Corps of the U.S. Army\, where he was a criminal prosecutor\, claims attorney\, deployed to Bosnia in support of Operation Joint Guard\, and was selected to be the Army’s liaison to the Department of Justice’s Torts Branch where he served as a trial attorney for two years. \nMr. Dauenheimer received his JD from the University of Colorado\, Boulder School of Law\, and his BA in Civil Engineering from Lafayette College\, Easton PA. \nJay P. Holland \nA principal in Joseph\, Greenwald & Laake’s Civil Litigation Group and chair of the firm’s Labor\, Employment\, and Qui Tam Whistleblower practice\, Jay Holland is a renowned employment and qui tam litigator known for taking on tough cases and achieving exceptional results. Anderson\, Jr. was appointed United States District Judge by President Ronald Reagan in October 1986. Prior to that\, Judge Anderson practiced law in Edgefield\, South Carolina\, and represented Edgefield and Aiken Counties in the South Carolina General Assembly. He is a graduate of Clemson University and the University of South Carolina School of Law. When appointed at age 36\, Judge Anderson became the youngest federal judge in South Carolina history and the second youngest in the country. He has served on the federal bench for 34 years\, seven of those years as Chief Judge. A strong advocate of legal education\, Judge Anderson has taken part in more than 200 CLE and law-related programs\, committees and associations\, including a six-year seat on the Federal Rules of Evidence Committee of the United States Judicial Conference. He also has authored two books on trial advocacy for lawyers. Judge Anderson recently took senior status\, but retains an active court schedule\, in addition to serving as an adjunct professor of Evidence and Federal Courts at the University of South Carolina School of Law. \n  \n \nDeborah B. Barbier \nDeborah focuses her practice on federal and state criminal defense\, Qui Tam/False Claims Act actions\, and business litigation. Deborah’s interest in the law began at a young age as her late father was an FBI agent. She attended the University of South Carolina for both her undergraduate and law degrees. Following graduation\, Deborah was selected for two consecutive clerkships at both the state and federal level. In 1996\, she began working at the U.S. Attorney’s Office for the District of South Carolina. Deborah served in this capacity for 15 years\, and she was honored to hold several leadership positions while there. In 2011\, Deborah felt as though it was the right time personally and professionally to enter into private practice. Since then\, Deborah has excelled in her defense work\, and she is excited to see what the future holds. \n  \nPamela Coyle Brecht \nPamela is a Partner at Pietragallo Gordon Alfano Bosick & Raspanti\, LLP. Ms. Brecht serves as Chair of the firm’s national Qui Tam/False Claims Act Practice Group. She is also experienced in white-collar criminal litigation\, employment law\, internal investigations\, and complex health care litigation. Ms. Brecht has litigated many of the most complex False Claims Act cases filed in the United States. Her cases have included alleged fraud by a large multi-state Medicaid managed care contractor\, FCA violations by three of the largest hospital corporations in the country\, and dissecting complex financial relationships among healthcare providers including Stark and Anti-Kickback issues. She has also litigated cases involving hospital fraud\, emergency room fraud\, medical device allegations\, Medicare Part C and Part D fraud\, government contractor fraud\, laboratory fraud\, as well as all types of pharmaceutical fraud. One of the whistleblower matters that Ms. Brecht has worked on was recognized in 2018 by The National Law Journal as one of the “Top 100 Verdicts.” The matter\, Lutz v Health Diagnostics Laboratory\, ranked as #39 on the list of highest verdicts throughout the nation for that year and came in at #2 for the highest verdicts coming out of Pennsylvania. \nJames Leventis – ACE Coordinator and Deputy Civil Chief for the District of South Carolina \nJames coordinates the District’s civil prosecution of health care and procurement fraud cases. He has served as an AUSA for over 11 years\, including three years in the criminal division. James has tried numerous cases to verdict\, including the District’s first civil health care fraud trial\, and argued before the Fourth Circuit Court of Appeals. James has received the U.S. Attorney’s Award for Excellence\, the Counsel of the Inspector General on Integrity and Efficiency Award for Excellence\, and a Special Commendation from the Civil Division of the Department of Justice for Outstanding Service. He was in private practice from 1974 to 1998. \nHon. Amiena Khan\, NAIJ \nHon. Amiena Khan was appointed by Attorney General Eric Holder in December\, 2010.  Judge Khan is seated at the New York Immigration Court and is a member of the New York State Bar.  She is the Executive Vice President of the National Association of Immigration Judges (NAIJ) and serves as the co-chair of the NAIJ Vulnerable Populations Committee. NAIJ is the collective bargaining unit for U.S. Immigration Judges nationwide. In her personal capacity\, she is a member of the Federal Bar Association and is a Board Member and the Programs Chair of the Federal Bar Association Immigration Law Section. Judge Khan is also a member of the National Association of Women Judges. \n  \nHon. DESCRIPTION:The Committee on Foreign Investment in the United States (“CFIUS”) is an interagency committee authorized to review certain transactions involving foreign investment in the United States and certain real estate transactions by foreign persons\, in order to determine the effect of such transactions on the national security of the U.S. CFIUS operates pursuant to section 721 of the Defense Production Act of 1950. The authority of the President to suspend or prohibit certain transactions was created through the 1988 Exon-Floria Amendment and has been revised by subsequent regulations. \nThe regulations governing the CFIUS review process are codified at 31 C.F.R. Chapter VIII. Effective February 13\, 2020\, changes to CFIUS’s jurisdiction and process were implemented which affect the access\, rights or involvement of foreign persons to U.S. businesses. CFIUS operates pursuant to section 721 of the Defense Production Act of 1950. \nThis webinar will address the events which led to the formation of CFIUS\, how it works\, and how to balance national security and business interests. Please contact meetings@fedbar.org for assistance.  \n\nAbout the Presenters:\nDr. Bijan Kasraie\, Partner\, KF Law LLC \nUpon receiving his Ph.D. degree in engineering from Pennsylvania State University\, Bijan Kasraie went to Iran\, where he served as Vice President of Operations for one of the largest cement complexes in Iran\, with over 15\,000 employees. Shortly afterward\, he was promoted to Executive Vice President.  In that position\, he doubled the company’s revenue by lowering the cost and improving the efficiency of the company. He was then hired as Executive Vice President for the second-largest bank in the country\, with over 6\,600 branches. During his ten years with the bank\, he transformed the entire operation from old-fashioned paper banking to fully automated systems.  In 1979 he returned to the U.S. and formed the Midcontinental Bank\, a privately owned bank with a presence in England\, Italy\, Switzerland\, the Caribbean\, and the U.S.  He served as President of the bank until its dissolution in 1991. During this period\, he also formed an independent oil and gas company with operations in the Appalachian Basin. Dr. Kasraie then formed the Midcontinental Group Company (“MGC”)\, a company involved with the  pharmaceutical\, import-export\, and recycling businesses\, among others. In 1997\, Dr. Kasraie obtained his law degree and formed the law firm of Marchman and Kasraie\, where he served as Managing Partner. The firm was active in corporate and security law\, international law\, and family law.  In 2012\, Dr. Kasraie co-founded the law firm of Kasraie & Fodor\, LLC. \nModerated By\nBeth S. West Allen is an intellectual property litigator and counselor in Las Vegas who represents a wide variety of international clients in federal courts. West served as chair of the FBA’s Government Relations Committee for seven years. He has served as a member of the FBA’s Board of Directors for much of the past decade\, serving two terms from 2011 to 2015 and from 2015 to 2018. In 2016\, West received the FBA’s President’s Award for longstanding service to the FBA and as chair of its Government Relations Committee. \nWest served as an FBA Circuit Vice President (CVP) for the Ninth Circuit\, where he assisted in the development of 16 FBA chapters from 2007 to 2013. During this time\, West was twice elected to serve as the Chair of the Circuit Vice Presidents. In 2013\, while serving as Government Relations Committee chair\, West testified before the U.S. Senate Judiciary Committee regarding the effect of sequestration on the federal courts. He helped institute the FBA’s annual “Capitol Hill Day” and taught at the FBA’s annual leadership training. Prior to serving as an FBA national officer\, West was the Nevada Chapter president from 2000 to 2001 and co-chair of the 2006 FBA National Convention held in Las Vegas. West has been a Life Fellow with the FBA Foundation since 2009. \nOver the years\, West has worked with many FBA leaders and committees. He was appointed to serve on the FBA’s National Council from 2001 to 2007. He has served as a member of the Government Relations Committee; the FBA 100th Anniversary Planning Committee; the Nomination and Elections Committee; the Constitution\, Bylaws\, Rules & Resolutions Committee (to update the FBA’s governance structure); the Chapter Activity Award and Fund Committees; and various national audit\, finance\, and special task force groups while serving on the Board of Directors. \nWest is a partner with the national law firm of Howard & Howard PLLC. Previously\, he was a partner for over a decade with Lewis Roca Rothgerber Christie LLP\, where he served on the firm’s governing executive committee. In Nevada\, West founded the Nevada State Bar’s Intellectual Property Section and served as that section’s first chair in 2004. Beginning in 2005\, West was appointed by the chief judge of the U.S. District Court District of Nevada to serve on the Civil Rules Standing Committee on the Local Rules. He was reappointed to this committee by the chief judge in 2009 and in 2011\, at which time he drafted the local patent rules for the District of Nevada. Carolina Chavez is the General Counsel and Deputy Commissioner for Policy at the New York City Mayor’s Office of Immigrant Affairs (MOIA)\, the primary policy advisor to the Mayor on all immigration related matters. In that capacity\, she oversees the Office’s legislative efforts to advocate for immigrant inclusive policies and programs at all levels of government\, as well as enforcement of the City’s local laws limiting law enforcement and government from cooperating with ICE on civil immigration enforcement. Carolina’s responsibilities also include advising on the City’s approach to immigration-related litigation\, both affirmative and defensive. She joined MOIA after serving as a Senior Counsel at the Mayor’s Office of Criminal Justice\, where her responsibilities included advising and operationalizing reforms aimed at reducing the over-policing and criminalization of communities of color. Prior to joining the Mayor’s Office\, Carolina was a Senior Counsel at the New York City Law Department\, where she litigated on behalf of the City and its employees in federal suits filed in the Southern and Eastern District Courts. She has served as an Administrative Law Judge for New York State\, and started her career at the New York County District Attorney’s Office. In addition\, she is an adjunct faculty member in the Lawyering and Legal Writing Program at Cardozo Law. Carolina is the proud daughter of immigrants. \n  \nArash Jahanian is the Director of Policy and Civil Rights Litigation at the Meyer Law Office\, PC.  He advises lawmakers\, advocates\, and stakeholders on proposed policies\, through the lens of the impact those policies will have on members of vulnerable communities including immigrants and people impacted by the justice system.  His litigation practice includes representation of victims of governmental abuse and employment discrimination. Prior to joining the Meyer Law Office\, Arash worked as a staff attorney at the ACLU of Colorado\, where he litigated and advocated on behalf of immigrants\, LGBTQ individuals\, prisoners\, victims of police racial profiling\, and people experiencing homelessness.  Arash contributed to lawsuits in Colorado that ended sheriffs’ practices of holding individuals at ICE’s request\, challenged a 287(g) program that would allow deputies to enforce immigration law\, and sought accountability for the death of man in ICE custody at the detention facility run by GEO Group\, Inc. Arash previously worked at the civil rights firm Rathod Mohamedbhai LLC\, where he represented victims of police brutality\, prison abuse\, and employment discrimination. Arash was one of the attorneys in the Wyoming marriage equality cases and has served as chair of the Denver LGBTQ Commission and president of the Colorado LGBT Bar Association. He is currently on the board of the Interfaith Alliance of Colorado and the Nomination Committee for the Denver Citizen Oversight Board. Arash was recognized as the Colorado Bar Association’s Outstanding Young Lawyer in 2015\, and was part of three different teams winning the Colorado Trial Lawyers Association’s Case of the Year Award. A graduate of Georgetown Law and the University of North Carolina\, Arash has also worked as an associate in Crowell & Moring LLP’s Washington\, DC office\, a judicial clerk for the Honorable Wiley Y. In June 2020\, a majority of the U.S. Supreme Court held in Bostock v. Clayton County that the term “sex” in Title VII prohibits workplace discrimination on the basis of sexual orientation or gender identity. Panelists will discuss this decision and its implications for the LGBTQ+ community. \nPresented by the LGBT Law Section \n\nAbout the Presenters:\nChristine E. Dieter\, Associate\, Hinckley Allen (Moderator) \nChristine is an Associate in the firm’s Environmental and Energy Practice Groups and Litigation practice. She has experience litigating in state and federal courts and before administrative agencies. Christine has worked on permitting matters for offshore wind farms and worked on litigation relating to the cleanup of contaminated land. Hodges\, Gonzalez-Pagan helped secure marriage equality at the U.S. Supreme Court while representing four same-sex couples seeking respect for their out-of-state marriages and accurate birth certificates for their Ohio-born children. He was also lead counsel in Conde-Vidal v. Rius-Armendariz and co-counsel in Robicheaux v. Caldwell\, successfully challenging Puerto Rico’s and Louisiana’s marriage bans\, respectively. Gonzalez-Pagan helped secure two landmark decisions—the first and second appellate rulings in the country—holding that Title VII covers sexual orientation discrimination in Hively v. Ivy Tech Community College and Zarda v. Altitude Express\, Inc. As lead counsel in Smith v. Avanti\, he also obtained the first court decision in the country holding that the Federal Housing Act’s sex discrimination prohibition covers discrimination against LGBT people. As Health Care Strategist\, Gonzalez-Pagan has been a leading voice in the proper interpretation of the Affordable Care Act’s nondiscrimination provision\, particularly as it applies to LGBT people. Gonzalez-Pagan is also a key architect of Lambda Legal’s efforts to secure the ability of transgender people to obtain accurate identity documents\, including birth certificates. Gonzalez-Pagan received his law degree from the University of Pennsylvania Law School\, where he was an editor of the University of Pennsylvania Journal of Constitutional Law. He also possesses a Master’s in Environmental Studies from the University of Pennsylvania and a Bachelor of Science in Biology from Cornell University.
